This permit, issued on December 102 2021 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Earthen Causeway with Culverts and Tide Gates
1) In order to protect juvenile shrimp and finfish populations, no in -water work shall be permitted
between April land September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.
2) In accordance with commitments made by the permittee, a coffer dam shall be left between the area
of construction and the existing canal until after completion of all construction activities to prevent
unnecessary siltation into the adjacent water body.

personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.

ADDITIONAL CONDITIONS
3) The tide gates shall be constructed in accordance with the attached application narrative and workplan
drawings. No additional structure shall be installed to further imped the natural flow of water within the
canal without permit. modification.
4) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the
approved earthen causeway alignment.
5) The alignment of the authorized earthen causeway shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction.
6) The fill material shall be clean and free of any pollutants except in trace quantities.
7) Unless altered herein, all fill material shall be obtained from a high ground source and confined behind
the permitted bulkhead.
8) No fill material is to be placed within 30 feet of the normal water level, except that which will be used to
backfill the area of the earthen causeway.
9) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
10) No fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters
outside of the alignment of the fill area indicated on the workplan drawings.
11) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters
and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of
petroleum products or any other hazardous waste, the permittee shall immediately report it to the National
Response Center at (800) 42478802 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
Sedimentation and Erosion Control
12) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
14) . This permit shall not be assigned, transferred, sold; or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
15) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.

ADDITIONAL CONDITIONS
-16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 19800029I (Action ID SAW-2020-00233).
NOTE: The N-C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-1200.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management. Commission's (EMC) Tar Pamlico River buffer regulations
in place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Regarding the application for a Major CAMA Permit, Comments from NCDMF and NCWRC,
The replacement of the bridge with Culverts, Head walls and Tide Gates at the Engelhard Volunteer Fire
Department and Community Center located at 34545 US HWY 264 in Engelhard NC is a crucial project that
will benefit the community in several ways. Safe and dependable access to and from the fire house for the
Volunteers as well as the community and the prevention of salt water intrusion are the two primary goals.
Currently the bridge used for sole access is in a state of disrepair that makes it unsafe for travel.
The Construction methodology, as stated in the permit documents will require no work within wetlands. The
work area includes only the present area of the bridge and temporary sheet piling just beyond the existing
footprint. All demolition, material stockpiling, and installation will occur on high ground. All spoil will be
disposed of on site on high ground as well. All costs associated with this project are covered and accounted
for by the EVFD and its partners. Consideration of future maintenance was part of the planning for this
project and viewed as minimal for this particular type installation. Those future costs are reasonable and
justifiable when compared to the benefits that will be achieved through this installation.
Consideration of potential impacts upstream and downstream were considered and addressed in the design
proposal. The use of (3) 60" culverts as suggested by North Carolina Department of Transportation Hydraulic
Engineers will ensure more than adequate outflow to prevent flooding in the upstream watershed. The
concern of flooding downstream because of the installation of tide gates is addressed in the attached Flood
hazard Assessment, the conclusion of which illustrates an extremely minimal impact.
The project site is greater than 2,000 ft (0.4 miles as stated in NCDMF comments) upstream of the upper
boundary of the designated Primary Nursery Area (PNA). We believe the designation of this PNA boundary
was not made arbitrarily but based on samplings and science that documented the resource presence and
usage, upstream to that boundary. Because of this, we believe the project location significantly upstream of
this documented boundary should not be subject to the scrutiny that working within the PNA boundary would
entail.
Finally, the proposed installation will include Aluminum Flap Gates that are constructed to require a
minimum amount of head pressure to open, as was indicated in our permit application. These gates are much
lighter than those of a cast steel type that do require more head pressure upstream to open. Cast steel gates
were never considered for this installation.

the issue with the tide gates is resolved. Maria is very concerned about hydrological trespassing, flooding, and PNA's in the head

