This permit, issued on August 26, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) In accordance with commitments made by the permittee and in order to satisfy concerns of the
resource agencies, the boat lift (slip #2) originally proposed for this project is hereby deleted. Any
and all reference to the originally proposed boat lift in the attached permit application or workplan
drawings is hereby considered null and void.
2) This permit authorizes the demolition of the existing docking, facility and the construction of only the
docks, piers, and other structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, shall
become a permanent part of this docking facility without permit modification. No non -water
dependent uses of structures shall be conducted on, in or over Public Trust waters without permit
modification.

This permit action may be appealed by the permittee or other
qualified persons within twenty(20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured
from the bottom of the decking.
4) The permittee. shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather..
5) This permit authorizes a maximum of one (1) formalized boat slip.
6) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource
agencies, physical stops shall be placed on the floating dock at a minimum height of 18" above the bottom
substrate to prevent the floating dock from disturbing the bottom substrate. The physical stops shall remain
in place for the life of the permitted docking facility.
7) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches are permitted.
Lattice is specifically excluded from being used under this authorization.
8) The roof of the gazebo shall not be designed for second story use.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
10) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
11) Should the lot to the east be sold prior to the initiation of construction of the docking facility, the
permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and
authorization to construct the portion of the docking facility within the property owner's riparian
setback, and submit it to the Division of Coastal Management prior to initiating construction of the
docking facility.
12) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
Sedimentation and Erosion Control
13) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.

15) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
16) . This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
17) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location.
18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2021-01208).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-0938.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of $400 was received by DCM for this project.

Applicant is proposing to install a new docking facility at Loot North Shore Drive West in Sunset
Beach. The new docking facility is proposing a 13' x 13' boat lift, 8' x 2o' floating dock, ii x 12'
covered platform, platform extension to access ramp leading to floating dock, and a pier leading to
the covered platform. Water depths in this area do not meet DMF requirements and shaded impact
allotment is exceeded based on shoreline length. Because of these conditions we are submitting a
Major Permit Application.

This office supports the recommendations of the resource agencies, particularly the NC Division of Marine
Fisheries, regarding potential impacts to shallow bottom. Should concerns be expressed over potential impacts
from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(ax2),
which requires that the location, design and need be consistent with the management objective of the Estuarine
System AEC and the project be sited and designed to avoid significant adverse impacts upon the productivity and
biological integrity of spawning and nursery areas.
The proposed development would provide docking space for two vessels. As proposed, the project would be
CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the docking facility length
limitations, the eight square -foot shading rule, and the 15ft. riparian setback rule. The docking facility would be
located entirely over open water. Despite the project meeting the specific use guidelines in estuarine waters,
there are still concerns about water depths and the impact of the proposed docking facility in a Primary
Nursery Area.

Gregg, got this email from Holley this morning. Didn't actually catch the low water depth here.
I was talking this over with Mickey, I was going to redact the permit, but there actually is no condition in RGP-56 that
requires a certain water depth, so this permit is actually still valid. So I guess we will have to rely on DCM to allow or
disallow this project.
Just wanted to let you know where we were. If you think I should handle a similar issue differently in the future, we can
discuss.

Location description: The site is located in Blane Creek at 1002 North Shore Drive W in Sunset Beach, Brunswick County, NC
Description of project area and activity: The proposal is to build a 6 ft. x 38 ft. access pier that would extend north into Blane
Creek and be attached to an existing 4 ft. x 20 ft. high -around access pier. A 12 ft. x 12 ft. gazebo will be built at the waterward
end of the vier and a 12 ft. x 4 ft. oven platform will be built off the east side of the gazebo. A 3 ft. x 4 ft. fineer pier would
extend off the east side of the oven platform, giving access to the north -facing gangway. An 8 ft. x 20 ft. floating dock (Slip #1)
would connect to the gangway and would be located waterward of the gazebo. A Oft. x 1311. boatlift (Slit) #2) will be installed
to the west of the proposed floating dock.

Carolina Division of Coastal Management (DCM) prior to commencing any work on this project.

