HomeMy WebLinkAbout20-21 Dare CountyPermit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission ,Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 Excavation and/or filling pursuant to NCGS 113-229 Permit Number 20-21 Issued to Dare County, PO Box 1000, Manteo, NC 27954 Authorizing development in Dare County at within the Hatteras Well Field AEC. at 50225 Water Association Rd., in Frisco, as requested in the permittee's application dated 11/11/20, including attached workplan drawings (14), Sheets 1-3 of 3 all dtd 10/28/20 and Sheets 1, 9-18 of 20 all dtd "Revised 11/10/20". This permit, issued on February 16, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )t these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Hatteras Well Field Expansion 1) This permit authorizes only the proposed upland development, as depicted in the attached permit application, project narrative, and workplan drawings. Any other work or development proposed in an Area of Environmental Concern (AEC),"including but not limited to the Hatteras Well Field AEC and located within the applicant's property, shall require a review and authorization from the Division of Coastal Management prior to work commencing. Sedimentation and Erosion Control 2) A Sedimentation and Erosion Control Plan has been issued for this project. The Division of Energy, Mineral and Land Resources, Land Quality Section has assigned the project DARE — 2021-008. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Dare County Permit No. 20-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 4) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 5) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. Stormwater Management 6) The Division of Energy, Mineral and Land Resources is currently reviewing a stormwater management plan permit application (SW7201201) to determine if the proposed project is in compliance with North Carolina's stormwater management rules. The permittee shall receive a Stormwater Management Permit, and provide a copy of this permit to DCM, prior to the initiation of any development activities authorized by this permit. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. General 7) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 8) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: The well field expansion and raw water line addition will be part of the Dare County Cape Hatteras Water System (NC0428025). As such, engineering plans must be approved by the NC Department of Environmental Quality, Public Water Supply Section prior to commencement of work. Plans and specifications should be submitted to 1634 Mail Service Center, Raleigh, NC 27699-1634. For more information, please contact the Public Water Supply Section at (919) 707-9100. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers has assigned the project Action ID SAW-2020-00371. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1909. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project, and my findings are as follows: 15A NCAC 07H .0406 PUBLIC WATER SUPPLY WELL FIELDS (b) Use Standards. Development within these AEC's shall be consistent with the following minimum standards: 1) No ground absorption sewage disposal or subsurface pollution injection systems shall be placed within the designated AEC boundary except to replace systems existing as of July 24,1987; 2) Development shall not significantly limit the quality or quantity of the public water supply or the amount of rechargeable water; 3) The development shall not cause salt water intrusion or result in the discharge of toxic or soluble contaminants into standing or groundwater; and 4) Groundwater absorption sewage treatment systems may also be used within the AEC boundary if specific provisions are met. Consistent: Raw groundwater from the existing water supply wellfield is pumped to the Cape Hatteras Reverse Osmosis and Anion Exchange Water Plant for treatment prior to public use. Raw water from the proposed wells will be incorporated and treated in kind. No sewage disposal or treatment systems are proposed. The proposed development meets the intent of this rule. DATE: December 29, 2020 Consistency Determination: The request is consistent with/not in conflict with the Dare County 2009 Land Use Plan certified by the CRC on February 24, 2011. Overview: The project area includes an 8.87 acre property at 50225 Water Association Road, the right-of-way of Water Association Road extending south from the 8.87 acre property, and a 166.38 acre parcel located at the southern terminus of Water Association Road. The 166.38 acre parcel is within the Cape Hatteras Wellfield Area of Environmental Concern (AEC). The 166.38 parcel contains some Section 404 wetlands. The project area is located almost entirely within the AE (6) Floodzone. Existing site improvements consist of the Dare County Hatteras Reverse Osmosis (RO) Water Treatment Plant at 50225 Water Association Road, a paved roadway transitioning to an approximately 1.8 mile earthen road with a raw water transmission line within the right-of-way of Water Association Road and twenty-one (21) wells alongside the earthen road and an existing water main under the road on the 166.38 acre parcel (wellfield parcel). The water main is attached to the water transmission line. The plant and associated wells provide a source of drinking water for the communities of Avon, Buxton, Hatteras, Frisco and parts of the National Park Seashore. Installation of three (3) water supply wells and 12,074 linear feet of raw water transmission line is proposed. Two (2) wells will connect to the Principal Aquifer and the remaining will connect to the Yorktown Aquifer. Each well will have an 8 foot by 18 foot concrete pad and well house located near the earthen road. PROJECT SUMMARY: The applicant proposes to install 3 new water supply wells and 12,047 linear feet of raw water transmission line to the existing Dare County Water System on Hatteras Island. RECEIVED DEC 0 12020 t)rM-MHD CITY Proposed Project The proposed 12,074 If raw water transmission line will extend from the three proposed future water supply wells (R05, R06, R07) to an existing raw water transmission main located adjacent to the Hatteras RO Water Treatment Plant located at 50225 Water Association Rd., Frisco, NC 27936. The proposed raw water transmission line will convey raw water from the future well sites to the system's water treatment plant once it is permitted, constructed, and brought online. There is an existing transmission line and the new line will follow the general alignment of the existing one with a 12" mandatory separation between the new and existing waterlines. Of the three proposed wells, two will draw water from the Principal Aquifer (R06 and R07), and one will draw water from the Yorktown Aquifer (RO5). Each of the proposed well sites are shown on the accompanying CAMA Permit Exhibits (aerial overlays) and full sized engineered plans (See Sheets 9 and 12 for the well locations). On the engineered plan set, Sheet 1 is the cover sheet, Sheets 9-17 are the proposed work plan and profile sheets and Sheet 18 is the detail sheet with well details. The overall project has a proposed built upon area (BUA) of 432 sq.ft. and is associated with three well houses, each on concrete pads, approximately 8' x 18' each. There will be no additional BUA associated with the raw water transmission line. The project will have an overall land disturbance area of approx. 