This memo is in reference to the Major CAMA Permit application submitted by Daniel
Brinn on behalf of the Engelhard Volunteer Fire Department in Hyde County to replace an existing,
but failing bridge, with culverts and flap -style tidegates in Far Creek Canal adjacent to US HWY
264 in Hyde County. The proposal included the placement of 3 — 60" metal culverts with associated
headwalls be installed in Far Creek Canal in order to have reliable access to the fire department.
The applicant has applied to install tide gates on these culverts in order to mitigate saltwater
intrusion into upstream agricultural properties.
The replacement of culverts should have no impact on public trust access to waters in Far
Creek Canal. The bridge clearance of the existing bridge is 12 inches at NWL, there are existing
bridges upstream — 244' and downstream — 335' with a similar clearance, and culverts upstream
approximately 880'. No coastal wetland AEC has been identified upstream of the project area that
would be impacted by the installation of the tidegates. The installation of the tidegates would limit
the upstream movement of aquatic organisms within the canal removing approximately 3,400
linear feet of channelized stream from use.
If there are no significant objections from the review agencies concerning negative impacts
to water quality, loss of habitat or negative impacts to Far Creek Canal, DCM Staff in the
Washington Regional Office recommends issuance of the permit. Coastal Resource Commission
rules that would support a denial or issuance of the permit include the general use standards for
Public Trust Areas 7H.0208(a)(2)(A)-(G). Staff recommends the standard conditions for culvert
pipe installation with the exception that "the culvert shall be buried at least one foot below normal
bed elevation" as this will disrupt the function of the tide gates.

Consistency Determination: The request is consistent with/not in conflict with the 2008 Hyde
County LAMA Core Land Use Plan certified by the CRC on March 28, 2008.
Project Overview: The subject property is located at 34545 US 264 adjacent to Far Creek in the town of
Engelhard, Hyde County. The property consists of the fire department building, bridge, gravel parking
area, and maintained lawn with a few trees and shrubs. The property is bordered on the south by Far
Creek and on the north by an unnamed canal.
AECs involved include: Estuarine Waters and Estuarine Shoreline. Far Creek in the area of the project and
upstream has no coastal wetlands and is highly modified system with little to no natural characteristics
left. Far Creek is classified as C, SW, is a PNA, and is closed to shellfishing. A review of SAV and cultural
or archaeological resources was not provided in the Field Report.
The Engelhard Fire Department is proposing to install three 60" culverts, headwalls, and associated fill
material in Far Creek to replace an existing bridge that has been damaged due to age and storm events.
The three 60" x 30' long culverts will be placed in Far Creek even with the bottom substrate with
approximately 1.7' of the culvert above normal water level. A section of the Far Creek under the culverts
measuring 30' x 30' x 2' will be excavated and backfilled with stone to provide a suitable substrate for the
culverts to be installed. Flap -style tide gates are proposed to be installed on all three culverts. Vinyl
sheetpile headwalls measuring 36' in length will be constructed on the up and downstream sides of the
culverts and backfilled and graded for a driving surface.
Anticipated impacts: The project as proposed will result in the fill of 900 ft2 of shallow canal bottom for
the creation of the culvert driveway. No traditional navigation should be impacted as the existing bridge
had only 12" of clearance from NWL, a bridge 330' downstream with a clearance of 12", and other culverts
exist 700 feet upstream. The installation of tide gates will cut DCM jurisdiction for estuarine waters on

approximately 3,400 linear feet of Far Creek, already impacted by channelization and the adjacent
highway.
Basis for Determination:
The project site is located in Hyde County as is subject to the 2008 Hyde County LAMA Core Land Use
Plan. The Future Land Use Map (FLUM) designates the site as Office & Institutional, whose preferred use
Public and private office and institutional uses, churches, meeting facilities, governmental facilities (pg.
235).
The following LUP policies are applicable to this request:
P.30 Residential, commercial, and industrial development which meets 15A NCAC 7H use standards will
be allowed in estuarine shoreline, estuarine water, and public trust areas. In all other areas,
development will be allowed that is consistent with applicable local, state, and federal regulations.
P.88 At a minimum, Hyde County will rely on 15A NCAC 7H to protect water quality.