A North Carolina Division of Marine Fisheries (NCDMF) Fisheries Resource Specialist has reviewed the
CAMA Major Permit application for proposed actions that impact fish and fish habitats. The applicant
proposes to install a private pier with a gazebo, open platform, floating dock, and boatlift for a total of
two formalized slips in Blane Creek where water depths range from 0' to-0.9'NLW.
The proposed project is located on Blane Creek at 1002 North Shore Drive W, on the island of Sunset
Beach, Brunswick County. The waters of Blane Creek are classified SA by the Division of Water Quality
and are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and are
closed to the harvest of shellfish. Water depths in the vicinity of the proposed docking facility range from
0' to -0.9'. NLW. These measurements were confirmed by DCM during a site visit on 6/2/2021.On
7/20/21 DMF staff took water depths and found 0' NLW in the vicinity of the proposed docking facility.
The DCM visit occurred close to a neap tide, while the DMF visit occurred near a spring tide. This can
explain the differences in observed water depths.
PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early
post -larval to juvenile and include finfish, crabs, and shrimp. Shallow soft bottom is an important
foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and cycling of sediment,
nutrients, and toxins between the bottom and water column. Soft bottom habitat is used to some extent by
most native coastal fish species in North Carolina. The habitat is particularly productive and, by providing
refuge from predators, is an important nursery area. Species dependent on shallow soft bottom include
clams, crabs, flounder, spot, Atlantic croaker, sea mullet, and rays. Many benthic predators are highly
associated with the shallow soft bottom habitat, including flounders, weakfish, red drum, sturgeon and
coastal sharks, although almost all fish will forage on microalgae, infauna, or epifauna on the soft bottom.
The Division has concerns with floating docks in very shallow waters. Floating docks that repeatedly sit
on a muddy bottom can cause anoxia in sediment which can kill small benthic invertebrates (diet of
juvenile fish). Furthermore, locating a boat lift with 0' NLW of water for the majority of the day could
negatively impact this nursery habitat. Formalized boat slips in shallow water can allow vessels to
repeatedly contact the bottom, resulting in anoxia in the sediment which can kill benthic invertebrates and
reduction of shallow bottom habitat during low tide. Deep water access is not nearby. Consequently,
vessels moving to and from these shallow water docks can cause propeller disturbance impacts to the
PNA.

The proposed floating dock is proposed in a maximum of 10.8" NLW. Though physical stops can be
removed or fail due to repeated wave action, the division does not object to the proposed floating dock
using 18" physical stops, since the existing floating dock is sitting on the muddy substrate and the newly
constructed floating dock with stops will minimize impacts. However, based on the above discussion, the
DMF does not recommend the proposed boat lift, because it is likely to have significant adverse impacts
on marine and estuarine fisheries resources at the project site based on the information included in the
application.
The division also requests that a moratorium on in -water work from 1 April to 30 September to reduce the
negative effects on critical fish life history activities, to include spawning migrations and nursery
functions.

Shore Drive W. in Sunset Beach, NO along Blane Ciek Our comments; are provided in accordance with
provisions of the Coastal Area Management Act (G.S.113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean WaterAct,as amended, the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S:C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act(FCMA), as
amended (16 U.S.C. 1801 et seq.), add the Migratory Bird Treaty Act (16 U.S.C. 703'-712 ct ucq).
The;applicant proposes to construct a '38' by 6' ad6css pier into Blanc Creek that ties into an existing 20'
by4" access. The waterward end of theTier would:be_a `12' by 12' gazebo with a 12' by 4, open platform.

stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological
factors.As a designated PNA, the creek provides an important rearing area for this variety of estuarine,
fishes and invertebrates that need relatively, undisturbedhabitats. Slips located in water depths less than-2' NLWmay cause chronic sediinentdisturbance fromthe' ingress / egress of vessels and from floating
strdcti;res that rest on the bottom substrate.during low water events.

