This permit, issued on May 18, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Christenbery Permit No ,6X21 Page 2 of 3 ADDITIONAL CONDITIONS 3) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit authorizes a maximum of 4 formalized boat slips. 9) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 10) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. 11) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 12) The roof of the covered platform shall not be designed for second story use. 13) Should either lot to the east or west be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Robert E,.and Karen A. Christenbery Permit No. 63-21 Page 3 of 3 ADDITIONAL CONDITIONS 15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 16) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the US Army Corps of Engineers. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0187. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $250 was received by DCM for this project. PROJECT DESCRIPTION The proposed project is at 336 Marker Fifty -Five Ave., located due west of the Holden Beach bridge and adjacent to the AIW W on Holden Beach, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Holden Beach. At the Supply intersection, turn left onto NC 211 S. Travel .3 miles down NC 211 S and turn right onto Stone Chimney Rd SW. Drive down Stone Chimney Rd for 5.5 miles and continue onto Old Ferry Connection SW for 1.1 miles. Tom right onto Sabbath Home Rd SW and then take the next left onto NC 130 E towards Holden Beach. Travel over the Holden Beach bridge and take a right onto Ocean Blvd W. Continue 1.2 miles and turn right onto High Point St. Take the next right onto Brunswick Ave. and then take an immediate left onto Marker Fifty -Five Ave. The project site will be located on the left-hand side of the road The property consists of a single-family residence located on a .81-acre parcel approximately 13' above normal high water (NHW) and is vegetated with ornamental grasses and landscaping. The project site has approximately 60' of shoreline frontage along the northern edge of the property and is stabilized with native vegetation including Wax Myrtle (Myrica cerifera) and Green Briar (Smilax spp.). High marsh species extend approximately 60' waterward from the embankment and include Salt Meadow Cordgrass (Spartina patens), Spike Grass (Distichilis spicata), Sea Lavender (Limonium spp.), and Black Needlemsh (Juncus roemerianus). Waterward of the high marsh is approximately 300' of Smooth Cordgrass (Spartina alterniora) that transitions from a stunted and sporadic stand to a dense swath as salinity increases. The width of the waterbody measures approximately 530' from marsh to marsh in the vicinity of the proposed pier. DCM staff verified water depths in the vicinity of the proposed boatlift range from -1.1' NLW to -1.6' NLW. According to the applicant, the existing docking facility was built in 2005 under State Permit #15-05. Upon permit approval, the applicant proposes to remove the existing docking facility while simultaneously building the proposed docking facility. The waters of the AIW W are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to install a private pier, covered platform, boatlift, floating dock, and 2 jet -ski lifts for a total of 4 formalized boat slips. The applicant proposes to build a 6' x 476' access pier that would originate from an upland point and extend north (-130' beyond NHW) into the AIW W. Approximately 465' down the access pier; the applicant proposes a Yx16' finger pier which would extend off the west side of the access pier, leading to a north -facing gangway and a proposed 10'xl6' floating dock (Slip 1). The applicant also proposes 2 jet -ski lifts (Slips 3 & 4), one located on the south side of the aforementioned finger pier and another directly across from the finger pier on the east side of the access pier (See Sheet 1 of 7). The proposed access pier would continue another 8' north and lead to a proposed 13.5'xl5' covered gazebo with a 5'xl4' open platform located waterward of the gazebo. A proposed 14'x14' boatlift (Slip 2) would be located off the east side of the gazebo. As proposed, the facility would be located within the applicant's area of riparian access and would encroach within both adjacent neighbor's 15' riparian setback. Initialed setback waivers were obtained from both Farrington Private Docking Facility January 11, 2021 adjacent neighbors for the proposed project. DCM staff took water measurements at 1:00pm on 1/11/21 and measured a range of -1.1' NLW to -1.6' NLW in the vicinity of the proposed boatlift. As proposed, the docking facility would be built landward of the existing pier -head line, the '% width, and the 80' Federal Channel Setback. As proposed, the docking facility would extend approximately 130' from the edge of marsh to approximately 24% of the waterbody width. 