Re: Objection to the Issuance of CAMA General Permit No. 86435-A for a Docking Facility Development Project,
located at 97 Osprey Lane, Southern Shores, Dare County.
Dear Mr. & Mrs. Galganski:
The Division of Coastal Management has reviewed your correspondence dated September 30, 2021 and received on
October 5, 2021, in regards to your objection as an adjacent riparian property owner to a permit request from Millstone
Marine Construction, an agent for Mark & Christine Mueller, The permit request was for the construction of a 13'x13' boat
lift and to properly notify you of changes in the existing docking facility's initial orientation and location along the shoreline
of 97 Osprey Lane in Southern Shores, Dare County. On September 16, 2021, DCM Field Representative Sarah Loeffler
conducted a site visit to evaluate the permittee's need for additional permitting, and to address the concerns expressed by
you in a phone call on September 8, 2021.
Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for
General Permits for this type of development that are found in 15A NCAC 07H.1200,
The Division has reviewed your objections, along with all aspects of this development proposal for consistency with the
aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the
proposed modification has found it to be consistent with the Rules of the CRC and the State's Coastal Management
Program, and that all pre -requisites have been satisfied. Therefore, the Division of Coastal Management issued the
General Permit No. 86435-A on December 6, 2021 (copy attached) for the proposed development.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division
of Coastal Management within 20 days of the permit issuance date. If you choose to pursue an appeal, please contact
this office so that we can provide you with the appropriate forms and addresses.

In response to the received Boatlift addition for owner Mark Mueller:
OBJECT. Owner Mueller's original application for proposed pier depicted the structure in or
about the middle of the 140' bulkhead, which in good faith, was not objected to. However, in a
bad faith move and without further notice, owner shifted the structure to the far end of the
bulkhead, settling within 1' of the permitted 15' off the adjacent property line. The proposed
boat lift sits parallel and as close as permitted by rules to our existing boat launch. It is clear
that the owner intended to leave his sightline undisturbed without any regard to his neighbor
by producing an unnecessary hardship to the egress and ingress to our boat launch.
Although we are of the understanding the application of this structure will most likely be
permitted under the existing rules, the deception exhibited by the applicant is unacceptable.
When an application is submitted for approval it should be held to the intent presented. The
owner could have comfortably shifted the structure utilizing any other portion of the 140'
bulkhead, especially in light of the fact the property to his right has no pier, bulkhead or boat
launch and is not occupied by a full time resident. Further, the applicant is not a full-time
resident and will not be utilizing the structure on any routine basis making his deception even
more callous.

Mark Mueller. I did not include a boatlift when we originally permitted the pier. This
