Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission .Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Permit Number 143-21 Issued to DJM-NC LLC. and Andrew Smith,1838 Sir Taylor Dr., Wilmington, NC 28405 Authorizing development in New Hanover County at adi. to AI W W. at 2016 t& 2020 Deep Creek Run. in Wilmington . as requested in the permittee's application dated 6/1/21, including attached workplan drawings (5). Sheets 1,2.3,5 of 5 all dated 5/25/21 and Sheet 4 of 5 dated 6/21/21. This permit. issued on October 28, 2021 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facilities I) This permit authorizes only the Floating docks at 2020 Deep Creek Run and the pier, ramp and Floating dock at 2016 Deep Creek Run. and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of these docking facilities without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No portion of the authorized docking facilities shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high- water line or the waterward edge of any coastal wetland vegetation which borders the water body. whichever is more restrictive. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Pennittee DJM-NC LLC. and Andrew Smith Permit No.143-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six Feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of six (6) formalized boat slips located as shown on the drawing labeled Sheet 4 of 5. Four (4) formalized boat slips are located at 2020 Deep Creek Run and two (2) formalized boat slips are located at 2016 Deep Creek Run. 7) In order to satisfy concerns of the resource agencies. physical stops shall be placed on the floating docks at a minimum height of 18" above the bottom substrate to prevent the floating docks from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 10) Should either lot associated with the permit or either adjacent riparian lots be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. USACE Conditions 11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands. watercourses or properties. DJM-NC LLC. and Andrew Smith ADDITIONAL CONDITIONS General Permit No. 143-21 Page 3 of 3 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) All construction debris associated with the removal or construction of the permitted docking facilities shall be contained within the authorized project area and disposed of in an approved upland location. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state. federal or local permits. approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-01528). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1117. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The van der Wart's have a number of objections spanning multiple permit applications that are both currently in process and yet to be accepted as complete. In addition, the applications span multiple properties and property owners. The objection on file spans these projects and the Division does not want to misinterpret the objections as they relate to each property. Are you able to provide an updated objection that is organized by subject property? Essentially listing the objections and concerns by property? This would make review of the objection concerns more complete and reduce any potential to incorrectly assign specific concerns to the wrong subject property. As mentioned before we have recently extended the projects and with outstanding comments are not at a point to finalize any decision. PROJECT DESCRIPTION: ®CM-MHD CITY The project site is located at 2016 and 2020 Deep Creek Run adjacent to Middle Sound, near the City of Wilmington, New Hanover County. The project site can be located from NC HWY 17 (Market Street) by traveling north on Market Street to Middle Sound Loop Road. Turn right onto Middle Sound Loop Road and proceed through the traffic circle at Ogden Elementary and continue to travel north approximately 1.8 miles until you reach Mason Landing Road. Tum left onto Mason Landing Road until you reach Deep Creek Run, which will be located on the right. Turn right onto Deep Creek Run until you reach the properties of interest. The two parcels that make up the project site total approximately 1.58 acres in size. The 2016 Deep Creek Run parcel is currently maintained as single-family residence and the 2020 Deep Creek Run parcel is undeveloped. The adjacent properties to the north and south are residential home sites. The highground of the 2016 Deep Creek Run single family home is vegetated primarily with maintained lawn grass and ornamental landscaping. The undeveloped 2020 Deep Creek Run parcel is vegetated with a mix of lawn and native grasses and live oak trees. The elevation of the high ground area of the properties averages approximately 10' above normal high water (NHW). The properties border a small, shared boat basin, measuring approximately 60' across and 400' in length which connects to the AIWW. Located between the boat basin and Middle SoundIAIWW is a band of Coastal Wetlands consisting primarily of Smooth Cordgrass (Spartina altemiflora), which measures approximately 200' in width. There is approximately 50' of shoreline associated with 2016 Deep Creek Run and approximately 100' of shoreline associated with 2020 Deep Creek Run stabilized with a wooden retaining wall. Waterward of the retaining wall is an area of highground and high marsh approximately 6-13' wide consisting primarily of small saplings, Wax Myrtle (Myrica centeta), and Goldenrod (Solidego sempervirens) the area then slopes into coastal wetland approximately 15 feet wide, composed primarily of Smooth Cordgrass (Spartina altemifiora) and Cattail (Typha sp.). According to the applicant water depths in the vicinity of the existing floating dock are currently A" normal low water (NLW). Permit history for the shared boat basin and access channel include State Permit #139-76 issued on 81611976 which authorized basin dimensions of 100' X 125' and access channel dimensions of 409 X 301, both at a depth of 4 MLW. This permit was renewed two times. The last renewal had an expiration date of April 30,1981. Aerial photography indicates that the project was maintained sometime between 1978 and 1984. State Permit #107-98 issued October 8, 1998 also authorized maintenance dredging for the boat basin and the access