All proposed development and associated construction must be done in accordance with the application and work plat drawings dated received by DCM on August 3, 2017, and subject to the following stipulations of the CRC Variance Final Order and additional permit conditions listed on Page 2. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s)dated received by the Division of Coastal Management on August 3, 2017. (2) Any change•or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. Disturbed areas shall be vegetated and stabilized (planted and mulched)within 14 days of construction completion. (6) The permittee is required to contact the Local Permit Officer (910) 796-7221, shortly before he plans to begin construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be redone. (7) Any structure(s) constructed within the Ocean Hazard area shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive provision shall control. (8) All buildings must be elevated on pilings with a diameter of at least 8 inches in diameter if round, or 8 inches to a side if square; and the first-floor level of the sills and joists must meet the 100-year flood level elevation. (9) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. (10) With exception of the authorized 37 sq. ft. enclosure(as granted under CRC Variance 17-06), all other development shall be located a minimum distance of 60' landward of the First Line of Stable Natural Vegetation(FLSNV). (11) This permit does not authorize any deck expansion seaward of the 60' setback, as measured from the First Line of Stable Natural Vegetation (FLSNV). (12) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC rules. State of North Carolina I Environmental Quality I Coastal Management 127 Cardinal Drive Ext.,Wilmington,NC 28405 STATE OF NORTH CAROLINA BEFORE THE NORTH CAROLINA COASTAL RESOURCES COUNTY OF PENDER COMMISSION CRC-VR-17-06 IN THE MATTER OF: ) PETITION FOR VARIANCE ) FINAL AGENCY DECISION BY MICHAEL AND MARY DRUMMOND ) As part of the renovation of their oceanfront property located at 1924 South Shore Drive in Surf City, Pender County, Petitioners Michael and Mary Drummond ("Petitioners") request variances from 15A NCAC 7H .306(a)(9)and 7H .0309 to allow construction of additional decking oceanward of the house and to enclose 37 square feet of decking under roof on the landward side of the house. Prior to Petitioners seeking a variance, DMC denied their request for a minor permit pursuant to the Coastal Areas Management Act of 1974 (hereinafter "CAMA") because the proposed development is located within the oceanfront erosion setback. This matter was heard on oral arguments, written briefs, stipulated facts and stipulated exhibits at the regularly scheduled meeting of the North Carolina Coastal Resources Commission (hereinafter Commission) on November 7, 2017 in Atlantic Beach, North Carolina pursuant to N.C. Gen. Stat. § 113A-120.1 and 15A NCAC 7J .0700, et seq. Assistant General Counsel Christine A. Goebel, Esq. appeared for the Department of Environmental Quality, Division of Coastal Management(DCM) and I. Clark Wright, Esq. appeared on behalf of Petitioners. The Commission adopts the following: STIPULATED FACTS A. Petitioners Mary and Michael Drummond own property located at 1924 South Shore Drive, Surf City, in Pender County,North Carolina(the "Site"). The Site consists of Lots 22, 23, 24 and 25, Block B, White Hills Beach, Surf City,North Carolina. B. Petitioner Mary Drummond's family has owned, used and enjoyed the Site since her father's purchase of the Site on June 30, 1970. During her childhood and continuing into her adulthood, Petitioner Mary Drummond used and enjoyed the family beach home located on this Site several times each year, on average. More recently, Petitioner Michael Drummond has used and enjoyed the Site twice per year on average since his marriage to Petitioner Mary Drummond in 1989. A copy of the 1970 deed was provided as a stipulated exhibit. C. Petitioner Mary Drummond first acquired legal interest in the Site by inheritance in 2008, upon the passing of her Father. BB&T managed the estate upon Mr. Herring's passing, and over time, Petitioners became dissatisfied with BB&T's management. D. Between 2008 and 2016, Petitioners unsuccessfully sought approval from BB&T as Trustee of the Site for repairs, including repairing storm damage to foundation pilings, addressing general wear and tear, and funding enclosure of the small area of the beach house that is the subject of the current variance request. E. Petitioners and Staff disagree on where the setback would have been located between 2008 and 2014 had Petitioners sought a CAMA permit during that Period. It is Petitioners' contention that if BB&T as Trustee had approved these needed repairs between 2008 and 2014, the FLSNV would have been more than 60 feet from the footprint of Petitioners' beach home and no CAMA permit authorization would have been required. DCM Staff contends that,based on a review of aerial imagery and using the measuring tools to measure 60' landward of the FLSNV, the area of the house where the 37-square foot addition