Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 Excavation and/or filling pursuantto NCGS 113-229 Permit Number 11-21 Issued to Hatteras Village Community Center District, 56658 NC-12, Hatteras, NC 27943 Authorizing development in Dare County adj. to Slash Creek, alone NC-12 and Eagle Pass Rd.. in Hatteras , as requested in the permittee's application dated 12/9/19, including the attached Ocean Hazard AEC notice dated 7/16/20 and workplan drawings (15), as referenced in Condition No. 1 below. This permit, issued on January 28, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may tines, imprisonment or crvn action; or may cause me permit to oe nuu ana vora. 1) Unless specifically altered herein, all development shall be carried out in accordance with the attached workplan drawings (15), Sheet CSC dated "Rec DCM-EC 7/13/20", Sheets C201, C202, C303, C304, C305, C307 and C702 all dated "Revised 2/13/20", Sheets C302, C306a, C306b, C306c and C701 all dated "Revised 7/8/2011, C308 dated "Revised 11/12/20" and C703 dated "Revised 11/17/20". (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Hatteras Village Community Center District Permit No. 11-21 Page 2 of 3 ADDITIONAL Concrete Sidewalks and Pedestrian Bridges 2) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the development of the concrete sidewalks and two pedestrian bridges, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any other work or development proposed in an Area of Environmental Concern (AEC), including but not limited to the Ocean Erodible Area and Coastal Shoreline AECs, shall require a review and authorization from the Division of Coastal Management prior to work commencing. Contact a Division of Coastal Management representative at (252) 264-3901 for this determination. 3) Prior to the initiation of construction of the portions of the authorized development within the Ocean Hazard AEC, a representative of the Division of Coastal Management shall stake the first line of stable, natural vegetation if applicable. This determination shall replace those done at the time the permit application was processed and approved. Construction shall begin within sixty days of this determination or the measurement is void and shall be re-established. In the case of a major shoreline change within that period, a new determination shall be required before construction begins. 4) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC Rules. 5) No development or land disturbing activity that is considered non -water dependent shall occur within 30 feet of the normal water level unless altered herein. 6) The pedestrian bridge along NC-12 over Slash Creek shall have a minimum vertical navigational clearance of 4 feet above the NWL at the lowest part of the bridge. The pedestrian bridge shall provide a minimum horizontal navigational clearance of 10 feet for a majority of the bridge spanning the creek. All as depicted in the attached workplan drawings. 7) The pedestrian bridge along Eagle Pass Road that is located in or over the water shall be constructed as expressly and specifically set forth in the permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this bridge without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. Hatteras Village Community Center District Permit No. 11-21 Page 3 of 3 ADDITIONAL CONDITIONS 10) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. Stormwater Management 11) The Division of Energy, Mineral & Land Resources (DEMLR) approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW7200208. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. General 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: If existing waterlines require relocation, plans must be submitted to the Public Water Supply Section (Plan Review Unit) for approval prior to the initiation of construction. Please contact the Public Water Supply Section at (919) 707-9100. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the NC Division of Water Resources. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level or landward edge of any coastal wetlands, whichever is more restrictive. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project Action ID No. SAW — 2020- 01499. NOTE: An application processing fee of $400 was received by DCM for this project. Morehead City, North Carolina 28557-3421 Dear Mr. Howell: RECEIVED JAN 2 5 2021 MP SECTION NIHD Please reference the application of Mr. Ricki Sheperd for Department of the Army authorization and a State Water Quality Certification to construct of 4t miles of 5' wide concrete sidewalks throughout the Village of Hatteras, which includes 3t miles along NC Hwy 12 and less than 1 mile along Eagle Pass Road, as well as a pedestrian bridge over the canal, parallel to the NC 12-southern canal crossing bridge, in Hatteras Village, Dare County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in > traee quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Project Setting As part of the Off Road Pathways for Hatteras Villages, this project is located within the Village of Hatteras, Dare County, starting at the northern -most property in front of #56310 NC 12 Hwy, which is west of the Atlantic Ocean, traveling south along Hwy 12, over The Slash Creek Bridge, the NC-12 southern canal bridge crossing, and to the southern intersection of Hwy 12 and Eagle Pass Road adjacent #58550 NC 12 Hwy. At the Eagle Pass/Hwy 12 intersection, the project will turn left and continue north along Eagle Pass Road to connect to the northern intersection of Eagle Pass Road and NC 12 Hwy. The cumulative shoreline portion of the project is 