This permit, issued on July 9, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)t tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Demolition
1) This permit authorizes the demolition of the existing groins, breakwaters and platform, all as
expressly and specifically set forth in the attached application and workplan drawings.
Breakwaters
2) The breakwaters shall be constructed in accordance with the alignment depicted on the attached
workplan drawings.
3) The height of the permitted breakwater shall not exceed two feet above the normal water level.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

4) The breakwater shall be constructed with an equal gap between each sheathing board totaling at least
one inch of open area for every linear foot of breakwater. The breakwater shall have at least one, five-
foot opening at every 100 feet. The breakwater sections may be staggered and overlap as long as the
five-foot separation between sections is maintained. Overlapping sections shall not overlap more than 10
feet.
5) The permitted breakwater shall be constructed of treated wood, plastic lumber, metal or vinyl sheet piles
or other suitable materials approved by Department personnel.
6) Breakwaters shall be marked at 50-foot intervals with yellow reflectors extending at least three feet
above mean high water.
7) No backfill of the breakwater or any other filling of wetlands, estuarine waters, public trust areas or high
ground is authorized by this permit.
8) Should either lot to the west or east be sold prior to the initiation of construction of the breakwater
section within the riparian setback, the permittee shall obtain a written agreement from the new owner(s)
waiving the minimum setback, and authorization to construct the portion of the breakwater section
within the property owner's riparian setback. A copy of the agreement shall be submitted to the
Division of Coastal Management prior to initiating construction of the breakwater section.
Docking Facility
9) This permit authorizes only the docks, piers, boat lifts and replacement of the existing structural
members, and other structures and uses located in or over the water that are expressly and specifically
set forth in the permit application. No other structure, whether floating or stationary, shall become a
permanent part of this docking facility without permit modification. No non -water dependent uses of
structures shall be conducted on, in or over Public Trust waters without permit modification.
10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
11) This permit authorizes 2 additional formalized boat slips for a maximum of 4 formalized boat slips at
this docking facility.
12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
13) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
General
14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

15) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to any authorization
from the U.S. Army Corps of Engineers.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-1871.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

Dear Mr. Rubino:
This letter is in response to your email dated September 8, 2021, regarding a refinement for Brymar
Properties of Virginia, LLC. In your correspondence, it was requested that Major Permit #85-21 be
modified to relocate the proposed stairs to a new position adjacent to the pier. The applicants have
also requested authorization to build the pier ramp at a slope that is ADA accessible.
Major Permit #85-21 was issued to Brymar Properties of Virginia, LLC, on July 9, 2021. This Permit
authorized the demolition of existing groins, replacement of breakwaters, new platforms, boat lifts and
PWC lifts, replacement of the access stairs with a ramp to the existing pier, and replacement of stairs
between terraced levels to access the lower yard. The project is located at 27 Ballast Point Drive in
Manteo, Dare County.
Your request as described and/or depicted in your submittal dated September 8, 2021, along with the
Refinement Plan dated September 8, 2021, is hereby authorized as a refinement to CAMA Major
Permit #85-21. All existing conditions remain in effect, including the expiration date of December 31,
2024. This letter is provided to you as a record of the authorization, and should be included with the
Permit file. It is noted that you may need to obtain a building permit from the Town of Manteo.

Major Permit Recommendations
The applicant proposes to remove existing breakwater sills and groins along the shoreline of the
property and construct three new sections of slotted vinyl and timber pile supported breakwater
sills. The sills will be in lengths of 42',100', and 24' respectively moving from west to east across
the property.
Other proposed water -dependent development includes, the removal of the existing platform and
the construction of a new 28'x16' platform with two lower platforms (22'x4' & 18'x6') forming an
%" shape on the western side of the larger platform. The applicant also proposes the installation
of two uncovered boat lifts (12'x12' & 16'x16') and two 8'x6' personal watercraft (PWC) lifts
located on west, east, and southern sides of the proposed platforms.
In addition to the water -dependent development, the applicant proposes to replace the existing
stairs currently providing access to the existing pier with a 20'x5' ramp. A new set of 10'x8' stairs
is also proposed between terraced levels to provide better access to the lower yard.
The site of the proposed development is located at 27 Ballast Point Drive within the Pirate's Cove
subdivision, Manteo, Dare County, adjacent to the Roanoke Sound. The development proposal
involves the Public Trust Area (PTA), Estuarine Waters (EW), and Estuarine Shoreline (ES).
1 have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:

Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are
not water dependent within the EW and PTA and lists uses that may be considered water
dependent.
Consistent: The applicant proposes to construct breakwater sills, platforms, boat lifts, and
PWC lifts. This sub -paragraph considers these structures as water dependent.
Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the
construction activities, involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse
impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds of
submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and
nursery areas.
Consistent: The development is designed to not interfere with shellfish beds, submerged
aquatic vegetation (SAV), and/or spawning and nursery areas. The location is not within
any primary nursery areas; a SAV survey was conducted with none being found; and
although the Roanoke Sound is open to shellfish taking there are no active shellfish leases
at this time within the project area.
Paragraph (a)(2)(B) states that development shall comply with state and federal water and air
quality standards.
Consistent: The proposed development will not violate water and air quality.
Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented
archaeological or historic resources as identified by the N.C. Department of Cultural Resources.
Consistent: There are no known archaeological or historical resources on the property.
Paragraph (a)(2)(D) states that development shall not increase siltation.
Consistent: It does not appear that the development will measurably increase siltation.
Paragraph (a)(2) (E) states that development shall not create stagnant water bodies.
Consistent: It does not appear that the development will create stagnant water bodies.
Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The development will have minimum adverse effects on the life cycles of
estuarine resources.
Paragraph (a)(2)(G) states that development shall not jeopardize the use of the navigation or for other public trust rights in public trust areas including estuarine watgvpIVED

Paragraph (b) addresses Specific Use Standards. Of these, sub -paragraph (6) Piers and Docking
Facilities pertain to this project, and those sub -paragraphs not listed are not applicable to this
project.
Paragraph (b)(6)(A) states that piers shall not exceed six feet in width.
Consistent: The existing pier will not be expanded and is currently 6' in width.
Paragraph (b) (6)(B) states that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a
maximum of 2,000 square feet.
Consistent: The shoreline of the property is ± 147 feet in length allowing for 1,176 ftz of
shading impact. The proposed platforms will shade 644 ftz. The square footage of the boat
lifts and PWC lifts is not included as they are uncovered. Therefore, the total area of
applicable shading impacts will be less than 1,176 ftz.
Paragraph (b)(6)(C) states piers and docking facilities over coastal wetlands shall be no wider
than six feet and shall be elevated at least three feet above any coastal wetland substrate as
measured from the bottom of the decking.
Consistent: The development will not impact any wetlands.
Paragraph (b)(6)(D) states a boathouse shall not exceed 400 square feet except to accommodate
a documented need for a larger boathouse and shall have sides extending no farther than one-half
the height of the walls and covering only the top half of the walls. Measurements of square footage
shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with
less than 75 linear feet of shoreline.
Consistent: No boathouse is proposed with this development.
Paragraph (b)(6)(E) states the total area enclosed by an individual boat lift shall not exceed 400
square feet except to accommodate a documented need for a larger boat lift.
Consistent: The total areas enclosed by the proposed individual boat and PWC lifts are 144
ftz, 256 ftz, and two at 46 ftz each. Therefore, none of the proposed boat lifts exceed 400 ftz.
Paragraph (b)(6)(F) states piers and docking facilities shall be single story. They may be roofed
but shall not be designed to allow for second story use.
Consistent: The proposed docking facility is all single story with no roofed areas.
Paragraph (b) (6)(G) states piers and docking facility length shall be limited by:
(i) not extending beyond the established pier or docking facility length along the same shoreline
for similar use:
Consistent: The pier is existing and consistent with other established piers al
shoreline. The existing pier will not be extended.

