including attached workplan drawing (1), Sheets 1 of 1 dated "Revised 3/15/21".
This permit, issued on September 7, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Dockine Facility Expansion
1) This permit authorizes only the pier extension, platform and lift, and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility expansion without
permit modification. No non -water dependent uses of structures shall be conducted on, in or over
Public Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) This permit authorizes a maximum of one (1) formalized boat slip.

4) No attempt shall be made by the permittee to prevent the full. and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
6) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including"kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
Sedimentation and Erosion Control
7) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
8) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
USACE Conditions
9) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2021-01616).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
,Quality Certification 4175 and'assigned the project DWR Project No. 2021-1164.

SUBJECT: Comments and Recommendations - CAMA Major Permit —Benjamin Hervey, Carteret County
The following is my assessment and consequent recommendations of the above referenced proposal: This proposal
incorporates 1,174 square feet of Public Trust Area. The proposal is not adjacent to a Federal Channel. These waters of
Hadowe Creek are open to shellfish harvest. This waterbody is a Primary Nursery Area.
This proposal will not pose a hazard to navigation. Assuming that state and federal agencies concur with the proposal, I
recommend the project be authorized as proposed, contingent upon the following conditions:
1. The permittee must install and maintain at his expense permanent reflectors attached to the outermost pilings of the
structure in order to make it more visible during hours of darkness or inclement weather.
2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or
adjacent to the authorized work.
3. The authorized structure and associated activity must not cause an unacceptable interference with navigation.
4. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions
of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it
transferred to a third party.
5. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may
become a permanent part of this marina/docking facility without permit modification. No non -water dependent uses
of structures may be conducted on, in or over public trust waters without permit modification.

6. The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the
structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel
to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where
the upland property line meets the water's edge.
7. The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208
of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted.
Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied
and enforced throughout the entire existence of the permitted structure.

Consistency Determination: The request is consistent with/not in conflict with Carteret County Land Use
Plan certified by the CRC on December 20, 2010.
Overview: The property is located at 3114 Mill Creek Road near Newport, Carteret County; adjacent to
Harlowe Creek. This lot is currently developed with a residential dwelling and dock. The existing pier is 4'
by 270' and the existing platform is 10' by 15'. The adjacent riparian property to the north is undeveloped
and the adjacent riparian property to the south is developed with a residential dwelling.
AECs onsite include Estuarine Waters and Public Trust Areas. Harlowe Creek surface water classifications
are SA (Market Shellfishing, Salt Water) and HQW (High Quality Water). The site is designated as a Primary
Nursery Area and is open to shellfish harvest. SAV was not observed at this location. There are no
historic/cultural resources.
The elevation of the adjacent high ground of the parcel is approximately 4' above the normal high water
level (NHL). Vegetation on the parcel mainly consists of lawn grasses, pine trees, and Coastal Wetlands
mainly consisting of Spartina alterniflora and Juncus roemerianus. The parcel has 168' of continuous
shoreline along Harlowe Creek, a tributary of the Newport River. Immediate offshore water depths
adjacent to the parcel range from -0.5' to -6' normal low water. The subaqueous substrate is soft with
shell.
The applicant is proposing to extend a private docking facility by constructing a 1-slip docking facility by
extending the current dock. The proposed pier extension would be 4' by 195' and the proposed T"
platform would be 15' x 15' with a 13' x 13' boat lift on the south side of the proposed platform. This
proposed expansion would take the docking facility approximately 460' waterward of the normal high
water mark in order to access the 4 nlw depth contour.

