Dr. in Pamlico Bluffs S/D, in Blounts Creek as requested in the permittee's application dated 12/30/20,
including attached workplan drawings (5), Pages 1-5 of 5 all dated 2/20/21.
This permit, issued on July 23, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization — Rip Rap with Section 404 Wetland Fill
1) The alignment of the toe of rip rap shall be positioned no less than 50 feet landward of the normal
water level at any point along its alignment.
2) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved
bulkhead alignment.
3) No open water shall be excavated or filled, even temporarily.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

4) The alignment of the authorized rip rap shall be staked by the permittee and verified by a representative
of the Division of Coastal Management within a maximum of 30 days prior to the start of construction.
Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions,
shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30
days prior to the new expected start of construction.
5) The fill material shall be clean and free of any pollutants except in trace quantities.
Upland Development - Walkway
6) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the walkway, all as
expressly and specifically set forth in the attached permit application and workplan drawings.
Docking Facility
7) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust
waters without permit modification.
8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
9) This permit authorizes a maximum of 2 formalized boat slips.
10) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the
authorized workplans.
11) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
13) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
14) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to
the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat
does not result from the construction and/or operation of the authorized facilities. Should dredging of
these areas be proposed in the future, the permittee is further advised that the Rules of the Coastal
Resources Commission prohibit new dredging within SAV beds.

15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
16) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to the NC Division of
Water Resources.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-01909).
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations
in place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Mr. Linwood Boyd has submitted a CAMA Major Permit application for the installation of riprap for
shoreline stabilization, a hog slat access path to the water, and a pier with platform, boat lift and boat house. The
property is located off Gilead Shores Rd (SR 1119), Lot 5 on Friedman Drive in Pamlico Bluffs subdivision, in
Blounts Creek, Beaufort County, North Carolina.
This office has reviewed the proposed project with regard to rules found in Subchapter 7H concerning
development in a Coastal Shoreline. It is staffs recommendation that the proposed project is consistent with
07H.0208 (6)(B) which states in part "The total square footage of shaded impact for docks and mooring facilities
(excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of2,000 square
feet." Staff also recommends that the proposed project is consistent with 15A NCAC 07H .0209 (e) which states
"The buffer requirements in paragraph (d) of this rule shall not apply to Coastal Shorelines where the EMC has
adopted rules that contain buffer standards". If the proposed project is approved by the N.0 Division of Water
Resources and the U.S. Army Corps of Engineers niles and regulations, this office recommends issuance of the
Permit with standard riprap permit conditions.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Permit application for proposed actions that may impact fish and fish
habitats. The proposed work is located at lot 5 on Friedman Drive, Blounts Creek, Beaufort
County, North Carolina. The applicant is proposing to add ± 200 linear feet (LF) along the
shoreline approximately 50 feet from the normal water line (NWL), install a 160 foot -long
pier that is six feet wide, a 20 foot by 20 foot platform, a 13 foot by 13 foot boatlift, and a 28
foot by 14 foot covered boathouse. The waters at this location are classified as SB NSW,
and are not open to shellfishing.
The location of the proposed work is within Blounts Creek, which has been designated as a
Secondary Nursery Habitat (SNA). SNAs are areas in which the later stages of juvenile
development take place. These areas are often transition zones, containing a mixture of
species at various life stages ranging from juveniles to adults. The shallow waters of SNAs
provide fish species with the ecosystem conditions necessary for post -larval development,
and protection of these habitats is critical to ensure the growth to maturity for numerous
commercially, recreationally, and ecologically important fish species. Therefore, DMF
would recommend that a 1 April through 30 September moratorium be included for all in -
water work.
Additionally, this location has a history of supporting submerged aquatic vegetation (SAV)
habitat. SAV provides many ecosystem services, including providing foraging, nursery, and
refuge habitat for many species. SAV also provides natural erosion protection, nutrient
uptake, and supports epiphytes that can provide water filtration that improves water
quality and clarity. Care should be taken to avoid direct and indirect impacts to SAV during
the proposed construction. Inclusion of the 1 April through 30 September moratorium as a
permit condition would aid in the minimization of impacts to SAV, as this would require in -
water work to occur outside of the active growth season. RECEIVED

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land
Use Plan 2006 Update certified by the CRC on January 13, 2010.
Overview The proposed project is located off SR 1119 at lot 5 on Friedman Drive in the Pamlico Bluffs
subdivision, in Blounts Creek, Beaufort County; along the shoreline of the Pamlico River. There are
currently no man-made features on the project site, however the site is suited for a single-family
residence. The lot is 2.93 acres in size and has a total shoreline length of ±260 linear feet on the Pamlico
River and includes a combination of high and low sediment bank with ranges from 1.0'- 30.0' in elevation
above the Normal Water Level (NWL). The low sediment bank which ranges in width from ±40' on the
northwest side of the property to ±70' on the southeast side is mostly a sandy beach bottom vegetated
with established cypress trees, scrub pines and various woody underbrush. The low sediment bank also
includes some fringe areas of delineated USA COE wooded wetland vegetation. The high sediment bank
is a high bluff shoreline covered with lawn grasses and various hardwood trees. The upstream edge of the
property abuts an access path made from concrete hog slats and the downstream edge of the property is
separated from the neighbor's gravel access path by a low wooded wetland area that drains to the Pamlico
River.
The applicant proposes to rip rap ±200' linear of shoreline along the base of the high sediment bank
which would include the filing of an area of section 404 wooded wetland under jurisdiction of the USA
COE approximately.56' from NWL. The applicant would also like to use the natural slope on the
downstream side of their property to install a 10' wide hog slat access path that borders the wooded
wetland area stopping the path 50' from NWL. The applicant also proposes the installation of a 6' by 160'
pier with a 20' by 20' platform, 13' by 13' boatlift, and a 28' by 14' covered boathouse. The pier, platform,
boathouse and boatlift will be located in estuarine waters and the Public Trust Area.

