This decision is based on my findings that your request violates NCGS 113A-120(a)(8)which requires that all applications be denied which are inconsistent with CAMA guidelines. You have applied to construct a residential structure at the project address, within the 30' Coastal Shoreline Buffer, which is inconsistent with 15 NCAC 7H .0209(d)(10), which states that: "Within the Coastal Shorelines category(estuarine and public trust shoreline AECs),new development shall be located a distance of 30 feet landward of the normal water level or normal high water lever'. Should you wish to appeal my decision to the Coastal Resource Commission or request a variance from that group, please contact me so I can provide you with the proper forms and any other information you may require. The home design has been minimized to 24' x 42' due to the limitations of the "pie shaped" lot on the canal. We have positioned the house in the only way possible to adhere to the town setbacks. The lot is so uniquely shaped that if we cannot encroach into the CAMA setback,then the home will not fit. Knowing the lot would be a challenge the home was designed to be as small as possible. We are asking for an encroachment of just a few feet to make all of this work. We are excited about replacing our 1968 mobile home with a beautiful new home. B.) The lot we need a variance for is the smallest "pie shaped" lot in the culdesac. Due to the small dimensions and unique size only a small home will fit here. We have designed a home that only has a 1,008 sq.ft. foot print. Even with making it this small,the back left corner of the porch is encroaching into the CAMA setback. C.) There are no actions we have taken to cause this issue. It is simply a matter of a uniquely small lot that is causing us the hardship. D.)
