This permit, issued on July 29, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )t tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Vessel Restriction Removal 1) This permit authorizes the removal of the NC Division of Marine Fisheries Shellfish Sanitation Section vessel restriction limiting vessels over 24 feet in length and vessels equipped with marine heads or cabins, as defined by the NC Division of Marine Fisheries Shellfish Sanitation Section. Excavation 2) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 99-21 Page 2 of 4 ADDITIONAL CONDITIONS 3) No excavation shall take place outside of the area indicated on the workplan drawings. 4) Excavation shall not exceed -6 feet below the mean low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 5) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 6) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawings. 7) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 8) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. Dredge Material Disposal DA-248 9) No dredge material shall be placed within 30 feet of the normal high-water line. 10) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the site is graded and stabilized. 11) The diked disposal area shall be constructed a sufficient distance from the normal high-water level or any marsh and sufficiently maintained to eliminate the possibility of dike erosion or dredge material deposition into surrounding wetlands or waters. 12) The proposed dredge material disposal site has been identified as U.S. Army Corps of Engineers Disposal Site DA-248. The permittee is advised to follow all required U.S. Army Corps of Engineers regulations whether or not such commitments are addressed by individual conditions of this permit. If the dredge material disposal site changes, the permittee shall contact the Division of Coastal Management prior to the initiation of dredging activities for additional authorization. 13) The dredge material disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. ADDITIONAL CONDITIONS USACE Conditions Permit No. 99-21 Page 3 of 4 14) A "Consent to Cross" authorization from the Corps of Engineers must be obtained for the easement of the Corps navigation channel prior to material disposal. Provide a written request and a map showing the disposal site and the crossing location to Justin Annette at Justin.R.Amette(a,usace.army.mil. Permission must also be obtained to utilize disposal site, DA-248. 15) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.1)df. Maintenance Clause 16) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for dredge material disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the dredge material disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. General 17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 18) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 35 (Action ID SAW-2002-00076). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0982. D-G Enterprises LTD. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the mean high-water level. However, when essential to maintain a traditional and established use, maintenance excavation may be approved I the applicant meets all of the following criteria: (i) The applicant demonstrates and documents that a water -dependent need exists for the excavation, (ii) There exists a previously permitted channel that was constructed or maintained under permits issued by the State or Federal government. If a natural channel was in use, or if a human -made channel was constructed before permitting was necessary, there shall be evidence that the channel was continuously used for a specific purpose; (iii) Excavated material can be removed and placed in a disposal area in accordance with Part (b)(1)(B) of this Rule without impacting adjacent nursery areas and submerged aquatic vegetation as defined by the MFC; and (iv) The original depth and width of a human -made or natural channel shall not be increased to allow a new or expanded use of the channel. The area of the existing boat basin has been utilized for docking and storage for the Cordgrass Bay community since it's construction in the 1980's. Since that time portions of the basin have been maintained for that use. Around 2001 the community proposed bringing the basin contours back to the original 1985 bathymetry. An Environmental Assessment was performed with a Finding of No Significant Impact (FONSI) and in 2002 a modification of State Permit # 24-98 to expand the dredge footprint was authorized. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to shallow bottom. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(b). It is the staffs recommendation that the proposed excavation is CONSISTENT with the Rules of 15 A NCAC 07H.0208 (b) (1) (1) and meets all the criteria within. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. It is recommended that any permit issued should include standard conditions for excavation including the Primary Nursery Area in -water work moratorium (April 1— September 30). Lumina Avenue in Wrightsville Beach, adjacent to Lollipop Bay / Middle Sound in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel east approximately 3.0 miles on Eastwood Rd towards Wrightsville Beach. Cross the drawbridge and take a slight left onto W. Salisbury Street. Travel for approximately 1.2 miles on W. Salisbury Street, and then turn left on to N. Lumina Avenue and the destination will be approximately 0.9 miles on the left. The project area is associated with a 5.71 acre parcel with condominiums, recreational amenities, and a 29-slip community docking facility. The property is bordered to the north and south by residential homes that have existing docking facilities, to the east is N. Lumina Avenue, and to the west is the lollipop bay / Middle Sound. Upland vegetation on the property currently consists of ornamental landscaping and lawn grasses. The parcel has greater than 1,000 linear feet of shoreline frontage and is currently stabilized by a