This permit, issued on September 8, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) In accordance with commitments made by the permittee, the stormwater pipe extension and rip rap apron originally proposed for this project is hereby deleted. Any and all reference to the originally . proposed stonnwater pipe extension in the attached permit application or workplan drawings is hereby null and void. Upland Development — Single Family Residence with Section 404 Fill 2) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the homesite, driveway, pool, deck and other associated infrastructure, and approximately 2,568 f' of Section 404 fill, all as expressly and specifically set forth in the attached permit application and workplan drawings. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. Signature of Permittee George Adams Family Trust ADDITIONAL CONDITIONS Stormwater Management Permit No. 121-21 Page 2 of 2 3) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA permit. Sedimentation and Erosion Control 4) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 5) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 7) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 29 (Action ID SAW-2021-01018). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0778. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. Hi Katharine, I spoke with the applicant and they are fine with removing the outfall pipe extension. If this could just be a condition of the permit that would be great. Although there were no proposed changes to the drainage in both volume and direction, this should eliminate any concerns. These are in addition to the concerns sent by the riparian property owner during the notification process. Do you know if the applicant has submitted any plans to the HOA? Their involvement and approval would be important in this case since there are objections and road is private. Let me know if the applicant wants to make revisions or discuss further. If the project is determined to be consistent with NCAC 07H .0209(d), it is recommended that any permit issued should include standard conditions for development and wetland impacts in ORW Coastal Shorelines. This office supports the recommendations of the resource agencies, particularly the NC Division of Water Resources and the U.S. Army Corps of Engineers, regarding potential impacts to water quality and §404 wetland impacts. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0209(d)(9), which says "Within the AECs for shorelines contiguous to waters classified as Outstanding Resource Waters by the EMC, no CAMA permit shall be approved for any project which would be inconsistent with applicable use standards adopted by the CRC, EMC, or MFC for estuarine waters, public trust areas, or coastal wetlands. The stormwater program started in 1988; however, I cannot find a permit that covers this section of Providence. We do have a permit for Providence Section II under SW8 880611. That being said, if the lot is receiving a CAMA major permit, then it is now subject to State Stormwater permitting and they will need to obtain a permit for any upland development. Obtaining a CAMA major permit is one of the triggers for requiring a state stormwater permit per 15A NCAC 02H.1019(2). As for the objections over the pipe, I don't believe the state stormwater program will be able to help in this instance. From the information provided, it sounds like the pipe in question is to direct drainage through the lot from the larger upstream area. If so, that is not something the state stormwater program has a say in. Ensuring proper drainage in existing drainage features is the responsibility of the local governments per GS 77-14 (attached). The wetland folks with USACE and DWR may also have a say if these features are jurisdictional. Let me know if you have further questions! There is an existing stormwateroutfall pipe on the property that runs under Carmel Trail and appears to drain the residential area on the landward side of the road. The stormwater pipe currently outfalls into upland area and has formed a small erosion head cut. Upland vegetation on the property currently consists of various native trees and shrubs such as sweet gum, pine trees, oak, and southern magnolia. According to the applicant there is approximately 108 linear feet of shoreline frontage with a strip of Coastal Wetlands approximately 10' wide consisting primarily of smooth cordgrass (Spartina altemiflora). Landward of the Coastal Wetlands is an area of §404 wetlands verified by the U.S. Army Corps of Engineers (USAGE). The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at the property as Residential (R-20S). The waters of Howe Creek in the project area are classified as SA-ORW by the Division of Water Quality. The waters in the project area ARE designated as Primary Secondary Nursery Area) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to construct a new single family home with associated Section 404 wetland fill, including relocating an existing stormwater outfall and adding rip rap. According to the applicant 2,568 ft2 of permanent §404 wetland impacts are anticipated from grading the existing highground areas and depositing that material into wetland areas to flatten the lot. The footprint of the proposed home and driveway would be 3,805 ft2 and 1,606 ft2 respectively. Construction of the house and driveway would result in 1,499 ft2 of permanent §404 wetland impacts. The proposed decking and pool footprint would be 952 ft2 and 336 ft2 respectively and collectively would result in 948 ft2 of permanent §404 wetland impacts. The stormwater pipe relocation and dissipator pad would result in 121 ft2 of permanent §404 wetland impacts and approximately 4 cubic yards of rock would be used in the dissipator pad. The height of the decking would range from 2.5' to 7' above the existing grade with the pool positioned either suspended above the existing grade or sitting at the existing grade. Additionally, the applicant proposes to extend the existing stormwater pipe approximately 70' south toward Howe Creek into §404 wetlands for site drainage improvements. As proposed the new outfall and dissipator pad would be located approximately 123.36' from normal high water (NHW) within Section 404 wetlands (see drawing 2 of 5). According to the applicant a total of 24.1 percent or 5,451 ft2 of impervious surface is proposed within the AEC, which encompasses the entire parcel. The adjacent neighbor to the east, Mr. John Carroll and Sue Bark, located at 6604 Cannel Trail submitted concerns about the moving the stormwater pipe outfall. Mr. Carroll's email will be included in the permit package. A multi - agency site visit was conducted on May 24, 2021 with a Division of Coastal Management, Division of Water Resources, and Army Corps of Engineers (USACE) representative present as well as the applicant's agent. Potential avoidance and minimization techniques and ideas were discussed and implemented to some extent by the applicant. Permanent §404 wetland impacts were reduced by 1,311 ft2 by moving the home site closer to the road, reducing the size of the dissipator pad, and removing some of the permanent impacts along the perimeter of the deck due to conversations with the USACE about the deck height and orientation. Waters in the project area are classified as SA, ORW and are not open to shellfishing. The project area is located in a Primary Nursery Area. The site is currently undeveloped and vegetated with typical native shrubs, trees, and typical section 404 and coastal wetland species. Section 404 wetlands and coastal wetlands were delineated by LMG staff and surveyed. Section 404 wetland lines have been approved by USACE, and the JD is attached. Coastal wetland lines were delineated by LMG staff and approved by DCM staff on 5/24/21. The elevation of the tract ranges from 0 ft to the +20 ft NHW. There is currently an existing outfall that directs runoff from the Providence subdivision to the 404 wetlands onsite. 3.1.2 Proposed Action The construction of a single-family residence is proposed on this 0.52-acre lot. Additionally, a relocation of the outfall pipe with the addition of a riprap curtain is proposed as a site drainage improvement. Based on a May 24 site meeting with DCM, DWR and USACE staff, the house was moved closer to the street, and the riprap outfall was moved further from the NHW and reduced in size. Due to the height above ground level and orientation of the open wood deck, impacts were not shown along the perimeter. Impacts to 404 wetlands have been minimized as much as possible during the site design, but because of the amount and location of wetlands within the lot, some impacts were required to make the lot buildable. The applicant now proposes 2,568 s.f. of permanent wetland impacts, which is 1,311 s.f. less than the original proposed impacts. Permanent impacts are needed for the construction of the proposed residence, therapy pool, and associated decking. The therapy pool is needed to accommodate the health care needs of the people who will live in the home. Note that the decking will be constructed between 2.5' and 7' above existing grade (see Appendix A, Sheet 5). However, because of anticipated shading from the deck, it is depicted as a permanent wetland impact. A proposed permanent wetland impact is also needed to extend the existing drainage pipe further down the lot as a site improvement. The house and driveway associated impacts total 1,499 s.f. The decking accounts for 948 s.f., the pipe for 78 s.f. and the rip rap outfall for 43 s.f. Approximately 4 CY of rip rap are proposed for the outfall apron. A total of 5,451 s.f. of impervious cover is proposed, which is 24.1% of the total area, and 133 s.f. less than the previous proposal. The total disturbed area is approximately 11,590 s.f., which is down from the previously proposed 12,721 s.f. See appendix A for details. Hi Lauren, Katharine, I wanted to comment on the proposed Drainage Pipe Extension that will connect to an existing culvert and run to a proposed Riprap Outfall on the the east side of the property, 6600 Carmel Trail next to my property 6604 Carmel Trail. My first comment on this is the new pipe extension is in the Wetland Line. Currently all the water from the neighborhood comes into the culvert that crosses under the street and gets diffused throughout the wetland. As you may know most of the water that comes into a wetland is held underneath the ground and depending on rainfall will rise to will cover the ground above. In the proposed drawing it shows the Drainage Pipe Extension and Riprap Outfall right near the lower corner of my home. Basically the new Drainage Pipe and Riprap Outfall will drop all the water from up above my neighborhood to the right corner of my home - I can only estimate where the Drainage Pipe Extension and Riprap Outfall will go because of footage references for this. Where the water was once diffused starting up above near the street will now diffuse starting down by the corner of my home as seen in the wetland marking tape and wetland flora and fauna. As I mentioned before most wetland water is held underground. With this said, for years under my home in the crawispace has been damp from ground water leaking in from various locations. I have had mold and mildew treatment done replacing the insulation about 9 years ago and now new problem of the insulation dropping off the insulation backing as a result of the dampness. Recently I installed a sump pump and dehumidifiers and sealing up the vents I have been able to mitigate some of the water intrusion but not all of it, it still weeps in where cement block meets the floor. The sump pump expels water out about 3 times an hour. I invite all concerned parties to come over and observe this. My concern is that now with the new Drainage Pipe Extension outlet moved further down to the Riprap Outfall further down 6600 Carmel Trl property, there will be more water to disperse from up above (culvert and neighborhood) from the current Wetland Line (existing culvert) and less area to do so as the discharge will be moved down also. As seen on the drawings the Wetland Line is quite large, moving water down does not remove the water only changes the characteristics of where the water is held and the flow of the water. Also the Riprap Outfall will now become the place for water to pool below the ground. I think this will add to more water being pumped by my sump pump and change the delineation of the Wetland Line increasing the amount of water on my property. My second comment is during Hurricane Florence (using the dimensions on the drawings provided) the water from Howe Creek did come up where the proposed Riprap Outfall will be (estimate 90' to 120" from the road). From this perspective I can see the new Drainage Pipe Extension and Riprap Outfall filling with water and backing up water onto my property however not only to my property but the homes above me. The ground is saturated in this area as there was some type of a drainage from the neighborhood running through the culvert to the wetland. Currently after several weeks of no rain, today there is water coming through the culvert front the neighborhood above as there is always water running through it. I'm also a member of the Architecture Review Board (ARB) for our Homeowner's Association. I am writing today to voice my concern over the attached project on behalf of my neighbors who will be most affected. The concern is that the proposed extension of the drainage culvert is not sufficient enough to handle a surge in stormwater drainage during a heavy storm or hurricane. Such a surge has potential to damage property. As the attachment states, it is not a surveyed or engineered drawing. I am not an engineer, but I would like to see evidence that an actual survey has been completed and the proposal is sufficient to properly drain the water from the other neighbors' properties. The side yard of my property (lot 53) fronts a vacant lot across the street (Carmel Trail); where you have posted a CAMA notice which invites comments on a single family home development proposal. The southeast side of my lot abuts David Lorenz, and my drainage is across his property to the vacant lot thru ar existing culvert. David asked me to forward my comments, written July 25, and included below, which were in response to Mr Stroms comments. I would like to add the following additive comments. My understanding is that the left side of the property is included in both a 404 Federal Wetland designation and abuts Howe Creek, which is under an ORW designation. My property and all of the adjoining properties all fall within the CAMA jurisdiction. My understanding is that stormwater runoff from improved lots is detrimental to the Howe Creek because of content of fertilizers, pesticides, and herbicides. I, and probably all of my neighbors have improved yards which contribute one or all of these components to our runoff. Because my back yard is near the low point of the swale that feeds into the culvert, I also have to maintain the low point of the Swale to avoid getting water into my basement. I have a walkout door very near the swale. I am not against development and construction of a home on the property. The extension of the culvert through a wetland which is filtering our collective runoff seems excessively detrimental to Howe Creek. It seems that maintaining some sort of open surface drainage through the property in question would best meet the needs of subdivision drainage, while still protecting Howe Creek from contaminants in our runoff. Providence was developed in a very old growth forested area. I have counted rings on stumps of trees downed during hurricanes and found they date back to 1896. Our developer went to great lengths to preserve mature trees. The ARB was been vested with the responsibility to the greatest extent possible, to preserve and protect our wooded natural habitat. All significant living trees require ARB approval before removal. The Corps of Engineers has control of any modifications to a wetland. Even though they might be open to some modifications, the extension of the culvert has several very negative impacts. That means that the amount of impervious surface is limited. Unfortunately that number has been increased since 1992. Still the idea of reducing storm water runoff to the creek is the point. and install of hard pipe goes against that. I was required to limit my impervious surface to less than a number around 25%. These preservation concepts seem to be completely lost on the younger/newer residents 4. I have looked at the space in question, and can understand the reason for the objection. One of the changes proposed is connecting a 90' long culvert to the existing culvert under Carmel Trail. This existing culvert drains the water from our property at 6600 Carmel Trail, and also the Nutt's property on Chesapeake. In heavy rains it also drains the properties behind ours. You can review the proposed plans on the attached file. There is a second attachment dealing with NC drainage regulations from NCDEQ. We have lived at 6600 Carmel Trail for >22 years. We know about storms and rain and drainage. I have several concerns about this proposal, which I have discussed with NCDENR (Katharine Elks). The main concern is extension of the culvert under Carmel Trail. (Obviously in order to extend the culvert, many trees would need to be removed. That is certainly an ARB issue.) However my main concern is potential back up of water in storms onto my property at the culvert inlet. When we first moved into our house (1998), the current culvert would occassionally back up and water would pond in our drainage ditch or swale. In major storms this water level reached our driveway, ultimately undermining and damaging it, and causing us to have the expense of replacing the section near the street. This backup was caused by sand and silt build up at the outflow of the culvert on the 6600 property. Since I figured this out in 2002, 1 have annually maintained the culvert outlet on the 6600 property. Each year I shovel out built up sand and maintain the drainage channel near the outlet. No backups have occurred since I started clearing the outflow end (6600) of the culvert. If the culvert is extended, removal of built up sand and silt will not be possible. This will ultimately lead to water backing up onto our property and causing damage. I do not want this. There is a simple alternative solution, which is to have a nice drainage ditch that is easily maintained and bounded with riprap or river stones. Our drainage ditch (riprap) has functioned perfectly since 1989 with only minor maintenance to remove weeds. To be clear, I have no issue with development of this property, and in fact would welcome it. However, I do not want to be left with drainage issues because of this. My hope is that someone from PHOA can also comment to NCDENR about this issue before July 31. Drainage and wetlands are what we live with here. The stormwater program started in 1988; however, I cannot find a permit that covers this section of Providence. We do have a permit for Providence Section II under SW8 880611. That being said, if the lot is receiving a CAMA major permit, then it is now subject to State Stormwater permitting and they will need to obtain a permit for any upland development. Obtaining a CAMA major permit is one of the triggers for requiring a state stormwater permit per 15A NCAC 02H.1019(2). As for the objections over the pipe, I don't believe the state stormwater program will be able to help in this instance. From the information provided, it sounds like the pipe in question is to direct drainage through the lot from the larger upstream area. If so, that is not something the state stormwater program has a say in. Ensuring proper drainage in existing drainage features is the responsibility of the local governments per GS 77-14 (attached). Three requests: T 1. What is the diameter or pipe size of the culvert extension? The diameter will match the existing pipe diameter. I don't recall the existing diameter. 2. How do they accomplish the "dog leg" or elbow in the extended culvert? We do not regulate construction methods since we are not engineers. I would assume, depending on the pipe material, it can be accomplished using a junction box or by bending the pipe if it is corrugated plastic or HDPE. 3. The stormwater program started in 1988; however, I cannot find a permit that covers this section of Providence. We do have a permit for Providence Section II under SW8 880611. That being said, if the lot is receiving a CAMA major permit, then it is now subject to State Stormwater permitting and they will need to obtain a permit for any upland development. Obtaining a CAMA major permit is one of the triggers for requiring a state stormwater permit per 15A NCAC 02H.1019(2). As for the objections over the pipe, I don't believe the state stormwater program will be able to help in this instance. From the information provided, it sounds like the pipe in question is to direct drainage through the lot from the larger upstream area. If so, that is not something the state stormwater program has a say