attached workplan drawings (4), Drawings 1-3 of 3 dated 9/15/20, and Drawing 4 of 4 dated "Received DCM Wilmington" 11/12/20.
This permit, issued on April 1, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)I mese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Reconstruction and Expansion
1) This permit authorizes only the docks, piers, boatlifts, floating platforms, and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility expansion
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) This permit authorizes a maximum of six (6) formalized boat slips.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
7) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
8) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as
measured from the bottom of the decking.
9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
USACE / FEDERAL CONDITIONS
10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
14) All debris associated with the removal and construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.

ADDITIONAL CONDITIONS
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2020-02070).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1881.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

Recommendations for State Permit— Jim Brady 1111812020
The total area of floating dock and platform was calculated as follows:
Shoreline length = 450' x 8' = 3,600 ft2 allowable
Fixed pier =131' x 6'= 786 ft2 (credit)
Fixed platform =16' x 14' = 224 ft2
Floating dock = 8' x 62' = 496 ft2
Boat lift =14' x 14' =196 ft2 (not counted)
Boat lift =14' x 14' = 224 ft2 (not counted)
Total = 720 ft2
The replacement would provide docking space for the total up to six (6) vessels at this location. It appears that the project is
consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the'% width rule, the eight square foot rule
and the pier width rule. The proposed structures would be located entirely over open water. If the project is determined to
be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include the standard pier
and dock conditions.

The Division of Water Resources (DWR) has received a copy of your CAMA Major application
request dated received by this office on November 20, 2020. DWR issues approval in the form
of a Water Quality Certification (WQC) in conjunction with the CAMA Major Permit and General
Permit(s) 198000291 or 197800056 issued by the US Army Corps of Engineers (USACE). This
Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in
your application do not require written authorization to utilize GC 4175. However, you are required
to follow the conditions listed in the attached certification. You should get or otherwise comply
with any other federal, state and local requirements before you go ahead with your project
including (but not limited to) erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at htto://www.ncoah.com/
or by calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A

The applicant proposes to remove the existing docking facility and construct a new fixed

located at 49 Pipers Neck Road, adjacent to Banks Channel and Middle Sound at Figure
Eight Island, New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are ES, EW, and
PTA. Waters at the project site are classified as SA-ORW and are open to the harvesting
of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the New Hanover County
Comprehensive Land Use Plan and offer the following comments.
The general area of the project is classified as Developed while the AECs impacted by
the work are classified as Conservation.
In general, New Hanover County allows development in Conservation classified AECs,
which is consistent with the State's minimum use standards. The New Hanover County
Comprehensive Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
This project is consistent with the New Hanover County Comprehensive Land Use Plan.

9. PROJECT DESCRIPTION:
The project site Is located at 51 Pipers Neck Road on Figure Eight Island, adjacentto Banks Channel and Middle
Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road
(SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which
traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south
approximately 1.5 miles. Turn right onto Little Neck Road and then take a left onto Pipers Neck Road and
continue until you reach the property which will be located on the right at the end of the cul-de-sac.
The property borders a man-made bay located on the southern end of the island, which connects to Banks
Channel and Middle Sound. According to the applicant the lot is approximately 0.75 acres in size and averages
4' above normal high water (NHW). The property has an existing single family home, limber bulkhead, and 3-slip
docking facility that includes a boatlift and run-up boat platform. Vegetation on the property landward of the
bulkhead consists of lawn grasses and ornamental landscaping. Waterward of the bulkhead, in the area of the
existing docking facility, a 13' wide strip of high Coastal Wetland consisting mostly of open sand with patchy
saltmeadow cordgrass (Sparfina patens) descends to the NHW line and slopes into an approximately 25' wide
unvegetated tidal swale and then rises slightly into a 33' wide band of Coastal Wetland comprised mostly of
smooth cordgrass (Spartina altemaflora).
The applicant's current docking facility is located within the manmade bay area. The fixed pier is 6' wide and
extends 105' from the bulkhead perpendicular to the shoreline and terminates in a 8' by 10' fixed 'T-head'
platform. A ramp extends from the fixed platform to a 12' by 26' floating dock oriented parallel with the shoreline.
Located on the south end of the floating dock is an approximately 10' by 15' run-up boat platform and 13' by 13'
boatlift located on the southwest side of the float (see sheet 3), The current docking facility accommodates up to
three (3) vessels and was originally authorized with a shorterfloating dock fortwo (2) vessels by General Permit
No. 28399 Issued on 10/12/2001. According to the applicant the parcel has approximately 450 linear feet of
shoreline stabilized with a bulkhead, 80 linear feet of which was replaced adjacent to Banks Channel on the
western side authorized under General Permit No. 35019 on 9/19/2008. In August of 2016, 93linear feet of new
Vinyl bulkhead was authorized to replace a section of failing timber bulkhead on the north west side of the
property under General Permit No. 67153.
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at
the property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the
Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of
Marine Fisheries and they are OPEN to the harvest of shellfish,
PROPOSED PROJECT:
The applicant proposes to remove the existing docking facility and construct a new fixed pier, "L-head"
platform, floating dock, and two boatlifts for a total of 6 boat slips. The existing docking facility would be
entirely removed and replaced with a new fixed pier angling south approximately 80 degrees perpendicular
to the shoreline measuring approximately 131' in length by 6' in width. The proposed fixed pier would
terminate in an "L-head" platform, measuring approximately 16' in length by 14' in width with a ramp to
floating dock, measuring 62' in length and 8' in width running approximately parallel to the shoreline. A 14'
by 14' boatlift is proposed to be installed on the northern end of the floating dock and a 14' by 16' boatlift is
proposed for the southern end of the floating dock. The proposed new docking facility would provide docking
space for up to six (6) vessels.

The application states that the existing water depth in the area of the proposed docking structures would be
approximately -5.0' at normal low water (NLW) (See Sheets 1 through 3),
10. ANTICIPATED IMPACTS:
The proposed structures would incorporate approximately 1,804 ft2 of Estuarine Shoreline, Estuarine Waters and
Pubic Trust Area, within the same general area of the existing docking structures. The proposed structure would
angle slightly to the south, extending approximately 80' into a waterbody from NHW, which measures
approximately 328' across. This distance would conform to both the 1l4 rule and the established pier lengths.
The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement.
Minor increases in turbidity should be expected during construction.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Jim
Brady, for State approval for development of the subject property located at 49 Pipers Neck Road, adjacent to the
Atlantic Intracoastal Waterway (AIWW) and the mouth of Bradley Creek, in Wilmington, in New Hanover County. It
was received as complete on November 12, 2020 and appears to be adequate for processing at this time. The
projected deadline for making a decision is January 26, 2021. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 12, 2020, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
