This letter confirms that on December 4, 2017, Frank Jennings and myself met with you to discuss a Notice
of Violation issued to you for the unauthorized installation of a block/brick patio with a gas fire pit within the
30' buffer along Yeopim Creek, at 108 Virginia Court, in Perquimans County. Notice of Violation case
number 17-15A was issued to you on September 25, 2017, for the unauthorized work and restoration was
requested.
Based on our conversation and your subsequent letter to Director Braxton Davis dated December 15, 2017,
1 am extending the restoration time limit. A final restoration date will be determined based upon the
Director's response to your request to retain the unauthorized development.

On January 31, 2018, 1 received your letter in reference to the 30-day time limit for restoring or
obtaining approval for the unauthorized development within Estuarine Waters and Public Trust
Areas of Environmental Concern within the Atlantic Intracoastal Waterway (AIWW) adjacent
your property located at 811 Shoreline Dr. W., in Sunset Beach, Brunswick County, North
Carolina. Notice of Violation case number 17-30D was issued to you on December 22, 2017
for the unauthorized work and requested restoration.
Based on your letter, and the circumstances surrounding this case, your request to extend the
restoration time limit is approved to allow you additional time to comply with the requested
restoration. The restoration time limit is extended to February 28, 2018. The requested
restoration must be performed to the satisfaction of the Division of Coastal Management by
the date indicated or you must provide an explanation for non-compliance and a reasonable
request for a time extension.

AGREEMENT TO PAY PROPOSED CIVIL ASSESSMENT
I understand that the staff of the Department of Environmental Quality will propose the assessment of a civil
penalty in the amount of $928.00against me for violation of the Coastal Area Management Act, NCGS 113A-
100 et sec, committed on or near property located at 212 Harbinger Ridge Road in Currituck County, North
Carolina. In order to resolve this matter with no further action or expense on my part, I accept responsibility
for the violation as described in the Notice of Violation letter dated September 7, 2017, and agree to pay the
proposed civil assessment of $928.00.
