This permit, issued on March 24, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ie subject to tines, imprisonment or civil action; or may cause the permit to be null and voi(l. Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No backfrll material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 4) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee l Frankie Ferrell & Brent Futch Permit No. 31-21 Page 2 of 3 ADDITIONAL CONDITIONS 5) All fill material to be placed below normal high-water line shall be confined behind the permitted bulkhead. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead shall be constructed prior to any backfilling activities. 8) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 9) All backfrll material shall be clean and free of any pollutants except in trace quantities. 10) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 2020- 0889vl. NOTE: The U.S. Army Corps of Engineers authorized this project by Nationwide Permit 3 (Action ID No. SAW-1992-02342), which was issued on 4/28/20. There is not an identifiable erosion problem and it is the opinion of the Division that the proposed alignment could adversely impact public trust rights. The bulkhead averages 7.5' waterward of NHW, with a maximum of 13' waterward of NHW. 'the applicant states in the project narrative that the purpose of locating the bulkhead waterward of NHW is to avoid a configuration that leads to debris accumulation, makes the current wall susceptible to storm damage, and to tie into a neighboring wall currently under construction. (7) Bulkheads (A) Bulkhead alignment. for the purpose or shoreline stabilization, shall approximate the location of normal high water or normal water level: (B) Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the rrsourccs: (C) Bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead: (D) Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: fi) Lite property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule: (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area cnxlel in the year prior to the date to of application, to align with adjacent bulkheads. or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features: (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; (iv) the need for a bulkhead below normal high water or normal water level is do- cumented by the Division of Coastal Management: and (v) the property to be butkheaded is in a non -oceanfront area. The project site is located at 105 South Channel Drive, adjacent to Banks Channel, in the Town of Wrightsville Beach, New Hanover County. The applicant proposes to install a new bulkhead an average of 7.5' waterward and maximum of 13' waterward of an existing bulkhead. According to the applicant, the existing wooden bulkhead is deteriorating. The applicant is proposing to install a new vinyl bulkhead with 64 linear feet along the parcel frontage. The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Banks Channel, in the Wrightsville Recreational Area are classified as SB, classification of waters intended for primary contact recreation, by the NC Division of Water Resources. These waters are NOT designated as -Primary Nursery Area (PNA), by the NC Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The proposed project will fill the 1280 SF area behind the proposed bulkhead with clean sand fill and an associated tie -back anchor system. The applicant plans to relocate the existing stairs to a new location immediately waterward of the proposed bulkhead. As proposed, the bulkhead would incorporate 480 SF of public trust area and impact 800 SF of high ground area within the 30' Coastal Shorelines buffer. The project's proposed new bulkhead would incorporate 480 ft2 of Public Trust Area and Estuarine Waters. The surface waters of North Carolina belong to the people under the Public Trust Doctrine, which states: Public trust areas are all waters of the Atlantic Ocean and the lands thereunder from the mean high water mark to the seaward limit of state jurisdiction; The public has rights in these areas, including navigation and recreation 15A NCAC 07H .0207 (a)(b). The applicant has provided no justification to fill in the proposed amount of Public Trust Lands in the form of intertidal habitat and may be inconsistent with NCAC 7H.0208(b)(7)(D)(ii). The shallow water of intertidal flats and surf zone provides refuge from predators for young and juvenile flounder, spot, croaker, shrimp, and many others. Species such as clams and gobies burrow in soft sediment to escape predation. Areas of Environmental Concern (AEC's) impacted by the proposal are ES, CS and PT. Waters at the project site are classified as SB# and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Town of Wrightsville Beach Land Use Plan and offer the following comments. The general area of the project is classified Developed, while the AECs impacted by the work are classified as Conservation. In general, the Town of Wrightsville Beach allows development in Conservation/Developed classified AECs which is consistent with the State's minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some policies, which exceed the State's minimum use standards including those for piers and marinas. However, none of these more restrictive policies seem to be applicable to this project. This project is consistent with