Reference the application of the Engelhard Volunteer Fire Department for a Department of
the Army permit to replace an existing bridge with 3 60-inch culverts, and install headwalls and
tide gates, on property located at the Engelhard Volunteer Fire Department, 34545 US HWY
264, adjacent to Far Creek, in the Town of Engelhard, Hyde County, North Carolina
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
3. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
6. In order to protect juvenile finfish resources, no excavation or filling activities will be
permitted between the dates of April 1 and September 30 of any year without the prior approval
of the North Carolina Division of Coastal Management and the U.S. Army Corps of Engineers.
7. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
8. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
9. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must he reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

I'm not sure what happened to the email that I wrote in response, but it appears to have been deleted rather than
sent. With that in mind, my apologies for the delayed response. In addition to the response submitted by WRC,
DMF offers the following response.
The county's response letter, and DMF comments, indicate that the project location is approximately 0.4 miles
upstream of the mapped upper limit of designated PNA in this area and therefore should not be subjected to the
scrutiny of working within a PNA. However, it is worth noting that the rules regarding the Far Creek PNA
designation to not include an upstream boundary. Rather, the rule indicates that the Creek west of the two
coordinates is designated as PNA. As written, the rule (15A NCAC 03R .0103 (2)(b) reads:
(b) Far Creek - west of a line beginning on the north shore at a point 35' 30.9782' N - 75' 57.761 VW; running
southerly to Gibbs Point to a point 35' 30.1375' N - 75' 57.8108' W

So, I really didn't see where the response addressed the gates and concerns regarding their installation.
The response did state the three 60" culverts were suggested by NCDOT hydraulic engineers and would provide
adequate flow. This addresses flow concerns with the change from the existing bridge to the culverts. The statement in
the response echoes the statements from NCDOT during the scoping meeting — an engineer reviewed and recommends
the culvert size for flows. The previously proposed 48" culverts were inadequate, according to NCDOT engineers present
at the scoping meeting. NCWRC also believes the 60" culverts would not have significant aquatic passage impacts in this
location for species under our purview. We do not object to the replacement of the existing bridge with three 60"
culverts.
Within the application package they stated the gates would "mitigate" saltwater intrusion up until 2', but that at 1.5'
there was no inundation in the subject area — so I guess that means they get a benefit for 0.5'? However, I did not see
where they modeled or addressed if water would circumvent installed gates and inundate upstream the structure due to
the surrounding topography and feature that runs behind the VFD. Surveys and modeling should be conducted on both
features (Far Creek Canal and the feature behind the VFD) to show waters would not circumvent the gates. They did
show in the application package water levels and inundation under current scenarios, but no modeling with gate
installation to show flooding effects on surrounding properties or that they would actually receive the 0.5' benefit. They
need to demonstrate they are not going to cause increased flooding on adjacent properties as well as a benefit from the
gates (that the feature behind the VFD will not circumvent the project). They also should reference the frequency of
+1.5' to 2' water rises (the road is 2.1' so anything above 2' would be flooded even with gates installed).
The installation of flap gates within surface waters is a significant proposal that needs careful review prior to
consideration. I still don't see where they provided sufficient information, they just responded. They have not
demonstrated how the installation of flap gates within surface waters (especially surface waters designated as PNA just
downstream of gate installation) will provide the benefit as stated in their purpose and need. Modeling and frequency of
events is something that has been discussed by agencies throughout project discussion.

and fish habitats. The proposed work is located at 34545 Hwy 264, Engelhard, within Hyde
County. The Engelhard Volunteer Fire Department (EVFD) is accessed by a wooden bridge
that spans Far Creek Canal, adjacent to Hwy 264. The bridge was damaged while a
firefighting apparatus was crossing the bridge during Hurricane Florence. Temporary
repairs are currently in place, but these repairs are not adequate to return the bridge to its
original carrying capacity and the bridge ultimately needs to be replaced. The EVFD is
proposing to replace the existing bridge with a culvert system. The reasons for using
culverts rather than a bridge include the lower cost associated with the installation and
maintenance of the culverts, and the inclusion of tide gates as a means for flood/saltwater
intrusion control.
The proposed culvert system includes three 60" culverts, headwalls, and associated fill
material in Far Creek. A temporary cofferdam will be installed and the area dewatered to
allow for construction. The three 60" by 30' culverts will -be placed in Far Creek even, with
the bottom substrate, with approximately 1.7' of the culvert being above normal water
level (NWL). A 30' by 30' by 2' section of Far Creek will be excavated and backfilled with
stone to provide a suitable substrate for the culverts to be installed. Flap -style tide gates
are proposed to be installed on all three culverts. Vinyl sheetpile headwalls measuring 36'
in length will be constructed on the up and downstream sides of the culverts and backfilled
and graded for a driving surface.
DMF is concerned with the potential impacts of replacing the bridge with the culverts and
tide gates. The project site is located 0.4 mi upstream of the upper boundary of designated
PNA in inland waters. Areas designated as PNA are estuarine waters that provide the
specific water quality and/or habitat functions needed for post -larval development.
Although just outside of the PNA boundary, it is likely that species that utili RZEM IVED

