PERMIT NORTH CAROLINA as authorized by the State of North Carolina, Department of Environmental Quality Environmental Quality and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area Management" Issued to Romas Heath Shoaf III authorizing development in the Ocean Hazard (AECs) at Lot 4, North Shore Drive (PIN801-23), in Surf City, Onslow County as requested in the permittee's application, dated June 14, 2018, and received by DCM on August 2, 2018. This permit, issued on August 15, 2018, is subject to compliance with the application and drawing dated received by DCM on July 27, 2018, (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Construction of a beach access walkway, deck and gazebo. (1) All proposed development and associated construction must be done in accordance with the permitted drawing, prepared by Weston Lyall, PE, PLS, PLLC, sealed on 7/26/2018 and received by DCM on July 27, 2018. (2) Any change or changes in the plans for development, construction, and/or land use activities will require re-evaluation and modification of this permit. (3) A copy of this permit shall be posted or available on site throughout the construction process. Contact this office at(910)796- 7221 for a final inspection at completion of work. Construction must begin within sixty (60) days of the determination or the measurement is void and must be redone. (5) Any structure(s) constructed within the Ocean Hazard area shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive provision shall control. (6) The authorized gazebo shall be a free-standing structure and shall not be structurally connected to the authorized deck. (7) This permit does not authorize the removal of sand or vegetation from/on/in the frontal dune, with exception of that necessary for piling installation. (8) With exception of the beach access walkway, 500 sq. ft. or less of elevated uncovered decking and 200 sq. ft. gazebo, all other structure(s) must be set back a minimum of 60 feet from the First Line of Stable Natural Vegetation (FLSNV), as determined by the DCM, the LPO, or another assigned agent of the DCM. (9) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Disturbed areas shall be vegetated and stabilized (planted and mulched)within 14 days of construction completion. (10) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC rules. (11) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third-party. NOTE: All construction must conform to the N.C. Dear Mr.Dail, We have received the referenced application as required by CAMA regulations and respond in strong opposition. We are opposed to this permit application for numerous reasons,too many to include in this initial letter. As I am positive there will be further submittals,I ask that all copies of all materials associated with this request be forwarded to me so that I can to review any proposal for Lot 4,North Shore Drive. You should not consider this rudimentary drawing to be the only submittal that should be forwarded to me,as I am aware how far out of compliance with CAMA rule this drawing and application are. I respectfully request to be copied on each revision. I have reviewed other similar CAMA permits and would like to point out some of the most glaring problems. First,much of the drawing is completely falsified. The applicant labels the location of"Sand Dunes"and"Elevated Stairs to top of Dunes"as if to suggest the frontal dune is located well away from the proposed construction,when in fact the location labeled"Sand Dunes"and"Elevated Stairs to top of Dunes"would be in the ocean well past average high tide. The board walk as shown on the drawing would extend all the way across the beach and into the ocean. There is no"vegetative line"shown,no vertical elevations shown,no visual depiction of what's proposed,and I strongly disagree about excluding the boardwalk square footage from the deck square footage when it is clearly the same platform elevation. Extending the deck square footage by simply labeling it differently makes the structure square footage contestable and worthy of appeal. The dunes at this location are some of the highest on the Island and there is no mechanism on the drawing to ensure the proposed deck and board walk would be constructed above the dune. Otherwise does the applicant propose to partially grade the dunes? Additionally there are no drawings of the railings or enclosure of the deck/gazebo to determine compliance with CAMA rules. There are no building standards shown likewise to ensure that this structure will not be uprooted and thrown against our homes during a hurricane. To be clear about this,Mr.Shoat is the applicant,but the lot owner is a limited liability corporation. According to the application the proposed structure will neither be residential,commercial,nor industrial;but instead"other". "Other"is on the CAMA application but not in the CAMA regulations. "Other"is too vague and I believe I am entitled to know what the LLC proposes to build and therefore how the LLC will use the property. I respectfully request to know specifically if the deck/gazebo will be rented. Because the proposed structures are non-residential, renting these would not be the same as renting a house,but more akin to renting a boat,or a bicycle,or a camping lot,and therefore must be designated as a commercial use. They cannot be called residential as there are no overnight accommodations,no sanitary sewer,and are not "accessory"to any residential use. Please understand that the Surf City Zoning designates this lot as residential and according to Section 4.19 Table of Uses,these structures are not listed as Permitted Uses. If CAMA chooses to permit the structure they would be at odds with the Surf City zoning code,and the CAMA standard that requires applications to"conform to local codes". Additionally,the application is not compliant with numerous CAMA standards including sections:.0303,.0306 I,b,d,k,.0308 B,C,D,.0309 A,E,G,I,and.0203 C4,A,and.0207. This should be considered a partial list as the current application is grossly deficient and cannot be completely reviewed. Mr.Dail,everyone in our community is opposed to this application. The proposal is not like other simple board walks to the beach. It opens a new"can of worms"for what is now a great place. The people here like it when turtles crawl onto the beaches and lay eggs. Quite franldy we are baffled why anyone who doesn't live here wants to build a$48,000 private beach access only about 100 yards from a public beach access. Parking is not a concern as there is only 1 or 2 days a year when a parking space is difficult to fmd. If permitted and built,theses structure will completely change the character of neighborhoods,and increase the burden on local police response. We are already being instructed to call the police if we have any concerns about their use. All the neighbors intend to call every time someone is urinating,throwing down trash,or sleeping in a vehicle parked at the proposed structure. Surf City does not need to go through this change. If permitted this deck/gazebo combo will set a terrible precedent for other neighborhoods and eventually there will be an uproar about how all this got started. Thank you for the opportunity to review this proposal. It is apparent that the CAMA rules are working and worthy of the public's support. I'm sure the entire town of Surf City would express appreciation for the unique,lengthy stretches of ocean front dunes that are a result of the CAMA program. The reference application is not consistent with CAMA rules and must be denied. Please advise me that this was done. Otherwise please advise me if any other action was taken or if any other plan,proposal,or any activity whatsoever,for the lots along North Shore Drive is submitted.
