This permit, issued on August 20, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Reconfiguration 1) This permit authorizes the demolition of the existing western docking facility and the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility reconfiguration without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high-water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Adam and Leigh Greene Permit No. 109-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of six (6) formalized boat slips. Two (2) formalized boat slips located at the existing eastern docking facility and four (4) located at the reconfigured western docking facility. 6) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 7) The roof of the gazebo shall not be designed for second story use. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 10) Should lot to the west be sold prior to the initiation of construction of the western docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 11) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. USACE Conditions 12) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws. ovg/raleigh/pdfs/ManateeGuidelines20l7.pdf. Adam and Leigh Greene ADDITIONAL CONDITIONS General Permit No.109-21 Page 3 of 3 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-00965). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1000. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $250 was received by DCM for this project. The property can be reached by traveling NC HWY 17 south towards Shallotte/Myrtle Beach then take NC-906 to SW 9`s Street in Oak Island. Turn left onto SW 9' Street and the property is at the street end on the right. The property was formerly two parcels and were combined into one larger lot. The project site is approximately .54 acres and is vegetated primarily with grasses, shrubs, and mature trees. The high ground portion is elevated approximately 7'-17' above the normal high water (NHW) level, and the shoreline (+/- 120 linear feet), which is stabilized by an existing bulkhead. There are coastal wetlands (Spartina alternii fora) within the riparian corridor of the applicant's property between the canal and existing bulkhead (approximately 12'-16' in width). The applicant's property is situated on Davis Canal, bordered by residential properties to the west and north, and SW 9th Street (town property) borders to the east. The width of the canal measures approximately 100' feet at the proposed project site. Existing structures on the project site include a single family residence, an existing bulkhead, and two separate private two slip docking facilities (4 slips total). The bulkhead was authorized in 2006 via CAMA General Permit GP-45830. No permit history was located for the existing docking facilities at the time of review. The applicant plans to demolish, reconstruct, and reconfigure the westernmost docking facility. The applicant plans to retain the easternmost docking facility as -is, with no proposed changes. The existing eastern docking facility consists of an access pier (4' x 3') extending from the bulkhead, and transitions to a fixed platform (12' x 12'). From the southern edge of the fixed platform, a gangway extends waterward to an existing floating dock (8' x 16') that is oriented parallel with the shoreline. To the west of the floating dock, there is an existing boat lift (12'x12'). Currently, the eastern docking facility serves as two slips (See Location Map page 2 of 5). The waters of the canal system are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the March 2021 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. The water depths range from -3.0 @ NLW on the landward side of the proposed features to -5' @ NLW on the waterward end of the proposed features. PROPOSED PROJECT The applicant proposes to demolish and reconfigure an existing docking facility, retain an existing docking facility, add an additional access point, resulting in an increase of 2 additional slips for a total of 6 slips along Davis Canal. Please note that on 5/6/21 this office distributed a different version of this project, which consisted of additional proposed constructed features for a total of 8 proposed slips. Since then, the applicant has changed plans, withdrawn the previous submittal and application, and is now proposing less constructed features, for a total of 6 proposed slips. The easternmost docking facility, described in the section above, will be retained as -is, with the existing features serving as slips 1 & 2 (see Location Map Page 2 of 5). Approximately 35' to the west, the applicant is proposing to construct a fixed finger pier (6'wide x 20'long) extending to the south from the bulkhead, which transitions to a short fixed finger pier extension (3' x 8') perpendicular to the shoreline. To the immediate East of the fixed finger pier, the applicant is proposing a constrict a boat lift (12' x 12% serving as slip #3. To the immediate west of the proposed fixed finger pier, the applicant is proposing to construct two additional boatlifts (each 12' x 12'), serving as slips #4 & #5 (See Location Map page 2 of 5). Approximately 25' to the west of the previous finger pier, the applicant is proposing to constrict a fixed access finger pier (3' x 14% extending to the south Greene Docking Expansion May 28, 2021 from the bulkhead, landing on a proposed gangway platform (30SF). The applicant is proposing to construct a fixed covered gazebo (roof dripline 17' x 171) to the immediate west of the proposed gangway landing. From the waterward edge of the proposed gangway landing, a gangway will lead down to a proposed floating dock (8' x 35') oriented perpendicular to the shoreline and serving as slip #6. No portion of the proposed constructed features will extend into the riparian corridor setback of the neighbor to the west. The existing easternmost docking facility (to be retained as is) is located in the setback for the eastern neighbor however no new work is being proposed there. The application states that existing water depths in the vicinity of the proposed constructed features would range from approximately -3.0' to -5.1' @ NLW. Water depths were verified by DCM staff. As proposed, the constructed features would be located within the established pier head line and within ''/e of the width of the waterbody. 10. ANTICIPATED IMPACTS The proposed docking facility would incorporate an additional approximately 1193 sq. ft. of Estuarine Waters and Public Trust Area, and shade 126 SF of Coastal Wetlands. The docking facility would remain consistent with the pier head line, and be consistent with the '/< width of the waterbody. The proposed docking facility would not encroach into the 15-foot riparian corridor setback of the western property owner. Minor increases in turbidity should be expected during piling installation.
