Notification to Local Governments Regarding Changes to State Guidelines for LAMA
Land Use Planning
The Division of Coastal Management (DCM) is pleased to notify local governments in the 20-county
coastal area that major amendments have been made to Subchapter 15A NCAC 07B "State Guidelines
for Land Use Planning" and became effective Monday, February 1, 2016. The new planning guidelines
were developed with substantial input from local governments and other interested stakeholders.
The amended guidelines provide increased flexibility for plan content and format, clarify that updates
and amendments are voluntary, facilitate streamlined plan approval, amendment, and update
processes, and promote integrated planning efforts. In addition, the amended guidelines provide local
governments with new process options for LAMA Major Permit reviews for consistency with the local
land use plan. Specifically;
15A NCAC 07B .0803 CERTIFICATION AND USE OF THE PLAN
(c) Use of the Plan. Once certified, the plan shall be utilized in the review of the CAMA permits in
accordance with G.S. 113A-111. Local governments shall have the option to exercise their enforcement
responsibility by choosing from the following:
(1) Local administration: The local government reviews the CAMA permits for consistency with the
plan;
(2) Joint administration: The local government identifies policies, including the future land use map
and implementation actions that will be used by the Division for the CAMA permit consistency reviews
or;
(3) Division administration: The Division reviews the CAMA permits for consistency with the plan
policies, including the future land use map and implementation actions.
The Division of Coastal Management is requesting each county and municipality with a certified land use
plan to notify the Division in writing as to which option (noted above) shall be used for CAMA permit
consistency review.
Currently DCM Planning Staff reviews CAMA Major Permits for consistency with local land use,plan
policies, implementation actions, and the future land use map and its designations. DCM Staff also

defends consistency determinations in court when challenged. Local governments should consider the
following when deciding which option the county or municipality shall use for land use plan consistency
reviews.
If a local government chooses the Local Administration option, where the local government reviews
CAMA permits for consistency with the plan, the following considerations need to be taken into
account:
• The local government will need to appoint a single contact for responsibility to perform the
consistency reviews.
• Local governments will have 21 days to review the CAMA Major Permit for consistency with the local
plan as well as local ordinances, and provide comments directly to the DCM Assistant Major Permit
Coordinator.
• In certain emergency situations, local governments may be asked to provide a consistency
determination immediately upon receipt of the CAMA permit packet.
• When a local government is the applicant of a CAMA permit for a county or municipal project, the
local government cannot review the permit for plan consistency. In this situation, the Division of
Coastal Management shall have the responsibility of reviewing the permit application for
consistency with the local land use plan.
• DCM will provide a template for the consistency review letter.
• Local governments should be prepared to be called to appear in court with DCM to defend their
consistency determination when challenged.
• For those who choose local administration, DCM staff will schedule a meeting with the local
government to discuss in more detail the process and expectations for local consistency review.
If a local government chooses the Joint Administration option, the local government shall identify only
the policies, including the future land use map and implementation actions that will be used for the
consistency review. Under this option, DCM Planning Staff will still perform the consistency review, but
will only consider the policies and implementation actions identified by the local government when
performing the consistency review.
If a local government chooses the Division Administration option, the Division of Coastal Management
will continue to review LAMA Major Permits for consistency with the local land use plan. Under this
option, the consistency review process will remain as it currently is with DCM Planning Staff performing
the consistency review.
Local governments are being asked to submit their CAMA Permit review option notification on official
letterhead to the Division of Coastal Management no later than July 1, 2016. If the Division does not
receive notification from a local government, the CAMA permit consistency review process will
continued to be administered by DCM (Division Administration option). Please mail this notification to:

This is in response to your April 4, 2016 memo regarding review of development proposals for
consistency with local CAMA plans. The City of Wilmington elects the Division
Administration option offered in the memo.
The City understands that by electing this option the Division of Coastal Management (DCM)
will continue to review CAMA Major Permits within the City limits for consistency with our
local plan. Under this option, the consistency review process will remain as it currently is, with
DCM Planning Staff performing the consistency review. We have been very satisfied in the past
with the reviews offered by your Division, and our Regional Planner, Mike Christenbury, and
wish to continue along that course. We believe allowing the independent review is beneficial to
the City and our business community.
While reviews in the past have been made in relation to our CAMA Plan adopted in 2006, the
City has a newly adopted Comprehensive Plan that we would hope DCM would consider for its
reviews in addition to the CAMA Plan.

like to handle consistency reviews for CAMA permits. This is to notify you that the Town
has selected option 2 — joint administration as our preferred method for how these
reviews will be handled. It is our understanding that we will provide your staff with the
local policies and regulations to be used as part of your CAMA permit review process
and that permits would not be issued within the Town if the actions proposed are
inconsistent with these policies.

this new process will take effect.

The Town of Oak Island is a local government located within the 20-county coastal area
that Subchapter 15A NCAC 07B "State Guidelines for Land Use Planning" applies to. A
notification was sent to Oak Island on May 3. 2016 from the NC -Division of Coastal
Management (DCM) informing the town that major amendments have been made to
Subehapter 15A NCAC 07B and that the amendments became effective Monday,
Februan I.2016.
The amended gives the town new process options for LAMA Major Permit reviews for
consistency with the local Land Use Plan. The town is aware of its options to review the
CAMA plan for consistency, have the review jointly done with town and DCM staff, or
to have the DCM administration solely continue to perform the CAMA plan consistency
for the CAMA permits.
The purpose of this letter is to serve as the official in writing notification, to the Division
of Coastal Management, of the Town -of Oak Island's decision to select the Division
Administration option. The town desires the Division of Coastal Management to contimie
to review CAMA Major Permits tier consistency with the local land use plan.

The Town of Beaufort appreciates the Division of Coastal Management and especially your
commitment to protecting the environment by ensuring land use compatibility within North
Carolina's 20 coastal counties. I personally appreciate the close working relationship that has
developed between our two organizations. Like so many other small coastal towns we have
relied on Coastal Management's vast experience, knowledge and expertise when reviewing
Major CAMA permits for their consistency with land use policies and future maps. We now ask
that you continue to do so, and would officially request that all major CAMA permits submitted
within the Town of Beaufort's jurisdiction be reviewed through the Division Administration
(Option 3).

Mr. Davis:
The Town of Duck greatly appreciates the efforts of you and your staff at the N.C. Division of
Coastal Management to streamline and improve standards for the development, updating, and
use of CAMA land use plans in local communities. As part of newly adopted standards, it is my
understanding that the Town of Duck must select one of the following options for the review of
CAMA permit for consistency with Duck's adopted CAMA Land Use Plan:
1. Local administration: The local government reviews the CAMA permits for consistency
with the plan.
2. Joint administration: The local government identifies policies, including the future land
use map and implementation actions that will be used by the Division for the CAMA
permit consistency reviews.
3. Division administration: The Division reviews the CAMA permits for consistency with
the plan policies, including the future land use map and implementation actions.
After consideration of these options, the Town of Duck has decided to proceed under the local
administration option.
The Town of Duck designates Joe Heard, Community Development Director to serve as the
individual responsible for conducting the consistency reviews.