timber bulkhead. High marsh of various widths are located waterward of the bulkhead consisting of sea oxeye (Borrichia frutescens), sea lavender (Limonium sp.), and salt meadow grass (Spartina patens). The high marsh descends into low marsh of various widths consisting primarily of smooth cordgrass (Spartina aftemiflora). The width of the coastal wetland areas as a whole ranges from 110' to 25' wide. Waterward of the Coastal Wetlands is a 29-slip docking facility. The docking facility has two access piers that average around 100' in length that connect to a 322' by 6' floating dock positioned parallel to the shoreline. Mooring piles are installed waterward of the parallel dock denoting slips. The condominium development was originally authorized by State Permit # 44-81. State Permit # 143-86 authorized a 10-slip docking facility, which was later modified in 1988 for the addition of 10 more slips and the second access. General Permit 15625-D authorized maintenance excavation of the boat basin measuring 25' by 45' by 4 mean low water (MLW) and 65' by 30' by -4 MLW on 4/4/1996. No previous dredging permit history was found. State Permit # 24-98 authorized 9 additional slips for a total of 29 slips. This permit was later modified to expand the dredging footprint to 120' by 60' to -5 MLW. The latest State Permit to be issued was 133-98 that authorized maintenance excavation of the boat basin. In 2001, prior to this permit expiring a modification was requested to return the boat basin contours to the 1985 bathymetry. Prior to authorization an Environmental Assessment (EA) was performed with a Finding of No Significant Impact (FONSI). A major modification for State Permit # 24-98 was issued on 1/7/2002 authorizing a dredge footprint of 340' by 130' by-6' MLW to reflect the original 1985 bathymetry. Most recently, General Permit # 70709 was issued on 2/12/2018 for maintenance dredging around the northern part of the docking facility to include an area landward of the floating dock approximately 20' by 124'. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Medium Density Residential and Conservation. The waters of Middle Sound adjacent to the project area are classified as SA by the Division of Water Quality, are designated as Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to perform maintenance excavation within the boat basin of the existing 29-slip community docking facility. The applicant also proposes to have the vessel restriction condition from previous permits removed since the waters around the community docking facility are now closed to shellfishing. A signed and sealed bathymetric survey was performed by ESP Associates, Inc. In the waters around the 29-slip community docking facility on 9/2/2020 (Appendix B). Using depths obtained by thFIRECEIVED survey and the previous dredging footprints the applicant is proposing to perform maintenance dredging in an area measuring approximately 362' in length by 65' to 85' in width to a final depth of -6 MLW (SheeV# 0 6 202 r)rWP-MHfD CITY Cordgrass Bay HOA Page 3 5). The area of the dredge footprint that proposes 85' in width is located on the northern side of the docking facility where the shoaling has been an issue in the past. The 85' width includes areas landward of the floating dock to help mitigate infilling in this problem area. Based on the survey the current depths in the boat basin range from -3 to -8 MLW and the proposed dredge footprint would connect to deeper water. Additionally, since depths are sufficient in parts of the proposed footprint the applicant proposes to impact approximately 19,000 ftz of the total 26,400 ftz footprint to maintain depths for docking and navigation and reduce infilling behind the floating dock. Approximately 1,200 cubic yards would be removed using a bucket to barge method and placed on DA 248 outside of the USACE right-of-way. The dredging contractor would provide permission to use the spoil site and a consent to cross agreement from the USACE. Based on past field reports it appears that the waters around this docking facility were closed to shellfishing between 1998 and 2001. The most recent State Permit # 133-98 does not include the vessel size condition. Additionally, the applicant's agent submitted correspondence from Andrew Haines, Environmental Program Supervisor Il, Shellfish Sanitation and Water Quality indicafing in their view vessel restrictions were no longer necessary. 11. ANTICIPATED IMPACTS: The project would result in excavation of approximately 19,000 ftz of shallow bottom habitat within a designated Primary Nursery Area. The estimated disposal on the high ground of DA-248 would be 1,200 cubic yards. permit history indicates that the areas proposed to be dredged have been previously dredged. No submerged aquatic vegetation (SAV) habitat is mapped in the area and none was noted during the site visit. Similarly, no shellfish beds were noted in proposed dredge footprint. Lumina Ave in Wrightsville Beach, New Hanover County. The condominium development was permit in 1981 by permit #44-81 and the original 10-slip community pier was permitted in 1986 by permit #143-86. Several maintenance dredging events have occurred since 1996. The northern portion of the basin was most recently maintained in 2017 and 2014. The area is designated as primary nursery area and is now closed to shellfishing. 