be found this short distance upstream of the end of the designation, especially considering
that every other crossing of Far Creek downstream of the project location is a bridge
structure. Taking into consideration the proximity to designated PNA, one concern DMF
has is with aquatic organism passage through the culverts and tide gates. When closed,
tide gates present a barrier to all fish migration. This could restrict access of species to
potential areas that provide appropriate conditions during vulnerable periods of life
history.
The total interior culvert diameter for water flow is often less than what occurs under
bridges. Therefore, culverts have the potential to take longer to drain during periods of
heavier flooding, depending on the flow direction, which increases the risk of flooding.
This can be exacerbated by the inclusion of tide gates. Although tide gates are useful for
reducing saltwater intrusions above the gate, this often comes at the cost of lowered
productivity for estuarine communities. Finally, although culverts cost less up front than
bridges, there is the potential for culverts with tide gates to require more routine
maintenance costs and generally have shorter life spans than bridges.
DMF understands and acknowledges the issues of flooding in this area, and that the culvert
and tide gate system may be helpful in preventing flooding issues. Taking the above issues
into consideration, DMF would object to the project as proposed. However, DMF would
remove this objection if the applicant is willing to either replace the existing bridge with a
new bridge or incorporate the tide gate measures detailed below. Replacing the existing
bridge with a new bridge (rather than culverts) would minimize the impacts to areas
designated as PNA and the various recreationally, commercially, and environmentally
important species that utilize these areas. In -kind replacement would not restrict the
movement of these species and may involve lower costs over time associated with the
maintenance and upkeep of the structure. To minimize potential impacts to the
replacement bridge, one solution could be to elevate the bridge slightly higher than the
existing bridge.
The application indicated that the costs associated with replacing the existing bridge with a
new bridge were greater than the costs for replacing the bridge with a culvert system. As
noted above, DMF believes that the routine maintenance associated with the culverts could
be greater than a bridge. Additionally, DMF has been in contact with DCM staff involved in
the NC Resilient Coastal Communities Program (RCCP), a program that identifies and
prioritizes projects to enhance community resilience to coastal hazards. In
communications with RCCP staff, it was noted that a bridge replacement is the type of
project that could be included in the RCCP project portfolio generated during Phase 2 of the
program. However, the entire planning process would need to be completed in order to
receive RCCP funding assistance. The program is expecting to offer additional funding
during the Spring of 2022. Additional information on this program can be found at

resiliency/nc-resilient-coastal. As costs area concern for this project, funding provided by
the RCCP could help to alleviate some of the constraints associated with costs.

If a culvert system with tide gates is included in the final permit, DMF would recommend
that the design be altered to include more environmentally friendly tide gates. The
proposed flap -style gates take more head pressure to open than gates with hinges on the
sides. This is partially because the pressure of the water also needs to overcome the
weight of the gate. Another alternative would be to include gates that are constructed of
lighter materials, such as aluminum. Inclusion of lighter materials would require
considerably less head pressure differential to open the gates.