Anticipated impacts
The proposed docking facility would usurp 1,174 square feet of Public Trust Area. Traditional marine
construction methodology would be utilized during the construction of this project. Turbidity impacts are
not anticipated during the construction activities in the Harlowe Creek.
There is not a Federal Channel in the nearby vicinity of this proposed docking' facility. This proposal should
not pose a hazard to traditional navigation as it is immediately adjacent to a natural shoreline peninsula
and does not appear to encroach into the traditional navigation route of Harlowe Creek.
Basis for Determination:
The project site is subject to the 2005 Carteret County Land Use Plan Update. The Future Land Use Map
(FLUM) designates the site as Rural with Services (land) and Conservation (Areas of Environmental
Concern). Uses allowed in Areas of Environmental Concern are those consistent with the State's minimum
use standards and state and federal regulations.
The following LUP policies may be applicable to this request:
Policy 2.1
Carteret County's policies for development in coastal and non -coastal ("404," "401," or jurisdictional)
wetlands are as follow:
1. Carteret County will allow only land uses in coastal wetlands that require water access, cannot
function elsewhere, and are consistent with state and federal regulations. Examples of acceptable
uses are utility easements, piers, and docks.
Policy 2.4
Carteret County's policies for development in estuarine and public trust waters are as follow:
1. Carteret County will only allow development activities in estuarine and public trust waters that
are associated with water -dependent uses, consistent with state and federal standards, and meet
all local policies contained in this plan.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report/ Bio-Report for
the subject project. The attached notice requests federal agency comments on this project by September 10, 2021.
The site is located within waters of/adjacent to Harlowe Creek, located at 3114 Mill Creek Road, in Newport, Carteret
County, North Carolina. Approximate Coordinates in Decimal Degrees are 34.785023 N,-76.724517 W.
The applicant proposes to expand an existing docking facility in order to reach sufficient water depths. The existing
facility is 4'X 270', with a 10'X15' platform. Specifically, the expansion involves extending the existing pier 195' for a total
length of 465' feet. The proposed pier extension would be 4' by 195', and a proposed ' L" platform would be 15' by 15',
with an -13' by 13' boat lift on the south side of the proposed platform. This proposed expansion would take the
docking facility approximately 460' waterward of the normal high water mark in order to access the -3' Normal Low
Water (NLW) depth contour.
The structure is not located near a federal channel.

the proposed project.
EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not
likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service. The waters within the project area ARE designated as PNA by the NC
Division of Marine Fisheries, are classified as SA; High Quality Waters by the NC Division of Water Resources, and are
Open to harvesting shell fish. Average water depths within the project area range from -0.5' to -6' at Normal Low Water
(NLW). Substrate is soft with shell. According to the BioReport and the applicant's narrative, SAV is not present at this
location.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by this office on June 16, 2021.
Harlowe Creek is classified as SA:HQW by the Division of Water Resources (DWR) and has been
determined to be a Primary Nursery Area (PNA) by the Division of Marine Fisheries (DMF). Please
understand that the waters around your project area have been identified as a PNA and should requests
for dredging within the proposed project area arise in the future, they will be denied. Please be aware
that new dredging within a PNA is not permitted under 15A NCAC 02B .0220. This activity results in
degradation of water quality standards and is therefore considered a water quality violation. Any
turbidity standard violations of waters going into these creeks are also considered Water Quality
Violations. Citation: 15A NCAC 02B .0220
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your
application do not require written authorization to utilize GC 4175. However, you are required to
follow the conditions listed in the attached certification.
You should also obtain and comply with any other federal, state and local requirements including
(butnot limited to erosion and sedimentation control regulations and state stormwater requirements
before you proceed with your project). Also, the approval to proceed with your proposed impacts to
waters a depicted in your application shall expire upon expiration of the 404 or CAMA Permit.

Dear Mr. Howell:
Reference the application of Mr. Benjamin Hervey to expand an existing docking facility
in waters of/adjacent to Harlowe Creek, at 3114 Mill Creek Road, in Newport, Carteret County,
North Carolina.
Specifically, the expansion involves extending the existing pier 195' for a total length of
465' feet. The proposed pier extension would be 4' by 195', and a proposed "L" platform would
be 15' by IT, with an —13' by 13' boat lift on the south side of the proposed platform. This
proposed expansion would take the docking facility approximately 460' waterward of the normal
high water mark in order to access the -3' Normal Low Water (NLW) depth contour.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the modification to the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
2. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety
Office at (910) 772-2191.
3. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.

4. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
5. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
6. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
7. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
9.The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
10. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter I I3A Article 4).
11. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by

the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
12. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre -project condition.
13. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Narrative Description:
The property is located adjacent to Harlowe Creek at 3114 Mill Creek Road near Newport, Carteret
County. This lot is currently developed with a residential dwelling and dock. The existing pier is 4' by
270' and the existing platform is 10' by 15'. The adjacent riparian property to the north is
undeveloped and the adjacent riparian property to the south is developed with a residential dwelling.
The elevation of the adjacent high ground of the parcel is approximately 4' above the normal high
water level (NHL). Vegetation on the parcel mainly consists of lawn grasses, pine trees, and Coastal
Wetlands mainly consisting of Spartina alterniora and Juncus roemerianus. The parcel has 168' of
continuous shoreline along Harlowe Creek, a tributary of the Newport River. Immediate offshore
water depths adjacent to the parcel range from —0.5' to —6' normal low water. The subaqueous
substrate is soft with shell.

