Permit Class NEW, STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermt"t for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Permit Number 95-21 Issued to Linwood and Diane Boyd, PO Box 564, Hamilton, NC 27840 Authorizing development in Beaufort County at adj. to Pamlico River, at Lot 5 off Friedman Dr. in Pamlico Bluffs S/D, in Blounts Creek as requested in the permittee's application dated 12/30/20, including attached workplan drawings (5), Pages 1-5 of 5 all dated 2/20/21. This permit, issued on July 23, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization — Rip Rap with Section 404 Wetland Fill 1) The alignment of the toe of rip rap shall be positioned no less than 50 feet landward of the normal water level at any point along its alignment. 2) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) No open water shall be excavated or filled, even temporarily. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. AdQl T� Signature ofPermittee Linwood and Diane Boyd ADDITIONAL CONDITIONS Permit No. 95-21 Page 2 of 3 4) The alignment of the authorized rip rap shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 5) The fill material shall be clean and free of any pollutants except in trace quantities. Upland Development - Walkway 6) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the walkway, all as expressly and specifically set forth in the attached permit application and workplan drawings. Docking Facility 7) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) This permit authorizes a maximum of 2 formalized boat slips. 10) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. 11) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 13) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 14) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat does not result from the construction and/or operation of the authorized facilities. Should dredging of these areas be proposed in the future, the permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging within SAV beds. Linwood and Diane Boyd ADDITIONAL CONDITIONS General Permit No. 95-21 Page 3 of 3 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 16) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to the NC Division of Water Resources. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-01909). NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6841 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. Your request to amend permit 95-21 to slope and grade approximately 5,940 ft2 at a 3:1 slope behind the newly install riprap revetment as shown on -your updated plat and cross section drawings dated 19 October 2021 is consistent with 15A NCAC.07H.0209 (d)(3)(3) and is hereby authorized. Please insure that all unconsolidated material is retained on -site by effective sedimentation and erosion control measures and the area is vegetatively stabilized within 30 days of construction completion. The proposed work is located at lot 5 on Friedman Drive, Blounts Creek, Beaufort County, North Carolina. The applicant is proposing to add ± 200 linear feet (LF) along the shoreline approximately 50 feet from the normal water line (NWL), install a 160 foot -long pier that is six feet wide, a 20 foot by 20 foot platform, a 13 foot by 13 foot boatlift, and a 28 foot by 14 foot covered boathouse. The waters at this location are classified as SB NSW, and are not open to shellfishing. The location of the proposed work is within Blounts Creek, which has been designated as a Secondary Nursery Habitat (SNA). SNAs are areas in which the later stages of juvenile development take place. These areas are often transition zones, containing a mixture of species at various life stages ranging from juveniles to adults. The shallow waters of SNAs provide fish species with the ecosystem conditions necessary for post -larval development, and protection of these habitats is critical to ensure the growth to maturity for numerous commercially, recreationally, and ecologically important fish species. Therefore, DMF would recommend that a 1 April through 30 September moratorium be included for all in - water work. Additionally, this location has a history of supporting submerged aquatic vegetation (SAV) habitat. SAV provides many ecosystem services, including providing foraging, nursery, and refuge habitat for many species. SAV also provides natural erosion protection, nutrient uptake, and supports epiphytes that can provide water filtration that improves water quality and clarity. Care should be taken to avoid direct and indirect impacts to SAV during the proposed construction. Inclusion of the 1 April through 30 September moratorium as a permit condition would aid in the minimization of impacts to SAV, as this would require in - water work to occur outside of the active growth season. The lot is 2.93 acres in size and has a total shoreline length of ±260 linear feet on the Pamlico River and includes a combination of high and low sediment bank with ranges from 1.0'- 30.0' in elevation above the Normal Water Level (NWL). The low sediment bank which ranges in width from ±40' on the northwest side of the property to ±70' on the southeast side is mostly a sandy beach bottom vegetated with established cypress trees, scrub pines and various woody underbrush. The low sediment bank also includes some fringe areas of delineated USA COE wooded wetland vegetation. The high sediment bank is a high bluff shoreline covered with lawn grasses and various hardwood trees. The upstream edge of the property abuts an access path made from concrete hog slats and the downstream edge of the property is separated from the neighbor's gravel access path by a low wooded wetland area that drains to the Pamlico River. The applicant proposes to rip rap ±200' linear of shoreline along the base of the high sediment bank which would include the filing of an area of section 404 wooded wetland under jurisdiction of the USA COE approximately.56' from NWL. The applicant would also like to use the natural slope on the downstream side of their property to install a 10' wide hog slat access path that borders the wooded wetland area stopping the path 50' from NWL. The applicant also proposes the installation of a 6' by 160' pier with a 20' by 20' platform, 13' by 13' boatlift, and a 28' by 14' covered boathouse. The pier, platform, boathouse and boatlift will be located in estuarine waters and the Public Trust Area. The base of the bluff runs west and narrows to 2 feet from the 50 foot buffer at the west property line.
