This permit, issued on January 6, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation rf these terms may be subject to tines, imprisonment or civil action; or may cause me permit io De nuts anu vuiu Excavation 1) In order to protect juvenile shrimp and frnfish populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) No excavation shall take place outside of the area indicated on the workplan drawings, including the access channel defined on the attached workplan by existing channel markers. 3) Excavation shall not exceed -5 feet below the mean lower low water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Brandywine Marina Association Permit No. 1-21 Page 2 of 4 ADDITIONAL CONDITIONS 4) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 5) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters. 6) This permit was issued based upon at determination that while the area to be excavated is immediately adjacent to areas containing actively growing submerged aquatic vegetation (SAV) beds, the area of proposed excavation would not directly impact actively growing SAV beds. During all authorized excavation events, the permittee shall implement all available precautions to ensure that damage to SAV beds does not occur. Should dredging outside the authorized template be proposed in the future, the permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging within SAV beds. 7) The permitte shall ensure that construction activities do not result in shoaling of dredged material within the federal channel (Atlantic Intracoastal Waterway). Material shall not be pushed into the federal channel Spoil D1sAosal 8) The permittee shall coordinate with the Town of Morehead City to determine if zoning permits are required if the spoil disposal site is within a special flood hazard area, and a copy of any authorization shall be provided to the Division of Coastal Management prior to inspection of the spoil disposal site. 9) No spoil material shall be placed within 30 feet of the normal high water line. 10) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the site is graded and stabilized. 11) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 12) The permittee and/or their contractor shall take all necessary precautions to ensure that the spoil material is properly contained during transport to the disposal site, and that all the proper coordination has taken place with the local or state governments to ensure that any damage to public streets caused by transport of the spoil material has been addressed. 13) In order to protect waters adjacent to the designated dredge spoil disposal site, the permittee shall provide the Division of Marine Fisheries — Shellfish Sanitation and Recreational Water Quality Section the dredge plan and the location of the spoil disposal site prior to any dredging activity, so a swimming advisory or shellfish closure determination can be made, and documentation of tXEM*6on provided to the Division of Coastal Management. JAN 14 2021 DCM-MHD Brandywine Marina Association Permit No. 1-21 Page 3 of 4 ADDITIONAL CONDITIONS Sedimentation and Erosion Control 14) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 15) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 16) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. Maintenance Clause 17) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. General 18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 19) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 20) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the U.S. Army Corps of Engineers. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0994. The DWR 200006797 file drawing sheet 3 of 3 the drawing (attached) shows a revision date and an original date of 11/30/93. Unfortunately, our 1994 file does not contain any drawings however they appear to originate from the 1994 file based in the revised date in the 200 file. The CAMA GP for maintenance excavation 7H .1500 specific condition #8 limits dredge depths to -6 feet ati1VILW/ , The -5 MLW depth shown on the attached drawing appears to be more consistent with the need to conduct C/ maintenance dredging events less than 1000 cubic yards and existing depths (2020) within the marina basin where the shoreline has been stabilized for many years. `Have the LAMA general permits for maintenance been issued to maintain dgpyths within the basin,$ he entrance channel, the access channel or all of the abpve%The proposed final dredge depth 0 -7 feet within the'Goat%asin and narrow basin entrance may restrict flow and flushing during the tidal cycle. The North Carolina water quality standards state that DO shall be "Not less than 5.0 mg/I, except that swamp waters, poorly flushed tidally influenced streams or embayment's, or estuarine bottom waters may have lower values if caused by natural conditions" (NCDENR, 2007). The DO standard of 5.0 mg/I is based on a daily average. Anticipated violations of DO or other water quality standards could result in denial of a 401 Certification for a proposed marina. It has been recognized that the DO standard may be difficult for many two or more segment marinas to achieve because reduced water circulation favors stagnation and oxygen demands can cause DO inside poorly flushed basins to be lower than in adjacent waters (NCDEM,1990). Although the marina is existing, the DO standards for the marina may not have been adequately evaluated at the time the original 1987 permit was issued. Additionally, the proposed depth of -7' at MLW has not been maintained since the ba ' cess channel were originally dug, the LAMA GPs for maintenance would have limited the dredge depth to - ' at MIL ithin the dredge footprint. Consideration should be given to the need to dredge to proposed depth of -7 t . It would appear that these depths have not been maintained since 1987. The marked access channel,would have an excavation area of 11000' x 6Q' and a final depth of -7' nlw' with a total of 6,667 cubic yards removed. AECs involved include Public Trust Areas and Estuarine Waters. Bogue Sound is classified as SA/HQW Waters by DWR. This part of Bogue Sound is not a designated Primary Nursery Area and is open to the taking of shellfish, however, the areas within the entrance canal and marina basin are closed. The bottom is a sandy substrate. No shellfish resources were noted within the marina basin or within the entrance canal and channel. Anticipated impacts: The proposed excavation would produce temporary turbidity in the water column and cause 104,000 square feet of disturbance to shallow bottom and open water. A total of11,408 cubic yards of material would be removed to a final depth of -7' nlw. No coastal wetlands would be impacted during this project and there would be no impact to SA V or shellfish resources. Spoils would be barged and offloaded at a preapproved site that would not involve the fill of noncoastal wetlands or allow runoff into the adjacent waterbody. The proposed project occurs within an area that has historically supported submerged aquatic vegetation (SAV), primarily in the vicinity of the access channel and entry basin (see attachment). SAV is a highly valuable habitat, both environmentally