was located within the setback since 2008. Page 2 of 15 F. On February 15, 2017, Petitioners purchased the Site outright because of their dissatisfaction with BB&T's management of the Site. This purchase was through an Executor's Deed, recorded on February 15, 2017 in Book 4637, beginning at Page 1751, Pender County Register of Deeds. A copy of this deed was provided as a stipulated exhibit. G. The Pender County Tax Card shows that the first home on the Site was built in 1972 and the current home was renovated after Hurricane Fran in 1996. The current building footprint has existed since 1982. A copy of the tax card was provided as a stipulated exhibit. H. The Site is located within the Ocean Erodible portion of the Ocean Hazard Area of Environmental Concern("AEC"), adjacent to the Atlantic Ocean. The applicable erosion rate at the Site is 2'/year, and so the setback for this proposed development under 5,000 square feet is 60' landward of the first line of stable and natural vegetation. There have been no large-scale nourishment projects at the Site, and so the actual first line is used,as there is no static line or development line. Surf City has no long-term nourishment project permitted or planned. I. Pursuant to N.C.G.S. 113A-118,the proposed development requires the issuance of a CAMA permit. J. At the Site, the waters of the Atlantic Ocean are classified as SB waters, open to the harvest of shellfish. The portion of the Site where development is proposed is located within a VE 14 Flood Zone. The landward portion of the Site near the road is located within a VE 12 Flood Zone. This Site is not located in a COBRA zone. K. On or about August 3, 2017, Petitioners applied for a CAMA Minor Development Permit proposing to convert 37 square feet of currently roof-covered decking into enclosed "Total Floor Area" as defined by the Commission's rules. Petitioners also propose to re-work the Page 3 of 15 existing decking which has approximately 665 square feet waterward of the 60' setback, including the removal of approximately 49 square feet of existing decking, the addition of approximately 137 square feet of new decking for a total of 753 net square feet. Petitioners also propose interior renovations and replacement of some pilings which are not part of this variance. A copy of Petitioners' CAMA Minor Development Permit Application with site plans was provided as a stipulated exhibit. L. The adjacent riparian property owners are The Shapiros to the northeast at 1920 South Shore Drive, and the Benedicts to the southwest at 1926 South Shore Drive. Both adjacent riparian property owners received certified mail notice of Petitioners' Minor Development CAMA permit application. Copies of the certified mail receipts were provided as a stipulated exhibit. M. Surf City does not have an authorized CAMA Minor Development Permit program, so Petitioners' application was processed by DCM's Wilmington Regional Office Staff. N. DCM received no objections from adjacent property owners or any member of the public. O. Most of Petitioners' existing beach home is located oceanward of the 60 foot CAMA setback line based on the location of the FLSNV flagged by DCM staff on April 18, 2017, and shown on Petitioners' site plans. The proposed 37 square foot addition is located within the setback, approximately 45 feet landward of the FLSNV. This addition to the Total Floor Area is required by the Commission's rules at 15A NCAC 7H .0306(a)(9)to be landward of the 60' setback,and it falls about 15' short of the setback line. Page 4 of 15 P. Petitioners have approximately 665 square feet of existing decking on the Site within the setback. Petitioners propose to re-work the decking by removing approximately 49 square feet and then adding approximately 137 square feet of new decking, for a net total of about 753 square feet of decking(253 square feet over the 500 square foot limit). However, Petitioners' are limited by the Commission's rules at 15A NCAC 7H .0306 and .0309, to no more than 500 square feet of elevated decking per 07H.0309(a)(3). Q. By letter dated August 23, 2017, DCM denied Petitioners' CAMA minor permit application, based on the proposed development of the house addition and the decking conflicting with 15A NCAC 07H.0306(a)(9) as the proposed development was not landward of the 60' setback, and because the decking exceeds the 500 square feet of decking exception of 7H.0309(a)(3). A copy of the DCM denial letter was provided as a stipulated exhibit. R. Both adjacent riparian property owners received certified mail notice of Petitioners' request for variance. Copies of these certified mail receipts was provided as a stipulated exhibit. Both adjacent property owners have communicated to Petitioners that they do not object to this variance. Copies of their correspondence were provided as stipulated exhibits. Additionally, the neighbor across the street to the north, Mrs. Teachey, has communicated to Petitioners she does not object to the variance. A copy of her correspondence was provided as a stipulated exhibit. S. For purposes of this Variance Request, Petitioners stipulate