The NC Wildlife Resources Commission understands our state is looking at different measures to address
coastal resiliency. New measures such as tide gates may be considered as management tools in some
scenarios. Implementation of these measures should consider individual as well as cumulative impacts, and of
specific concern to us the benefits to wildlife resources, within the immediate project area and watershed
landscape.
Our agency is aware there has been recent discussion regarding the status of Engelhard Volunteer Fire
Department bridge replacement proposal that includes culvert installation with tide gates. Although we did
not receive a direct response regarding the benefits of hydrologic modeling, flood control specifically is not
under our purview. Natural flowing waterways are beneficial to wildlife and fishery resources and any changes
to their function warrant careful consideration. Therefore, with the information we have, we see no wildlife
specific impacts in the immediate project area as proposed. The NC Wildlife Resources Commission has no
additional concerns, requests, or comments at this time that should prevent the project from moving forward
in the application process. Please consider this response as you evaluate your permit decision.

So, I really didn't see where the response addressed the gates and concerns regarding their installation.
The response did state the three 60" culverts were suggested by NCDOT hydraulic engineers and would provide
adequate flow. This addresses flow concerns with the change from the existing bridge to the culverts. The statement in
the response echoes the statements from NCDOT during the scoping meeting — an engineer reviewed and recommends
the culvert size for flows. The previously proposed 48" culverts were inadequate, according to NCDOT engineers present
at the scoping meeting. NCWRC also believes the 60" culverts would not have significant aquatic passage impacts in this
location for species under our purview. We do not object to the replacement of the existing bridge with three 60"
culverts.
Within the application package they stated the gates would "mitigate" saltwater intrusion up until 2', but that at 1.5'
there was no inundation in the subject area — so I guess that means they get a benefit for 0.5? However, I did not see
where they modeled or addressed if water would circumvent installed gates and inundate upstream the structure due to
the surrounding topography and feature that runs behind the VFD. Surveys and gI9dgIirLgshould be conducted on both
features (Far Creek Canal and the feature behind the VFD) to show waters would not circumvent the gates. They did
show in the application package water levels and inundation under current scenarios, but no modeling with gate
installation to show flooding effects on surrounding properties or that they would actually receive the 0.5' benefit. They
need to demonstrate they are not going to cause increased flooding on adjacent properties as well as a benefit from the
gates (that the feature behind the VFD will not circumvent the project). They also should reference the frequency of
+1.5' to 2' water rises (the road is 2.1' so anything above 2' would be flooded even with gates installed).
The installation of flap gates within surface waters is a significant proposal that needs careful review prior to
consideration. I still don't see where they provided sufficient information, they just responded. They have not
demonstrated how the installation of flap gates within surface waters (especially surface waters designated as PNA just
downstream of gate installation) will provide the benefit as stated in their purpose and need. Modeling and frequency of
events is something that has been discussed by agencies throughout project discussion.

NCWRC has comment similar to NCDMF though I do not see adequate information to demonstrate hydrologic trespass
or flooding would not occur to nearby properties with installation of any tide gates. I also do not know if any tide gate
use would alter PNA performance or change its function thereby impacting water quality standards. Therefore, we do
not support tide gates at this time.
NCWRC does not believe the 60" culverts would significantly alter passage. NCDOT stated at the last scoping meeting
that culverts sized at 60" would not negatively affect the highway system as they would be the same size as culverts
located upstream.