10. ANTICIPATED IMPACTS The proposed (4) four -slip docking facility would result in the shading of 2,160 square feet of Coastal Wetlands and the incorporation of approximately 1,173 square feet of Estuarine Waters and Public Trust Area. As proposed, the docking facility would not exceed the existing pier -head line, the '/4 width of the waterbody, or the 80' Federal Channel Setback The proposed development would be located within the 15' riparian corridor setbacks to the east and west. Turbidity associated with the piling installation would be kept to a minimum. Christenbery Jr and Karen -Ann Christenbery Location of Project Site: 336 Marker Fifty Five Drive, adjacent to the AIWW at Holden Beach Project Summary: The applicant proposes the replacement of their old private pier and dock structure with the new construction of a private pier, floating dock, boat lift and two jet ski lifts. Project Description/Narrative The project is located at 336 Marker Fifty Five Drive in the Marker Fifty Five subdivision in the central portion of Holden Beach, adjacent to the AIWW in Brunswick County. The project site is a .36 acre upland lot with a marsh riparian area of .45 acres. The lot has water frontage on the AIWW. To get to the property, one should travel US 17 to Shallotte, then follow NC 130 towards Holden Beach. Continue to follow NC 130 as it turns right and cross over the Holden Beach Bridge. At the base of the bridge, turn right onto Ocean Boulevard West. Travel west to High Point Street and turn right. Take another right turn onto Brunswick Avenue and then a nearly immediate left onto Marker Fifty Five Avenue. 336 Marker Fifty Five is located on the left. The high ground property has an average elevation of approximately 13 feet above mean sea level. The lot is developed with a single family home and driveway. Municipal water and sewer is provided. The high ground consists of lawn and landscape vegetation. Toward the AIWW, the high ground takes a moderate slope of about 15 feet down to the coastal wetlands. High coastal marsh vegetation including, Black Needle Rush and Salt Meadow grass is interspersed with Giant Cordgrass near the base of the slope and extending waterward, where Smooth Cordgrass becomes prominent and extends waterward to the open AIWW. We are proposing to replace the existing dock and pier that was built in 2005. The old structure has survived several storm and high water events, however it is now in poor condition. The floating dock and gangway are currently missing. The pier has been deemed safe by inspecting contractors, but not functional. The pier walkway is low and susceptible to further water damage. The boatlift out dated, rusted and is too short for the type of boat that we will use. The boat lift is also not capable of bring the boat to a height that will avoid high water levels. We are proposing building the new structure as the old structure is simultaneously removed in the process. Moving forward, the property has an angled shoreline length of approximately 85 linear feet along the waterway. The Riparian Corridor from the AIWW to the corners of the lot measure 59.7 feet (60 feet). The pier would be elevated above the wetlands at its landward end. From the top of the slope, the 6 foot wide pier walkway would extend 494 feet to the edge of the 80 foot federally managed AIWW setback. It would extend approximately 100 feet beyond the edge of the marsh and terminate with a 14' x 18' fixed dock. The fixed dock will include a 5' x 14' uncovered area at the end by the AIWW. The total end covered and uncovered area (shaded impact) will be: 1) 5' x 14' uncovered 70 sq ft shaded impact 2) 14' x 13' covered 182 sq ft shaded impact 3) 6" overhang on 3 sides of covered 14' +13' + 13' = 40' divided by 6" (1/2) 20 sq shaded impact The total shaded impact area for the fixed pier only is: 272 sq ft We would also like to propose a 3' x 16' platform walkway leading to a gangway and then a 10' x 16, floating dock. 1) 3' x 16' platform 48 sq ft shaded impact 2)10' x 16' floating dock 160 sq ft shaded impact The total shaded impact for the platform and floating dock 208 sq ft The total shaded impact area for the entire project 480 sq ft shaded impact The allowable square footage of the proposed docks is calculated as follows: • 60 ft width between Riparian Boundaries times 8 is 480 sq ft. The proposed pier, walkway, platform, gangway and floating dock total 3384 total square feet. The proposed structure would approach, but not exceed the edge of the Corps of Engineers AIWW 80' setback. The pier wouldexceed''/a width of the waterbody, however there are longer piers within 200' on either side and the pier would not'exceed 1/3 of the waterbody. The width of the waterbody is approximately 530'. The proposed project would encroach 5' to the East and 5' to the West into the 15' riparian setbacks. Adjacent neighbor consent forms have been signed and both neighbors have given permission to enter the riparian setbacks. There is a proposed 14' by 14' boatlift slip to the East and two fixed Jet Ski lifts that will attach to the walkway and gangway platform. We -are also proposing to trim the non -wetland brush overgrowth on the downward slope from the upland to the marsh. Trim to grade only with no soil displacement.
