Based on the information provided, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received by DCM on November 3, 2021, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. STRUCTURAL ACCESSWAY EXEMPTED 1. The accessway must not exceed six feet in width and shall provide only pedestrian access to the ocean beach. 2. The accessway must be constructed so as to make negligible alterations to the frontal dunes. This means that the accessway must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any alteration to the dunes. In no case shall the frontal dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. 3. Construction of the accessway be shall consistent with all other applicable local ordinances and N.C. Building Code standards. 4. No portion of the proposed walkway may extend beyond the seaward toe of the Frontal Dune,nor shall it extend onto the wet sand beach.The walkway shall terminate as close as possible to the toe of the existing frontal dune. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 120 days from the date of the letter. The surveys have my name on them, they are sealed, and i am the current owner. The "zig zag" crossover would be acceptable, provided the walkway was limited to 6' in width throughout the continuance. As for getting this approved, the only think I need is the name, mailing address and telephone number of the property owner, as recorded with the County/local government. I have adjusted the survey keeping in mind the rear toe of the dune. I also was asked by my wife to propose having a horizonal bend in the 6 foot uncovered walkway at the peak of the dune. She saw a similar design down the street from us so wondered if we would do that too? In any case, i have attached the proposed design and the walkovers are now in green and descriptions in red. The only issue I see with regard to your proposal is that the walkways would need to terminate at the base of the dune (shown as rear toe of dune on your drawings), along the ocean side. Unfortunately, I cannot authorize any walkway extension seaward of the toe of dune. Let me know once you have addressed and revised.
