Issued to Zachary and Susan Salmon authorizing development in the Estuarine Shoreline (AEC) at Lot 20, Abigail
Ct., in Surf City, Pender County as requested in the permittee's application, dated July 8th, 2016, and received by DCM
on July 14, 2016. This permit, issued on July 26, 2016, is subject to compliance with the application dated and received
by DCM on July 14, 2016 (where consistent with the permit), all applicable regulations and special conditions and notes
set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action, or may
cause the permit to be null and void.
This permit authorizes: Construction of a single family residence.
(1) All proposed development and associated construction must be done in accordance with the permitted site drawings,
revised and received by DCM on July 26,2016.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, and/or land use activities will require re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site throughout the construction process. Contact this office at(910)

This permit action may be appealed by the permittee or other qualified persons
within twenty (20)days of the issuing date. This permit must be on the project
site and accessible to the permit officer when the project is inspected for Jason Dail
compliance. Any maintenance work or project modification not covered under CA A LOCAL PERMIT OFFICIAL

(5) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetated and stabilized (planted and
mulched)within 14 days of construction completion.
(6) Any proposed for grading within the 30' buffer from the Normal High Water level must be contoured to prevent
additional stormwater runoff to the adjacent marsh and/or canal. This area shall be immediately vegetatively
stabilized, and must remain in a vegetated state.
(7) With exception of 200 sq. ft. or less of elevated, slatted uncovered wood decking, no structure(s) shall be located
within the 30' Coastal Shoreline buffer, including but not limited to concrete slabs, stepping stones, roof covers,
accessory buildings,etc.
(8) All buildings shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards
of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood
Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent
with any of the following AEC standards, the more restrictive provision shall control.
(9) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third-party.

This letter is in response to your correspondence,which was received by the Division of Coastal
Management on July 25,2016,regarding your concerns about the proposed development by Zachary and
Susan Salmon,at Lot 20 Abigail Court,in Surf City,Pender County. The project consists of
construction of a dwelling with amenities.The proposed project has been determined to comply with the
Rules of the Coastal Resources Commission(15 A NCAC 07H.0209),and as a result,a permit has been
issued to authorize the development. I have enclosed a copy of the permit,as well as,the applicable
rules.
If you wish to contest our decision to issue this permit,you may file a request for a Third Party Appeal.
The Chairman of the Coastal Resources Commission will consider each case and determine whether to
grant your request to file for a Contested Case Hearing. The hearing request must be filed with the
Director,Division of Coastal Management,in writing and must be received within twenty(20)days of the
disputed permit decision. I have enclosed the applicable forms and instructions that must be filed prior to

Dear Mr. Dail,
On Saturday, July 16, I received a package from Charles Rigs. It was sent certified mail and
required my signature upon delivery. The package contained a Minor CAMA application for
property located at the end of Abigail Court on behalf of Mr. Salmon, who was listed as the
property owner. This package was also sent to the other adjoining homeowners, Jim Hines, and
Channel Bend HOA. Mr. Riggs' letter stated I had ten days from acceptance of the letter on July
16, to respond to the application. Over the past few years, there have been many issues raised
about how this plan was developed. The seawalls, pavement and turnarounds and easements
that were submitted and recorded, were not adhered to. Our HOA was even named in a lawsuit
over these errors, and was forced to seek legal counsel. Upon signing an agreement for the
property, Mr. Salmon assured the HOA that he was going to work to correct the existing
problems with the property. As president of the Cedar Point HOA board of directors, I was
optimistic that we could finally put all of these issues with the property behind us. The board
assisted Mr. Salmon by twice contacting the membership and having them sign notarized
amendments to our restrictive covenants to enable him to proceed with his plans. However,
after seeing what he has proposed in his application, I fear that once again we will have to deal
with controversy.
The following are my objections to this application:
1. Zack Salmon is listed as the property owner on the application. I was given ten days from
July 16 to respond. Upon checking with the recorder's office on the morning of thel8th. the
title to the property had not yet been transferred to Mr. Salmon. I think it was improper for
Mr. Riggs, a licensed professional, to try to fast tract this project on behalf of Mr. Salmon by
sending an application containing a time restraint for objections, prior to the transfer of that
property to his client, while listing his client as owner of the property.
2. All disturbed areas are to be indicated on the enclosed drawings. There is no indication on
the enclosed drawing as to what provisions are being made to handle the rain water
collected by the gutter system, and the stormwater runoff created by the proposed driveway
and turnaround.
3. The drawings indicate two stories of decking overhanging the seawall, supported by angle
bracing attached to the ground floor pilings. I strongly object to having any of the house's
structure extending beyond the seawall. This design feature, with decks extending beyond the
seawall shows no commonality to the residences in our, or our surrounding neighborhoods. I
have done a lot of boating around the island and on the ICW. I have yet to see the decking of a
residential home constructed beyond a seawall. This design is so uncommon, it is likely to be a
point of controversy. Our HOA has an active "Architectural Review Committee", and I think it

would have been wise to consult those members . I feel submitting this design to CAMA is
premature, as such a deviation in this design may not be approved.
Also, even though it is noted that the drawings included in the application are not to scale, no
dimensions were noted to the width of the deck and how much of the deck protrudes over the
seawall. Also, I believe the size of materials needed to support two stories of decking have been
depicted inaccurately.
Let me conclude by assuring you that I have no objections with houses being built on lots 18,
19, and 20. I do object to the unconventional construction that is being proposed. As a Cedar
Point board member, I'm afraid history will repeat itself, and that there will be a tremendous
amount of controversy over his planned design.