The subject property is located at 34545 US 264 adjacent to Far Creek in the town of
Engelhard, Hyde county. This project is focused on the failing bridge across Far Creek that
provides access to the Engelhard Fire Department from US 264. The property consists of the fire
department building, gravel parking area, and maintained lawn with a few trees and shrubs. The
property is bordered on the south by Far Creek and on the north by an unnamed canal. Far Creek
in the area of the project and upstream has no coastal wetlands and is highly modified system
with little to no natural characteristics left.
Far Creek is an estuarine waterbody designated a Primary Nursery Area by the division
of Marine Fisheries and is classified as C, SW by the Environmental Resources Commission.
Project Description
The Engelhard Fire Department is proposing to install three 60" culverts, headwalls, and
associated fill material in Far Creek to replace an existing bridge that has been damaged due to
age and storm events. The applicant has two stated reasons for using culverts instead of a
standard bridge replacement. One being a lower cost associated with installation and
maintenance and two being installation of tide gates for flood/saltwater intrusion control. A
temporary cofferdam will be installed and the area dewatered to allow for construction. The three
60" x 30' long culverts will be placed in Far Creek even with the bottom substrate with
approximately 1.7' of the culvert above normal water level. A section of the Far Creek under the
culverts measuring 30' x 30' x 2' will be excavated and backfilled with stone to provide a
suitable substrate for the culverts to be installed. Flap -style tide gates are proposed to be installed
on all three culverts. Vinyl sheetpile headwalls measuring 36' in length will be constructed on
the up and downstream sides of the culverts and backfilled and graded for a driving surface.
Two scoping meetings where held where DWR was present on January 28'" 2020 and on
February 1812021. At these meetings the NCDOT recommended to the 60" culverts to meet
current guidelines for flow requirements.
Anticipated Impacts
The project as proposed will result in the fill of 900ft2 of shallow canal bottom for the
creation of the culvert driveway. No traditional navigation should be impacted as the existing
bridge had only 12" of clearance from NWL, a bridge 330' downstream with a clearance of 12",
and other culverts exist 700 feet upstream. The installation of tide gates will cut DCM

BRIDGE REPLACEMENT WITH CULVERTS AND TIDE GATES
PROJECT NARRATIVE
The Engelhard Volunteer Fire Department is accessed by a wooden bridge spanning Far Creek Canal
adjacent to US Highway 264. The bridge was damaged while a firefighting apparatus was crossing during
Hurricane Florence. Temporary repairs are in place but these are not adequate to return the bridge to
its original carrying capacity and ultimately the bridge needs to be replaced.
The preferred alternative is to replace the bridge with a structure that will have 3 culverts. The proposed
culverts will be 60" in diameter and 30' long. There will be aluminum headwall on each end of the
culverts and tide gates will be installed on the outlet end (east end) of each culvert. The culverts will be
installed at had bottom and the top of the pipes will be 1.7 above normal water level.
The culverts are a durable and stable replacement that will return access to the fire department to its
original capacity. This is critical for public safety as Implements will once again be able to cross far creek
canal fully loaded with equipment and water for firefighting and emergency response. The proposed
culverts will also require less maintenance in the future.
The attachment of tide gates to this structure will have the added benefit of preventing saltwater
intrusion on portions of the 979 acres upstream. That watershed consists of dozens of homes, multiple
businesses and hundreds of acres of agricultural property. The benefit to these properties as well as the
protection of a valuable part of Hyde Counties limited tax base is a critical component of this project.
To complete this project the old wooden bridge will be removed. Temporary sheet walls will be installed
across the canal both upstream and downstream of the site. The area would be dewatered. Muck and
soft sediment would be removed and stone fill would be placed to create a foundation for the new
structure. The new structure would be lowered into place and backfilled with suitable fill. The road
surface would be graded and rocked and temporary sheet piling would be removed.
An encroachment agreement will be required from the North Carolina Department of Transportation
A scoping meeting was held at which DWR was present. The date of the scoping meeting was 1-28-2020
and this project was discussed. This meeting met the requirement for requesting a pre -filing meeting
under 40 CFR Part 121 for 401 Certifications in accordance with the federal Clean Water Act.

On January 28'h, 2020 a scoping meeting was held in Washington N.C. between North Carolina
Division of Environmental Quality Staff, Engelhard Volunteer Fire Department Board Members, Local
Stakeholders, and myself. The Purpose of the meeting was to discuss the replacement of the EVFD
Bridge with culverts and tide gates. It was already known that the proposal would require a Major CAMA
permit would be required, as the proposed location has been traditionally considered the landward
jurisdictional boundary for DCM along Far Creek. The main concern expressed by all present DEQ
agencies was the need to asses potential increased flooding downstream within the village of Engelhard
that might result from the installation of tide gates at this location.
The Following is an assessment of that Risk Based on Elevation Data, Local Knowledge and Observation,
and North Carolina Emergency Management Flood Inundation Mapping and Alert Network (FIMAN)
data
Purpose
The County of Hyde has long recognized the negative effects of saltwater intrusion and has
worked diligently to mitigate damages where possible. Property that suffers from saltwater intrusion is less
productive and therefore less valuable. Property value is the single biggest variable in the Counties budget, so
the protection of property value is considered critical to providing services to the citizens of Hyde County,
both now and into the future. One of the best examples of this proactive approach is the Swan Quarter Dike,
which was conceived in the 1960s and today protects more than $64,000,000.00 in property value from salt
water intrusion and flooding.
Hyde County recognizes the proposed Tide Gate installation at the Engelhard Volunteer Fire
Department as another opportunity to protect property, and property value on behalf of its Citizens. Much of
the 979 acres within the watershed of this project are considered susceptible to salt water flooding and there
are areas where the damages of salt water intrusion can already be seen. This project would effectively
mitigate the threat of saltwater intrusion from the DCM line at the EVFD, which results from normal wind
and lunar tide events. Mitigating these concems farther downstream would be preferable, but is not feasible
because of Environmental Regulations and the lack of confidence that any permittable downstream solution
could be found.

