Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 _ Excavation and/or filling pursuant to NCGS 113-229 Issued to Rodney Clark, 615 Lockwood Court SE, Bolivia, NC 28422 Permit Number 19-21 Authorizing development in Brunswick County at adi. to the Lockwoods Folly River, at 615 Lockwood Court SE, in Bolivia , as requested in the permittee's application dated 5/13/20 (MP-1) and 5/18/20 (MP-4), including attached workplan drawings (5), Pages 1, 2, 4, 5 of 5 dated 5/15/20, and Site Plan Page I of I dated 1/18/21. This permit, issued on February 11, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility Expansion 1) This permit authorizes only the additional boatlift and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Rodney Clark Permit No. 19-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) This permit authorizes one (1) additional formalized boat slip for a maximum of two (2) formalized boat slips. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) In order to satisfy concerns of the resource agencies, physical stops shall be placed on the boat lift at a minimum height of 18" above the bottom substrate to prevent the boat lift from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. 8) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. USACE / FEDERAL CONDITIONS 9) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 13) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2020-02098). Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1883. The applicant proposes to install a second boatlift and relocate the existing elevator boatlift increasing the total slip count from two to three. The proposed project is located at 615 Lockwood Court SE, in the Eastern Bend of the Lockwood Folly River on the west end of Bolivia, Brunswick County. The waters are classified SA by the Division of Water Resources (NCDWR), and are not designated as a Primary Nursery Area (PNA) by the NCDMF. There is no submerged aquatic vegetation (SAV) documented in the Lockwood Folly River are closed to the harvest of shellfish. There are scattered clusters of live oysters on the bottom. This applicant's property is located along waters that are classified as Secondary Nursery Area (SNA) by the NCDMF, which are estuarine waters commonly used as a developmental transition zone, where later juvenile fish development takes place. Species within this area are mixture of late juveniles that have migrated from the PNAs upstream, as well as sub -adults and adults. The current pier and dock are located over coastal wetlands and the application states that existing water depth in the vicinity of the proposed boatlift would range from approximately 0.0' to Offat NLW. Shallow habitat, such as this, with coastal wetlands and live oysters, provide vulnerable juvenile species with protection from predators, an abundance of food, and water temperatures preferable to juvenile finfish and shellfish species. Coastal wetlands are considered among the most productive ecosystems in the world. Coastal wetlands are a productive detritus based system that trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier to flood damage, and provide nursery functions and support fish production. Recent research indicates that even narrow fringes of wetlands are essential factors for fish utilization and erosion control. An estimated 95% of commercial finfish and shellfish species in the US are wetland dependent. Species common to coastal wetlands include sheepshead, red drum, flounder, spot, Atlantic croaker, menhaden, oysters and penaeid shrimp; with a myriad of prey species as well. Wetlands can enhance foraging functions of adjacent habitats, which is why PNA and SNA habitats are closely linked with coastal wetlands. The applicant is proposing to move the existing elevator boat lift to the other side of the pier, and build a new boat lift where the original was. The relocated lift would be positioned over a greater extent of marsh grass and similar bottom with no to minimal water depth. Locating a boat lift over coastal wetlands with 0.0 ft of water for the majority of the day would negatively impact this nursery habitat and benthic community. Formalized boat slips in shallow water can allow vessels to repeatedly contact the bottom, resulting in loss of wetlands, and anoxia in the sediment, which can kill benthic invertebrates and reduce available shallow bottom habitat for fish during low tide. The proposed application would increase the slip number from two to three. Navigable deep water access is a long distance from the dock. Consequently, vessels moving to and from these shallow water docks can cause propeller disturbance impacts to the SNA and coastal wetlands. Based on the above discussion, the DMF recommends denial of the permit application for this project as proposed because it is likely to have significant adverse impacts on marine and estuarine fisheries resources at the project site based on the information included in the application. Clark dock modification; Lockwood Folly River, Brunswick County Dear Mr. Weychert: After discussions with staff, I concur with their recommendation to deny this application to install a second boat lift on an existing dock, expanding the number of slips to three. The existing dock ends at the edge of the coastal marsh. The existing boat lift is partially over coastal marsh and oysters, and there is no water at low tide or for a large portion of the tide cycle. There is also an existing floating dock that sits on the bottom during this time. If a second boat lift was added to the other side of the dock it would also be partially over coastal marsh. This area of the river is designated as Secondary Nursery Area (SNA). Shallow bottom habitat with marsh and oysters such as this is a productive habitat for juvenile fish and shellfish. An additional slip would increase damage to marsh and shallow nursery bottom. Due to the extensive distance of the flat, lengthening the dock is not a viable solution, and impacts from prop scarring and structures sitting on the bottom would occur. Additionally, the floating dock at the site was not permitted and should be removed to reduce impacts to the benthic community. Thank you for the opportunity to comment on this application. The applicant proposes to install a second boatlift and relocate the existing elevator boatlift increasing the total slip count from two to three. The proposed project is located at 615 Lockwood Court SE, in the Eastern Bend of the Lockwood Folly River on the west end of Bolivia, Brunswick County. The waters are classified SA by the Division of Water Resources (NCDWR), and are not designated as a Primary Nursery Area (PNA) by the NCDMF. There is no submerged aquatic vegetation (SAV) documented in the Lockwood Folly Riverare closed to the harvest of shellfish. This applicant's property is located along waters that are classified as Secondary Nursery Area (SNA) by the NCDMF, which are estuarine waters commonly used as a developmental transition zone, where later juvenile fish development takes place. Species within this area are mixture of late juveniles that have migrated from the PNAs upstream, as well as sub -adults and adults. The current pier and dock are located over coastal wetlands and the application states that existing water depth in the vicinity of the proposed boatlift would range from approximately 0.0' to Offat NLW. Shallow habitat, such as this, with coastal wetlands and oyster shell, provide vulnerable juvenile species with protection from predators, an abundance of food, and water temperatures preferable to juvenile finfish and shellfish species. Coastal wetlands are considered among the most productive ecosystems in the world. Coastal wetlands are a productive detritus based system that trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier to flood damage, and provide nursery functions and support fish production. Recent research indicates that even narrow fringes of wetlands are essential factors for fish utilization and erosion control. An estimated 95% of commercial finfish and shellfish species in the US are wetland dependent. Species common to coastal wetlands include sheepshead, red drum, flounder, spot, Atlantic croaker, menhaden, oysters and penaeid shrimp; with a myriad of prey species as well. Wetlands can enhance foraging functions of adjacent habitats, which is why PNA and SNA habitats are closely linked with coastal wetlands. Locating a boat lift over coastal wetlands with 0 ft of water for the majority of the day could negatively impact this nursery habitat and benthic community. Formalized boat slips in shallow water can allow vessels to repeatedly' contact the bottom, resulting in loss of wetlands, and anoxia in the sediment which can kill benthic invertebrates and reduction of shallow bottom habitat during low tide. The proposed application would increase the slip number from two to three. Navigable deep water access is a long distance from the dock. Consequently, vessels moving to and from these shallow water docks can cause propeller disturbance impacts to the SNA and coastal wetlands. Based on the above discussion, the DMF recommends denial of the permit application for this project as proposed because it is likely to have significant adverse impacts on marine and estuarine fisheries resources at the project site based on the information included in the application. The NCDMF recommends eliminating the proposed construction of a new boatlift and repair the existing elevator boatlift (12'x12') only by installing two additional pilings making it a 4-piling elevator style boat lift.