in. Ensuring proper drainage in existing drainage features is the responsibility of the local governments per GS 77-14 (attached). The wetland folks with USACE and DWR may also have a say if these features are jurisdictional. Let me know if you have further questions! As I mentioned, I am the homeowner at 6611 Carmel Trail. I have a drainage ditch or swale, on my property that drains to the culvert intake under Carmel Trail. The outflow of the culvert is on the 6600 Carmel Trail property. The drainage from this ditch drains four (4) adjacent properties. In big storms sheets of water flow across our side yard from adjacent properties, quickly filling the drainage ditch. We have lived at this address since 1998. In 1999 we had Hurricane Floyd (and Dennis), which is when I first became aware of the build up at the outflow of this culvert. Significant backup of water occurred to the level of my concrete driveway. Afterwards, I discovered that the the culvert was >50% blocked by sand and silt debris. I was able to clear it out with some shoveling, and normal outflow was observed. However in 2000 (or 2001?) we had more storms, and again water backed up to my driveway. Again when I checked the culvert outflow it was partially blocked. I cleaned it out and regular flow seemed to occur. Ultimately, our concrete driveway had to be replaced, and much of the cracking was likely due to wash out because of the baked culvert. For the past 20 years I have been shoveling sand out of the culvert to prevent build up and back up of water. I also dug out about 20 feet of trench below the culvert to help with drainage. We have also done much to reduce erosion on our property- planting a row of crape myrtles, planting decorative grass all along our driveway, some b used along the shoulder of the drainage, and a large bed of native ferns in the upper part of the drainage area. More recently, maybe 10 years ago, I noticed significant erosion above the culvert outflow from water streaming off the shoulder of Carmel Trail. After tropical rainstorms, sheets of water drain across the side of the road and into the ditch with the culvert on the 6600 side. This was causing erosion above the culvert. So I added bulkheads above the culvert to reduce erosion from water draining off Carmel Trail onto the 6600 property. My concern: I am quite concerned about what could happen to my property if the culvert is extended. If the culvert is extended, there will be no practical way to remove accumulated sand and silt that washed through the culvert. Eventually it will again clog up, restricting drainage, and likely backing up onto my driveway. (My 22 years living here supports this conclusion I think.) I hope that the extended culvert is not approved. Thank you. Project Narrative 3.1.1 Project Location and Existing Conditions The project is located on Howe Creek at 6600 Carmel Trail in Wilmington, New Hanover County. Waters in the project area are classified as SA, ORW and are not open to shellfishing. The project area is located in a Primary Nursery Area. The site is currently undeveloped and vegetated with typical native shrubs, trees, and typical section 404 and coastal wetland species. Section 404 wetlands and coastal wetlands were delineated by LMG staff and surveyed. Section 404 wetland lines have been approved by USACE, and the JD is attached. Coastal wetland lines were delineated by LMG staff and approved by DCM staff on 5/24/21. The elevation of the tract ranges from 0 ft to the +20 ft NHW. There is currently an existing outfall that directs runoff from the Providence subdivision to the 404 wetlands onsite. 3.1.2 Proposed Action The construction of a single-family residence is proposed on this 0.52-acre lot. Additionally, a relocation of the outfall pipe with the addition of a riprap curtain is proposed as a site drainage improvement. Based on a May 24 site meeting with DCM, DWR and USACE staff, the house was moved closer to the street, and the riprap outfall was moved further from the NHW and reduced in size. Due to the height above ground level and orientation of the open wood deck, impacts were not shown along the perimeter. Impacts to 404 wetlands have been minimized as much as possible during the site design, but because of the amount and location of wetlands within the lot, some impacts were required to make the lot buildable. The applicant now proposes 2,568 s.f. of permanent wetland impacts, which is 1,311 s.f. less than the original proposed impacts. Permanent impacts are needed for the construction of the proposed residence, therapy pool, and associated decking. The therapy pool is needed to accommodate the health care needs of the people who will live in the home. Note that the decking will be constructed between 2.5' and 7' above existing grade (see Appendix A, Sheet 5). However, because of anticipated shading from the deck, it is depicted as a permanent wetland impact. A proposed permanent wetland impact is also needed to extend the existing drainage pipe further down the lot as a site improvement. A total of 5,451 s.f. of impervious cover is proposed, which is 24.1% of the total area, and 133 s.f. less than the previous proposal. The total disturbed area is approximately 11,590 s.f., which is down from the previously proposed 12,721 s.f. See appendix A for details.
