This is the Town of Sunset Beach LAMA Land Use Plan adopted November 21, 2017 by the Town of Sunset Beach, North Carolina. 2. Sunset Beach is located within Brunswick County in southeast North Carolina near the towns of Shallotte, Ocean Isle Beach, and Calabash. 3. Sunset Beach is requesting certification of the 201.6 CAMA Land Use Plan which can be' found at https://files.nc.gov/ncdeq/Coastal%20Management/documents/PDF/Land%20Use%20PIans/1 ocally-adopted-plans/SunsetBeachLUP_LocallyAdopted.pdf. The 2016 CAMA Land Use Plan updates the existing Sunset Beach, North Carolina LAMA Land Use Land Use Plan previously certified by the Coastal Resources Commission on July 15, 2010. . 4. Sunset Beach adopted the Land Use Plan by resolution on November 21, 2017 after a duly advertised public hearing. The public had the opportunity to provide written comments on the plan up to thirty (30) calendar days after local adoption. No comments were received. CONCLUSIONS OF LAW l . Sunset Beach's CAMA. Land. Use Plan has met the substantive requirements outlined within the Land Use Planning Requirements effective February 1, 2016. 2. There are no conflicts evident in 2016 Sunset Beach's CAMA Land Use Plan with either state or federal law or the State's Coastal Management Program. I i The elected body of Sunset Beaeh made a final decision on the contents of the 2016 Sunset Beach Land Use Plan and provided o it PP y for the public to provide written comment following local adoption of the plan, as required b ''N.C. 11 y § 3A-110 and 15A NCAC 7B .0802 and .0803, and 2016 Sunset .Beach's Land Us e Plan was submitted to the NC ` Division of Coastal Management Commission without wine n objection or comment from the public. 4. During its regularly scheduled meetingon November 7 . 8, 2017, the North Carolina Coastal Resources .Commission delegated -to the Direct or of the No rth Carolina Division `of Coastal Management, Department of Environmenta l Quality, its authority to approve Land Use. Plans pursuant to. N.Q.G.S. ;§.113A-1.10(f). The conditions under which .the delegation . was made are included in the November 20, 2017 letter to Braxton Davis Director from Commission Chair Renee Cahoon. Pursuant to that delegation, the g undersigned makes the following decision: . DAVIS Wrector MEMORANDUM NORTH CAROLINA Environmental Quality TO: Mike Lopazanski, Policy & Planning Section Chief Division of Coastal Management FROM: Michael Christenbury, Wilmington District Planner Division of Coastal Management DATE: January 3, 2019 SUBJECT: Certification of the 2016 Sunset Beach CAMA Land Use Plan Recommendation Certification of the Sunset Beach 2016 CAMA Land .Use Plan with the determination that the Town has met the substantive requirements outlined in the 15 NCAC 7B Land Use Plan Guidelines and that there are no conflicts with either state or federal law or the State's Coastal Management Program. Overview The Town of Sunset Beach (hereinafter "Sunset Beach") is located within Brunswick County in southeast North Carolina, approximately 40 miles southwest of Wilmington and near the towns of Ocean Isle Beach, Shallotte and Calabash. Like many coastal communities in southeastern North Carolina and northeastern South Carolina, Sunset Beach has seen a steady increase in growth over the last fifteen years. This increasein development has been primarily attributed. to increases in coastal tourism and retirees moving to the: area. This land use plan includes demographics based on census data, future population projections, and policies and priorities based on current conditions. The plan summarizes policies and proposals and looks beyond everyday development pressures to create a roadmap for the future. The Town is requesting Certification of the Sunset Beach CAMA Land Use Plan. The Sunset Beach Board of Alderman held a duly advertised public hearing to consider the proposed Comprehensive Land Use Plan and voted unanimously, by resolution to adopt the Land Use Plan on November 21, 2017. The public had the opportunity to provide written comments on the plan up to thirty (30) calendar days after local adoption. BEACH LAND USE PLAN WHEREAS, from September, 2015 to June, 2016, the Planning Board drafted a Land Use Plan with the assistance of its consultant Cape Fear Council of Governments, and conducted a series of public workshops and. meetings as part of a comprehensive ve public participation program, and WHERE AS,, the 2017 Land Use Plan was unanimously recornmended for approval by the Town's Planning Board on August, 2016; and WHEREAS, the Division of Coastal. Management's (DCM) Wilmington . TOWN OF 11 01-1 SUNSET BEACH PUBLIC HEARING NOTICE CAMA Land Use Plan The Sunset Beach Town Council will hold a Public Hearing on Tuesday, November 21, 2017 at 9:00 A.M. in the Town Hall Council Chambers at 700 Sunset Blvd. North Sun- set Beach, NC 28468 to hear comments regarding the draft 2017 Town of Sunset Beach Land Use Plan. The 2017 Land Use Plan provides a blue- print for growth and development over the next 20 to 30 years. When viewed as a guide, the document is intended to pres- ent the basic description of the Town of Sunset Beach now and into the next few decades. The Plan may be viewed in the Town Projects section of the website www. sunsetbeachnc.gov or during normal busi- ness hours at Sunset beach TownHall. Following the Public Hearing, the Council will consider taking action to formally adopt the proposed 2017 Town of Sunset Beach Land Use Plan. The public has the opportunity to provide written comment to the Division of Coast- al Management following adoption of the Land Use Plan.