Anticipated Impacts:
There is not a Federal Channel in the nearby vicinity of this proposed docking facility. This
proposal should not pose a hazard to traditional navigation as it is immediately adjacent to a
natural shoreline peninsula and does not appear to encroach into the traditional navigation route
of Harlowe Creek. The proposed docking facility would usurp 1,174 square feet of Public Trust
Area. Traditional marine construction methodology would be utilized during the construction of
this project. Turbidity impacts are not anticipated during the construction activities in the
Harlowe Creek.

Project Narrative
Introduction
Benjamin and Tanya Hervey are the owners of residential property located adjacent Harlowe Creek at
3114 Mill Creek Road in Newport in Carteret County. The property contains an existing residence,
driveway, and pier. The owners propose to extend the existing pier an additional 195' to reach deep
water. The pier extension will include a new platform and installation of one boat lift. No highground
development is proposed as part of this project.
Site Description
The project site measures 71,373 square feet (1.64 acres). A single-family residence, driveway, and pier
are located on the property. Vegetation at the site consists of lawn grass and wetland vegetation. The
approximate elevation of the site above Normal High Water (NHW) is +4'.
The existing pier measures 270' by 4' with a 10' by 15.4' platform at the waterward end for a total
existing structure length of 280'. The pier extends 55' into Harlowe Creek, measured from the
waterward edge of wetlands.
The total length of the shoreline measured along NHW is 168 linear feet. Coastal wetlands border the
shoreline, extending waterward for about 200'. An irregularly shaped peninsula of wetlands continues
for an additional 240' along the southern end of the shoreline.
An oyster rock is located at the waterward end or point of the wetlands as shown on project plans.
Shellfish are scattered predominantly 4' to 5' waterward of the outer marsh edges along the remaining
shoreline of the property. No submerged aquatic vegetation was observed during a survey completed in
January 2021.
Harlowe Creek is a Primary Nursery Area (PNA), as designated by the NC Division of Marine Fisheries.
Waters at the project site are classified as "Conditionally Approved Closed", meaning they are typically
closed to shellfish harvest, but can be temporarily opened when conditions warrant.
The project area is not zoned by Carteret County. Adjacent land uses to the project site are single-family
residential. The existing Hervey residence is served by an individual septic system, with drinking water
provided by a private well.

Project Description
The owners propose to extend the existing pier an additional 195' to reach deep water. An additional
platform measuring 15' x 15' is proposed for location at the waterward end for a total finished length of
490' for the docking facility. A boatlift measuring 12.5' x 12.5' is proposed for installation adjacent the
southern side of the new platform.
The proposed dock extension and boat lift location limit additional impacts to coastal wetlands and
shellfish. Water depths at the location of the proposed boat lift measure -3' to -4' NLW. The project
engineer has calculated that 920 square feet of coastal wetlands are currently shaded and 20 square
feet of scattered and intermittent oysters are similarly impacted by the existing pier. No additional
shading of wetlands or shellfish is anticipated by the proposed new work.
The proposed docking facility will be located 43' from the adjacent riparian property to the north and
82' from the adjacent riparian property to the south. It will be located 1345' from the adjacent docking
facility to the north and 1675' from the adjacent docking facility to the south.
Harlowe Creek is 1137' wide at the narrowest point adjacent the project site. The proposed pier
extension will measure 265' from the waterward edge of coastal wetlands, and as such will not exceed
the one -quarter water body width of 284' for Harlowe Creek at the project site.
Construction Methods
Dock construction will employ conventional marine construction techniques. One barge with
pile -driving equipment stored in deep water will be used for construction of the dock extension.
All construction activities will occur during periods of water depths sufficient to avoid barge
from resting on or disturbing bottom.
Pre -Filing Meeting Request
In compliance with the Clean Water Act Section 401 Certification Rule, a Pre -Filing Meeting Request for
this project was submitted to the NC Division of Water Resources (DWR) on March 8, 2021. On April 8,
2021 DWR responded that the request had reached the 30 calendar days requirement and that the
permit application could be accepted. The ID number assigned to this project is 20210533, Version 1.
Included in this application is a copy of the DWR Pre -Filing Meeting Request Form that was submitted to
DWR and the email confirming that the pre -filing time clock was reached.

