This permit, issued on August 26, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource agencies, the boat lift (slip #2) originally proposed for this project is hereby deleted. Any and all reference to the originally proposed boat lift in the attached permit application or workplan drawings is hereby considered null and void. 2) This permit authorizes the demolition of the existing docking, facility and the construction of only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty(20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No.111-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 4) The permittee. shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather.. 5) This permit authorizes a maximum of one (1) formalized boat slip. 6) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource agencies, physical stops shall be placed on the floating dock at a minimum height of 18" above the bottom substrate to prevent the floating dock from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. 7) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 8) The roof of the gazebo shall not be designed for second story use. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 11) Should the lot to the east be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 12) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Sedimentation and Erosion Control 13) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. ADDITIONAL CONDITIONS USACE Conditions Permit No.111-21 Page 3 of 3 _ 15) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws-gov/raleigh/pdfs/ManateeGuidelines20l7.adf. General 16) . This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-01208). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0938. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. The applicant proposes to install a private pier with a gazebo, open platform, floating dock, and boatlift for a total of two formalized slips in Blane Creek where water depths range from 0' to-0.9'NLW. The proposed project is located on Blane Creek at 1002 North Shore Drive W, on the island of Sunset Beach, Brunswick County. The waters of Blane Creek are classified SA by the Division of Water Quality and are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and are closed to the harvest of shellfish. Water depths in the vicinity of the proposed docking facility range from 0' to -0.9'. NLW. These measurements were confirmed by DCM during a site visit on 6/2/2021.On 7/20/21 DMF staff took water depths and found 0' NLW in the vicinity of the proposed docking facility. The DCM visit occurred close to a neap tide, while the DMF visit occurred near a spring tide. This can explain the differences in observed water depths. PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile and include finfish, crabs, and shrimp. Shallow soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and cycling of sediment, nutrients, and toxins between the bottom and water column. Soft bottom habitat is used to some extent by most native coastal fish species in North Carolina. The habitat is particularly productive and, by providing refuge from predators, is an important nursery area. Species dependent on shallow soft bottom include clams, crabs, flounder, spot, Atlantic croaker, sea mullet, and rays. Many benthic predators are highly associated with the shallow soft bottom habitat, including flounders, weakfish, red drum, sturgeon and coastal sharks, although almost all fish will forage on microalgae, infauna, or epifauna on the soft bottom. The Division has concerns with floating docks in very shallow waters. Floating docks that repeatedly sit on a muddy bottom can cause anoxia in sediment which can kill small benthic invertebrates (diet of juvenile fish). Furthermore, locating a boat lift with 0' NLW of water for the majority of the day could negatively impact this nursery habitat. Formalized boat slips in shallow water can allow vessels to repeatedly contact the bottom, resulting in anoxia in the sediment which can kill benthic invertebrates and reduction of shallow bottom habitat during low tide. Deep water access is not nearby. Consequently, vessels moving to and from these shallow water docks can cause propeller disturbance impacts to the PNA. PROJECT DESCRIPTION The proposed project is located on Blane Creek at 1002 North Shore Drive W, on the island of Sunset Beach, Brunswick County. The property can be reached from Wilmington by traveling south on NC HWY 17 towards South Carolina. Continue 35 miles south on NC HWY 17 and make a left turn onto Seaside Road SW. Drive south on Seaside Road SW for 3.5 miles and take a right onto Sunset Blvd N for 2 miles. At the round -about, take the first right and continue over the bridge. Take the first right onto North Shore Drive W and continue to 1002 North Shore Drive W on the right-hand side. Existing structures on the project site include a single family residence, bulkhead, and a dilapidated docking facility located on the north side of the property. The existing docking facility will be removed but the applicant has decided to keep the existing 6ft. wide stairs off the bulkhead and the high -ground portion of the access pier. The project site is approximately .17 acres. According to the applicant, high ground elevations are approximately 7ft. above the normal high water (NHW) level, and the applicant's entire shoreline (+/- 51 linear feet) is stabilized by bulkhead. The high ground is vegetated primarily with domestic grasses and ornamental landscaping. A dense stand of Smooth Cordgrass (Spartina alterniflora) extends approximately 20ft. waterward of the bulkhead in the vicinity of the proposed docking facility (See Sheet 2 of 3). The proposed project would be located on the north side of the property. A residential property borders the project site to the west and a town -owned right-of-way is located to the east. The width of Blane Creek measures approximately 183ft. from the edge of marsh in the area of the proposed project. The waters of Blane Creek are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the June 2021 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths in the vicinity of the proposed docking facility range from Oft. to -0.9ft. NLW. These measurements were confirmed by DCM during a site visit on 6-2-2021. According to the applicant, tidal amplitude in the project area is approximately 411. between NLW and NHW. PROPOSED PROJECT The applicant proposes to install a private pier with a gazebo, open platform, floating dock, and boatlift for a total of two formalized slips in Blane Creek where water depths range from Oft. to -0.9ft. NLW. The applicant proposes to build a 6ft. x 3811. access pier that would extend north into Blane Creek and be attached to an existing 4ft. x 20ft. high -ground access pier (See Sheet 2 of 3). At the waterward end of the proposed access pier would be a 1211. x 12ft. gazebo with a 12ft. x 4ft. open platform off the east side. A aft. x 4ft. finger pier would extend off the east side of the open platform, giving access to the north -facing gangway. As proposed, an 8ft. x 2011. floating dock (Slip #1) would be located waterward of the gazebo, extending approximately 10ft. below NLW. A proposed 13ft. x 13ft. boatlift (Slip #2) would be installed to the west of the proposed floating dock. Water depths in the vicinity of the proposed boatlift and floating dock range from Oft. NLW on th4 dPVtD edge to -0.911. As proposed, the docking facility would be located within the applicant's area of riparian access and has obtained riparian setback waivers from both adjacent neighbors. According to the application, the waterward edge of the proposed docking facility would be built approximately 1Oft. beyond the existing pier -head line to access deeper water but would not exceed the ''A width of Blane Creek. As proposed, the docking facility would extend approximately 39ft. beyond the edge of marsh to approximately 21 % of the waterbody width. 10. ANTICIPATED IMPACTS The proposed two -slip docking facility would be located over an area of shallow water (Oft. to -0.9ft. NLW) in a Primary Nursery Area. Installing physical stops 18in. above the substrate on the floating dock and boatlifts could reduce impacts to soft -bottom habitat and limit usage to periods of mid and high tides. Despite using stops to physically limit the structures' height above the substrate, prop scouring in critical habitat is still a concern during ingress and egress. The proposed two -slip docking facility would result in the shading of 114sq. ft. of Coastal Wetlands and the incorporation of approximately 647sq. ft. of Estuarine Waters and Public Trust Area. As proposed, the docking facility would be located waterward of the pier -head line but not exceed the `/, width of the waterbody. The applicant has received signed waivers to encroach into the 1511. riparian corridor setbacks to the east and west. Turbidity associated with the piling installation would be kept to a minimum.