2.0 acres. Stormwater and Erosion and Sedimentation Control The proposed well and raw water transmission line will require a NCDEQ General Stormwater Permit to Construct A Linear Utility Line and a NCDEQ. Proposed improvements will be low density in nature and built upon areas will be limited to the production well infrastructure. Stormwater draining from new built upon areas will sheet flow via land grading into adjacent open areas where it will infiltrate into the in -situ sandy soils. No work shall begin until all permit approvals have been granted. At least one week before construction activities begin, a pre -construction meeting shall be held between the Contractor, Owner, and Engineer. Limits of clearing, grading, and/or other land disturbing activities shall be staked prior to the commencement of construction activities. Open transmission line trench excavations lengths shall be closely related to the rate of pipe laying and shall be backfilled as pipe installation progresses. Transmission line trenches shall not remain open overnight. Any open transmission line trenches shall be backfilled at the end of each working day. No more than 500 If of trench shall be open at any time. The construction plans and specifications require that all erosion and sedimentation control practices be inspected weekly and after heavy rainfall producing events with needed repairs being made immediately. Furthermore, the plans require that if any erosion develops during the construction of the project, additional erosion controls shall be installed to address the problem area. Based on consultation with NC Division of Coastal Management (NCDCM), it is understood that the subject property is within the Public Water Supply Wellfield CAMA AEC per 15A NCAC 07H .0406. As described in the CAMA regulations, the aquifer system below this AEC serves as the sole source of drinking water for the communities of Avon, Buxton, Frisco, and Hatteras as well as the NPS National Seashore Recreation Area. This is an existing public water supply wellfield that serves these areas of Hatteras Island. Raw groundwater from the wellfield is pumped to the Cape Hatteras Reverse Osmosis and Anion Exchange Water Plant for treatment prior to serving potable water to the public. The existing wellfield consists of a series of wells, screened in the Surficial Aquifer (up to100'), Principal Aquifer (145-200') and Yorktown Aquifer System (230-300'). All existing wells and water supply infrastructure located within this AEC has been permitted through LAMA. Prior permits include: • CAMA Minor 89-125, Issued 1/8/1990 • CAMA Major 152-91, Issued 12/18/1991; amended 1/14/1992 • CAMA Major 30-95. Issued 3/17/1995 There is an earthen road that runs the entire length of the wellfield. The wells are alongside of the road and the existing water main is under the road. There are no wells or water lines in wetland areas. As part of the environmental planning phase, Quible performed a Section 404 wetland delineation for prospective well locations along the wellfield/ earthen road. The purpose of this was to site all wells in upland areas that do not require wetland impact permits from USACE and NCDWR (a copy of the PJD is included). All existing wetland areas will be protected and maintained in their natural state. The Dare County Water Plant is approximately 2,825'±from the Pamlico Sound, and Great Ridge Road is 3,464'± to 5,468'± north of the Atlantic Ocean. The project is not sited along either shoreline, but rather is positioned on a low sand ridge within a maritime forest. Vegetation found within this forest include, but are not limited to, indigenous grasses, live and red oak, loblolly pine, wax myrtle, red bay, holly, and phragmites. The project is in a 166-acre tract, with an elevation of approximately 6' above normal water level. The Water Plant is located outside of the public water supply well fields area of environmental concern (AEC), but all of the 21 existing wells are located within the Cape Hatteras Well Field AEC. This area has been used as a drinking water source for the communities of Avon, Buxton, Hatteras, Frisco, and parts of the National Park Seashore since 1969. There are 2 single-family residences located within this AEC that were constructed in the 1990's. A CAMA Minor Permit, #89-125, was issued to the Cape Hatteras Water Association (CHWA) on 01/08/1990 for the installation of 4 test wells on state property at the eastern end of the Cape Hatteras Well Field AEC. Major Permit #152-91 was issued to the CHWA on 12/18/1992 and amended on 01 /14/1992, which authorized the construction of an access road, 9 wells and associated utilities. Major Permit #30-95 was issued to the CHWA on 03/17/1995 for the replacement of 19 wells and add 4 monitoring wells. Development Proposal Dare County proposes to expand the water distribution's water supply by adding 3 new well sites. The development will be done in stages: 1) the installation of temporary silt fencing, a construction entrance and other erosion control facilities as needed; 2) construction and drilling of 3 new wells with a rotary rig; 3) each well will have an 8'x18' concrete pad and well house, 4) an open transmission line will be trenched for 12,074 linear feet (If) of 6" to 10" raw water main, which will be installed parallel to the existing main under the road. Any open trenches will be backfilled at the end of each working day, with no more than 500 If of trench open at any time. With the construction of the wells alongside the road, and the water main under the road, there will be no impacts to wetland vegetation. Anticipated Impacts Within the Cape Hatteras Well Field AEC, 432 sf will be filled with the addition of 8'x18' concrete pads for the 3 well houses, and 83,488± sf of area will be disturbed during the 4 stages of development noted in the development proposal. Approximately 3,200±sf of high ground area will be disturbed during the work proposed on the water main outside of the AEC, along Water Association Road.
