Permit Class NEW Permit Number 40-21 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to City of Washington, PO Box 1988, Washington, NC 27889 Authorizing development in Beaufort County at adi. to Trainers Creek at Masons Landing BAA, at 625 Clarks Neck Rd., in Washington, as requested in the permittee's application dtd 2/22/21 (MP-1) & 12/1/20 (MP-4), incl att workplan drawings (4), CD 1.0, 2.0, 3.0 all dtd 3/12/20 & Cross Section dtd 10/29/20. This permit, issued on April 8, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation it mese terms may oe subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Kayak Launch at Masons Landing BAA 1) This permit authorizes only the kayak launch and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this boating access facility without permit modification. No non - water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee City of Washington Permit No. 40-21 Page 2 of 2 ADDITIONAL CONDITIONS 3) This permit does not authorize any new formalized boat slips. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 6) Should the Lot to the north be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 7) The kayak launch shall post signage indicating that the authorized launch is only intended for non - motorized vessel usage. General 8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 9) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2021-00464). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0015 v2. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations in place at the time of such development. Overview: The project site is located at 625 Clarks Neck Road, adjacent the downstream side on the bridge over Tranters Creek on SR 1565 in the City of Washington in Beaufort County, North Carolina. Two CAMA permits have been issues at this site, CAMA Major Permit No. 36-91 and CAMA Major Permit 97- 13. Both permits have expired. The property is owned by the City of Washington and the NC WRC has a long term lease to operate the site for public boating access to Tranters Creek. Existing onsite development includes paved parking, piers with floating platforms, riprap, and two boat ramps. The site is vegetated with maintained upland grass with the exception of the narrow wetland fringe adjacent the creek and 2 trees on either side on the handicap parking. The applicant proposed to add additional platform to the existing L-Head platform as a 10' by 26' floating dock on the upstream side nearest Clarks Neck Road to act as a canoe/kayak launching area. AECs onsite include: Public Trust Areas. Tranters Creek is classified C;Sw,NSW by the Environmental Management Commission. Tranters Creek is designated as Inland Fishing Waters by the NC Wildlife Resources Commission. The site is a not a Primary Nursery Area, and is closed to shellfishing. A fringe of Section 404 wooded wetlands exists on both sides of the existing boat ramps. Although the additional pier will run in front of the existing wetlands there is no fill associated with this project. A report of SAV and archaeological/cultural resources was not provided. Anticipated impacts The addition of the floating platform will result in the shading of±260 ft2 of bottom. The project will result in short-term localized turbidity form the construction of the additional float dock. The Future Land Use Map (FLUM) designates the site as Conservation. This land use category has the following development guidelines: Allowable Density: Except for cluster development, the minimum lot size for development within the Conservation category is 20,000 square feet. Densities will not exceed 1.5 units per acre. Cluster development will be encouraged in conservation areas. Impervious Surface: The impervious surface coverage objective per parcel is 10%regardless of use. This will require revision to the City's zoning ordinance. Maximum Building Height: The maximum building height for this category is 35 feet. Permitted Uses: This category was established in response to environmentally sensitive and natural hazard areas identified through the land suitability analysis and environmental composite discussion earlier in this plan. Due to these factors, land use within this category should consist of low density residential housing and recreational/open space with accessory support uses. All development should be contingent on whether all environmental impacts have been assessed, and potential effects of natural hazards taken into account. Development within this category will primarily rely on on -site wastewater treatment facilities. Uses Not Permitted: Non-residential uses are not routinely permitted in this district. However, proposals for non-residential development will be assessed on a case -by -case basis by making a determination regarding a given adverse development impact on environmental conditions. Land Use Policies: The following LUP policies may be applicable to this request. Conservation P.29 (pg. 193) Except for policy P.74 and implementing actions 1.24 and 1.25, residential, commercial, and industrial development which meets 15A NCAC 7H use standards will be allowed in estuarine shoreline, estuarine water, and public trust areas. Policy P.74 and implementing actions 1.24 and 1.25 are more restrictive than 15A NCAC 7H because the city desires greater control/protection. P.34 (pg. 194) As stated elsewhere in this plan, with the exception of policy P.74 and implementing actions 1.24 and 1.25, the City of Washington supports the enforcement of 15A NCAC 7H in areas of environmental GAliid41111 *Policy P.74 and implementing actions 1.24 and 1.25 have been included for reference. Masons Landing Boating Access Area City of Washington c/o NC WRC Beaufort County Project setting BIII Barber with Sound Rivers Inc., on behalf of the City of Washington, has submitted the following application for the addition of a floating canoe/kayak launch to the existing boating access area on Tranters Creek owned by the City of Washington and leased by the North Carolina Wildlife Resources Commission (NC WRC). The project site is located at 625 Clarks Neck Road, adjacent the downstream side on the bridge over Tranters Creek on SR 1565 in the City of Washington in Beaufort County, North Carolina. The property is owned by the City of Washington and the NC WRC has a long term lease to operate the site for public boating access to Tranters Creek. The Division of Coastal Management Issued CAMA Major Permit No. 36-91 to the City of Washington on 4 March 1991 for the construction of a 2 ramp boating access with fixed docks and a gravel parking area. All work was completed on [he permit and it expired on 31 December 1994. On 20 August 2013 The City of Washington received CAMA Major Permit 97-13 to replace the existing boat ramps with two new ramps, add floating access docks, riprap, and a paved parking area. To date, all work all work authorized by the permit has been completed and the permit expired on 16 December 2016. Currently, two 14" by 28' boat ramps separated by 6' by 60' floating platform provide access to Tranters Creek. In addition, 2 — 6' by 52' piers including 8' by'22' 1-head platforms abut each boat ramp. The existing water depth at the end of the existing boat ramp is 6' below the normal water level (NW L). A fringe of Section 404 wooded wetlands exists on both sides of the existing boat ramps. Although the additional pier will run in front of the existing wetlands there is no fill associated with this project. The existing paved parking lot provides parking for 35 vehicles with trailers, 5 without trailers as well as and additional handicap parking spaces. The site is vegetated with maintained upland grass with the exception of the narrow wetland fringe adjacent the creek and 2 trees on either side on the handicap parking area. The project site is bordered on the northern (upstream) side by Clarks Neck Road. The southern (downstream) side of the property is bordered by and undeveloped wooded track. Tranters Creek is classified C;Sw,NSW by the Environmental Management Commission and is closed to shellfishing. Tranters Creek is designated as Inland Fishing Waters by the NC Wildlife Resources Commission. Tranters Creek is approximately 220' in width at the location of the boat ramp. Project description The applicant proposes to enhance Masons Landing Boating Access Area as follows: 1. Add additional platform to the existing L-Head platform as a 10' by 26' floating dock on the upstream side nearest Clarks Neck Road to act as a canoe/kayak launching area.