and economically. These habitats provide nursery, foraging, and/or spawning areas for various recreationally and commercially important fish and invertebrate species. Additionally, SAV plays a critical role in natural erosion control and shoreline stabilization, as well as water quality enhancement, primary production, and nutrient cycling. Therefore, it is crucial that SAV habitat be protected, in order to maintain these critical environmental contributions. Prior to the commencement of dredging activities, a survey for SAV should be completed and the results of that survey should be provided to DMF, as well as any additional interested agencies/parties. This survey should be completed during the active growth period (April through October). The DWR has concerns regarding the proposed final dredge depth of -7 feet at NLW. The DWR 2000697 file drawing sheet 2 of 3 (attached) shows a depth of-5 feet MLW within the access channel. The DWR 200006797 file drawing sheet 3 of 3 the drawing (attached) shows a revision date and an original date of 11/30/93. Unfortunately, our 1994 file does not contain any drawings however they appear to originate from the 1994 file based in the revised date in the 2000 file. The CAMA GP for maintenance excavation 7H .1500 specific condition #8 limits dredge depths to -6 feet at MLW. The -5 MLW depth shown on the attached drawing appears to be more consistent with the need to conduct maintenance dredging events less than 1000 cubic yards and existing depths (2020) within the marina basin where the shoreline has been stabilized for many years. Have the CAMA general permits for maintenance been issued to maintain depths within the basin, the entrance channel, the access channel or all of the above? The proposed final dredge depth of -7 feet within the boat basin and narrow basin entrance may restrict flow and flushing during the tidal cycle. The North Carolina water quality standards state that DO shall be "Not less than 5.0 mg/I, except that swamp waters, poorly flushed tidally influenced streams or embayment's, or estuarine bottom waters may have lower values if caused by natural conditions" (NCDENR, 2007). The DO standard of 5.0 mg/I is based on a daily average. Anticipated violations of DO or other water quality standards could result in denial of a 401 Certification for a proposed marina. It has been recognized that the DO standard may be difficult for many two or more segment marinas to achieve because reduced water circulation favors stagnation and oxygen demands can cause DO inside poorly flushed basins to be lower than in adjacent waters (NCDEM, 1990). Although the marina is existing, the DO standards for the marina may not have been adequately evaluated at the time the original 1987 permit was issued. Additionally, the proposed depth of -7' at MLW has not been maintained since the basin and access channel were originally dug, the CAMA GPs for maintenance would have limited the dredge depth to -6' at MLW within the dredge footprint. Consideration should be given to the need to dredge to proposed depth of -7' at NLW. It would appear that these depths have not been maintained since 1987. The survey should be within the channel markers and extend to the AIWW to achieve connecting waters. Unfortunately it took some time to figure out the reason for the error on the applicant side and I just received a response yesterday. Narrative Description: The Brandywine Marina Association project is located off highway 24 at 107 Brandywine Marina Drive in Morehead City, Carteret County. The project area is found by turning south off of Highway 24 East in Morehead City into the main entrance road for the Brandywine Bay subdivision which is also known as Bay Drive. Follow Bay Drive for approximately 900 feet and Field Investigation Brandywine Bay Marina Association Page 02 turn right onto Marina Drive. The subject property is an existing developed subdivision with individual single-family homes and a 40-slip residential marina within an upland basin. Along the high ground portion of the site is existing development consisting of a parking area, boat ramp, bulkhead, and a 40-slip marina with docks. South of the basin in Bogue Sound there is an existing breakwater and there is a designated marked entrance channel. This excavation was originally authorized by Dredge and Fill Permit # 3-87 issued in 1987. The excavation was authorized within the entrance channel, entrance canal and marina basin to a final depth of -7' nlw. These areas have been routinely maintained by excavation of 1,000cy or less of the shallow areas through the CAMA General Permit process throughout the years. The water depths along this shoreline currently range from - 2.5' nlw to -4' nlw. The Division of Water Quality classifies this area as SA/HQW Waters. This part of Bogue Sound is not a designated Primary Nursery Area and is open to the taking of shellfish, however, the areas within the entrance canal and marina basin are closed. The bottom is a sandy substrate. The Town of Morehead City Land Use Plan classifies this area as Low Density Residential with Conservation within the AEC. No shellfish resources were noted within the marina basin or within the entrance canal and channel. The shoreline for the entire tract is approximately 890'. There are single-family homes to the east and the west of the project site. The beginning of the offshore access channel is located 750 feet north of the AIW W. 10. Project Description: To improve safety and navigation, the Brandywine Marina Association is proposing to perform maintenance excavation to remove sandy bottom substrate material from the existing upland marina basin, entry basin and access channel. The average existing water depths within these areas range from -4nlw in the upland basin, -2' nlw to -3' nlw within the entry basin, and depths from -3nlw to -7nlw within the access channel . The connecting water depths at the channel entrance are-7'nlw. A total sum of 11,408 cubic yards of bottom substrate material would be removed from all proposed dredge areas with 6,667 cubic yards removed from the access ,channel, 4,000 cubic yards removed from the entrance basin and 741 cubic yards removed from the marina upland basin. The marked access channel would have an excavation area of 1,000' x 60' and a final depth of -7' nlw' with a total of 6,667 cubic yards removed. The entry basin would have an excavation area of 480' x 50' x -7' nlw and a total of 4,000 cubic yards removed. The upland marina basin would have an excavation area of 250' x 80' x - 7' nlw and a'total of 741 cubic yards of material removed. The final depth for the all the excavation' areas would be —7' feet nlw which is the connecting water depth. Per the applicant, the maintenance excavation would be done via the bucket to barge method and either hauled off by trucks or by barge to a pre -approved spoil disposal site. 11. Anticipated Impacts: The proposed excavation would produce temporary turbidity in the water column and cause 104,000 square feet of disturbance to shallow bottom and open water. No coastal wetlands would be impacted during this project and there would be no impact to SAV or shellfish resources.