the Town of Wrightsville Beach Land Use Plan. The area between the new and old bulkheads will be filled, thus filling 480 square feet of intertidal area of Banks Channel. The site is located at 105 South Channel Drive in the Town of Wrightsville Beach, New Hanover County, North Carolina. Your proposal has been reviewed and found to be consistent with the provisions and objectives of the CAMA-Corps Programmatic Permit process, via Programmatic General Permit 291 (copy attached), for construction activities that receive authorization from the State of North Carolina. Therefore, you may commence construction activity in strict accordance with the applicable State authorization, attached Federal special conditions, PGP-291 conditions and the approved plan. Failure to comply with the State authorization or conditions of the Federal permit could result in civil and/or administrative penalties. This authorization does not relieve the applicant of the requirement to obtain a Coastal Area Management Act permit from the North Carolina Division of Coastal Management. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. TN _'2_ 2. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. Approval of the structure is based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash from passing vessels. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 5. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 6. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within -waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 7. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. PROJECT DESCRIPTION: The project site is located at 105 South Channel Drive, adjacent to Banks Channel, in the Town of Wrightsville Beach, New Hanover County. To locate the property from the Wilmington Regional Office (WiRO) travel east on Eastwood Road approximately 3 miles towards Wrightsville Beach. Continue onto Causeway Drive, and turn right on Live Oak Drive and continue two blocks until you reach Jasmine Place and turn right. Take the next right onto South Channel Drive and the property of interest will be located on the left. The property is approximately 0.11 acres in size with an elevation of approximately 6' above Normal High Water (NHW) for most of the parcel. There is approximately 86' of shoreline at NHW, currently stabilized by an existing wooden bulkhead (64' of shoreline frontage and 22' return wall) along Banks Channel. The parcel currently features a stone sidewalk, shed, and private docking facility with mooring pilings. The property is associated with another parcel owned by the applicants across the street, at 106 Channel Drive South, which features an existing single family residence on the property. The upland property consists of ornamental vegetation and maintained lawn grass. There are currently no Coastal Wetlands on the property. The applicant currently maintains a private docking facility in Banks Channel. An existing fixed pier (6'wide x 64' long) originates from the existing bulkhead and terminates at an'L head' covered platform (15' wide by 15' long). Along the span of the existing fixed access pier, approximately 4' waterward of the existing bulkhead, there is an existing staircase that leads down to a sandy beach, oriented parallel to the existing bulkhead. Approximately 16 feet waterward of the existing bulkhead, also along the span of the fixed access pier, there is an existing'bumpout' fixed platform section consisting of a 7' long right triangle connected to a fixed platform 'bumpout' section (6' x 6'). From the waterward end of the `bumpout', a ramp leads to an existing floating dock (24' x IT) oriented in the same direction as the access pier. From the southwest corner of the floating dock, an existing floating finger pier extends waterward (16' long x 4 wide) and connects to another existing floating finger pier (17' long by 4' wide) that is oriented parallel with the shoreline. Effectively, the existing floating docks encircle and form a 'C-shape' around the existing fixed covered platform and appears to provide dockage for up to three (3) vessels. It appears through aerial photography review that the existing docking facility and bulkhead was built prior to 1993. No permit history could be located for the structures by DCM staff or the property owners. The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Banks Channel, in the Wrightsville Recreational Area are classified as SB#, by the NC Division of Water Resources. These waters are NOT designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to install a new bulkhead an average of 7.5'waterward and maximum of 13' waterward of an existing bulkhead. According to the applicant, the existing wooden bulkhead is deteriorating. The applicant is proposing to install a new vinyl bulkhead with 64 linear feet along the parcel frontage. The applicant's requested alignment for the new bulkhead would be located 2' waterward of the existing bulkhead (and current NHW) on the eastern comer of the property and continue diagonally across in a southwesterly direction to the western corner of the property, where the wall would be located 13' waterward of the existing bulkhead (See Sheet 3 of 4). The applicant is proposing to fill the 1280 SF area behind the proposed bulkhead with clean sand fill and an associated tie -back anchor system.
