Authorizing development in Brunswick County at adi to Old Sound Creek, at 43 Driftwood
St. in Ocean Isle Beach as requested in the permittee's application dated 4/20/21;
including attached workplan drawings (5), Sheets 1-4 of 4 all dated 4/2/21 and Survey dated 2/16/21.
This permit, issued on August 27, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
tf these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be nun ana voia.
Shoreline Stabilization - Bulkhead
1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached
workplan drawings.
.2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the
approved bulkhead alignment.
3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start
of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM
within a maximum of 30 days prior to the new expected start of construction.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must. be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
o
structure.
7) This permit does not authorize any excavation waterward of the approved alignment.
8) The fill material shall be clean and free of any pollutants except in trace quantities.
9) Unless altered herein, all backfill material shall be obtained from a high ground source and confined
behind the permitted bulkhead.
10) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will
be used to backfill the area behind the permitted bulkhead.
11) All fill material to be placed below normal high-water level shall be confined behind the permitted
bulkhead.
12) If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
Sedimentation and Erosion Control
13) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
15) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
USACE Conditions
16) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third patty without the
written approval of the Division of Coastal Management.
18) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 3
(Action ID SAW-2021-01206).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-0941.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the mean high-water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Recommendations for State Permit- Nathaniel and Mary Evans
It is the staffs recommendation that the applicant's proposal to install approximately 202 linear ft. of bulkhead
with 16 linear ft. of return walls, resulting in the filling of approximately 78011of Coastal Wetlands and Public
Trust Area is CONSISTENT with the Rules of 15 NCAC 7H.0205 (d) Use Standards for Coastal Wetlands,
Rules of 15 NCAC 7H.0206 (d) Use Standards for Estuarine Waters, Rules of 15 NCAC 7H.0207 (d) Use
Standards for Public Trust Areas and Rules of 15 NCAC 7H.0208 (b)(7) Use Standards for Bulkheads. The
applicant has proposed efforts to minimize impacts to any adjacent resources.
As proposed, this office has no objections to the proposed project and any permit issued should include the
standard permit conditions for bulkheads and upland development.

The applicant is proposing to construct approximately 202 linear feet of bulkhead an
average of 4.5 ft. waterward of the existing bulkhead, with approximately 780 square feet
of coastal wetland fill. The project is located at 43 Driftwood Street in Ocean Isle Beach,
Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine
Shoreline, Coastal Wetlands and PTA. Waters at the project site are classified as SA;
HQW and are not open to the harvesting of shellfish. The area is not a Primary Nursery
Area.
I have reviewed this proposal for consistency with the Ocean Isle Beach Land Use Plan
and offer the following comments.
The general area of the project is classified as Residential.
In general, Ocean Isle Beach allows development in Residential classified AECs, which
is consistent with the State's minimum use standards. The Ocean Isle Beach Land Use
Plan contains some policies, which exceed the State's minimum use standards. However,
none of these standards appear to be applicable to this proposal.
This project appears to be consistent with the Ocean Isle Beach Land Use Plan update.

proposes to construct a bulkhead with approximately 780 square feet of coastal wetland fill below high

you must notify the Division and you may be required to submit a new application package with the
appropriate fee. If the property is sold, the new owner must be given a copy of this Certification and is
responsible for complying with all conditions. [15A NCAC 02H .0507(d)(2)].
If you are unable to comply with any of the conditions of the attached Water Quality General
Certification or with the additional conditions itemized below, you must notify the Wilmington Regional
Office within 24 hours (or the next business day if a weekend or holiday) from the time the permittee
becomes aware of the circumstances.
The permittee shall report to the Regional Office any noncompliance with, and/or any violation of,
stream or wetland standards [15A NCAC 02B .0200] including but not limited to sediment impacts to
streams or wetlands. Information shall be provided orally within 24 hours (or the next business day if a
weekend or holiday) from the time the permittee became aware of the non-compliance circumstances.

1. All backfill material shall be obtained from a high ground source and confined landward of the
permitted bulkhead.

quantities. Metal products, organic materials, rock, concrete, bricks, or other non -earthen
debris shall not be used.

The Permittee shall adhere specially to 15A NCAC 02B .0222 Tidal Salt Water Quality Standards
for Class SB Waters.(12) pH: shall be normal for waters in the area, which generally shall range
between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of
natural conditions; (19) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU;
if turbidity exceeds this level due to natural background conditions, the existing turbidity level

best uses provided for in state rule (including, at minimum: aquatic life propagation, survival,