3.1.2 Proposed Action The applicants proposed to conduct maintenance dredging to -6 MLW where currently needed within the 362' x 66' basin. The northern portion of the basin is 85' wide to allow for maintenance dredging behind the floating dock since this section experiences more rapid infilling. In total, approximately 19,000 s.f. of the 26,400 s.f. basin are proposed for maintenance dredging with the current event. See Appendix A for details. Spoil material will be placed on the southern corner of DA 248, outside USACE ROW adjacent to existing dike. The selected dredge contractor will provide the needed permission to use the spoil site and a consent agreement from the USACE will be obtained if needed. Since waters in the vicinity of the marina are now closed to shellfish, the applicants request that the restriction to boats 24' in length with no heads or cabins be removed. Accordingly, initial consultation with Division of Marina Fisheries, Shellfish Sanitation staff confirm that this restriction is no longer needed. The waters are designated as Primary Nursery Area by the NC Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. After rapid in -filling continued in the northern end of the docking area, following the maintenance dredging in early 1999, the applicants hired a consultant to recommend a remedy to the shoaling problem. Their study of the project area estimates the sedimentation rate of the Cordgrass Bay Marina basin to be 610 cubic yards/year, based upon the changes between the 1985 and the 2000 bathymetry (See Figures 5 & 6). Further, the apparent fact that the most significant shoaling has occurred during the past 6 years, indicates a much higher sedimentation rate during that period. The study concludes that this increase is likely related to recent storm frequency, as well as, changes in the dynamics of Mason Inlet and the small tidal creek connecting -the inlet, to "the Lollipop'. The work proposed for the initial maintenance dredging would be located from the mid point of the dock extending north, for approximately 200 feet. Since the existing water depths in the southern half of the basin area are adequate, the applicants would limit maintenance dredging to the -6 feet at MLW contour, around the southern end of the floating dock and mooring piling area (approximately 140' long X 10'-20' wide). Approximately 5,000 cubic yards of material would be removed by a hydraulic pipeline dredge and pumped to an existing spoil disposal island located at the confluence of the Lollipop entrance channel and the Atlantic Intracoastal Waterway. The applicant has obtained verbal permission from the US Army Corps of Engineers to use the spoil site, and final rwntractural agreements are now pending. With dike and stilling basin improvements, the site appears to be of adequate size for this project. 10. ANTICIPATED IMPACTS The project would result in the deepening of approximately 32,600 square feet of shallow bottom habitat, within a designated as Primary Nursery Area. Permit records indicate that approximately 7,200 square feet of this area has been previously dredged. Short term increases in turbidity can be expected during the dredging event. However, when essential to maintain a traditional and established use, maintenance excavation may be approved if the applicant meets all of the following criteria as shown by clear and convincing evidence accompanying the permit application. (i) The applicant demonstrates and documents that a water -dependent need exists for the excavation; and (R) There exists a previously permitted channel which was constructed or maintained under permits issued by the State or Federal Government. If a channel was in use, or if a human -made channel was constructed before permitting was necessary, there shall be clear evidence that the channel was continuously used for a specific purpose; and (iii) Excavated material can be removed and placed in an approved disposal area without significantly impacting adjacent nursery areas and beds of submerged aquatic vegetation; and (iv) The original depth and width of a human -made or natural channel will not be increased to allow a new or expanded use of the channel. Aerial photography indicates that the area proposed for dredging had been excavated prior to 1978 and much of the area remained deep until approximately 1990 when shoaling started to occur near the north end of the northern most floating dock. It is unknown to what depth this area was originally excavated. The General Permit issued in 1996 allowed a depth of -4' MLW for a portion of the area in the current proposal. The basin has been used continuously for a specific purpose since the docks were constructed in the late 1980's and we have allowed at least a portion of the area to be maintained since that time. Provided that the NC Division of Marine Fisheries agrees with the benthic habitat study conclusion that the area proposed for excavation is not indicative of the high productivity associated with PNA's, then it would appear that the project is consistent with 15A NCAC 7H .0208. It is also recommended that if a permit is issued for this project, the permit contain the following conditions: The spoil area must be inspected and approved by the Division of Coastal Management prior to the beginning of any dredge activity. 2. In order to protect juvenile shrimp and finfish populations, no excavation or filling will be permitted between April 1st and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 3. Hi Gregg, Yes, the permit history and dredge boundary for this one are all over the place, many of the maintenance events were done under GPs. I assume you're referring to the northern extents, the western and southern boundaries should be pretty straight forward and fit well within the historical limits as shown on aerial images (most recently the 12/2004 imagery on Google Earth). The northern extents were most recently maintained in 2017/2018 and can be also seen on Google Earth imagery (4/2018). Adam Kneirim with Maritech Dredging performed the maintenance dredging under a GP, but I did not see a copy of that. We can try further to locate more of the permits but I would hope the aerials would be sufficient enough in this case? Do you have any documentation that shows the proposal is within a previous footprint? I have a feeling that the resource agencies may wonder if it is maintenance dredging within PNA if the dimensions don't match and I did not see any documentation in the file noting previous authorized dimensions. I know you and Wilmington staff went over the maintenance vs new dredging, but Kathrine is out of town right now.