(ii) not extending into the channel portion of the water body.
Consistent: The pier is existing and will not be extended into the channel portion of the
water body.
(iii) not extending more than one-fourth the width of a natural water body, or human -made canal
or basin.
Consistent: The estimated width of the adjacent waterbody at the project location is
estimated to be - 2.1 miles (-11,088 feet) across. The existing pier will not be extended
and at 126 feet is considerably below one-fourth the width of the natural water body.
Paragraph (b)(6)(H) states piers or docking facilities longer than 400 feet shall be permitted only
if the proposed length gives access to deeper water at a rate of 1 foot each 100 foot increments of
length longer than 400 feet.
Consistent: The existing pier is 126 feet in length and will not be extended.
Paragraph (b)(6)(I) states piers and docking facilities shall not interfere with the access to any
riparian property and shall have a minimum setback of 15 feet between any part of the pier or
docking facility and the adjacent property owner's area of riparian access.
Consistent: The proposed boat lifts located on the western and eastern sides of the docking
facility will be ± 60' from the western and ±20' from the eastern property lines and will not
encroach within the 15' setback.
Paragraph (b)(6)()) states applicants for authorization to construct pier or docking facility shall
provide notice of the permit application to the owner of any part of a shellfish franchise or lease
over which the proposed dock or pier would extend. The applicant shall allow the lease holder the
opportunity to mark a navigation route from the pier to the edge of the lease.
Consistent: The location of the proposed development is adjacent to the Roanoke Sound
which is open to shellfishing. However, no leases or franchises currently exist within the
project location.
15A NCAC 07H.0209 Use Standards
Paragraph (d) addresses General Use Standards. Acceptable uses shall be those consistent with
the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those
types of development activities that will not be detrimental to the public trust rights and the
biological and physical functions of the estuarine and ocean system. Every effort shall be made
by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine
and coastal systems through the planning and design of the development project. In every
instance, the particular location, use, and design characteristics shall comply with the general use
and specific use standards for coastal shorelines, and where applicable, the general use and
specific use standards for coastal wetlands, estuarine waters, and public trust ar �VE ®
Rule .0208 of this Section. Development shall be compatible with the following

Paragraph (d)(1) states all development projects, proposals, and designs shall preserve and not
weaken or eliminate natural barriers to erosion including peat marshland, resistant clay
shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d)(2) states all development projects, proposals, and designs shall limit the
construction of impervious surfaces and areas not allowing natural drainage to only so much as is
necessary to adequately service the major purpose or use for which the lot is to be
developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the
applicant can effectively demonstrate, through innovative design, that the protection provided by
the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment
of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious
areas are not increased and the applicant designs the project to comply with the intent of the rule
to the maximum extent feasible.
Consistent: The proposed landward development will be constructed using wooden
decking and is therefore considered pervious. So no additional impervious coverage is
proposed to be added.
Paragraph (d)(3) states all development projects, proposals, and designs shall comply with the
following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.
Consistent: The proposed development is consistent with the intent of this rule.
(B) No development project proposal or design shall permit an angle for graded slopes or fill which
is greater than an angle which can be retained by vegetative cover or other erosion -control devices
or structures.
Consistent: No grading or fill is proposed with this project.
(C) All development projects, proposals, and designs which involve uncovering more than one acre
of land shall plant a ground cover sufficient to restrain erosion within 30 working days of
completion of the grading, provided that this shall not apply to clearing land for the purpose of
forming a reservoir later to be inundated.
Consistent: The land disturbance proposed by the development is ± 180 ftz which is far
below one acre of disturbance.
Paragraph (d)(4) states development shall not have a significant adverse impact on estuarine and
ocean resources. Significant adverse impacts include development that wou3d ,Iir etj �r ®
indirectly impair water quality standards, increase shoreline erosion, alter coast�l"utietn�s�oi�
Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal

Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d)(5) states development shall not interfere with existing public rights of access to, or
use of, navigable waters or public resources.
Consistent: The development proposed will not interfere with public rights of access and
will enhance accessibility for the property owners and other users of the property.
Paragraph (d)(6) states no public facility shall be permitted if such a facility is likely to require
public expenditures for maintenance and continued use, unless it can be shown that the public
purpose served by the facility outweighs the required public expenditures for construction,
maintenance, and continued use.
Consistent: The proposed development is intended for private use.
Paragraph (d)(7) states development shall not cause irreversible damage to valuable, historic
architectural or archaeological resources as documented by the local historic commission or the
North Carolina Department of Cultural Resources.
Consistent: There are no known archaeological or historical resources on the property.
Paragraph (d)(8) states established common-law and statutory public rights of access to the public
trust lands and waters in estuarine areas shall not be eliminated or restricted. Development shall
not encroach upon public accessways nor shall it limit the intended use of the accessways.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d)(9) states within the AECs for shoreline contiguous to waters classified as ORW by
the EMC, no CAMA permit shall be approved for any project that would be inconsistent with rules
adopted by the CRC, EMC, or MFC for estuarine waters, public trust areas, or coastal wetlands. For
development activities not covered by specific use standards, no permit shall be issued if the
activity would, based on site specific information, degrade water quality or outstanding resource
values.
Consistent: The proposed development is not within waters classified as ORW by the EMC,
and is covered by specific use standards.
Paragraph (d)(10) states within the Coastal Shorelines category (estuarine and public trust
shoreline AECs), new development shall be located a distance of 30 feet landward of the normal
water level or normal high-water level, with the exception of the following. Of these exceptions,
(A), (D), and (F) pertain to this project, and those exemptions not listed are not applicable to this
project.

Exemption (d)(10)(D) states elevated, slatted, wooden boardwalks exclusively for pedestrian use
and six feet in width or less.
Consistent: The proposed pedestrian ramp for pier access is 5' in width and constructed of
elevated, slatted, wooden decking.
Exemption (d)(10)(F) states decks/observation decks limited to slatted, wooden, elevated, and
unroofed decks that shall no singularly or collectively exceed 200 ftz.
Consistent: The proposed stairway to the lower yard terrace will be constructed of slatted,
wooden decking, will be unroofed, and will have an area of 80 ftz which is below 200 ftz. No
other wooden decking current exists within 30 feet landward of the normal water line
except for access stairs off of the pier which will be removed with the construction of the
aforementioned wooden ramp for pier access.
Based on my review of the applicable subsections of the North Carolina Administrative Code, the
permit application and plans, I recommend a permit be issued to Brymar Properties of Virginia,
LLC for the development as proposed.

terminus platform, a 4 foot by 22 foot platform and a 6 foot by 18 foot platform, a
12 foot by 12 foot boatlift, a 16 foot by 16 foot boatlift, and two (2) 6 foot by 8 foot
personal watercraft (PWC) lifts, and replace 126 feet of 6 foot wide pier decking
on the Roanoke Sound, and remove existing stairs and construct a 5 foot wide by
20 foot long ramp and an 8 foot wide by 10 foot long stair; on the property at 27
Ballast Point Drive, in the Pirate's Cove subdivision, in the Town of Manteo.
DATE: March 23, 2021
Consistency Determination: The request is consistent with/not in conflict with the Town of
Manteo 2007 Land Use Plan certified by the CRC on July 27,
2007, as amended through February 12, 2009.
Overview: The .34 acre (15,000 sq. ft.) subject property has 147 linear feet of shoreline along the
Roanoke Sound. Water depths range from 2 to 5 feet below Normal Water Level (NWL) between
the shoreline and a distance of 140 feet from shore. Site elevations range from 3 feet above NWL
to greater than 10 feet above NWL in the high ground areas. The site is vegetated with lawn
grasses and small shrubs. A shoreline fringe is located in the AE (4) Floodzone with the
remainder of the property located outside of a Floodzone.
Existing site improvements consist of an elevated two-story single-family house with stacked
decks, a pool with a concrete surround, a cemented driveway, ground terracing with
approximately 152 linear feet of vinyl retaining wall, and two (2) sets of stairs. One stair connects
the upper and lower ground terraces and the other connects the upper terrace to the pier. Existing
shoreline improvements consist of bulkhead, four (4) groins, three (3) breakwaters totaling 100
feet in length, and a 6 foot wide by 126 foot long pier with a 10 foot by 40 foot terminus platform
and five (5) tie pilings creating two (2) formalized slips. The groins are derelict and the breakwater
sills are dilapidated. The bulkhead and breakwater system were permitted in 1995 under CAMA
General Permits #14112A, #14386A and #149131A, the pier and platform ware permitted in April