Abstract:
A boundary retracement of the O.B. Culpepper property (Lot 9 in Map Book 4, page 4 of the Carteret
County Registry) and channel location or depth of the adjacent waters of Harlow Creek was required to
establish the riparian corridor for the extension of an existing pier. Aerial photography, tax mapping, an
original 1957 subdivision map, and a deed description from a survey from 2005 were consulted. No title
search was done by the surveyor or supplied. A title search is suggested. Further investigation of the
ownership of submerged land waterward of this property needs to be completed. The property is
developed with a house and other typical improvements. For this scope of work improvements were not
surveyed. Boundaries that were surveyed along the water included wetlands, mean high water and
coastal marsh. Wetland demarcations were established by elevation and the species composition and
distribution of coastal and wetland vegetation. The wetland and coastal marsh lines were delineated by
a cursory approach by showing more, as landward. Three original iron pipe corners were found. The
southwest corner was located near a ditch and had been replaced with an 18" rebar. The iron pipe
corners on the water were clearly visible and the southwest corner was covered with soil. There were no
significant changes in the boundary as to the original 1957 survey.
Survey Method Condensed:
The research was conducted in December, the maps and deeds were obtained by going online and
retrieving the documents off the Carteret County website. The deeds and map were entered into the
computer and checked for closure errors using Cad and Carlson Software.
The water portion of the survey was done on December 9, 2020. A flat bottom boat was used as the
platform. The water survey points were collected along 12, 25 minimum foot transect gridlinesat three
second intervals which resulted in a sounding every 5 feet. The survey method used was using a Trimble
R12i GNSS receiver linked to the North Carolina Real Time Network by cellular hotspot (Pivers Island,
Beaufort, NC base station) and was able to obtain centimeter level elevation at the base of the GPS/
GNSS receiver. A Sea Floor Sonarmite was used to collect the soundings and Bluetooth to a ruggedized
Trimble computer using Windows 10 operating system that applied the depths to the corrected GNSS
position. A total of 10.5 acres were surveyed where the depth was greater than 15 inches resulting in
2700 data points.
The land survey was done on January 24, 2021. A computer work sketch was generated from the deeds
and was used as a guide for preliminary measurements and a Subsurface Instruments magnetometer
was used to locate the buried iron stake corner. A Trimble GNSS receiver was used to take precise
measurements of the existing corners. Rotation and translation calculation was performed to compute
the deed corners to NC state plane coordinates. The coastal vegetation and freshwater wetlands were
mapped. A topographic survey was completed along a 25' transect from the upland through the marsh
below the high water mark.
The post Held office work began by downloading the data into the computer, plotting, editing points and
inspecting the data. NOAA VDATUM program was used to compute the mean high water elevation, and
mean low water at the Harlow Creek site. The Beaufort Tidal Gauge was used as a quality control check.
Carlson software was used to map the high water elevation. A 3D contour model was generated for the
water portion. The expected accuracy is 0.1' - 0.2' of the water portion with a 95 percent confidence
level and centimeter level for the land work.

The Department of Environment and Natural Resources hereby gives public notice as required by
NCGS 113A-119(b) that application for a development permit in an Area of Environmental Concern as
designated under the LAMA was received on April 12, 2021. According to said application, Mr. Benjamin

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located adjacent to Harlowe Creek at 3114
Mill Creek Road near Newport, Carteret County. It was received on April 12, 2021, and
appears to be adequate for processing at this time. The projected deadline for making a
decision is June 26, 2021. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by
the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from April 12, 2021, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along
the road right-of-way fronting your property, or at a point along the road right-of-way
where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.

This DEED made this the 30th day of March, 2006, by and between DENVER G. LAMB AND

That the Grantor, for a valuable consideration paid by the Grantee, the receipt of which is hereby

in the high-water mark of Harlowe Creek; thence with the high-water mark of Harlowe Creek the

25.58' to a point thence S 22-34-00 E, 57.68' to a new iron stake;
thence leaving the high-water mark and running N 86-31-52 W, 395.02' to the point and place of�
beginning. This being all of that property as shown on that survey entitled, "Survey for Denver
Lamb and Dora Jean Lamb", dated November 8, 2005, prepared by Arthur R. Denning and
incorporated herein for a more accurate description. The above property is all of Lot "9" as
shown on that plat recorded in Map Book 4, page 4, Carteret County Registry and is the same
properly conveyed to Grantor by deed recorded in Book 748 at page 471, Carteret County
Registry.

Dowry Road, identified as "road" on the above plat and also all right of ingress and egress over

TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and appurtenances
thereto belonging to the Grantee in fee simple.
And the Grantor covenants with the Grantee, that Grantor is seized of the premises in fee simple,
has the right to convey the same in fee simple, that title is marketable and free and clear of all
encumbrances, and that Grantor will warrant and defend the title against the lawful claims of all persons
whomsoever except for the exceptions hereinafter stated.
Title to the property hereinabove is subject to the following exceptions:
