This permit, issued on January 19, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Non -Conforming Structure
1) This permit authorizes only the pier and covered platform with half walls, and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this non -conforming structure
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
structure. Any sewage discharge at the structure shall be considered a violation of this permit for
which the permittee is responsible. This prohibition shall be applied and enforced throughout the
entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) All portions of the permitted access pier structure built over Coastal Wetlands shall not exceed four (4)
feet in width and shall be elevated a minimum of three (3) feet above the wetland substrate as measured
from the bottom of the decking. All portions of the permitted covered platform structure built over
Coastal Wetlands shall be elevated a minimum of eight (8) feet above the wetland substrate as measured
from the bottom of the decking.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit does not authorize any formalized boat slips.
6) The authorized non -conforming structure shall be single story, and shall not be designed to allow for
second story use.
7) The non -conforming structure shall not be completely enclosed or have side coverage more than one
half the height of the side, from the roof waterward.
8) This permit authorizes only the replacement of the existing non -conforming structure within the
previously existing footprint. No portion of the replaced non -conforming structure shall be located
outside of the previously existing structure footprint.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
10) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
As -built Survey
11) An as -built survey shall be performed on the non -conforming structure, and copies of the survey
provided to the Division of Coastal Management, within 60 days of completion of construction of these
portions of the project.
General
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: This docking facility was permitted under the rule of 15A NCAC 07J .0211 for Non -Conforming
Development.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-01930).
NOTE: The'N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1679.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $400 was received by DCM for this project.

The project will encompass an elevated wooden deck with roof and 1/2 sides extending downward from the roof. The deck
will be utilized for recreational purposes, including hunting and fishing and will provide an escape from inclement weather
and relief and rest location from the sun and wind. Pier will provide access to deck.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
Pilings will be mechanincally driven. Hand tools induindg power saw, hammer and nails, and framing tools will be used. A
portable generator may also be utilized. No tools or equipment will be left or stored on the island.

the standard review time be extended. An additional 75 days is provided by G.S. I I3A-122(c)
which would make February 25, 2021 the new deadline for reaching a decision on your request.

Mr. Garrish has submitted a CAMA Major Permit application request to rebuild a covered platform
measuring 12' x 16' that will be elevated 8' above the marsh substrate and have half walls extending down from the
roofline as well as a 4' x 24' access pier on a privately owned marsh island in the Pamlico Sound east of Ocracoke
Island, Hyde County, North Carolina. The proposed development of a covered deck with half walls and access pier
over coastal wetlands would be total replacement of a structure destroyed during Hurricane Dorian in September of
2019. Previously the structure had been replaced in 2016 without a permit after being destroyed by hurricanes and
Mr. Garrish was issued a CAMA violation, case #16-0213, and assessed a $581 civil penalty. The violation was
closed out and structure was allowed to remain. This structure that was destroyed during hurricane Dorian was a
fully enclosed structure where the new proposed development will have half walls.
Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development in
Estuarine Water and Public Trust Areas as well as Subchapter 7J. It is staff's recommendation that project appears
consistent with the language found in 15A NCAC 07J.0211 regarding non -conforming development fitting the 4
points laid out in the rule.
(1) The structure will not be enlarged beyond its original dimension
(2) The Structure will serve a similar use
(3) The are no practical alternatives for replacing the structure to provide the same or similar benefits in
compliance with current rules
(4) The structure will be rebuilt so as to comply with current rules to the maximum extent possible
Staff recommends the application for CAMA Major Permit be issued based on the language set forth in 15A
NCAC 07J .211 since the structure will not be enlarged beyond its original dimension it will serve a similar purpose
for recreation and have less use as the new structure is not enclosed, there is no portion of the island that is not
coastal wetlands over which to build the structure, the pier fits the use standards for coastal wetlands and the
platform is elevated five feet higher than required in use standard

Consistency Determination: The request is consistent with the 2008 Hyde County CAMA Core Land Use
Plan certified by the CRC on March 27, 2008, provided the structure is less than the maximum building
height of 35 ft. as required by the Unbuildable Land Future Land Use Map Classification.
Project Overview: The project site is located on Terrapin Island (35°10'11.6"N, 75°49'37.2"W) in the
Pamlico Sound near the northern end of Ocracoke Island approximately 850' northwest of the Quark
Hammock boat launch in Shingle Creek. The private island is 10,985 sq. ft. (0.25 acres).
A piling supported habitable structure has been located on the island since the early 1980's with a 12'x16'
footprint. The original structure included beds and appliances to allow overnight use. The original
structure was lost in a series of storms and in 2015 the structure was rebuilt without LAMA authorization.
In 2016 the site was investigated by Coastal Management and the USACE and the rebuild of the structure
was deemed repair and allowed to remain. In November of 2016 a pier permit was issued to the owner
to Mr. Garrish to provide access from the edge of the island to the structure. The structure and pier, save
a few pilings, was completely destroyed during Hurricane Dorian in September of 2019
The applicant is proposing to build a similar structure over the marsh island in the same footprint as the
previous 12'x16' structure. According to the application package "The structure will be used as its original
purpose and intentions and were in the past, which is to provide an escape from inclement weather, relief
from the sun and wind, the restful and relaxed break during their anticipated recreational hunting and
fishing pursuits in the immediate vicinity of their property. The owners do not plan to permanently store
any items or equipment on the site or engage in any non -water dependent usages or activities" (Letter to

