concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area
Management"
Issued to Damon and Morgan Oney authorizing development in the Ocean Hazard (AECs) at 1320 N. Shore Drive, in Surf
City, Pender County as requested in the permittee's application, dated March 12, 2021, and received by DCM on June 1,
2021. This permit, issued on June 16, 2021, is subject to compliance with the application and drawing dated received by
DCM on June 1, 2021, (where consistent with the permit), all applicable regulations and special conditions and notes set
forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action, or may cause the
permit to be null and void.
This permit authorizes: Construction of a beach access walkway, deck and gazebo.
(1) All proposed development and associated construction must be done in accordance with the permitted drawing dated and
received by DCM on June 1, 2021.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(2) Any change or changes in the plans for development, construction, and/or land use activities will require re-evaluation and
modification of this permit.
(3) A copy of this permit shall be posted or available on site throughout the construction process. Contact this office at(910) 796-
7221 for a final inspection at completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. This permit must be on the project
site and accessible to the permit officer when the project is inspected for Jason Dail
compliance. Any maintenance work or project modification not covered under CAM OCAL PERMIT OFFICIAL
this permit,require further written permit approval.All work must cease when this 127 Cardinal Drive Extension

(4) The permittee is required to contact the Local Permit Officer (910) 796-7221, shortly before he plans to begin
construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline
change. Construction must begin within sixty (60) days of the determination or the measurement is void and must
be redone.
(5) Any structure(s) constructed within the Ocean Hazard area shall comply with the NC Building Code, including the
Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage
Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code
or a flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more
restrictive provision shall control.
(6) The authorized gazebo shall be a free-standing structure and shall not be structurally connected to the
authorized decking or any other component of the structure. The total square footage of the gazebo,
including the roof overhang,shall not exceed a footprint larger than 192 square feet.
(7) This permit does not authorize the removal of sand or vegetation on/in the frontal dune, with exception of
that necessary for piling installation.
(8) With exception of the beach access walkway, 168 sq. ft. or less of elevated, uncovered, structurally independent
decking and 192 sq. ft. gazebo, all other structure(s) must be set back a minimum of 60 feet from the First Line of
Stable Natural Vegetation (FLSNV), as determined by the DCM, the LPO,or another assigned agent of the DCM.
(9) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetated and stabilized (planted and
mulched)within 14 days of construction completion.
(10) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by
changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time
when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural
shoreline recovery or beach renounshment takes place within two years of the time the structure becomes
imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or
dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary
protective measures allowed under CRC rules.
(11) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third-party.The permittee is required to contact the Local Permit Officer (910) 796-7221, shortly
before he plans to begin construction to arrange a setback measurement that will be effective for sixty (60) days
barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the
measurement is void and must be redone.
(12) With exception of the 6' wide or less beach access walkway, this permit does not authorize any development
seaward of the First Line of Stable Natural Vegetation(FLSNV).

regulations, applicable local ordinances and FEMA Flood Regulations.

FILLING OUT THE APPLICATION FORM
The shaded area at the top of the first page is completed by the Local Permit
Officer. The LPO will assign a permit application number and check the AEC in
which the property is located.
In the general information section, the applicant and future permittee is always the
Land Owner, although an agent, such as a contractor or realtor, may obtain the
permit for the property owner. The applicant's mailing and email address is entered
here. If an agent is utilized to apply for the permit, their contact information is
entered in the Authorized Agent section. Location of Project is the address of
property where the work is to take place (the 911 address, subdivision and lot
number, State or County road, etc.). Description of Project should include all land
clearing, demolition, construction, and landscaping activities that are proposed to
complete the project. It is better to go over-board here, than to omit something that
would necessitate having to modify or re-apply for another permit to complete the
development. Size of Lot/Parcel can be listed as square feet or acres, or both.
Check the applicable Proposed Use, residential (single-family or multi-family),
commercial, or other. The Total Floor Area of a Building in the Ocean Hazard
AEC section is only completed for those projects that are located in one or more of
the Ocean Erodible, High Hazard Flood, Inlet Hazard or Unvegetated Beach AECs.
Total Enclosed Floor Area is the combined square-footage of all heated or air
conditioned living space. If the project is not in the Ocean Hazard Area, then insert
N/A and go to the next section and determine in which Coastal Shoreline AEC the
project is located. The Size of Building Footprint and Other Impervious
Surfaces/Built-Upon Surfaces in the Coastal Shoreline AEC is calculated by
totaling all of the impervious surfaces within the applicable distance (30 ft., 75 ft. or
575 ft.)from Normal High Water(NHW)or Normal Water Level (NWL). Sometimes
the impervious surfaces that are allowed on an individual lot are further limited by
the conditions of the subdivision's State Stormwater Management Permit. The
applicant should insert the amount of impervious coverage that is allocated to their
lot under their subdivision's State Stormwater Permit. This number is usually found
on the property deed or subdivision covenants. Typically, any subdivision that was
developed after January 1,1988, will have a State Stormwater Plan.
On the second page of the application, the section entitled Statement of
Ownership is completed by the applicant using information from the property
deed. The applicant must check one of the three options and fill in the appropriate
information. Make sure that adjacent riparian property owners have been listed in
the Notification of Adjacent Property Owners section and that they have been
contacted by the applicant, either in person or by certified mail. Copies of the
completed letters and certified mail receipts, if required, should accompany the
application.
Finally, the applicant/agent must sign and date the application at the bottom
of the page.