To minimize the impacts this facility may have, we request the floating platform incorporate stops at 18"
to prevent the structure from sitting on the substrate. The thick organic material can cause significant
turbidity when disturbed. If the existing floating structure without stops was not present, our comments
may have leaned toward no allowance of a floating dock. We also support the statement by NCDMF with
regard to the boat lift and how its presence will lead to chronic disturbance from vessel use and therefore
should be removed from project design or designed in a manner to have it in deeper water depths. An in -
water construction moratorium from April 1— September 30 would finther protect aquatic resources.

The Division of Water Resources (DWR) has received a copy ofyour CAMA Major permit application
request dated received by this office on June 16, 2021 and additional information received on
August 10, 2021 removing the boatlift from the proposal. Blane Creek is classified as SA:HQW by
the Division of Water Resources (DWR) and has been determined to be a Primary Nursery Area
(PNA) by the Division of Marine Fisheries (DMF). Please understand that the waters around your
project area have been identified as a PNA and should requests for dredging within the proposed
project area arise in the future, they will be denied. Please be aware that new dredging within a
PNA is not permitted under 15A NCAC 02B .0220. This activity results in degradation of water
quality standards and is therefore considered a water quality violation. Any turbidity standard
violations of waters going into these creeks are also considered Water Quality Violations.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in
your application do not require written authorization to utilize GC 4175. However, you are required
to follow the conditions listed in the attached certification.
You should also obtain and comply with any other federal, state and local requirements including
(but not limited to erosion and sedimentation control regulations and state stormwater
requirements before you proceed with your project). Also, the approval to proceed with your
proposed impacts to waters a depicted in your application shall expire upon expiration of the 404
or CAMA Permit.

AECs which is consistent with the State's minimum use standards. The Town of Sunset
Beach Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
Provided all local, state and federal requirements can be met, this project appears to
be consistent with the Town of Sunset Beach Land Use Plan.

Please see above for comments from DMF and WRC. DWR is of similar mind, but I do not have any comments as of
yet. In summary, due to the PNA they are objecting to the lift (Slip 2) due to impacts to PNA. They are ok with the
floater on stops due to it being existing and being moved out to deeper water as impact minimization efforts. My
understanding from DWR is a denial of the lift (Slip 2) as well, though I do not have anything official yet. Options at
this point is trending to condition out the lift on any final decision that results in a permit. In addition, though USACE
has authorized under the GP56, they are concerned as well but are unable to retract the GP-56 after issuance.
Finally, please accept this as notification of the extension of the project. The 150 day is 10/22/21.
Please let me know how you would like to proceed and if the applicant would remove the lift from the proposal and
reduce the project to one slip.

Please see above for comments from DMF and WRC. DWR is of similar mind, but I do not have any comments as of
yet. In summary, due to the PNA they are objecting to the lift (Slip 2) due to impacts to PNA. They are ok with the
floater on stops due to it being existing and being moved out to deeper water as impact minimization efforts. My
understanding from DWR is a denial of the lift (Slip 2) as well, though I do not have anything official yet. Options at this
point is trending to condition out the lift on any final decision that results in a permit. In addition, though USACE has
authorized under the GP56, they are concerned as well but are unable to retract the GP-56 after issuance.
Finally, please accept this as notification of the extension of the project. The 150 day is 10/22/21.
Please let me know how you would like to proceed and if the applicant would remove the lift from the proposal and
reduce the project to one slip.

