This permit, issued on June 11.2021 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
to lines, imprisonment or civil action; or may cause the permit to be null and void.
Bulkhead Replacement
1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is
not authorized.
4) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the
approved bulkhead alignment.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
5) All fill material to be placed below normal high-water level shall be confined behind the permitted
bulkhead.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure.
7) The bulkhead shall be constructed prior to any backfilling activities.
8) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or
other suitable materials approved by Division personnel.
9) All backfill material shall be clean and free of any pollutants except in trace quantities.
10) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction.
Sedimentation and Erosion Control
11) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the bulkhead cap immediately following completion of backfilling activities.
General
13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
15) All debris associated with the removal or construction of the permitted bulkhead shall be contained
within the authorized project area and removed to an appropriate upland location.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 2021-
0611.

Thanks again for the call earlier, that cleared things up for me and as we discussed here is what I need to correct the
application...
1. The Deed for 207A Florida Ave.
2. The MP-1 form updated to include Wright Investments LLC as the 21d applicant.
3. Both yourself and your brother-in-law who is the owner of Wright Investments to Sign and Date the updated
application.
With this documentation I will correct the permit and resend the official permit copy with the original following in the
mail.

The deed notes Wright Investments as the legal owner of the property. I took this project over from staff that has
moved on very late in the process. The permit file only indicates the one deed with Wright Investments as the deed
holder. The workplans only show one property that the bulkhead spans. If the project covers 2 properties then I will
need the deed for the second property to show ownership. At this time the permit emailed 6/11/21 is null and void
until the property issue is resolved.

Shouldn't the permit name be as the application/applicants applied for it?

If this isn't a problem, I am fine with it, however I just wanted to make sure both names were in it if I was ever
questioned about the part of the bulkhead on my side.

It is the staff s recommendation that the new bulkhead waterward of an existing bulkhead appears to be
CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (7) (D(ii) Use Standards for Bulkheads and Shore
Stabilization Measures. The applicant states in the project narrative that the purpose of replacing the bulkhead
will be to alleviate the concerns of the failing bulkhead and to prevent tidal water from frequently flooding the
water. The applicant has demonstrated an attempt to minimize impacts to coastal wetlands by scaling back the
alignment landward to the minimum necessary for construction. This office has no objection to the proposed
work, provided it is consistent with all other state and federal permitting requirements, and in the absence of other
concerns from review agencies.

I do not appear to have all of these, but everyone that I have an e-mail for except NCDMF is under one acre of land
disturbance so neither erosion & sediment control or stormwater permit requirements would be triggered. The NCDMF
project takes place in the Atlantic Ocean is not with NC jurisdiction insofar as land is concerned.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by this office on March 17, 2021. The application proposes to construct a new
vinyl bulkhead approximately 18 inches waterward of the existing dilapidated bulkhead. The proposed
project is located in the waters of the Carolina Beach Yacht Basin which are class SB waters by DWR. The
DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the Regional
General Permit 291 issued by the US Army Corps of Engineers (USACE). This Certification allows you to
use the Regional General Permit 291 when issued by the US Army Corps of Engineers.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your
application do not require written authorization to utilize GC 4175. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH

Consistency Determination: This project is consistent with the Carolina Beach
Land Use Plan.
The applicant is requesting a Major Modification to construct a new vinyl bulkhead 18
inches waterward of the existing bulkhead within areas of environmental concern. The
project is located at 207 A & B Florida Avenue in Carolina Beach, adjacent to the
Carolina Beach Yacht Basin.
Areas of Environmental Concern (AEC's) impacted by the proposal are CW and ES.
Waters at the project site are classified as SB# and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Carolina Beach Land Use Plan and
offer the following comments.
The AECs impacted by the work are classified as Developed.
In general, the Town of Carolina Beach allows development in Developed classified
AECs which is consistent with the State's minimum use standards. The Town of
Carolina Beach Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the Town of Carolina Beach Land Use Plan.