3,215± feet, and the estimated elevation of the tracts above normal water level (NWL) is 3'. NC 12 Hwy is also listed as the Outer Banks Scenic Highway. In the Ocean Erodible Area (OEA), Area of Environmental Concern (AEC), the concrete sidewalk project will begin sited on the west side of NC Hwy 12 North and cross over to the east side of NC 12 at the intersection of Elizabeth Avenue (refer to Plan Sheet C306a). The VE zone ranges from 9' to 10' east of the Hwy, and the western side of the Hwy is zoned AE 3' to 5'. The OEA AEC extends a total of 360' from the First Line of Stable Natural Vegetation (FLSNV), with a minimum setback of 120' (30 times the setback factor of 4). The dunes east of Hwy 12 are vegetated with Sea oats (Uniola paniculata). The proposed location for the sidewalk has fine sands and indigenous grasses. At the Slash Creek Bridge, a sidewalk is proposed to connect to the southeast side. The riparian property to the southeast consists of a cleared, vacant parcel of land with a bulkheaded shoreline. The riparian properties to the northeast consists of a small, vacant parcel of land with a natural shoreline, as well as single-family residence with a bulkheaded shoreline, dock and boatlift. Sidewalks are also proposed to connect to the northwest and southwest sides of Slash Creek Bridge. The riparian property to the northwest consist of a single-family residence with a bulkheaded shoreline, pier and boatlift. The riparian property to the southwest is owned by Dare County, and is the location for the Hatteras Village Medical Center Association. The proposed location of the sidewalks currently has indigenous grass and concrete/rock onsite. A section of the sidewalk project will turn north onto Kohler Drive (SR 1237) in front of First National Bank and end at a crosswalk to Saxon Cut Drive (SR 1340). This will provide pedestrian access to the US Weather Bureau Station building, which is operated as a welcome center by the Outer Banks Visitors Bureau through a partnership with the National Park Service, RECEIVED AUG 2 6 2020 DrM_MHII rITV Field Investigation Report: Hatteras Village Community Center District Page 3 At the NC 12-southern canal bridge crossing in Hatteras, the east and west riparian property owners have single family residences, bulkheaded shorelines, and boatlifts; the property owner to the west also had a shoreside dock. Each property has indigenous lawn grass onsite; the property owner to east also has a concrete driveway in place. This bridge is north of Teach's Lair Marina, and the canal connects to the Pamlico Sound. The water depth at this crossing is -5.5' NWL. On January 22, 2020, the water level was approximately 2' below the bridge. According to the applicant, the US Coast Guard does not consider the creek to be navigable. There are no docking facilities/moorings within 0.4 miles north of the bridge crossing. The sidewalk project continues to Eagle Pass Road (SR 1241). Approximately 180' south of Flambeau Road and SS America Lane, SR 1241 extends across a narrow section bounded by a canal that connects a portion of Slash Creek with Duck pond. A marsh in the west side canal contained coastal wetland vegetation of Black needlerush (Juncus roemerianus) and Smooth cordgrass (Spartina altemiflora). Vegetation along the Duck pond on the east side of the road contained Black needlerush (Juncus roemerianus) and non -coastal vegetation. The project would not impact any wetland vegetation. There are three large culverts at this crossing to preserve a hydraulic connection. The right-of-way is located within the 30' setback. Division staff had noted that concrete is not one of the exceptions to the buffer rule, and suggested an elevated walkway in this area. Per the applicant's narrative, there is concern that an elevated walkway could potentially compromise the integrity of the culverts. Therefore, the applicants are requesting a concrete sidewalk in this location, with the walk to be sloped inwards with a swale separating it from the road and directing runoff to infiltration areas. Staff notes that there is approximately 10' from the edge of the canal (where riprap is currently sited along the water's edge) to the road. The right-of-way is covered with indigenous grasses. According to the applicant (MP-3 Upland Development) , a Sedimentation and Erosion Control plan was submitted to the Division of Land Resources (aka DEMLR) on 02/21/20, and a site development plan was submitted to the Division of Water Quality (DWQ) for stormwater certification 02/21/20. A Right -of -Way Encroachment Agreement with the NC Department of Transportation (NCDOT) is pending. The adjacent waterbodies associated with this project are the Atlantic Ocean, Slash Creek, and a man-made canal connected to Duck Pond. The Slash Creek connects to the Pamlico Sound on the northern and southern termini. The Slash and connecting tributaries are classified as Coastal Waters, and are in the Pasquotank River Basin. The Environmental Management Commission's water classifications for this tributary are SA and High Quality Waters (HQW), and the Atlantic Ocean as SB. The area is closed to shellfishing, and is not a primary nursery area (PNA). Development Proposal The applicant is proposing the construction of 4t miles of 5' wide concrete sidewalks throughout the Village of Hatteras, which includes 3t miles along NC Hwy 12 and less than 1 mile along Eagle Pass Road, as well as a pedestrian bridge over the canal, parallel to the NC 12-southern canal crossing bridge. The goals for this project are to provide a safe pedestrian route throughout the