The following maps were created using the North Carolina Emergency Management Flood Inundation
Mapping and Alert Network (FIMAN) website. Overlaid are the watershed and location of the proposed tide
gates. These maps effectively illustrate the already existing flood hazards in the Engelhard area downstream
of the EVFD, at elevation ranges from 1.0' to 1.5', keeping in mind the source of this flood water is the
expansive Pamlico Sound.
At+1.0ft NAVD-88 there is already some minor flooding in the Village of Engelhard but no surface
inundation within the watershed of the proposed project.

At +2.Oft NAVD-88 there is significant surface inundation within the village of Engelhard. Almost all of the
streets and yards are flooded. Note the area within the watershed that is inundated, this represents property
that will be adversely effected by salt water intrusion.
This flood inundation map represents the project's Maximum Benefit. The surface of US Highway 264
adjacent to the proposed tide gates is approximately +2.1ft NAVD-88, meaning that tide levels beyond 2.1ft
will bypass/overtop the structure and the area within the watershed will ultimately still be inundated. Up to
the 2.l' elevation there is significant protection of upstream land and improvements, while providing not
worse flooding of the downstream lands due to the fact the flooding source is the tidal influenced Pamlico
Sound.

At +2.5ft NAVD-88 there is significant surface inundation within the village of Engelhard. Nearly all of the
streets and yards are flooded. At this point water would have bypassed the proposed structure and this map
would accurately represent inundation with or without the proposed tide gates.
Conclusion
This project provides a Salt Water intrusion Benefit from +1.Oft to +2.Oft NAVD-88. This tide range covers
much of the normal wind tide events that have contributed to Salt Intrusion pressure on properties within the
area. Approximately 350 Acres will benefit from this mitigation effort during an event with water levels of up
to 2.Oft. At +2.011 the majority of Engelhard is already inundated and the volume of water excluded from
within the watershed is miniscule in comparison to the volume of the Pamlico Sound source waters flooding
outsideldownstream of the proposed tide gates. We therefore draw the conclusion that this project will havp;EIVED
little to no effect on flooding downstream of the installation site, beyond what presently exists.

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of the property located 34545 US 264 Hyde County
Engelhard North Carolina, and appears to be adequate for processing at this time. The
projected deadline for making a decision is 25 September 2021. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice
of an extended review. However, an additional letter will be provided on or about the 75th
day. Shane Staples, Field Representative for the Division of Coastal Management is
responsible for processing your permit and he can be reached at 252-948-3950 or via email

If this agency does not render a permit decision within 70 days from 12 July 2021, you
may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working
days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 12 July 2021. According to the said application submitted by Engelhard Fire
Department — proposes to replace existing bridge over Far Creek wit 3 culver crossing consisting
of 3-60" culverts, headwalls, and earthen fill.
A copy of the entire application may be examined or copied at the office of Kelly Spivey,
District Manager, Washington Regional Office, 943 Washington Square Mall, Washington, NC,
during normal business hours. Public comments received by 28 August 2021 will be considered.
Later comments will be accepted and considered up to the time of permit decision. Project
modifications may occur based on further review and comments. Notice of the permit decision in
this matter will be provided upon written request.
