Any violation rf these terms may be subject to fines, imprisonment or civil action; or may cause the permit to he nun ana voia. Boat Lift Reconfiguration 1) This permit authorizes only the movement offshore of the boat lift located in Slip 42 and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource agencies, the boat lift will remain a sling style lift for the life of the permitted docking facility. (See attached sheets for Additional Conditions) qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Permit No.155-21 Page 2 oV ADDITIONAL CONDITIONS 3) The waterward edge of the authorized boat lift shall be staked by the permittee prior to the start of the dock construction and the permittee shall contact the appropriate DCM Field Representative for an inspection to verify the authorized dock length and distance from normal high water. The stake shall . remain in place for the duration of the construction�project. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. . 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit does not authorize any new formalized boat slips. The docking facility is authorized for no more than three (3) formalized boat slips. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Sedimentation and Erosion Control 10) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to. a third party without the written approval of the Division of Coastal Management. 13) All construction debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and disposed of in an approved upland location. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: - The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2009-01552). NOTE: The N.C. Division of Water Resourcesauthorized the. proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2009-0825 v2. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $250 was received by DCM for this project. The adjusted 75 day date after the additional information was received is now 11/19/21. Since that date is this week please accept this as notification of the extension of the project. The 150 day is 2/2/22. Once USACE is in I should be able to make a final decision shortly thereafter. Few other things I want to check up on... 1. The agent authorization for Cottage Point was signed, but it did not have you entered as the agent. That section was left blank. 2. The MP-1 identified Hutchins and Price as riparian neighbors. Hutchins is part of the HOA and we have the documentation that shows the HOA members waive rights. Therefore, protection of these habitats is critical for the successful growth to maturity for the species that utilize these areas. DMF would typically require a moratorium of April 1 through September 30 for all in -water work in areas designated as PNA. However, taking into consideration the limited scope of this proposal, DMF will not request the moratorium as a permit requirement. It would be ideal for the work to occur during the environmental window, though, as that would help to minimize potential impacts to species utilizing the PNA. There are no SAV within the proposed boatlift relocation. The water depths within the proposed boatlift relocation are an average of -2.5' nlw. All portions of the relocated boatlift would be landward of the channel edge of approximately 25'. Riparian corridors were determined by the original 2009 major permit, existing pier alignment, channel location and channel alignment. There would be a total of three slips (three existing slips). The boat size would be limited to a maximum of 21' and of open runabout design. The water depths within the slip areas are -2.15' nlw to 2.85' nlw/mlw depending on location, with connecting water depths of -2.85' plus nlw/mlw. 11. Anticipated Impacts: The proposed boatlift relocation would incorporate 143 ft2 of shallow bottom habitat. The development would not increase the number of existing slips (3). The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. The relocated boatlift should not be a hindrance to navigation due to the fact all portions would be located landward 25' from the historic channel edge. The proposed boatlift relocation would also meet the minimum 15' setback from the riparian access lines and not exceed a maximum distance of 83' waterward of the edge of marsh directly south of slip #2 and no more than 70' beyond the marsh" knuckle" west of slip # 3. It was the consensus of those present to keep the present homeowner's dues to $300 per year per lot. New Business: Tom Giblin commented that $5,000 was spent by the owners of the boat lifts to get a survey for a major CAMA permit for the extension of the common dock. He continued that as Ed Smith put money in toward the construction of the dock, it was acknowledged that a boat lift space would be encumbered by his lot [from Lot #51 and this will have to be changed in the bylaws of the homeowners association.