village, interconnect with local points of interest, reduce traffic, and promote exercise. RECEIVED AUG 2 6 2020 DCM.MHIn r1TV Field Investigation Report: Hatteras Village Community Center District Page 4 Although the majority of the sidewalks will be located within the NCDOT right -way -way, a small section will extend into property owned by Dare County. Primarily, the sidewalk will be new concrete. Sections that are presently paved and in good condition will utilize striping with no other modifications. Portions of pavement along locations on NC Hwy 12 that are beyond the limits of the highway will be removed for improvement, and provide for drainage and increase of infiltration for water quality, which will include swale, curb or gutter construction in locations and modifications to existing drop inlets. In the Ocean Erodible (OE) Area of Environmental Concern (AEC) along NC Hwy 12 North, approximately 2,750 Ift of 5' wide concrete sidewalk is proposed. At the site of the Slash Creek Bridge, the proposal within the CS AEC includes new concrete sidewalks and the removal of existing asphalt and/or concrete pavement. Dimensions for this walkway total 273'x5', for a cumulative impact of 1,365 sf within this AEC. The NC 12-southern canal bridge crossing in Hatteras, located just north of the southern end of Eagle Pass Road, currently has no means of pedestrian access. The pedestrian route of the 5'-wide sidewalk project proposes to cross over the man-made canal with an elevated, wooden bridge with handrails measuring 98' long by 8' wide. Approximately 62'x8' (496 so of the bridge will be over the canal, with approximately 2.75' navigational clearance, and the balance of 288 sf will be overland. In order to provide clearance over the private property owners' bulkheads and transition down to maintain access over the existing driveway to the east, an ADA compliant concrete ramp with handrails is proposed to be utilized and a section of the driveway will be removed and replaced for the necessary alignment. The concrete ramp will also direct stormwater runoff away from the canal towards sandy soils. Approximately 11'x9'11" (2 cy) of high ground is proposed to be excavated for the bridge construction. The excavated material will be used for fill at the transitional area of the walkway/ramp. Heading north on Eagle Pass Road (SR 1241), approximately 270'x5' of concrete sidewalk will located within the CS AEC for a total of 1,350 sf. Of this total, approximately 100 Ift of the proposed concrete will be located within the 30' setback. No impervious surface currently exists in this project area. Anticipated Impacts The construction of the concrete walkways will result in 13,750± of impervious surface in the OEA AEC. Construction of the pedestrian bridge will result in the shading of 496± sf of PTA AEC and 288± shading of PTS AEC. The driving of pilings for the bridge may result in temporary turbidity in the adjacent waterway. Construction of the concrete walkways and approaches to the pedestrian bridge will result in 2,427± sf of impervious surface in the CS AEC. The remaining land disturbance for the Hatteras Village sidewalk project is noted to be outside of the CAMA's AECs. The total impacts in the High Ground area are noted as 224,361± sf, of which includes 99± sf of dredging associated with the construction of the pedestrian bridge. The project as proposed will disturb a total of 5.54 acres. DMEC rn�f Sidewalks throughout the Village of Hatteras along NC-12 and Eagle Pass Road Project Narrative Revised August 11, 2020 ��k The Hatteras Village Community Center District is pursuing the construction of approximately 3.69 miles of sidewalks in Hatteras Village, including 2.92 miles along NC-12 and 0.77 miles along Eagle Pass Road. This sidewalk seeks to provide a safe pedestrian route throughout the village in a manner that is aesthetically pleasing and compliant with all local, state and federal regulations. The sidewalk will interconnect local points of interest within the village with the goal of reducing traffic and promoting exercise. The alignment has been selected based upon available right-of-way, location of destinations, safety and minimizing roadway crossings as well as impacts to environmentally sensitive areas. The sidewalks will be primarily located within the NCDOT right of way, with a small portion extending into County owned property. The project is included within the "Off Road Pathways for Hatteras Island Villages". This document is a plan developed by the Outer Banks National Scenic Byway Committee and released in August 2006. This portion of NC-12 is within the Outer Banks National Scenic Byway. While the Hatteras Village Sidewalk project is not specifically being undertaken by the Byway Committee, the Hatteras Village Community Center District seeks to comply with the Outer Banks National Scenic Byway island wide pathway plan. The sidewalk will be constructed primarily of new concrete, although sections that are currently paved will utilize striping of existing pavement where the pavement is in good condition and no other modifications are being sought. The project also includes an elevated wooden pedestrian bridge crossing over the man-made canal beneath NC- 12 near Eagle Pass Road. Along many locations on NC-12, pavement exists well beyond the limits of NC-12 lanes and paved shoulder. The project intends to remove certain portions of this excess pavement for beautification within the Village while providing for drainage and increasing infiltration capacity to improve water quality. The Hatteras Village Community Center