HomeMy WebLinkAboutTB_16-06_ Pope 4 Issued by WiRO TB16-06 Topsail Beach Permit Number CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environmental Quality and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area Management" Issued to William B. Pope authorizing development in the Estuarine Shoreline (AEC) at 442 N. Anderson, in Topsail Beach, Pender County as requested in the permittee's application, dated May 10, 2016. This permit, issued on May 26, 2016, is subject to compliance with the application and drawing dated and received by DCM on May 10, 2016 (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Clearing and grading. (1) All proposed development and associated construction must be done in accordance with the permitted drawing received by DCM on May 10, 2016. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development,construction, and/or land use activities will require re-evaluation and modification of this permit. Disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. (6) Any proposed for grading within the 30' buffer from the Normal High Water level must be contoured to prevent additional stormwater runoff to the adjacent marsh and/or waterbody. This area shall be immediately stabilized, and must remain in a vegetated state. (7) With exception of the development activities authorized under this permit, no additional development may take place within 30-feet of the normal or mean high water boundary. This permit does not authorize the placement of rock, gravel, concrete, or other impervious material within 30' of the normal high water line. (8) All development shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the following AEC standards,the more restrictive provision shall control. As we discussed, Mr.Jason Dail,the DCM Field Representative (CAMA rep.) with NC DEQ/DCM out of Wilmington, NC has indicated the most expeditious method of him being able to issue the CAMA permit for the grading work on our sound side property is to present him "letters from adjacent property owners" stating no objection to the work as presented in the "Description Of Project" which you received. Having said that, I am understanding you did mail out the "statement of no objection"to Mr. Eddie Grady of Holly Ridge who as the grading contractor is acting as our agent. In order to expedite the process as quickly as practical, if you could simply respond to this email stating you have reviewed the application and have "no objection to the work being proposed" I can then forward the same to Mr. Dail of CAMA.
