New Hanover County at adi. to AIW W, at 9 Corbett St., in Wrightsville Beach as requested in the permittee's application dated 9/20/21. including attached workplan drawings (4), SO-S1 both dated 9/17/21 and S2-S3 both dated 4/26/21. This permit, issued on October 20, 2021 , is subject to compliance with the application, (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation if these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null ano vota. Shoreline Stabilization — Bulkhead and Rin Rap 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead and rip rap shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Rebecca Colonna Permit No. 141-21 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) This permit does not authorize any excavation waterward of the approved alignment. 8) The fill material shall be clean and free of any pollutants except in•trace quantities. 9) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 10) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will be used to backfill the area behind the permitted bulkhead. 11) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. Boat Ramp 12) Unless specifically altered herein, this permit authorizes one concrete boat ramp, as indicated on the attached workplan drawings. 13) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 14) Placement of fill materials below normal water level shall be limited to the ramp structure. 15) Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. USACE Conditions 16) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.aov/raleigh/pdfs/ManateeGuidelines20l7.gddf. Rebecca Colonna ADDITIONAL CONDITIONS Sedimentation and Erosion Control Permit No. 141-21 Page 3 of 3 17) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 18) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 19) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in appropriate waste receptacles in an upland location. 22) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 3 (Action ID SAW-2012-00472). NOTE: 'The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0878. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. If Katherine has not touched base with you I'm sure she will soon with next steps. I have seen the updated survey and using that to update the workplans will clarify things significantly. The revised workplans will require the immediate neighbor to be re - notified. This is important when changing the original design and protects the applicant in case there are any neighbor issues. If you re -notify the neighbor via certified mail then we must wait for 30 days from the re -notification to give the neighbor time to provide any comment. If you are able to provide the neighbor with a riparian notification form and get their signature and statement of no objection then we can move forward and will not need to wait for the 30 days to pass. The redesign and notification will require the project to be placed on hold, effective September 16, 2021 until such as time as the workplans are updated and the neighbor is re -notified with the updated plans. This hold will also include the time for re -notification has elapsed or a signed statement of no object is obtained from the neighbor and supplied to the office. We will still process the application and provide the updated plans to the necessary agencies so their files are updated. Though I do not foresee any issues with the redesign, I will keep in touch if any additional comments come in. PROJECT DESCRIPTION DCM-MHD CITY The project site is located at 9 Corbett Street, on Banks Channel, in the town of Wrightsville Beach, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel east approximately 3.0 miles on Eastwood Rd towards Wrightsville Beach. Cross the drawbridge and the Banks Channel bridge and take a right onto Waynick Boulevard. Travel approximately 1.2 miles on Waynick Boulevard, follow the road as it turns to the left and becomes Sunset Avenue, and then take a right at the stop sign onto South Lumina Avenue. Travel approximately 0.2 miles and take a right onto Corbett Street and the project location will be at the end of the street to the left. Currently, the property has an existing single family home, a 3 (three) slip private docking facility, and a private boat ramp. The project site is bordered to the south and east by existing single family homes. The parcel to the north of the project location is a street end with a stormwater pipe, owned by the Town of Wrightsville Beach. Banks Channel borders the property to the west. Elevation at the site averages approximately 4' above normal high water (NHW). The high ground portion of the property contains ornamental landscaping, lawn, and dune grasses. A sand beach approximately 30' wide at low tide is located along the approximately 80' shoreline of the property. The neighboring property to the south has a bulkhead located approximately 11.75' below NHW as marked by DCM personnel on 11/18/2020. The existing docking facility was authorized by State Permit # 44-12 on 5/9/2012, later modified on 10/1912015, and consists of a 6' by 81' access pier extending waterward into Banks Channel. The access pier is perpendicular to the shoreline for approximately 45', then angles to the south for 20' and then turns perpendicular to the shoreline again for an additional 15'. An access ramp extends from the fixed pier onto a 6' by 42' floating dock positioned perpendicular to the shoreline terminating in a 17' by 23' gazebo. A 5' by 14' floating finger pier extends parallel to the shoreline on the north side of the 6' by 42' floating dock approximately 6' from the landward end of the float. A 5' by 25' floating finger pier is attached to the end of the 4' by 14' float in a position perpendicular to the shoreline, creating a U-shaped configuration. A 12' by 12' boat lift is installed within the U- shaped dock and another boatlift measuring approximately 15' by 20' is installed on the north side of the 5' by 25' floating finger pier. The existing concrete boat ramp is located directly south of the access pier and measures approximately 10' wide and 30' long. Approximately 10' of the 30' length is located below NHW. No additional permit history was found for this site. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Low Density Residential. The waters in the project area are classified as SA-HQW by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to construct a vinyl bulkhead an average of 7.5 feet below normal high water (NHW) and reinforce and repair the existing boat ramp. The applicant proposes to construct the vinyl bulkhead a maximum of 11.75' below NHW on the southern end of the property to tie into the neighboring bulkhead. The sheet pilings for the bulkhead would be tied into wingwalls installed along each side of the boat ramp, extending to the high ground above the NHW line. Additionally, sheet pilings will be installed along the waterward edge of the ramp cut down to grade for reinforcement against erosion. After the proposed boat ramp reinforcement the bulkhead would continue north angled landward toward the NHW line to the northern property boundary for an average of 7.5' below NHW. The proposed bulkhead would incorporate approximately 505 ftz of Estuarine Waters/Public Trust Area (see Sheet SO). The repairs and reinforcement of the existing boat ramp would include pouring a new 10' by 30', concrete slab 9 Corbett Street, Rebecca Colonna Page Three that is 4" thick. According to the application, to pour the new slab the vinyl sheet pilings placed around the boat ramp for support will be left at a height above NHW to act as a form and prevent contact with Estuarine Waters. Also, an anti -washout additive would be added to the concrete mix to prevent chemical components in the concrete from leaching. Additionally, the applicant would install a floating boom at the waterward end of the ramp until the concrete has cured. After curing the vinyl sheet piling would be cut flush to the grade of the boat ramp. Approximately 100 ft2 of the new concrete slab would be located below NHW. The footprint of the boat ramp would not be expanded (see Sheet S1). The applicant has performed 2 surveys in the past, an as -built in 2015 and a preliminary survey in 2018. Both show the shoreline has eroded and the high water line has migrated landward. (see Sheet S2 and S3). Based on the narrative the applicant believes the increased erosion is the result of the installation of the adjacent southern bulkhead. The bulkhead placement proposed matches the 2018 MHW line on the south side of the property with the alignment angling back to the current NHW line, 10. ANTICIPATED IMPACTS As proposed, the new bulkhead would extend a maximum of 11.75' and an average of 7.5' below NHW which, would result in the incorporation of approximately 505 ft2 of Estuarine Water/Public Trust Area. The new 10' by 30' boat ramp slab proposed in the existing footprint would have approximately 10' below NHW, resulting in approximately too ft2 of fill in Public Trust Area. This erosion appears to have begun immediately after her neighbors installed a new bulkhead. This CAMA permit request is to install a new bulkhead at the NHW line as marked by CAMA on November 2, 2018. This will require approximately 505 sf of fill behind the new bulkhead. Fill will consist of clean sand. The bulkhead will include a filter system behind the wall that will treat a portion of the runoff. The project also includes maintenance and shoreline protection for an existing concrete boat ramp. Boat ramp maintenance will include approximately 100 sf of fill. This fill consists of a 4" thick concrete overlay. Boat Ramp Maintenance construction method include: - The sheetpile protecting the edges of the boat ramp will extend above high tide to act as a form for the concrete. The sheetpile will be supported to stay in place during high tide. The sheetpile will not be removed until the concrete is cured. - The boat ramp concrete overlay mix design includes an anti -washout additive.