District is currently seeking funding for the construction of these sidewalks through grants or other sources. For this reason, there is no definitive date for construction. It is anticipated that construction will begin in 2020. George met with Cynthia Rountree (NCDEQ DCM) and Billy Standridge (USACOE) to obtain confirmation of the wetland limits. The Flagging locations was obtained by Seaboard Surveying during the physical survey for the project area and are shown on the prepared plans. Throughout this process, four locations where the project limits will be located within CAMA AEC's as follows: NC-12 / southern canal crossing: The pedestrian route will cross over a man- made canal as it runs parallel to NC-12 just north of the southern end of Eagle Pass Road. The bridge has no provisions for pedestrian access so an independent pedestrian bridge will be constructed across the canal. The horizontal and vertical alignment for this bridge is determined by numerous constraints, including the bulkhead elevations on each side of the canal and the existing driveway on the south side of the canal. In this location, the horizontal alignment proved difficult to provide clearance over the bulkhead and transition down to maintain access across the existing adjacent driveway. In order to do so, a concrete ramp meeting ADA standards is being utilized and a portion of the driveway will be removed and replaced to accommodate the alignment. The concrete ramp is necessary to the water dependent bridge. This will direct stormwater away from the canals and towards sandy upland soils. The guardrail will also need to be modified to allow for access. NC-12 / Slash Creek: The Slash Creek bridge currently contains a sidewalk on the ocean -side of the bridge. Plans are currently being developed for replacement of the bridge (anticipated for 2023) that will include sidewalks on both sides. AAL and the Hatteras Village Community Center District are coordinating with NCDOT on matter, although it is expected that the bridge replacement will occur after the sidewalks are installed. The sidewalks within the 30' setback that will be constructed will include the removal of existing pavement and result in a significant decrease of the amount of impervious surface within the setback. NC-12 / Ocean Erodible Area: At the northern and of the project, the sidewalk encroaches within the 360' Ocean Erodible Area AEC (approximately 2,237 If of new sidewalk). In this location, much of the sidewalk has been placed on the sound side of NC-12. An Ocean Hazard AEC Notice is being provided with this submittal. Eagle Pass (Duck Pond / Slash Creek connection): Near the northern end of Eagle Pass, the roadway extends across a narrow segment bounded by a canal connecting a portion of Slash Creek with Duck pond (as noted on the NCDEQ water classification GIS database). Three large diameter culverts are located at this crossing to maintain the hydraulic connection. The entire right of way is located within the 30' setback and there is concern that an elevated walkway is not feasible due to the potential to compromise the integrity of the culverts as well as proximity of a structure adjacent to the road. The walk will be sloped inwards with a swale separating it from the road and directing runoff to infiltration areas on each side of the crossing. Stormwater Management: Stormwater runoff from the sidewalk is being directed via sheet flow to the shoulder areas of the sidewalk for vegetative filtration and infiltration into the adjacent soils. Due to the limitations of the existing right of way width and other constraints presented by existing utilities and vegetation, there is limited opportunity to provide vegetative filters for this runoff. However, the soils in the area are very sandy and most runoff is expected to infiltrate directly into the adjacent soils. In addition, portions of the Village have pavement that extends from the edge of the NC-12 paved shoulder to the right-of-way limits in a continuous manner. While some of this pavement serves as parking for nearby business or attractions, other areas have been identified to have excess pavement removed. At these locations, current conditions typically direct the runoff via sheet flow directly into a closed drainage system that outlets to the sound and existing waterways. The removal of this pavement will create open vegetated areas that will provide infiltration and filtration of stormwater to occur and are anticipated to benefit water quality. Erosion and Sedimentation Control: The sidewalk construction will include clearing and grading operations, pavement removal, concrete forming and placement, piling installations for elevated wooden pedestrian bridge construction, landscaping and some drainage improvements along the route. Existing NCDOT drainage ditches and areas of environmental concern will be protected from construction activities and sedimentation utilizing silt fencing along banks, coir log placement within swales and drop inlet protection. The disturbed areas are to be stabilized with coastal vegetation, temporary straw matting, hydro seeding and/or matting. Soils: The sidewalk extends nearly 4 miles adjacent to roadway and thus encounters several varieties of sandy soils. Dare County Soil Survey maps illustrate Carteret sand (CeA), Corolla fine sand (CoB), Duckston fine sand (DtA) and Newhan fine sand (NeC). There is also a section of Psamments (PsB) dredge sand that runs alongside NC-12. It is unclear if this extends into the right of way. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alterations are designed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. Permits issued in the Ocean Hazard Area of Environmental Concern include the condition that structures be relocated or dismantled if they become imminently threatened by changes in shoreline configuration. The structure(s) must be relocated or dismantled within two (2) years of becoming imminently threatened, and in any case upon its collapse or subsidence. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual long-temt average ocean erosion rate for the area where your property is located is 4 feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. The Flood waters in a major storm are predicted to be about 9-16 feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary sand bags may be authorized under certain conditions. The applicant must acknowledge this information and requirements by signing this notice in the space below. Without the proper signature, the application will not be complete. Property Owner's Signaturel Date Inlet Hazard Area SPECIAL NOTE: This hazard notice is required for development in areas subject to sudden and massive storms and erosion. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begins on the project site, the Local Permit Officer must be contacted to determine the vegetation line and setback distance at your site. If the property has seen little change since the time of permit issuance, and the proposed development can still meet the setback requirement, the LPO will inform you that you may begin work. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year, and, sooner or later, will threaten oceanfront structures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are intended to avoid an unreasonable risk to life and property, and to limit public and private losses from storm and long-term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge, you can snake a more informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal management rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront, less than 5,000 square feet in size, must be behind the frontal dune, landward of the crest of the primary dune, and set back from the first line of stable natural vegetation a distance equal to 30 times the annual erosion rate (a minimum of 60 feet). The setback calculation increases as the size of the structure increases [15A NCAC 7H.0306(a)(2)]. For example: A structure between 5,000 and 10,000 square feet would require a setback from the first line of stable, natural vegetation to a distance equal to 60 times the annual erosion rate (a minimum of 120 feet). The graduated setback continues to increase through structure sizes greater than 100,000 square feet. The beachfront is an ever -changing landform. The beach and the dunes are natural "shock absorbers" taking the beating of the wind and waves and protecting the inland areas. By incorporating building setbacks into the regulations, you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as close to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Exception The Coastal Resources Commission recognized that these rules, initially passed in June 1979, might prove a hardship for some property owners. Therefore, they established an exception for lots that cannot meet the setback requirement. The exception allows buildings in front of the current setback, if the following conditions apply: I ) the lot must have been platted as of June I, 1979, and is not capable of being enlarged by combining with adjoining land under the same ownership; 2) development must be constructed as far back on the property as possible and in no case less than 60 feet landward of the vegetation line; 3) no development can take place on the frontal dune; 4) special construction standards on piling depth and square footage must be met; and 5) all other CAMA, state and local regulations must be met. The exception is not available in the Inlet Hazard Area. For this reason, this report has been prepared for review by the State Historic Preservation Office for review in conjunction with the previous Byway submittals. This sidewalk seeks to provide a safe pedestrian route throughout the village in a manner that is aesthetically pleasing and compliant with all local, state and federal regulations. The sidewalk will interconnection local points of interest within the village to reduce traffic and promote exercise. The alignment has been selected based upon available right-of- way, location of destinations, safety and minimizing roadway crossings as well as impacts to environmentally sensitive areas. The sidewalk will be constructed primarily of new concrete, although sections that are currently paved may utilize striping of existing pavement where the pavement is in good condition and no other modifications are being sought. There is a portion of the sidewalk that will be crossing jurisdictional waters in which case an elevated wooden walkways will be utilized. The Hatteras Village Community Center District is currently seeking funding for the construction of these sidewalks through grants or other sources. For this reason, there is no definitive date or construction. The District is anxious to begin construction and therefore it is possible that the project may be constructed in phases as funding permits. It is anticipated that at least a portion of the project is anticipated to be built in 2020. It was received complete on August 11, 2020, and appears to be adequate for processing at this time. The projected deadline for making a decision is October 25, 2020. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day.