channel. The authorized dimensions of the basin at that time were 80' x 85' to a depth of -6' MLW. Authorized access channel dimensions were 480' x 15' (bottom width) to a depth of 4 MLW. This permit was modified several times, including a modification authorized on June 12, 2003 to expand the access channel dimensions to 150' x 20' (width) to a depth of -2' Associated with 2020 Deep Creek Run is an 18' by 18' gazebo with access to a floating 2 slip docking facility. The gazebo extends from the retaining wall over approximately 13' of highground and 5' of Coastal Wetlands with a small 6' by 9' access pier extending perpendicular to the shoreline into the man-made basin with a ramp extending north down to the 6' by 40.5' floating dock positioned parallel to the shoreline and crossing the riparian line shared with 2016 Deep Creek Run. The docking facility was permitted to have a 16' by 16' fixed platform under General Permit 74713- 1), issued on September 16, 2019; however, there is no permit history for the existing roof and the properties were recently purchased by the applicant. Most recently, State Permit # 22-21 was issued on February 25, 2021 authorizing maintenance dredging for the adjacent boat basin and access channel to -5 NLW with the condition that "No excavation shall take place within 10 feet of any Coastal Wetlands.". A pending Major Modification for State Permit # 22-21 will be distributed soon that proposes to widen the access channel within previously permitted dimensions. Authorization of this major modification may alter the minimum distance of excavation to Coastal Wetlands in the vicinity of the access channel. The current depths in the boat basin range from shoaled mud flats in the vicinity of the proposed floating docks to approximately -2 NLW. The current New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Residential. The waters of Middle SoundIAIWW are classified SA-ORW by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvest of shellfish. DJM•NC, LLC Page 3 PROPOSED PROJECT: The applicant proposes to construct a new private docking facility with 2 slips at 2016 Deep Creek Run and expand the existing docking facility at 2020 Deep Creek Run to accommodate up to 4 slips for a total of 6 slips between the two parcels owned by the applicant. The new private docking facility at the 2016 Deep Creek Run parcel would include a 6' wide by 26' long fixed access pier extending from the retaining wall into the boat basin perpendicular to the shoreline. The access pier would span some highground and therefore approximately only a 6' by 20' pier would extend below NHW. An access ramp would extend from the north side of the fixed pier parallel to the shoreline onto a 6' by 48' floating dock also positioned parallel to the shoreline. According to the applicant, the existing 18' x 18' gazebo and 6' by 9' access pier located at 2020 Deep Creek Run would remain unchanged. Current site conditions in the vicinity of the gazebo indicate that approximately 13' of the gazebo extend over highground, with the remaining, 5' by 18' portion over NHW and coastal wetlands. From the 6' by 9' fixed pier the existing access ramp extending north parallel to the shoreline would remain and a new ramp would extend to the south would be added. The floating dock to the north would expand from 6' by 40.5' to 6' by 44' and the floating dock to the south would measure 6' by 34' in length, both positioned parallel to the shoreline (see Sheet 4 of 5). According to the applicant, at NLW there is an approximately +6" shoal in the location of the proposed floating dock in front of 2016 Deep Creek Run and the proposed southern floating dock at 2020 Deep Creek Run. The depths around the existing float at 2020 Deep Creek Run are approximately •4" NLW (See Sheet 3 of 5). The boat basin where the proposed floating docks are located is scheduled for maintenance excavation however the location of the proposed floating docks are not within the excavation footprint, due to the permit condition that requires excavation remain a minimum of 10' from any Coastal Wetland. According to the applicant, if commenting agencies have concerns about water depths around the proposed floating docks stops will be installed. The proposed docking facility at both properties would adhere to the %width rule, which, in this location is approximately 11.75' for the 47' wide water body. The proposed floating docks would encroach into the 15' riparian setback between the parcels as well as the adjacent neighboring parcels, for which waivers have been obtained. 10. ANTICIPATED IMPACTS: The proposed new private docking facility at 2016 Deep Creek Run would incorporate approximately 288 ft2 of Public Trust Area, shade approximately 120 112 of Coastal Wetlands, and shade approximately 36 ft2 of high ground. The proposed docking facility expansion at 2020 Deep Creek Run would incorporate approximately 225 ft2 of additional Public Trust Area which, added to the existing structures below NHW total 522 ft2 of incorporation, 90 ft2 of Coastal Wetland shading, and 120 ft2 of highground shading. The total incorporation of Public Trust Area, Coastal Wetland shading, and highground shading for the project area consisting of both parcels would be 810 ft2, 210 ft2, and 270112 respectively. Minor increases in turbidity should be expected during construction. There is an existing docking facility located at 2016 and the existing floating dock (6' x 40'/s') encroaches into the Riparian Corridor of 2020. This floating dock will be removed and replaced with a conforming 6' x 44' floating dock. A new access ramp will be installed leading to a new floating dock (6' x 34') to be located on the western side of the existing 6' x 9' finger pier running parallel to the shoreline. As proposed, this docking facility will accommodate up to 4 small vessels. A new docking facility is being proposed at 2020 Deep Creek Run consisting of a 6' x 26' pier extending from the existing bulkhead. A new 3' x 16' access ramp will extend from the eastern side of this pier down to a new 6' x 48' floating dock running parallel to the shoreline. As proposed, this docking facility will accommodate 2 vessels. The existing water depths in the areas of the proposed floating docks range from +6" to -6" @ NLW.