that their proposed 37 square foot addition constitutes development that is inconsistent with the CAMA setback specified in 15 NCAC 7H .0306(a)(9), and that the(existing and) proposed decking exceeds the 500 square feet allowed by 7H.0309(a)(3). Page 5 of 15 T. Petitioners' proposed improvements call for enclosing 37 square feet of deck area as additional heated/cooled "Total Floor Area" per the applicable CAMA use standard. This area is currently covered by the roof line of the existing home and Petitioners' building plans do not show any increase in impervious surface area on Petitioners' lot. U. As shown in the Site plans, no portion of Petitioners' proposed 37 square foot addition extends beyond the home's existing roof line and eaves. V. On October 4, 2017, Petitioners filed this Variance Request requesting a variance from the 60-foot setback requirement defined in 07H.0306(a)(9)with regard to the 37 square foot addition, and from 07H.0306 and 07H.0309(a)(3) in order to re-work the decking which exceeds the 500 square foot limit by approximately 253 square feet. The proposed development changes are shown on Petitioners' CAMA permit application materials provided as a Stipulated Exhibit. STIPULATED EXHIBITS Included with the Petition and the Staff Recommendation for the Commission's review were the following Stipulated Exhibits: A. June 29, 1970 Deed of Conveyance to Petitioner Mary Dnnnmond's father, Otha Edwin Herring and wife, Jeanette Lewis Herring; B. Petitioners' 2017 Tax Card for 1924 S. Shore Drive; C. Petitioners' Google Earth aerial images of 1924 S. Shore Drive from 2008-2016; D. DCM staff's aerial images of 1924 S. Shore Drive depicting the vegetation line and 60- foot CAMA setback from 2008-2016; E. February 13, 2017 Executor's Deed to Petitioners; F. Letter dated August 23, 2017 denying the CAMA Minor Development Application to Mary and Michael Drummond from Jason Dail; I. Petitioners' notice of variance to adjacent riparian property owners, the Shapiros and Benedicts,with email replies in support of the variance; J. Letter supporting the variance to Petitioners from their neighbors Gary and Virginia Teachey. CONCLUSIONS OF LAW A. The Commission has jurisdiction over the parties and the subject matter. B. All notices for the proceeding were adequate and proper. C. Petitioners have shown that their request to enclose 37 square feet of decking, currently under roof,on the street side of the building meets the requirements in N.C.G.S. § 113A- 120.1(a)and 15 NCAC 07J .0703(f). D. Petitioners have failed to show that their request to increase the square footage of the deck on the ocean side of the building during the renovation meets the requirements which must be found before a variance can be granted. E. The Commission's analysis of each request is set forth separately as follows: 1. Request to Enclose 37 Square Feet meets Variance Requirements. a. Strict application of the ocean erosion setback in 15A NCAC 07H.0306(aX9)will cause unnecessary hardships. The Commission affirmatively finds that denying Petitioners' request to enclose 37 square feet of deck located under roof on the street side of their property would cause Petitioners unnecessary hardship. 15A NCAC 07H .0306 establishes general use standards for ocean hazard Page 7 of 15 areas and provides setbacks designed to protect life and property using calculations based on the total square footage of heated and air-conditioned living space. The ocean erosion setback rule is designed to ensure that development within the coastal shorelines is compatible with and does not harm the biological and physical functions of the shoreline system. The existing home includes approximately 1955 square feet of heated and cooled living space. Adding 37 square feet to the total would not have an impact on the amount of the setback calculated. The existing setback for the property is located 60 feet landward from the first line of stable, natural vegetation (FLSNV). Currently about two-thirds of the home is within the setback area. Without the variance, Petitioners would not be able to enclose an additional 37 square foot area on the street side of the property. Therefore, strict application of this rule would cause Petitioners unnecessary hardship. Following discussion regarding this factor, the Commission affirmatively found that Petitioners have shown that the hardship caused by denying a permit for the proposed development is unnecessary insofar as the Commission can protect the shoreline system even if the proposed enclosure is allowed as the proposed addition to the street side of the house will be de minimis in nature. Furthermore,the location of the enclosed area on the side of the house away from the ocean and under an existing roof line reduces the likelihood that it will create additional storm debris. For these reasons, the Commission affirmatively finds that Petitioners has met the first factor without which a CAMA variance cannot be granted as it relates to the 37 square foot enclosure. b. Any Hardship results from conditions peculiar to Petitioners' property. The Commission