Authorizing development in Pender County at adi. to Banks Channel, at 409 Evelyn Lane,
in Topsail Beach as requested in the permittee's application dated 1/6/21(MP-1) and 10/01/20 (MP-
4), including attached workplan drawings (4), all dated "Received DCM Wilmington" 2/3/21.
This permit, issued on April 1, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subiect to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the additional boatlift and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
6) This permit authorizes an additional one (1) slip for a maximum of three (3) formalized boat slips.
7) Should either adjacent lot to the north or south be sold prior to the initiation of construction of the
docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15
foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating
construction of the docking facility.
USACE / FEDERAL CONDITIONS
8) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
12) The permittee shall be responsible for the immediate removal of any displaced debris, trash, or litter
associated with the project site.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 197800056 (Action ID SAW-2021-00287).

ADDITIONAL CONDITIONS
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-0340.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water.
NOTE: An application processing fee of $250 was received by DCM for this project.

The total area of the existing and proposed structures was calculated as follows:
Shoreline length = +/-75 ft. x 8 sq. ft. = 600 sq. ft. allowable.
Proposed and Existing:
Platform = 8' x12' = 96 sq. ft
Floating dock = 8' x 25' = 200 sq. ft.
Boatlifts x 2 = 288 sq. ft. (not included)
Total proposed =144 sq. ft. (not included)
Existing Platform space total = 296 sq. ft.
The boat lift installation would provide docking space for up to three (3) vessels at this
location. As proposed, the project would be CONSISTENT with the use standards set forth
in NCAC 07H .0208(b) (6), including the 1/4 width rule, the eight -square foot rule and the
pier -width rule. The proposed structures would be located entirely over open water. This
office has NO OBJECTION to the proposed work provided it is consistent with all other
state and federal permitting requirements.
It is recommended that any permit issued should include standard conditions for private
docking facilities.

Dear Mr. Herring:
Through coordination with the North Carolina Division of Coastal Management we have
learned of your request to expand an existing docking facility located at 409 Evelyn Avenue,
along Banks Channel and Topsail Sound in Topsail, Pender County, North Carolina.
On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans received by DCM Wilmington on February 3, 2021, which are a part
of this permit.
2. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the

modified. Your Department of the Army permit will expire on December 31, 2021.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by the Division of Coastal Management office on February 3, 2021. The application
proposes to construct a docking facility with fixed platform, finger piers, a floating dock and two (2)
boaflifts. The proposed project is located in the waters of Banks Channel which are classified as SA:HQW
by DWR.
DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the Regional
General Permit 56 issued by the US Army Corps of Engineers (USACE). This Certification allows you to use
the Regional General Permit 56 when issued by the US Army Corps of Engineers. In accordance with the
attached General Certification #4175 (GC 4175), the impacts described in your application do not require
written authorization to utilize GC 4175. However, you are required to follow the conditions listed in the
attached certification. You should get or otherwise comply with any other federal, state and local
requirements before you go ahead with your project including (but not limited to) erosion and sediment
control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received
in the OAH during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding

Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the site are classified as SA and are not open to shell fishing. The area is not a
Primary Nursery Area.
I have reviewed this proposal for consistency with the Topsail Beach Land Use Plan and
offer the following comments.
The general area of the project is classified as Developed (upland) and Conservation
(AEC).
In general, the Topsail Beach Land Use Plan allows development in Developed and
Conservation classified AECs which is consistent with the State's minimum use
standards. The Topsail Beach Land Use Plan contains some policies, which exceed the
State's minimum use standards. However, none of these more restrictive policies appear
to be applicable to this project.
This project appears to be consistent with the Topsail Beach Land Use Plan Update.

9. PROJECT DESCRIPTION:
The project site is located at 409 Evelyn Lane, adjacent to Banks Channel and Topsail Sound, in
Topsail Beach, Pender County. To find the property from the Wilmington Regional Office, take
Highway 17 North from Wilmington approximately 20 miles and turn right on N.C. State Highway
210. Travel approximately 2.8 miles to the intersection of NC 210 and NC 50. Turn right onto NC
50/NC 210 and travel approximately 1.9 miles onto Topsail Island. Turn right onto S. Topsail Dr.
/NC 50 and travel approximately 5.90 miles to Empie Avenue and turn right. Travel approximately
along Empie Lane and just before the dead end turn left onto Evelyn Lane. The subject property will
be located on the left-hand side of the road at house number 409.
Existing man-made features on the property include a single-family residential dwelling, with a
bulkhead and private docking facility. High ground vegetation consists of lawn grass and
ornamental shrubs. The high ground portion is elevated approximately T-5' above the normal high
water (NHW) level, and the shoreline (+/- 75 linear feet) is stabilized by bulkhead. There are no
Coastal Wetlands on -site, or adjacent to the property. Residential properties border the land to the
north, south and east and Banks Channel/Topsail Sound borders the propertyto the west.
The existing pier and docking facility was authorized under CAMA General Permit No. 75394-D,
issued on October 5, 2020. The facility is located along the southern portion of the property and
extends approximately 35' into a man-made basin located off Banks Channel. The facility consists of
an 8' x 12' T-head shaped platform, 8' x 25' floating dock and 12' x 12' boatlift (located on west side
of the existing floating dock). The existing docking facility is located just inshore of the adjacent
docking facilities to the east and west, within % of the width of the water body.
The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina
Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the
North Carolina Division of Marine Fisheries, and the man-made basin is CLOSED to the harvest of
shellfish. Based on visual observations made by DCM staff during the October 2020 site visit, there
appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding area. Water depths in
the vicinity of the existing facility range from -2' to -6', relative to normal low water (NLW).
PROPOSED PROJECT:
The applicant proposes to expand the existing docking facility by installing a new 12' x 12' boatlift,
creating up to three (3) boat slips. According to the application package, a new boatlift would be
installed along the eastern side of the existing floating dock, between the applicant's pier and the
neighboring docking facility. The proposed boatlift would provide dockage for a single vessel. The
additional lift would create up to three (3) potential docking spaces, when combined with the
existing structures (existing boatlift and floating dock). The proposed boat lift would encroach
within the 15-foot riparian corridor setback of the northern property owner; however, the
applicant has obtained an "initialed" waiver allowing the encroachment.

10. ANTICIPATED IMPACTS:
The proposed structure would incorporate approximately 144 sq. ft. of Estuarine Waters and Pubic
Trust Area. The boatlift would remain consistent with similar pier length requirements (established
pier -head line) and would be located outside of the yacht basins entrance channel. Minor increases
in turbidity should be expected during construction. Water depths in the vicinity of the proposed
project range from -2.0' to -6.0' @ normal low water.

requesting authorization under the Rules of the N.C. Coastal Resources Commission for
development activities at 409 Evelyn Lane, adjacent to Banks Channel and Topsail Sound,
in Topsail Beach, Pender County. It was received as complete on February 3, 2021 and
appears to be adequate for processing at this time. The projected deadline for making a
decision on your permit application is April 19, 2021. An additional 75-day review period is
provided bylaw when such time is necessary to complete the review. Ifyou have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from February 3, 2021, you
may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project Such a meeting will be held within five working
days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a
Private road would lead one into your property. Failure to post this notice could result in
an incomplete application.
