Dear Mayor Styron:
The Coastal Resources Commission (CRC) met in Wilmington on October 23-
24, 2002 and considered the request from the Town of Oriental that it delegate
planning authority to the Town to develop an individual land use plan.
Upon finding that Oriental has adopted and is enforcing zoning and subdivision
ordinances and is enforcing the State Building Code regulations within its
jurisdiction, the CRC granted individual planning authority in accordance with
N.C.G.S.113A-110(c).

Dear Mrs. Vinson,
The Town of Oriental is seeking authorization to write it's own CAMA Land Use Plan.
The Town of Oriental does have a zoning ordinance (Growth Management Ordinance)
and a subdivision ordinance. Both ordinances are enforced by the Town.
All building inspections in the Town are performed by the Pamlico County building
inspector. To the best of my knowledge, all State Building Code regulations are enforced.

In accordance with § 113A-110(c) Coastal Area Management Act and the 2002 Coastal
Resources Commission (CRC) Land Use Planning guidelines [7B.0701(a)], any municipality
that wishes to develop and adopt its own CAMA Land Use Plan must be delegated this authority
by either the County in which municipality is located or through the CRC.
In order for the CRC to grant authority to a municipality to develop an individual plan, the
regulations require the CRC to find that the local government has adopted and is enforcing
zoning and subdivision ordinances and is enforcing the State Building Code regulations within
its jurisdiction.
If your municipality wishes to seek authorization to write an individual plan from the CRC, a
letter must be submitted to the CRC from the Mayor or his/her designee verifying that the
municipality has adopted and is enforcing zoning and subdivision ordinances and is enforcing
the State Building Code regulations. The letter should be sent to Kathy Vinson, Planning and
Public Access Manager, Division of Coastal Management, 151-B Highway 24, Hestron Plaza II,
Morehead City, NC 28557.
If your municipality wishes to seek authority from the County in which you are located, a
certified resolution from the County's elected board of this action, a letter from the chief elected
County official documenting the action of the elected board, or a certified copy of the minutes of
the meeting where the authorization was granted must be submitted to the Division of Coastal
Management (a sample resolution is enclosed). Please note that the regulations do not require the
County to make the findings required of the CRC concerning municipal adoption and
enforcement of zoning and subdivision regulations and enforcement of the State Building Code
regulations. This documentation should also be sent to Kathy Vinson in Morehead City.
For those municipalities anticipating grant assistance for plan development, please note that the
funding contract will be contingent upon,receiving CAMA land use planning authority from
either the County or the CRC. Therefore you should promptly proceed with this process.

RESOLUTION DELEGATING AUTHORITY TO THE (Town/City off TO
ADOPT AN INDIVIDUAL LAND USE PLAN INDEPENDENT OF (
COUNTY) AS ALLOWED UNDER THE COASTAL AREA MANAGEMENT
ACT OF 1974
WHEREAS, § 113A-110(c) of the Coastal Area Management Act (CAMA) provides that
either the County or the Coastal Resources Commission (CRC) may delegate
responsibility to a municipality to prepare and adopt a CAMA Land Use Plan
independent of the County Land Use Plan; and
WHEREAS, the County Commissioners were advised that the Town/City
of has requested authority from County to prepare a CAMA
Land Use Plan independent from the County CAMA Land Use Plan; and
WHEREAS, the Town/City of is recognized as an incorporated municipality
by the State of North Carolina and is located in the County of ;
NOW, THEREFORE BE IT RESOLVED that the County of, has delegated
authority to the Town/City of to prepare and adopt its own CAMA Land
Use Plan for areas within its planning jurisdiction.