2004 under CAMA General Permit #37464A, and a revised platform with tie pilings was permitted
in July 2004 under CAMA General Permit #38259A.
Removal of existing groins, breakwater sills, terminus platform, pier decking, and stairs,
installation of three (3) breakwater sills totaling 166 linear feet, a 16 foot by 28 foot terminus
platform, a 4 foot by 22 foot platform and a 6 foot by 18 foot platform, a 12 foot by 12 foot boatlift,
a 16 foot by 16 foot boatlift, and two (2) 6 foot by 8 foot personal watercraft (PWC) lifts,
replacement 126 feet of 6 foot wide pier decking, and construction of a 5 foot wide by 20 foot long
ramp and an 8 foot wide by 10 foot long stair are proposed. A 42 foot long, a 100 foot long, and
a 24 foot long section of breakwater will be provided. Gaps of 1 inch will be provided for every
foot along the breakwaters. All sections will be placed an average of 20 feet and a maximum of
25 feet waterward of NWL. The sections will have 5 foot openings and will overlap each other by
10 feet. The three (3) platforms will be configured to create an "L"-shape at the pier terminus.
The lifts will create a total of four (4) docking spaces on the property. The pier supports will
remain, only the decking will be replaced. The ramp will replace the existing stairs providing
access from the upper terrace to the pier and stairs will be provided to provide better access
between the upper and lower terrace.
The waters of Roanoke Sound in this area are classified as SA:HQW and Joint Waters and are
open to shellfish taking. A Submerged Aquatic Vegetation (SAV) surrey was conducted and no
SAV was reported to be growing in the project area, though the property is adjacent to an area
designated by the NC Division of Marine Fisheries as SAV habitat. A review of historic and
archaeological resources was not provided.
Anticipated impacts resulting from this project are expected to include: the filling of 166 sq. ft. of
Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the shading of 1,140
sq. ft. of Public Trust Area/Estuarine Waters AEC, and; the disturbance/shading of 180 sq. ft. of
High Ground within the Estuarine Shoreline AEC.
The existing pier shades 756 sq. ft. of Public Trust Area/Estuarine Waters AEC.
No impervious surface coverage is proposed.
Basis for Determination:
The subject property is designated as "Single Family Residential', on the "Town of Manteo Future
Land Use Map." As indicated on Page 129, this designation has a density of 4-6 units per acre

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Permit application for proposed actions that may impact fish and fish
habitats. The proposed work is located 27 Ballast Point Drive, in the Town of Manteo, Dare
County, North Carolina. The applicant is proposing to construct three new sections of vinyl
breakwaters (one 42 foot section, one 24 foot section, and one 100 foot section), three new
platforms (one that is 28 feet by 16 feet, and two lower that are 22 feet by 4 feet and 18 feet
by 6 feet) at the end of the existing pier, two boat lifts, and two personal watercraft lifts. No
submerged aquatic vegetation (SAV) was observed in the area. The waters at this site are
classified as SA;HQW and are open to shellfish taking.
DMF has concerns with the proposed breakwater replacement. First, the proposal
indicates that the replacements would extend to two feet above the normal water line
(NWL). DMF recommends that the design be adjusted so that the top of these structures do
not extend to more than one foot above NWL. Second, DMF recommends that the
permitted design include gaps of four to six (4-6) inches every 25 linear feet to allow for
fish movement. Finally, DMF would recommend ensuring that there is sufficient reflective
marking on the breakwaters for navigational safety.

Please reference the application of Mr. Mark Compton for Department of the Army
authorization and a State Water Quality Certification to construct three new sections of vinyl
sills (42', 100', and 24') placed parallel to the shoreline, three new platforms at the end of the
existing pier, two boat lifts, and two personal watercraft (PWC) lifts adjacent to those
platforms, at 27 Ballast Point Drive, adjacent to the Roanoke Sound, in Manteo, Dare County,
North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or
'--V%
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this
permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in McML.IWOOD
considered significant.