affirmatively finds that Petitioners have demonstrated any hardships resulting from denying the request to enclose 37 square feet on the street side of the house result Page 8 of 15 from conditions peculiar to the property space. Specifically, Petitioners' property have been unchanged since a 1996 renovation following Hurricane Fran and has maintained essentially the same footprint since the mid-1980s. The area involved is located completely under the existing roof and drip line and there is minimal potential for storm debris as a result of enclosing the front deck and adding 37 square feet of living space. Accordingly, the Commission affirmatively finds that Petitioners have demonstrated that any hardship resulting from a denial of their request to enclose 37 square feet of decking under roof results from conditions peculiar to the property. Thus, Petitioners have met the second factor required for the grant of a variance. c. Petitioners have demonstrated they did not cause the hardship associated with denying their request to enclose 37 square feet. The Commission affirmatively finds that Petitioners have demonstrated that any hardship caused by denying the request to enclose 37 square feet does not result from actions taken by the Petitioners. Specifically,any hardship is not based on Petitioners' action but would appear to result from the layout of the house which has remained unchanged after being renovated in 1996 following Hurricane Fran and has had the current building footprint since 1982.This footprint has been in place since before CAMA. Thus, Petitioners did not cause the hardship associated with denying the request. For these reasons, the Commission affirmatively finds that Petitioners have demonstrated that they have met the third factor required for a variance as it relates to the addition. Page 9 of 15 d. Petitioners have demonstrated that the request to enclose 37 square feet is consistent with the spirit, purpose and intent of the Commission's rules, will secure public safety and welfare, and will preserve substantial justice. Petitioners have demonstrated (a) that the requested variance to enclose 37 square feet of deck under roof to increase living space is consistent with the spirit, purpose and intent of the Commission's rules, (b) that it will secure public safety and welfare, and (c) that it will preserve substantial justice. The principal purposes of the oceanfront erosion setback rule is to protect life and property. The Commission is persuaded that the proposed addition of 37 square feet to the existing heated and cooled living space will have a de minimis impact and is unlikely to have adverse impacts on the resource protection goals of the CAMA program. Moreover,the proposed enclosed area is on the street-side of the existing house under roof and is unlikely to contribute debris in the event of a storm. Thus, the small additional enclosed area will have a negligible impact on public safety and welfare. Finally, granting the variance is consistent with substantial justice as it balances Petitioners' interest in renovating the property with the CAMA goals. For these reasons,the Commission affirmative finds that Petitioners have meet their burden to establish the fourth factor required by N.C.G.S. § 113A-120.1(a) without which a variance allowing enclosure of 37 square feet on the street side of the house cannot be granted. 2. Request to Add Ocean side Decking in 60 foot setback fails to meet Variance Requirements. a. Strict application of the ocean erosion setback in 15A NCAC 07H .0306(a)(9) and the exception allowed by 15A NCAC 07H .0309 does not cause Petitioners unnecessary hardships. The Commission affirmatively finds that denying Petitioners' request to add additional square footage to the deck on the ocean side of the house based on a strict application of the Page 10 of 15 Commission's rules would NOT cause Petitioners unnecessary hardship. 15A NCAC 07H .0309 allows an exception for 500 square feet of elevated decking to be located within the oceanfront erosion setback established by 15A NCAC 07H .0306(a). Petitioners' house currently includes more than the allowed amount of decking in the oceanfront setback. Despite the current overage, Petitioners have requested permission to renovate the deck and add an additional 137 square feet of decking to the total square footage in the oceanfront setback. The proposed deck additions are located oceanward of the existing deck, less than thirty feet waterward of the FLSNV on an eroding beach. The community does not have a history of large-scale nourishment and there is no long-term nourishment plan. These facts result in a strong possibility that the new deck could be impacted by future storms and cause damage to other homes, cause safety issues,and increase the public cost required to remove storm debris. Petitioners argue that their proposal addresses the Commission's concern because they are renovating a deteriorated portion of the deck. The Commission found this argument unconvincing because homeowners are responsible for property maintenance regardless of the circumstances. The