in an area of environment concern pursuant to Section 113A-118 of the
General Statutes,"Coastal Area Management"
Issued to Living Coastal, LLC clo Robb Stinger authorizing development in the Estuarine Shoreline Area of
Environmental Concern (AEC) along Walter R. Atkinson Road (Lot 13), in Surf City, Pender County as requested in
the permittee's application package, dated August 19, 2014, and received by DCM on August 27, 2014. This permit,
issued on September 19, 2014, is subject to compliance with the application and site drawing (where consistent with the
permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may
subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: Construction of a single-family residence with uncovered decks, and drive strips.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s)dated received August 27, 2014.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 766-7221 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This :/1

(5) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetate and stabilized (planted and
mulched)within 14 days of construction completion.
(6) According to the application package,the amount of impervious surface/coverage shall be limited to 936 square feet
within the 75' Area of Environmental Concern (as measured from the mean high water boundary or normal high
water line).
(7) Any proposed for grading within the 30' buffer from the Normal High Water level must be contoured to prevent
additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must
remain in a vegetated state.
(8) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of Normal High Water.
(9) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third-party.

THE PROPERTY. In consideration of the mutual promises and covenants herein contained, Seller hereby agrees to
sell and convey to Buyer,who agrees to purchase,that certain parcel of land situated in the County of Pender, State of
North Carolina,being Lot# 13 in 1'HE PENINSULA AT TOPSAIL,as shown on plat recorded in Plat Book 56,
Page 39 (the "Plat") in the Pender County Registry (the "Property"). "The Peninsula at Topsail ", a planned

2. PURCHASE PRICE. Buyer shall pay to Seller the total sum of$ 11111111111116 (the "Purchase Price") in

funds.
3. CLOSING. Closing shall be held on or before September 7,2014 (the "Closing Date") at the offices of a
local law firm or as arranged through the offices of the Escrow Agent. Time is of the essence as to the Closing Date.
If Buyer is unable or unwilling to close on the Closing Date, Buyer shall be in default under this Agreement. In the