9. PROJECT DESCRIPTION:
The project is located at 207 A&B Florida Avenue, adjacent to the Carolina Beach Yacht Basin/Myrtle
Grove Sound, in the Town of Carolina Beach, New Hanover Co. To locate the project site from the
Wilmington Regional Office (WiRO), travel from Wilmington to Carolina Beach south on College Road
(NC Hwy 132) to Carolina Beach Road for approximately 12 miles south. Continue over Snows Cut
Bridge on N. Lake Park Blvd. for approximately 1.2 miles south until you reach Carl Winner Drive.
Turn left onto Carl Winner Drive until you reach Canal Drive. Turn left on Canal Drive and continue
north approximately 1.3 miles until you reach Florida Avenue, which will be located on the left.
Continue traveling on Florida Avenue until you reach the project site on the left.
The property is composed of two parcels approximately .17 and .18 acres in size (0.35 acres total) and
both property owners have submitted authorization for this proposal. The property contains
approximately 62 LF of shoreline frontage along the Carolina Beach Yacht Basin. The upland portion
contains an existing two family residence and driveway, ornamental grasses and vegetation. The
shoreline is currently stabilized with a deteriorating bulkhead. Waterward of the bulkhead, there is
coastal wetlands vegetation consisting primarily of Smooth Chordgrass (Spartina alternii fora) and
Black Needlerush (Juncus roemerianus).
The current docking facility consists of a fixed pier (98' x 6') extending from the high ground in a
waterward direction and terminates in a fixed covered t head platform (13' x 13'). From the waterward
edge of the platform, a gangway leads to a u-shaped floating dock. The U-shaped floating dock is
comprised of three sections. The first section (24'x10') is parallel with the pier alignment. From the
landward, north side of the floating dock, another section (6' x 23') extends parallel with the shoreline,
and lands on another section of floating dock, (6' x 24') extending perpendicular to the shoreline. There
is an existing boatlift on the north side of the northernmost section of floating dock (slip 4). CAMA
General Permit GP-76169D, issued 11/30/20, authorized the installation of a boat lift within an existing
slip (slip 1). Currently the facility accommodates 4 vessels.
The Town of Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent
high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are
classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area
by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to install a new vinyl bulkhead 18" waterward of existing deteriorating
bulkhead, within the Coastal Wetlands AEC, across the applicant's property. According to the
application materials, the proposed bulkhead would be 62 feet in length, and tie into the neighboring
bulkhead to the south, and include an 18" return on the northern side of the parcel. The project narrative
submitted by the agent indicates that the existing bulkhead is failing, at it its current height of 2' above
the substrate, the property is prone to flooding at high tide events. For this proposal, the applicant is
proposing to replace the bulkhead with a longer sheet to gain a height of 4' above the substrate to
alleviate the flooding problems. The agent has proposed an alignment just waterward enough of the
existing bulkhead for the new construction, in an attempt to minimize coastal wetlands impacts.

10. ANTICIPATED IMPACTS:
As proposed, the new bulkhead would fill approximately 93 SF of Coastal Wetlands (consisting primarily
of smooth chordgrass (spartina alterniora) and black needlerush Uuncus roemerianus). The proposed
development would disturb approximately 1240 SF of high ground with tie back anchor installation and
backfill, and disturbance from the wall installation. The project narrative provided in the application states
that the applicants intent is to stop frequent flooding on the property during high tides, due to the low
profile of the current bulkhead. Minor increases in turbidity should be expected during project
construction however, turbidity levels should return to normal once the project is complete

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent
for Harvey Allison and Wright Investments LLC, for State approval for development of the subject
property located at 207 A&B Florida Avenue, adjacent to adjacent to the Carolina Beach Yacht Basin in
Carolina Beach, New Hanover County. It was received as complete on March 4, 2021 and appears to be
adequate for processing at this time. The projected deadline for making a decision is May 18, 2021. An
additional 75-day review period is provided by law when such time is necessary to complete the review.
If you have not been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 4, 2021, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a 'Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing
if you wish to receive a copy of my field report and/or comments from reviewing agencies.

Concern as designated under the CAMA: On March 15, 2021, Harvey Allison & Wright Investments, LLC
proposed to install a new vinyl bulkhead to replace an existing deteriorating bulkhead at 207A & B Florida
Ave., adjacent to the Carolina Beach Yacht Basin in Carolina Beach, New Hanover County; and on March
16, 2021, the New Hanover County Airport Authority proposed to perform FEMA ditch and runoff drainage
mitigation at 1740 Airport Blvd, adjacent to an unnamed tributary in Wilmington, New Hanover County.