Commission also notes any of the decking located on the oceanward side of the home is susceptible to both long-term oceanfront erosion and storm-related erosion. Given this potential for the new decking to be impacted by storms, any hardship caused by denying the proposed variance is a necessary hardship designed to protect the goals of CAMA and protect public safety and welfare. For these reasons, the Commission finds that Petitioners has failed to meet the first factor as it relates to the decking; therefore, a variance cannot be granted. Page 11 of 15 b. Petitioners failed to demonstrate that any hardship results from conditions peculiar to Petitioners' property. The Commission finds that Petitioners have failed to demonstrate that any hardship results from conditions peculiar to the property as it relates to the oceanfront decking. The Commission finds no peculiarities such as size,location or topography which cause hardships to the Petitioners. The Commission also found that the earlier damage and repair resulting from Hurricane Fran was not unique to the Petitioners. For these reasons,the Commission does not find that Petitioners have demonstrated the hardship related to the decking results from conditions peculiar to Petitioners' property. c. Petitioners fail to show that they did not cause the hardships. The Commission finds that any hardships caused by denying the variance request result from actions taken by Petitioners. The Commission agrees that the Petitioners did not cause the erosion of the vegetation line and dune system,and did not cause the deck to be located within the 60-foot setback. However, shoreline erosion is a common problem for oceanfront properties and is an issue taken into consideration in the Commission's rules. The Commission found that the hardship was caused by the Petitioners' choice of design, which exceeded the 500-foot exception allowed for decking under the Commission's rules. The Commission appreciated the fact that the Petitioners tried to reduce the potential for storm debris by renovating the existing deck (and presumably strengthening the deck). But, Petitioners have failed to carry their burden of showing why they could not simply rework the existing decking to conform to the Commission's rules instead of adding square footage to the decking which is already at risk within the ocean erosion hazard setback. Page 12 of 15 d. Petitioners have failed to demonstrate that the requested variance is consistent with the spirit,purpose and intent of the Commission's rules, will secure public safety and welfare,and preserve substantial justice. Petitioners have failed to demonstrate(a)that the requested variance is consistent with the spirit, purpose and intent of the Commission's rules, (b) that it will secure public safety and welfare,and(c)that it will preserve substantial justice. The principal purposes of the ocean hazard setback rule is to protect life and property. Petitioners do not state any credible reason for needing to rework the design of the oceanfront portion of the existing deck and enlarge the square footage. The Commissin's rule already provides a generous exception authorizing 500 square feet of elevated decking within the setback. Here Petitioners are requesting permission to add square footage within the setback. The plan calls for this square footage to be added to the oceanward side of the house, closest to the ocean hazard and most susceptible to both long-term erosion and storm-related erosion.Additionally this site has not received nourishment in the past,and Surf City has no long-term nourishment plan. On this eroding shoreline, it is likely that in a short period of time, the new decking, which would be less than thirty feet from the FLSNV, could encroach on the public trust beach. For these reasons, the Commission affirmatively finds that Petitioners' proposed development of an oceanfront deck is NOT consistent with the spirit,purpose,and intent of the Commission's rule, and will negatively impact public safety and welfare. Finally, the Commission affirmatively finds that Petitioners have failed to establish that granting a variance will preserve substantial justice. On the contrary, it would create an injustice to allow Petitioners to construct a deck that is not aligned with the Commission's rules when other property owners are required to follow the rules and are limited to having only 500 square feet of deck within the ocean front eroision setback. Page 13 of 15 For all of these reasons, the Commission affirmatively finds that Petitioners request to increase the size of their ocean front deck fails to meet the fourth factor required by N.C.G.S. § 113A-120.1(a). ORDER THEREFORE, the requested variance from 15A NCAC 7H. .0306(a)(9) to enclose 37 square feet of decking under roof on the landward side of the house is GRANTED. FURTHERMORE, the requested variance from 15A NCAC 7H .0309 to increase the decking on the oceanside of the house is DENIED. In order to proceed with the renovation, Petitioners are responsible for obtaining all required permits from the proper permitting authority.
