Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Justin, I have a dock that is looking to get expanded 14' waterward of the current alignment. It's close to the USACE
setback, but not necessarily dangerously close. I wanted to run this by you to see if you had any concerns about the
proposal, or if you may have better measurement tools than I do. Just wanted to cover all the bases before moving
forward. Please let me know if you have any concerns or if you need any additional information. Below is the response I
planned on giving to the applicant:

Mr. Cruz, in reviewing your preliminary drawings, I wanted to share a few notes. First, as long as your new construction
has a vertical elevation difference of 12", it can be considered a separate component and will still meet our
requirements of having no single component of the facility exceeding 400 SF. Secondly, the image attached below
shows the additional 14' waterward expansion of the platform indicated by the yellow line. The red line is the USACE
setback requirement. It is imperative that you do not encroach into that channel. From aerial measurements it appears
that you have—20-22' from that setback line, so please stress to Mr. Moore that 14' is the MAXIMUM extent of the
development that would be allowed.
If all of these requirements can be adhered to, it would seem at this time that your proposed development would qualify
for a general permit .1200.
