Excavation and/or filling pursuant to NCGS 113-229 Permit Number 117-21 Issued to Frank Golden, 8700 Bald Eagle Lane, Wilmington, NC 28411 Authorizing development in New Hanover County at adj. to AIW W- at 8700 Bald Eagle Lane, in Wilmington as requested in the permittee's application dated 2/16/21, including attached workpian drawings (4), Sheets, 1-3 of 4 all dated 2/15/21 and Sheet 4 of 4 dated 8/97. This permit, issued on September 3, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions acid notes set forth below. Any violation n mese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Dockine Facility Expansion 1) This permit authorizes only the relocation of the existing floating dock and the docks, piers, and other structures and uses located in or aver the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) 't his permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible "on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina. Signature of Permittee -= i Frank Golden Permit No. 117-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) This permit authorizes two (2) additional formalized boat slips for a maximum of four (4) formalized boat slips at this docking facility. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. USACE Conditions 6) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. Sedimentation and Erosion Control 7) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 8) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or'local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-01514). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1135. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. PROJECT DESCRIPTION JUL 14 2021 DCM-MHD CITY The project site is located at 8700 Bald Eagle Lane, on the Atlantic Intracoastal Waterway (AIWW), in Wilmington, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel north approximately 5.3 miles on Market Street (Hwy 17) towards Porters Neck. Take a right on Porters Neck Road and travel 0.9 miles to the traffic circle. Continue straight through the traffic circle staying on Porters Neck Road for another 1.4 miles. Take a left at the stop sign onto Bald Eagle Lane. Travel approximately 0.8 miles and the property will be on the right. Currently, the property has an existing 2 (two) slip private docking facility and timber bulkhead. The average elevation of the property is approximately 15' above normal high water (NHW). The high ground portion of the properly contains ornamental landscaping and lawn grasses, Coastal Wetlands varying from approximately 10' to 30' in width are waterwanl of the bulkhead which is approximately 106' in length and ties into the return walls for existing bulkheads at both the northern and southern neighboring properties. The existing docking facility consists of a 6' by 84' access pier that terminates in a 20' by 20' gazebo positioned in a L-head configuration to the south. A ramp extends to the north from the access pier approximately 10' landward of L-head gazebo connecting to a 6' by 30' floating dock positioned perpendicular to the shoreline. A 13' by 14' boatlift is located in between the gazebo and floating dock (see Sheet 3 of 4). During a site visit on April 27, 2021 DCM noted submerged aquatic vegetation (SAV) in the waters surrounding the docking facility. Water depths at the time of the visit were approximately -1.7' Normal Low Water (NLW) at the landward edge of the floating dock. The bulkhead was originally authorized by General Permit 320-D issued on 9/9/1986 and expired on 1219/1986. No permit history could be found for the original docking facility; however, it appears based on Google Earth imagery, that the docking facility was first constructed sometime between 1993 and 1998. General Permit 72348-D issued on 8/11/2018 and expired on 9/20/2019 authorized the replacement of the docking facility after Hurricane Florence. The docking facility was later expanded and reconfigured to the current configuration through General Permit 74565-D issued on 8/26/2019 and expired on 12126/2019. Water depths in the project area have been maintained to a depth of -6 NLW through State Permit # 164-97, recently renewed on February 24, 2020 for maintenance excavation of the adjacent access channel. In the drawings for State Permit # 164-97 the Crawford property corresponds to the project area, 8700 Bald Eagle Lane (See Sheet 4 of 4). A copy of the latest State Permit # 164- 97 renewal is attached, and the original permit is conditioned to protect juvenile shrimp and fish by prohibiting excavation from April 1 through September 30r^. The most recent maintenance event appears have been performed between 2015 and 2016 based on Google Earth aerial imagery. The New Hanover County Land Use Plan classifies the area in the vicinity of the project area as Conservation. The waters in the project area are classified as SA-ORW by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are open to the harvest of shellfish. The applicant proposes to reconfigure and expand the existing docking facility to include an additional boatlift and fixed finger pier to access the new lift for a total of 4 boat slips. In the reconfiguration, the existing ramp would remain in the same position however the existing 6' by 30' floating dock, positioned perpendicular to the shoreline, would be moved landward to fall within the excavation footprint associated with State Permit # 164-97. A new 8' by 6' floating plafform would be attached to the waterward edge of the floating dock to allow the access ramp enough room for 8700 Bald Eagle Lane, Frank Golden Page Three movement during tidal fluctuations. A new 4' by 25' fixed finger pier would extend north positioned parallel to the shoreline from the gazebo. The existing boatlift would be reconfigured in the same footprint for vessels to enter from the north instead of the east and a new 13' by 14' boatlift would be added, the lifts are positioned on each side of the proposed new 4' by 25' fixed finger pier. Current water depths in the vicinity of the floating dock in the proposed more landward position are between-0.8'-2' normal low water (NLW). The applicant plans to perform a maintenance excavation through State Permit #164-97 after the moratorium to a maximum depth of -6 NLW to gain the water depth needed for the proposed project. The proposed configuration would put 3 of the slips within the maintenance excavation footprint. The proposed 4r^ slip at the existing boatlift is the waterward most slip with a current depth of -2' NLW. The proposed docking facility changes would not result in encroachment into either neighboring 15' riparian setback (see Sheet 1 of 4). 10, ANTICIPATED IMPACTS As proposed the new structures would result in the incorporation of approximately an additional 330 ftz of Public Trust Area and Estuarine Waters. The project area consists of open water, no impacts to vegetated wetlands or to the high ground areas are proposed. The constructed features would not encroach into either adjacent 15' riparian setback, nor encroach into the established pierhead line.
