This permit, issued on September 22, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )f these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null ana vora. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 3) This permit authorizes a maximum of three (3).formalized boat slips. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Petmittee Ronald Barrow Permit No. 128-21 Page 2 of 3 ADDITIONAL CONDITIONS 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) The authorized covered platform section shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 6) The roof of the covered platform section shall not be designed for second story use. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 9) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. 10) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 11) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat does not result from the construction and/or operation of the authorized facilities. Should dredging of these areas be proposed in the future, the permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging within SAV beds. Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. USACE Conditions 14) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. Ronald Barrow Permit No. 128-21 Page 3 of 3 ADDITIONAL CONDITIONS General 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. 16) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in appropriate waste receptacles in an upland location. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2021-01267). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1013. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. There is permit history for 103 and 109 Sound View Drive North, Hampstead, with the most recent being Michael McWilliams at 103 Sound View. In this area, there is no defined channel and I don't believe either are elevated beyond the standard height (i.e. no elevated crossing for channel). Let me know if you need anything else. Can you give me any add info on the adjacent piers and if they have any sections spanning the channels through the CW? This one will impact the project on hold to the north so I want to make sure we are consistent. Increased sedimentation raises concern for shellfish and shellfish habitat by either the direct burial of oyster beds or reductions in filtration efficiency, respiration rates, and/or reproduction and settlement. Larval oysters require a clean hard bottom for attachment and sedimentation as little as 1 or 2 mm may inhibit settlement. Duration of sedimentation suspension and water quality degradation has been shown to result in juvenile oyster mortality. Coastal wetlands are considered among the most productive ecosystems in the world. Coastal wetlands are a productive detritus -based system that trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier to flood damage, and provide nursery functions and support fish production. SAV is similar to PNA in that we award it the utmost protection as a valuable and fragile productive nursery habitat. On the Atlantic coast, North Carolina ranks second behind Florida in SAV presence (Funderburk et al. 1991; Sargent et al 1995). Observations since 2000 have indicated that SAV coverage in North Carolina is expanding into previously unobserved areas. SAV is a vital component to the estuarine system and is prime nursery area for many fisheries species, such as gag grouper, flounder, red drum, black sea bass, weakfish and Atlantic croaker (Deaton et al. 2010). SAV supports high diversity of foraging fish and invertebrates, and provides valuable ecosystem services as a primary producer and enhancer of water quality (Deaton et al. 2010). SAV filters water, stabilizes sediment (Fonseca 1996; Stephan and Bigford 1997), and provides refuge for juvenile finfish, crabs and shrimp (Savino and Stein 1989; Rooker et al.1998). SAV supports a vast array of epiphytes and other sessile invertebrates that serve as a food source for many fisheries species. Waters containing SAV have higher species richness and abundance than those without SAV (Thayer et al.1975, Ross and Stevens 1992), and can improve water quality and clarity through the filtration of water by the associated epiphytic community. SAV is recognized as essential fish habitat due to its primary production, structural complexity, modification of energy regimes, sediment and shoreline stabilization, and nutrient cycling (Deaton et al. 2010). For the above -mentioned reasons, the N.C. Division of Marine Fisheries would request that a moratorium on in -water work, from 1 April to 30 September is recommended to reduce the negative effects on critical fish life history activities, to include spawning migrations and nursery functions. Specifically, the applicant proposes to construct a 6' x 545' access pier that would extend toward the southeast. Approximately halfway the length of the access pier, the applicant proposes to construct a 12' x 12' uncovered platform, which would be located over open water (i.e. not over any marsh area). The fixed access pier would continue through the platform and terminate in another "L-shaped" platform, measuring approximately 13' x 13'. The proposed platform (@ the terminal end) would extend along the eastern side of the walkway. Just south, and immediately adjacent to the proposed fixed pier, the applicant proposes to install a 13' x 13' boatlift and 8' x 24' floating dock. As designed, the boatlift would be located between the fixed platform and floating dock. Both the boatlift and floating dock would be oriented perpendicular to the shore and would provide access to two of the three proposed slips. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the modification to the State authorization: 1. In order to further protect the endangered West Indian Manatee, Trichechus manatur, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. This prohibition applies to all borrow and fill activities connected with this project. 6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733- 5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 8. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 9.The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 10. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 12. PROJECT DESCRIPTION: The project site is located at 107 Sound View Drive N, adjacent to the AIWW, in Hampstead, Pender County. To get to the site from Wilmington take US Hwy 17 N to Country Club Road (approximately 13.5 miles from the Wilmington Regional Office). Turn right onto Country Club Road and continue approximately 2.18 miles before turning right onto S. Belvedere Drive. Continue along S. Belvedere drive until it dead ends at Sound View Drive. At the intersection, turn left onto Sound View Drive and the property will be located along the right at number 107 (vacant lot). The property consists of a 0.76-acre parcel that is situated on land that is approximately 0-11 feet above mean high water (MHW) and is vegetated primarily with lawn grasses. The property is currently undeveloped with exception of an existing bulkhead/retaining wall that runs the width of the shoreline (approximately 101' as measured along the Mean High Water line) along the southeastern shoreline. Coastal wetland and 404-type wetlands transition from the bulkhead to the waters edge. Smooth Cordgrass (Spartina alternii fora), along with Glasswort (Salicornia spp.) and Sea Lavender (Limonium carolinianum), span along the intertidal flat a distance of approximately 400' before reaching the open water area of the AIWW. The width of the waterbody, in the vicinity of the project site, measures approximately 650' from marsh to marsh. The waters of the AIWW are classified SA by the Division of Water Quality. The project area IS designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a new three (3) slip docking facility. Beginning from the center of the lot, along the bulkhead/retaining wall, the applicant proposes to construct a 6' x 545' access pier that would extend toward the southeast. As described in the application package, water depths in the vicinity of the proposed docking facility average approximately -2.5' to-2.11', relative to the Mean Low Water level. Based on the work plan drawings, the applicant's proposal is located outside of the 15' riparian corridor setback of both adjoining property owners. As a result, the applicant did not require a waiver from neither neighbor for the proposed development. It should be noted the applicant's proposal (i.e. construction of a pier and docking facility along the western shore of the AIWW) stops short of the'/4 width of water body limitation as well as the existing pier head line. According to the applicant's agent, this was a financial decision, as the applicant did not want to extend any further waterward than necessary to gain adequate water depth. However, in doing so, there is the potential that the existing facility would be located in waters suitable for SAV growth, as evident in the attached SAV survey which was conducted and provided by the marine contractor. Nonetheless, DCM has completed a site visit and although SAV was found throughout the area (along the entire length of shoreline bordering Sound View Drive), it does not appear to be emergent in the footprint of the proposed facility. Additionally, existing water depths appear to be consistent with those provided and documented in the application package. 10. ANTICIPATED IMPACTS The proposed three (3) slip docking facility would result in the incorporation of approximately 714 sq. ft. of estuarine and public trust area, and 960 sq. ft. of shaded impacts (wetlands). Although no Submerged Aquatic Vegetation (SAV) was observed within the project area during the 9/14/20 site visit, conditions are favorable for existence and the NC Division of Marine Fisheries has designated a portion of this shoreline as SAV "habitat". Furthermore, the applicant has provided an SAV survey that shows an existing bed of SAV just inland of the proposed floating dock; however, based on the designed layout, this area would not be permanently impacted. Based on this information, in combination with DCM's site visit on 9/14/20 (at low tide), it is staff s opinion that the proposed project area (dock footprint) is void of any established beds of SAV. The proposed development would be located outside of the 15' riparian corridor setbacks on both sides, would be constructed within'/4 of the width of the waterbody and outside of the federal channel setback.