The proposed structure will be an open -deck covered structure with a dripline dimension of 12' x 16' and
be elevated 8' overthe marsh substrate. The significant change made to the design of the structure is that
it will consist of half -walls that will extend down from the roofline 7', leaving 7' of exposed open air deck
below. Based on the drawing dated 9/28/2020 from the Washington Regional Office the height of the
building appears to be approximately 23 feet tall (not including the roof). A 4' x 24' pier will provide access
from the edge of the marsh to the structure.
The project is located in the following Areas of Environmental Concern (AEC): Coastal Wetlands (CW),
Public Trust Shoreline (PTS) and Public Trust Area (PTA). The project is in the Pamlico Sound that is
designated as SA;HQW by the Environmental Management Commission. The site is not a Primary Nursery
Area (PNA), and is designated open to shellfishing by the by the Marine Fisheries Commission. A review
of wetlands, SAV, historic, and archaeological resources was not provided. However, for the purpose of
this review the assumption is that coastal wetlands are on -site, as Coastal Wetlands are indicated as an
AEC and the anticipate impacts indicate the shading of coastal wetlands.
Anticipated impacts The project as proposed will result in the shading of 288 ft2 of coastal wetlands on
the privatelyowned marsh island. Temporary impacts would include localized noise and turbidity resulting
from the removal of the existing pier and construction of the new pier.
Basis for Determination:
The 2008 Hyde County CAMA Core Land Use Plan Future Land Use Map (FLUM) does not designates the
project, however all AECs are designated as "Unbuildable Land", which limits development to 1SA NCAC
7H use standards.
The LUP defined the category as follows:
"This category includes all AECs as defined by 15A NCAC 7H (see Section5(F)(g)). There should be no
development or development limited to 15A NCAC 7H use standards. Hyde County is home to a
substantial number of environmentally sensitive areas. The county feels very strongly about protecting
these areas. This land use district includes all CAMA defined Areas of Environmental Concern. These areas
are defined and discussed on pages 66 through 90 of the plan. Development within these areas should be
limited to low density housing. Non-residential development in the form of commercial or industrial
operations should not be permitted.
Allowable density 1 unit per acre (residential)
Maximum building height 35 feet
Permitted uses Single-family residential homes (assumes soils suitable for
development are available)
Uses not permitted All non-residential uses including commercial and industrial
operations
Land Use Policies: The following LUP policies may be applicable to this request.
The Policy Section of the LUP notes that "It is intended that all policies are consistent with (do not
exceed) applicable State and Federal requirements when State and Federal requirements apply"

Reference the application of James D. Garrish, III, for a Department of the Army permit to
construct a pile supported covered deck in the original footprint of a previously enclosed
structure, and construct an access pier, on property located on Terrapin Island, adjacent to the
Pamlico Sound, near Quark Hammock and Shingle Creek, near Ocracoke, in Hyde County,
North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAAINATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
8. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Dear Mr. Spivey:
By copy of the attached application and plans, the owners request to reconstruct a new 12 fit x 16 ft
elevated wooden deck with roof and Y2 sides, within the footprint of a previously existing enclosed
habitable -structure and access pier, on their property located off the North side of NC Highway 12, on
Terrapin Island, at Quork Hammock, adjacent to Shingle Creek and the Pamlico Sound, Ocracoke Island,
Hyde County, North Carolina.
The original enclosed habitable structure was originally built on Terrapin Island in early 1980. The
original footprint of the structure measured approximately 16 feet by 12 feet with a small attached
porch. The structure was built on pilings and included one room with bunk beds and appliances
conducive for overnight use and extended day use to escape inclement weather and relief from the sun
and wind during recreational activities. The island was approximately 0.28-acre in size and access was
only available via small boat from the nearby mainland shoreline. Through the active Hurricane years,
including a series of Major Hurricanes and Northeasters, the original stricture eventually succumbed to
the elements and only the original pilings remained.
During the Fall of 2015, the owners began to rebuild the previously existing habitable structure on the
island in its original alignment and utilized the remaining pilings as part of the support system. The
structure was rebuilt in the same design and comprised the same enclosure with windows, doors, roof,
and small exterior porch. In March 2016, State and Federal Permit agencies investigated the work, which
was undertaken without any permit review process, and determined that the work consisted of repair
and replacement and as such was allowed to remain. In addition, on November 8, 2016, the NC Division
of Coastal Management issued a pier permit to the owner to provide access to the structure from the
waterward end. Unfortunately Hurricane Dorian made a direct hit in the area and damaged both the
pier and the enclosed habitable structure.
The Owner and his agents have made numerous inquiries to local, state, and federal stakeholders and
have determined that the best course of action in this matter is to pursue a new structure that will be
more compliant with current laws, rules, and regulations, but will still allow them ample opportunity to
enjoy their use and privilege of their property. In this regard, the owners propose to build a new open
deck with roof top and 1/2 sides extending downward similar to standard boat house designs. The deck
will be elevated a minimum of 6-8 feet high over the surface substrate and there will be no fill placed
below or underneath at any time. The structure will be used as its original purpose and intentions were
in the past, which is to provide an escape from inclement weather, relief from the sun and wind, and a
restful and relaxed break during their anticipated recreational hunting and fishing pursuits in the
immediate vicinity of their property. The owners do not plan to permanently store any items or
equipment on the site or engage in any non -water dependent usages or activities.

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.