9. PROJECT DESCRIPTION
The proposed project is located on Blane Creek at 1002 North Shore Drive W, on the island of Sunset Beach,
Brunswick County.
The property can be reached from Wilmington by traveling south on NC HWY 17 towards South Carolina.
Continue 35 miles south on NC HWY 17 and make a left turn onto Seaside Road SW. Drive south on Seaside
Road SW for 3.5 miles and take a right onto Sunset Blvd N for 2 miles. At the round -about, take the first right
and continue over the bridge. Take the first right onto North Shore Drive W and continue to 1002 North Shore
Drive W on the right-hand side.
Existing structures on the project site include a single family residence, bulkhead, and a dilapidated docking
facility located on the north side of the property. The existing docking facility will be removed but the applicant
has decided to keep the existing 6ft. wide stairs off the bulkhead and the high -ground portion of the access pier.
The project site is approximately .17 acres. According to the applicant, high ground elevations are
approximately 7ft. above the normal high water (NHW) level, and the applicant's entire shoreline (+/- 51 linear
feet) is stabilized by bulkhead. The high ground is vegetated primarily with domestic grasses and ornamental
landscaping. A dense stand of Smooth Cordgrass (Spartina alterniflora) extends approximately 20ft. waterward
of the bulkhead in the vicinity of the proposed docking facility (See Sheet 2 of 3). The proposed project would
be located on the north side of the property. A residential property borders the project site to the west and a
town -owned right-of-way is located to the east. The width of Blane Creek measures approximately 183ft. from
the edge of marsh in the area of the proposed project.
The waters of Blane Creek are classified SA by the Division of Water Quality and ARE designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of
shellfish. Based on visual observations made by DCM staff during the June 2021 site visit, there appears to be
NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths in the vicinity of the
proposed docking facility range from Oft. to -0.9ft. NLW. These measurements were confirmed by DCM during
a site visit on 6-2-2021. According to the applicant, tidal amplitude in the project area is approximately 411.
between NLW and NHW.
PROPOSED PROJECT
The applicant proposes to install a private pier with a gazebo, open platform, floating dock, and boatlift for a
total of two formalized slips in Blane Creek where water depths range from Oft. to -0.9ft. NLW.
The applicant proposes to build a 6ft. x 3811. access pier that would extend north into Blane Creek and be
attached to an existing 4ft. x 20ft. high -ground access pier (See Sheet 2 of 3). At the waterward end of the
proposed access pier would be a 1211. x 12ft. gazebo with a 12ft. x 4ft. open platform off the east side. A aft. x
4ft. finger pier would extend off the east side of the open platform, giving access to the north -facing gangway.
As proposed, an 8ft. x 2011. floating dock (Slip #1) would be located waterward of the gazebo, extending
approximately 10ft. below NLW. A proposed 13ft. x 13ft. boatlift (Slip #2) would be installed to the west of the
proposed floating dock.
Water depths in the vicinity of the proposed boatlift and floating dock range from Oft. NLW on th4 dPVtD
edge to -0.911. NLW on the waterward edge.

Physical stops would be installed on the floating dock and boatlift pilings no lower than 18in. from the substrate
to reduce prop dredging during periods of low tide. As proposed, the docking facility would be located within
the applicant's area of riparian access and has obtained riparian setback waivers from both adjacent neighbors.
According to the application, the waterward edge of the proposed docking facility would be built approximately
1Oft. beyond the existing pier -head line to access deeper water but would not exceed the ''A width of Blane
Creek. As proposed, the docking facility would extend approximately 39ft. beyond the edge of marsh to
approximately 21 % of the waterbody width.
10. ANTICIPATED IMPACTS
The proposed two -slip docking facility would be located over an area of shallow water (Oft. to -0.9ft. NLW) in a
Primary Nursery Area. Installing physical stops 18in. above the substrate on the floating dock and boatlifts
could reduce impacts to soft -bottom habitat and limit usage to periods of mid and high tides. Despite using
stops to physically limit the structures' height above the substrate, prop scouring in critical habitat is still a
concern during ingress and egress.
The proposed two -slip docking facility would result in the shading of 114sq. ft. of Coastal Wetlands and the
incorporation of approximately 647sq. ft. of Estuarine Waters and Public Trust Area. As proposed, the docking
facility would be located waterward of the pier -head line but not exceed the `/, width of the waterbody. The
applicant has received signed waivers to encroach into the 1511. riparian corridor setbacks to the east and west.
Turbidity associated with the piling installation would be kept to a minimum.

The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for 1002
North Shore LLC, for State approval for the construction of a new two -slip docking facility, located at 1002 North
Shore Dr., Sunset Beach, Brunswick County, NC. It was received complete on May 25, 2021 and appears to be
adequate for processing at this time. The projected deadline for making a decision is August 8th, 2021. An
additional 75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 25, 2021 you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