AECs involved include: Public Trust Area, Public Trust Shoreline, Estuarine Waters, and Estuarine
Shoreline. The project is located within in Tar -Pamlico River Basin and is subject to the Tar -Pamlico Buffer
Rule. The Pamlico River at this site is classified as SB, NSW, is not a primary nursery area and is closed to
shellfishing. A review of shellfish resources, Coastal Wetlands and archaeological/cultural resources in the
area was not provided.
Anticipated Impacts The installation/placement of rip rap at the base of the high bluff will result in
approximately 450ft2 of section 404 wetland fill and small section of the access path will impact ±250ft2
of coastal shoreline. The installation of the pier and docking facilities will result in the shading of ±1752
ft2 of river bottom as well as some short term localized turbidity throughout the construction process.
Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land
Use Map (FLUM) classifies the site as Transition, Conservation I (water protected by Tar -Pam Buffer), and
Conservation II (100-year flood plain).
The following LUP policies may be applicable to this request:
2.1 Conservation I
2.1.3 Only development and land/water use activities that are consistent with the use standards for
coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this
classification. Permitted extractive uses in the Aurora area will continue.
2.2 Conservation II
2.2.2 Only development that is consistent with the use standards for the estuarine shoreline AEC and the
public trust shoreline AEC (15A NCAC 07H .0209(d) is allowed.

Reference the application of Linwood G. Boyd for a Department of the Army permit to
place fill material within freshwater wetlands and construct a pier, platform, boat house and an
access area, on property located at Lot 5 Friedman Drive, adjacent to Blounts Creek, near
Chocowinity, in Beaufort County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
3. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands

shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
5. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
6. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include,:but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
7. Violations of these conditions or,violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Mr. Linwood Boyd has submitted a CAMA Major Permit application for the installation of riprap
rock for shoreline stabilization, an access road, a pier with platform, boatlift and covered boathouse located
on his property off SR 1119 at lot 5 on Friedman Drive in Pamlico Bluffs subdivision, in Blounts Creek,
Beaufort County, North Carolina. There are currently no man-made features on the project site, however the

Both the downstream and upstream properties have installed drivable access paths to the water and
either stabilized their shoreline and added piers with platforms and boatlifts. The upstream property has
upland development and downstream lot does not have any upland development to date.
This area of the Pamlico River is classified as SB NSW by the Environmental Management
Commission at the project site. The Pamlico River is classified as coastal fishing waters at this site and the
site is not located in a primary nursery area. The property is subject to the Tar -Pamlico Riparian Buffer rules
enforced by the N.C. Division of Water Resources.

Lot 5 will be occupied as a private single family residence. At this time
the property is vacant, we plan to build a primary residence on the high
bluff, outside of any buffer or regulated zones.
Item One - to apply rip rap to the base of the bluff to protect and shield

Item Two - to install an access pathway from the top of the bluff to the
water level on the (south)east side of the property. The path will be
approximately 10 feet wide and will be located approximately 50 feet

Item Three - to install a pier for private access by the property owner
that includes a deck, a covered boat lift and an uncovered boat lift. The
pier, deck and boat lift will be very similar in size and design to the
existing pier, deck and boat lift recently constructed on lot six by Randy
Erwin.
On December 2, 2020, Chris Pullinger and Tina Martin with NC Division
of Water Resources, Kelly Spivey and Ashley Grandy of Division of
Coastal Management/NC Dept of Environmental Quality and a
representative of USACOE met on site fulfilling the pre -application

Work Plat - explanation of map legend
Each plat shows numbered posts 1-9 which locate the survey line at the
normal water level. The posts follow the survey line from East to West
and are spaced 30 feet apart.
Page One - "Horizontal Depth" - Bottom of the page shows posts 1-9.
Side of the page shows length going from water landward. The first line
is the 30" riparian buffer "zone 1". The second line is the "tier two" zone.
On the (south) east side the distance to the bluff is 20 feet landward
from the 50 foot riparian buffer to the base of the bluff. The base of the
bluff runs west and narrows to 2 feet from the 50 foot buffer at the west
property line. The top line beginning at the east end is 73 feet landward
and at the west end is 52 feet landward.
Page Two - "Vertical Rise" - Bottom of the page shows posts 1-9. Side of
the page shows height of the bluff. There is a "terrace" from 3 to 9 that is
from about 5 feet above NWL up to about 10 feet. The "bluff' runs from
5 feet high at the east side to a peak of 33 feet in the middle and down to
18 feet on the west side.
Page Three - "Depth to Base of Bluff'- Bottom of the page shows posts
1-9. Also shown are the existing Cypress trees. The distance from the
NWL to the base of the bluff is from 73 feet on the east to 58 feet on the
west.
Page Four - "Vertical Rise" - Bottom of the page shows posts 1-9. Point
"A" at the 30 foot mark landward from the NWL shows the elevation at
point "A". For example at post 4, the elevation at point "A" is 16" above
NWL at 30 feet landward, point "B" rises 7" to 23" at 52 feet landward,
point "C" rises an additional 31" to 54" at 67' landward, point "D" rises
3' at 70' feet landward and point "E" rises 17' to the top of the bluff at
77' landward. Total vertical rise at point Four is 25'. For every post, the
numbers on the left are the progessive distance landward and the
numbers on the right are the progessive vertical rise.