9. PROJECT DESCRIPTION DCM-MHD CITY
The proposed project is located on the west end of Ocean Isle Beach in Brunswick County. The property can be
reached by traveling south on NC HWY 17 towards South Carolina. Continue I 1 miles past the Supply 4-way
intersection and make a left turn onto Ocean Isle Beach Road SW. Drive south on Ocean Isle Beach Road SW
for 3.5 miles and continue straight through the round -about towards Causeway Drive. Continue over the bridge
and take a right onto W. 31d St. Stay on W Yd St. until the end of the road and take a right onto Driftwood St.
The project site is the last house on the left.
The proposed project site is composed of 3 separate parcels (PID # 257FDO3901, 257FDO39, 257FDO40) and
sits at the end of a manmade canal that connects to Old Sound Creek with a total of 180 linear feet of shoreline.
Existing structures on the combined .25-acre property include a single-family residence, a docking facility, a
concrete in -ground pool, and a deteriorating timber bulkhead. Based on DCM records, no previous permit
history can be found for the construction of the existing bulkhead but the applicant states the bulkhead was
constructed in 1985 which was prior to the construction of the existing dwelling in 1989. GP-39773 was issued
on 12/15/2004 for the construction of the docking facility.
High ground is located approximately 4ft. above normal high water (NHW) and primarily consists of domestic
grasses and ornamental shrubs. Foundation pilings are located between 2-8ft. from the existing bulkhead and
the in -ground pool sits within 1 Oft. of the north -facing bulkhead (See Sheet 2 of 4). The existing bulkhead is
located at NHW and spans approximately 180 linear feet, stabilizing the north and west sides of the property. A
dense swath of Salt Marsh Cordgrass (Spartina alterna,Jlora) grows across the entire waterward edge of the
existing bulkhead extending an average of 1 Oft. offshore of the bulkhead. No 404-type wetlands appear to be
located within the project area.
The waters of Ocean Isle Beach are classified SA by the Division of Water Quality and ARE NOT designated
as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest
of shellfish. Based on visual observations made by DCM staff during the May 2021 site visit, there appears to
be NO Submerged Aquatic Vegetation (SAV) on site.
PROPOSED PROJECT
The applicant proposes to install approximately 202 linear feet of bulkhead an average of 4.5ft. waterward of
the existing bulkhead, resulting in the filling of approximately 780ft2 of Coastal Wetlands along Old Sound
Creek in Ocean Isle Beach.
According to the applicant, the existing 180ft. timber bulkhead is beginning to deteriorate. The applicant states
that as the bulkhead continues to weaken, the pressure exerted from foundation pilings, located as close as 2ft.
from the existing wall, create the potential for catastrophic failure. As stated in the narrative, attempting to
replace the existing bulkhead in the same footprint may lead to a bulkhead failure and the potential for greater
Coastal Wetland and surface water impacts than if the proposed bulkhead were stepped out in front of the
existing wall. The proximity of the concrete in -ground pool to the failing wall also creates issues with replacing
the bulkhead in the existing footprint. Typical tie rod installation requires up to 20ft. of high ground
disturbance. According to the applicant, stepping out the bulkhead would minimize the likelihood that the
concrete pool is damaged during tie rod installation.
As proposed, the new bulkhead would step out anywhere from 2ft. to 8ft. waterward of NHW, with an average
distance of 4.5ft. (See Sheet 3 of 4). To avoid and minimize wetland impacts, the applicant has requested to step
out various distances based on the proximity of the nearest structure to the existing bulkhead. For example, the

foundation pilings of the residential double deck are located within 2ft. of the existing bulkhead so the applicant
has requested to step out the proposed bulkhead 8ft. offshore. The concrete in -ground pool and apron are within
6ft. of the existing bulkhead so the applicant has only requested to step out the proposed bulkhead 2ft offshore.
Vinyl installation would be conducted using a barge -mounted pile driver while high ground equipment would
be limited to a skid steer and hand tools. The proposed bulkhead would be secured with typical tie rods and
anchor piles and backfWed with clean upland material at ground elevation, resulting in approximately 1,111f
of high ground disturbance. The proposed bulkhead would terminate with 8-1 Oft. wing walls on the northeast
and southwest property corners, making the bulkhead structurally independent.
10. ANTICIPATED IMPACTS
The proposed bulkhead would step out an average of 4.5ft. waterward of NHW, resulting in the filling of
approximately 780ft2 of Coastal Wetlands and Estuarine Waters/Public Trust Area Clean sandy loam would be
used as backfill material and result in approximately 1,11 lft of high ground disturbance. Increased turbidity
levels should be expected during project activity. Marsh mats would be used as needed to reduce Coastal
Wetland impacts during sheet pile installation. Increased turbidity levels should be expected during sheet pile
installation. Backfill material would be trucked in and secured outside the 30ft. buffer with silt fencing.

Narrative
As the acting agent for Nathaniel & Mary Evans who owns 43 Driftwood Street, Ocean Isle
Beach, in Brunswick County, I am submitting the enclosed CAMA Major Permit Application for
the installation of a new vinyl bulkhead. As proposed, the new vinyl bulkhead would be installed
2' to 8' waterward of the existing failing wooden bulkhead which equates to 10' waterward of
the foundation pilings and pool even though there are Coastal Wetlands in front of and up to the
existing bulkhead. The existing bulkhead is located only 2' to 8' from the foundation pilings of
the existing dwelling and inground concrete swimming pool, thus extremely restricting the work
area between the existing bulkhead and the dwelling along the northern side adjacent to Old
Sound Creek. The existing bulkhead was installed in 1985 which was prior to the construction of
the existing dwelling which was 1989. As such, this has created a tremendous amount of
pressure on the failing bulkhead which prevents the removal of the existing bulkhead in order to
place a new bulkhead in the same location without a huge potential for the foundation of the
dwelling to have a catastrophic failure. Due to these conditions, we are requesting, and it is
extremely important that the existing bulkhead remain in place and the new bulkhead to be
installed 2' to 8' waterward of the existing bulkhead (10' waterward of the foundation pilings)
even though there are Coastal Wetlands (primarily Spartinia alternafora) right up to the existing
bulkhead. The loss of approx. 780 sq. ft. of Coastal Wetlands would have a much less
environmental impact than the potential catastrophic failure of the foundation of the dwelling.
The DWR pre -filing meeting request has been filled out on the website and a copy of the return
email resulting from that submittal is included in this CAMA Major Permit application.

Dear Ms. Wilson:
The Division of Coastal Management hereby acknowledges receipt of your application for State approval for the
replacement of a failing bulkhead located at 43 Driftwood St., Brunswick County, NC. It was received complete on
May 25'2021 and appears to he adequate for processing at this time. The projected deadline for making a decision
is August 8i6, 2021. An additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 25'h, 2021 you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing' postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