The Division of Coastal Management's Wilmington Regional office received a CAMA Minor Permit application from you
on April 15, 2021, and a subsequent submittal was received by DCM on May 17, 2021, requesting approval for
development activities at 1320 N. Shore Drive, Surf City, NC. In reviewing your application, we have discovered that
additional information is needed to complete the review process. Accordingly, I am requesting that you submit the
following additional information to this office:
1) On page 1 of the application package, uder"Description of Project", you have noted that you intend to construct a
"522 sq. ft. deck". Please be advised, due to the location of the proposed structure, in relation to the vegetation
line,the square footage for decking allowance is capped at 500 sq. ft. Please revise the application package and
site plan to reflect the reduction of decking to 500 sq. ft. or less.This revision was requested based on the initial
submittal and has

these structures will need to be structurally independent of one another and will need to be shown that way on
the site plan(s). While 15A NCAC 07H .0309 (a) allows for up to 500 sq. ft. of decking, and up to a 200 sq. ft.
gazebo, these structures would need to remain structurally independent of one another with their own support
pilings, banding/girders, etc. Please revise the site plan to depict these structures as "structurally independent".
The cover being supported by individual pilings does not make this a gazebo. For permitting purposes, the gazebo
will need to be separate (i.e. structurally independent—framing, pilings, roof, decking, hand rails, etc.) from the
decking, otherwise the roof portion is considered a covered deck.
In accordance with the Department of Environment and Natural Resources regulations,we note that the
application for 1320 N. Shore Drive,Surf City, as received in our office on April 15, 2021, and May 17, 2021 is
incomplete for processing. Upon resubmission of a complete application, a local decision will be made in 25 days,
provided this period is not extended as provided by law. Please contact me at 910-796-7221 if you have any

FLSNV) at this property for Oscar Rodriguez, and while the site plans refer to a
"FLSNV", there are not reference points to identify where this line is located in relation to
your proposed development. Please revise the site plans to accurately reflect the reference
points associated with the alignment of the FLSNV, and all proposed development. The
site plan should also show the 60' small structure setback, which is measured landward of
the FSLNV.
3) Please be advised, with exception of a 6' wide or less beach access walkway(or run
of steps), no development is permissible seaward of the FLSNV. According to your site

overhang cannot be permitted according to 15A NCAC 07H .0306 (a)(5). Please revise the
site plan and eliminate any portion of the proposed decking or gazebo so that it does not
extend seaward of the FLSNV.
4) The site plans also show one cohesive structure to include a covered deck and
uncovered deck. Please be advised these structures will need to be structurally
independent of one another and will need to be shown that way on the site plan(s). While
15A NCAC 07H .0309 (a) allows for up to 500 sq. ft. of decking, and up to a 200 sq. ft.
gazebo, these structures would need to remain structurally independent of one another
with their own support pilings, banding/girders, etc. Please revise the site plan to depict
these structures as "structurally independent".
5) Please show the property boundaries on the site plan drawings.
6) Based on the information provided in the application package, it appears you notified
KS KS Enterprises as part of the requirement for adjacent property owner notification.
Please be advised,the Town of Surf City will also need to be notified(via hand delivery
or certified mail) as their property (Public Beach Access site no. 7) abuts your property
along the northern side. Please provide proof of this notification to complete this portion
of the application requirements.