11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
12. In order to protect the endangered West Indian manatee (Trichechus manatus) the Permittee
shall implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at http://www.fws.gov/nc-

8. PROJECT SUMMARY: The applicant proposes the construction of three new sections of
vinyl sills placed parallel to the shoreline. They also propose the construction of three new
platforms at the end of the existing pier, two boat lifts, and two personal watercraft (PWC)
lifts adjacent to those platforms. In addition to the water -dependent structures, the
applicant proposes to replace existing stairs currently providing access to the pier with a
ramp and construct a new staircase in the center of the property providing access to the
lower terrace of the yard.
Project Setting
The proposed development is located at 27 Ballast Point Drive (portions of Lots 27 & 28)
within the Ballast Point Phase 1 Section of Pirate's Cove subdivision. The property is within the
town of Manteo, Dare County, and is adjacent to the Roanoke Sound.
The property is platted at ± 15,000 ft2 (± 0.34 acres) and contains ± 147' of shoreline.
Elevations ranges from ± 3' at Normal Water Level (NWL) to >_ 10' above NWL in the high
ground areas. A portion of the high ground is terraced into two levels by a vinyl retaining wall.
Man-made features within the property include a multi -level, single-family residence with stacked
decks, a pool area with a concrete surround, and cemented driveway. The property is vegetated
with landscape shrubs and domestic lawn grasses.
The shoreline of the property is hardened and contains man-made features including a
bulkhead, four derelict groins, and three dilapidated wooden breakwater sills (± 100'). Other
features include a pier (accessed by a set of stairs), a platform, and five tie pilings creating two
formalized slips, all located to the eastern side of the shoreline.
The applicant purchased the property in August 2020. No permit history was submitted by
the applicant, but a search of CAMA records found two general permits issued in 2004 to
previous property owner Mr. Brett Meisenheimer for water dependent structures. CAMA General
Permit #37464A was issued on 4/01/2004 for the construction of a 130' pier with a 10'x20'
platform and two 8'x10' finger piers. Shortly thereafter, CAMA General Permit #38259A was
issued on 7/15/2004 for the construction of a 130' pier with a 10'x40' platform, and four tie pilings
which is consistent with the existing structures. A further search found three permits from 1995
issued to a previous property owner Roanoke Properties CAMA General Permit #14112A,
#14386A, and #14913A permitted bulkheads and breakwater systems on portions or all of Lots
27, 28, and other adjacent lots.
The waters of the Roanoke Sound are joint waters, classified as SA & HQW, and are
open to shellfish taking. The property is located on the northern end of a peninsula and it is over
two miles across the water body to the opposite shoreline. The bottom substrate is hard bottom
sand and water depths within the project site range from ± 2' to ± 5' below NWL. No wetlands
were found to exist along the shoreline. A submerged aquatic vegetation (SAV) survey was
conducted and no rooted SAV was reported to be growing in the project area at that time. The
property is adjacent to an area designated by NC Division of Marine Fisheries as SAV habitat.
The shorelines of adjacent properties are also hardened with bulkheads and similarly developed
with piers, platforms, groins, and breakwater sills. rdECEIVED

Development Proposal
The applicant is proposing to remove the existing breakwater sills and groins along the
shoreline of the property, and construct three new sections of slotted vinyl and timber pile
supported breakwater sills. A 42' section is proposed on the western side of the property,
followed by a centrally located 1 00'section, and ending with a 24' section on the eastern side. All
sections will be placed an average of 20' waterward of NWL with a maximum distance of 25 feet.
The sill sections will have five foot openings and will overlap each other by ten feet.
Other proposed development includes the removal of the existing platform and the
construction of a new 28' x 16' platform with two lower platforms (22' x 4' & 18' x 6') forming an
"L" shape on the western side. The applicant also proposes the installation of two uncovered
boat lifts located to the west and east of the new platforms. The proposed boat lift dimensions
are 12' x12' to the west and 16' x 16' to the east. Two uncovered personal watercraft (PWC) lifts
are also proposed with each lift measuring 8' x 6' and located on the southern edge of the lower
platform. This would create a total of four designated docking spaces on the property.
In addition to the water dependent developments, the applicant also proposes to replace
the existing stairs currently providing access to the existing pier with a 20' x 5' ramp. A new set of
10' x 8' stairs is also proposed between the upper terraced level and the lower terraced level to
provide better access to the lower yard. No impervious coverage is being proposed.
Water depths at the proposed development locations are ± 2' to ± 3' within the
breakwater sills area and ± 4.5' to ± 5.25' below NWL in the platform and lift areas. No rooted
SAV or wetlands were observed on the property or within the waters of the project area. The
decking and girders on the existing pier will be replaced during the construction period with the
dimensions remaining unchanged. The existing and proposed structures are similar to the others
in the area and the length of the proposed development meets the ''Y4 width rule. Waivers have
been requested and were granted by the adjacent property owners allowing for placement of the
proposed breakwater sills within the 15' setback. The proposed docking facility is ± 93' and
± 106' away from any adjacent docking structures.
Anticipated Impacts
• The proposed docking facility (consisting of three platforms and excluding the pier) will
shade 644 ft2 of Estuarine Waters and Public Trust Area AEC's.
• The installation of the proposed boat lifts and PWC lifts will increase the total number
of formalized docking spaces from two slips to four slips.
• The construction of the proposed pier access ramp and stairs to lower terraced area
will result in disturbance/shading of 180 ft2 within the 30' AEC Buffer.
• The construction of the proposed breakwaters along the proposed alignment will result
in the disturbance of 166 ft2 of shallow water bottom within the Estuarine Waters and
Public Trust Area AEC's.

