Box 2475 Surf City, NC 28445 RE: EXEMPTED PROJECT(MINOR) - MAINTENANCE AND REPAIR (15A NCAC 07K .0103) 2404 S. Shore Drive, Surf City, Pender County OCEAN HAZARD AREA OF ENVIRONMENTAL CONCERN Dear Mr. Rademacher: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your submitted site drawing received on February 8, 2011 and meet the conditions specified below. If you plans should change and your project will no longer meet these conditions, please contact me before proceeding. MAINTENANCE AND REPAIR- (G.S. 113-103(5)(6)(5) and 7K.0209) - Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are permissible. The repairs are limited to 50%of the physical value of the existing structure and the following specific conditions: 1. The project consists of the repair of the existing beach access, as shown on the attached drawing. 2. The proposed repairs shall be consistent with all other applicable local ordinances and North Carolina Building Code standards. 3. The accessway must not exceed six feet in width and shall provide only pedestrian access to the ocean beach. 4. The accessway must be constructed so as to make negligible alterations to the frontal dunes. This means that the accessway must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any alteration to the dunes. The accessway shall be constructed in a manner that would minimize any impedance of the public use of the beach. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date of the letter.
