SW. in Supply , as requested in the permittee's application dated 9/20/20 (MP-1), 10/2/20 (MP-4), including attached Sheet 3 of 6 dated revised 12/3/20, and Sheet 4 of 6 dated 10/2/20. This permit, issued on March 18, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Marina 1) This permit authorizes only the docks, piers, floating piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this marina without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Double L Holdings, LLC Permit No. 30-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) The marina will display a sign showing the location of the nearest pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. 7) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) This permit authorizes a maximum of 10 boat slips and 8 jet ski or kayak slips. 12) The elevated access pier shall have a minimum vertical navigational clearance of 6 feet above the MHW at the lowest part of the pier. The pier shall provide a minimum horizontal navigational clearance of 6 feet. 13) The jet ski/kayak docking slips shall post signage indicating that the authorized slips are only intended for jet ski or kayak vessel usage. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Double L Holdings, LLC Permit No. 30-21 Page 3 of 3 ADDITIONAL CONDITIONS 15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 16) All debris associated with this development shall be contained within the authorized project area and removed to an appropriate upland refuse disposal site. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1677. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water. NOTE: An application processing fee of $400 was received by DCM for this project. PROJECT DESCRIPTION The project site is located at 1045 B-Var Rd SW on the mainland side of the AIWW in Supply, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Holden Beach. At the Supply intersection, turn left onto NC 211 S. Travel .3 miles down NC 211 S and turn right onto Stone Chimney Road SW. Drive down Stone Chimney Road for 5.5 miles and continue onto Old Ferry Connection SW for 1.5 miles. Continue straight as the road turns into Old Ferry Rd SW. Take the fast left onto B-Vaz Rd SW and the project location will be on the right hand side, adjacent to Hewett Marina. Existing structures on the project site include a non -conforming restaurant located partially over the AIWW and the remnants of a multi -slip commercial docking facility. The existing non -conforming restaurant, formally named Betty's, was originally built around 1973. Portions of the previous docking facility extended approximately 13' into the 80' Federal Channel Setback but were largely destroyed during Hurricane Dorian. A large 36' x 40' open deck remains over Coastal Wetlands and open water on the east side of the restaurant. To the west of the restaurant is a 9' x 55' pier extending from the southwestern corner of a 30' x 40' open deck. Approximately 63 sq. ft. of the existing pier remains waterward of the 80' Federal Channel Setback. According to the application, the existing pier and open decks are in good structural condition and will remain in place. All freestanding pilings that currently exist from the previous docking facility will he removed from the project footprint including all pilings located waterward of the 80' Federal Channel Setback. The project site is approximately 1.38 acres and the high ground consists of packed gravel, domestic grasses, and ornamental landscaping. The high ground portion is elevated approximately 4' above the normal high water (NHW) level, and the shoreline (+/- 200 linear feet) is stabilized by bulkhead on the west side of the property and 404-type wetlands on the east side of the property. The bulkhead was never completed on the east side of the property, allowing a 40' wide swath of Smooth Cordgrass (Spartina alterniflora) to encroach landward of the bulkhead (see Sheet # 3 of 6). According to the application, the eastern portion of the bulkhead measures approximately 23' waterward of the NHW line (see Sheet # 3 of 6). The applicant's property sits on the mainland in Brunswick county, across the AIWW from Holden Beach. A commercial boatyard borders the property to the west and a vacant commercial lot sits to the east. According to the application, a grandfathered residence is located on a commercial lot to the north. The waters of the AIWW are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the August 2020 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths at the waterward end of the proposed docking facility range from approximately -2.0' to -2.9' relative to NLW. The widthof the AIWW measures approximately 360' feet at the proposed project site. PROPOSED PROJECT The applicant proposes to install a marina, consisting of a second access pier, a floating dock, and 5 finger piers with 10 boat slips and 8 PWC slips for a total of 18 transient boatslips. The applicant proposes to redesign and rebuild a marina to be used as transient slips for the patrons of the restaurant. The finger pier would connect to a proposed 6' x 39' fixed pier which would extend perpendicular to the AIW W. An east -facing gangway would be built at the waterward end of the proposed 6' x 39' fixed pier and lead down to a proposed 6' x 119' floating dock which would run parallel to the AIW W. Starting at the west end of the proposed floating dock, (5) 4' x 14' finger piers would be spaced approximately 23' apart and extend perpendicular to the AIW W, allowing for a total of 10 transient boat slips (Slips # 1-10, see Sheet 3 of 6). The landward side of the proposed 6' x 119' floating dock would also be utilized as a transient day dock, allowing for up to 8 PWC vessels or kayaks (Slips # 11-18). A portion of the proposed 6' x 39' fixed pier would be elevated a minimum of 6' above NHW to allow access to public trust waters and slips #11-18 (see Sheet # 4 of 6). The far east end of the proposed 6' x 119' floating dock would also be attached to a gangway that would connect to the existing 9' x 55' fixed pier. Existing freestanding pilings that are scattered throughout the project footprint and beyond the 80' Federal Channel Setback would be removed. According the to the proposed work plat, no freestanding pilings would remain within the applicant's riparian corridor (see Sheet # 3 of 6). According to the application, water depths on the landward side of the proposed floating dock measure -1.6' NLW and drop to -2.0' NLW at the waterward end of the proposed finger piers. The work plat (see Sheet # 3 of 6) shows that no portion of the proposed marina would extend waterward of the 80' Federal Channel Setback or the '/. width of the waterbody. According to the application, the proposed structures would not encroach into either adjacent neighbors' riparian setback. Since the marina is not proposing to add pump out services, signage prohibiting the discharge of sewage would be placed at each end of the proposed 6' x 119' floating dock. 10. ANTICIPATED IMPACTS The proposed marina would incorporate approximately 1,246 sq. ft. of Estuarine Waters and Public Trust Area. The proposed marina would remain consistent with similar pier length requirements (established pier -head line). The removal of freestanding pilings waterward of the 80' Federal Channel Setback would reduce navigational hazards and increase access to the proposed marina and public trust waters. According to the application, the proposed marina would not encroach into the 15-foot riparian corridor setback of either adjacent riparian neighbor. Minor increases in turbidity should be expected during piling installation. The existing non -conforming structure was originally built around 1973. Prior to Hurricane Dorian (August 24, 2019) extending from the southeastern corner of the existing open deck was a pier (approx. 8' x 25') running perpendicular to the AIW W which connected to a covered platform (approx. 26' x 40') which appears to have extended approx. 13' into the 80' Federal Channel Setback. Only the pilings from these structures remain. All other structures remain in good condition. The existing fixed pier (approx. 9' x 55') extending from the southwestem comer of the existing open deck remains intacted. The applicants would like to construct a new fixed pier (6' x*Mrwhich would extend perpendicular to the AIW W from the southeastern comer of the existing open deck, replacing the original 8' x 25' pier and covered platform. A new floating dock (6' x 119') would connect via a new ramp from the new fixed pier running parrell to the AIW W and would connect via a new ramp to the existing (9' x 55') fixed pier extending from the southwestern open deck. Extending from the new floating dock would be 5 new 4' x 14' floating finger piers, all located on the southern side of the main floating dock. The finger piers would be spaced approx. 23' apart and would accommodate 10 vessels. Dockage between the restaurant and the landward side of the floating dock will be 8 slips which will be limited to jet skis and kayaks due to the shallow water depths. The proposed 18 slips will be for temporary tie-up only for vessels while patrons visit the restaurant.