The Project Site is a 0.34-acre parcel owned by Brymar Properties of Virginia, LLC and located ' lr
at 27 Ballast Point Drive (Pirates Cove Subdivision) in Manteo, Dare County, NC. The Site is
waterfront, located on the Roanoke Sound side of the Subdivision.
Current site conditions include a two-story single-family residence with landscaped shrubs and
maintained grasses, a pool and associated concrete decking, a two-tier bulkhead, a dilapidated
slotted breakwater system, and pier/platform with two existing boat slips. There are no coastal
wetlands or non -coastal Section 404 wetlands present onsite. Adjacent properties to the north
and south consist of single-family residences with bulkheading, breakwaters, and piers.
Proposed Work
The proposed work requiring a CAMA Major Permit includes the removal of all dilapidated
breakwaters and groins along the shoreline of the subject property. The breakwaters will be
replaced with three new sections of slotted vinyl breakwater walls (timber pile -supported). The
42 LF section is proposed on the west side of the property, with a central 100 LF section and a
24 LF section on the eastern side of the property. The two end sections would extend to the
property line as shown on the accompanying plan. All breakwater replacement work has the
support of the adjacent riparian owners who are providing waivers and no objection statements
for work within the riparian corridors.
The owner also proposes to repair the existing 126 LF pier (decking and supports only- piles are
satisfactory and will remain) and remove and replace the platform at the end of the existing pier.
The new proposed platform would be 28 LF by 16 ft, with a 196 SF L-shaped lower platform
accessed by a 3 ft wide aluminum ramp. Along this new platform, two boat lifts (one 12 ft by 12
ft, and one 16ft by 16 ft) and two personal watercraft (pwc) lifts are proposed. Also proposed
are a ladder for water access and a fixed table as shown on the plan. In addition to the water
dependent structures, the owner proposes to replace the existing stairs that access the pier with
a ramp and add a new staircase in front of the existing pool to better access the lower yard.
There is no new impervious coverage associated with the project.
Purpose and Need
The property owner's current pier and breakwaters are in need of repair and replacement. The
breakwaters are dilapidated and are not functioning properly any more and the pier decking is
twisted and needs to be replaced. The new pier platform system will also allow for better safe
dockage, including two boats and two pwc's by installing lifts and a lower platform to reduce the
height above water for access. The new breakwaters would help to protect the property and will
remove the current failing ones that have become a hazard. This property and the nearby ones
at the end of Ballast Point are exposed to WNE wind driven waves in addition to boat wake
forces. At least two of the owners to the southeast have similarly replaced their breakwaters in
the recent past for the same reasons. This new breakwater system will include deep pile
penetration and salt tolerant materials that will significantly improve the lifespan of the
structures.

The NC Division of Coastal Management hereby acknowledges receipt of your application
submitted for State approval for development to construct three platforms, two boatlifts, two
Personal watercraft lifts and stabilized the shoreline with vinyl sills at 27 Ballast Point Drive in the
Town of Manteo in Dare County.
It was received complete February 11, 2021 and appears to be adequate for processing at this time.
The projected deadline for making a decision is April 27, 2021. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from February 11, 2021, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
