Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.
River Basin Rules Applicable To Your Project:

for the River Basin checked above due to its location within that River Basin. These buffer rules are enforced by the
NC Division of Water Resources. If you have any questions, please contact the Division of Water Resources at the
Washington Regional Office (252-946-6481) or the Wilmington Regional Office (910-796-7215).
Notes/Additional Permit Conditions:
Please ensure all debris associated with the removal or construction of the permitted development is contained within the authorized
project area and disposed of in an appropriate upland location.

During the recent Northeaster which lasted 3 days, we had some land erosion at the head of our dock.
We have had Pete from Crystal Coast Landscaping to evaluate the repair. He suggested a small load of riprap and
some geo grid and directed us to plant coastal grass once the repairs are completed.
We have the Master Association approval since they own the land and we have deeded access.
See the pictures below of the intended repair area. The area is roughly 6' deep x 12' wide
We have advised the adjacent neighbors.

THIS EASEMENT AGREEMENT is made and entered into this 26 day
of August, 2004, by and between BEACON'S REACH MASTER ASSOCIATION,
INC., a North Carolina nonprofit corporation, hereinafter referred
to as "Grantor", and William Bradbury, Jr. and wife, Sherry A.
Bradbury, 111 Egret Lake Drive, Pine Knoll Shores, Carteret County,
North Carolina, hereinafter referred to as "Grantees".
STATES ENT OF EXPLANATION
Grantor is the owner of a certain area of marshland situated
between Grantees' property and Bogue Sound in Beacon's Reach, Egret
Lake, Pine Knoll Shores, Carteret County, North Carolina. Grantees
are the owners of Lot 23, Egret Lake, Phase II, as shown on that
plat entitled "Beacon's Reach Egret Lake, Phase II, Lots 23-32"
prepared by John R. Brammer. dated April 11, 1980, recorded in Map
Book 26, Page 20, of the Carteret County Registry,
STATEMENT OF AGREEMENT
In consideration of good and valuable consideration paid by
Grantees to Grantor, the receipt and sufficiency of which in hereby -
acknowledged, it is agreed as follows:

1. Description of P.asemgnt,. Grantor hereby grants, bargains,
.sells and conveys unto Grantees the following exclusive appurtenant
casement:
Being a strip of marshland ten (10) feet in
width extending westwardly to Bogue Bound from
Lot 23 of Beacon's Reach Egret Lake Phase II
per map recordod in Map Book 26, Page 20,
Carteret County Registry as generally shown on
the .attached sketch.

Prior to construction, Grantees will propose the exact
location of the walkway to Grantor and receive wxiLteu permission
to construct the walkway, which permission shall not be
unreasonably withheld; in the event Grantees wish to relocate all
or any part of the walkway, written permission of the Grantor shall
be required, which permission shall not be unreasonably withheld.
2. Purpose of Easement. Tbis easement is for construction of
a walkway and for Grantees' pedestrian ingress, egress, and regress
between their property and Bogue Sound.
3. Construction of the walkway. The Grantees shall be
responsible for all necessary local and state permits Sox Lhe
construction of the walkway. All costs associated with
construction of said walkway shall be the responsibility of the
Grantees.
4. Maintenance of the WAlkwpy. The Grantees, their heirs,
executors, administrators, successors, and assigns shall be
responsible for maintaining the walkway in a good and safe
condition. If the Grantor receives information that the Grantees
are not maintaining the walkway in a good and safe condition, this
Agreement shall terminate. Prior to the termination the Grantor
shall give written notice to the Grantees that said walkway is not
In a state of good repair. If said walkway is not repaired within
30 days of the date of this notice, the easement granted herein
shall terminate. Upon termination, the walkway shall be removed

from the premises and the cost of removal shall be the
responsibility of Lhe Grantees.
5. Dllr' tlon of Eas ment. This easement is perpetual and
shall run with the land.
6. Indemnification. Grantees further agree that they, their
heirs, executors, administrators, successors, and assigns, shall at
all times indemnify and hold the Grantor harmless against any and
all suits, actions, claims, debts, damages, costs, charges and
expenses, including court costs and counsel fees, and against any
and all loss and damages whatever, that shall Or may at any time
arise in connection with tho walkway.
Should any claim of liability related to the walkway be filed
against Grantor by a third party, such that Grantor suffers any
damages or loss not compensated by the Grantees, this Agreement
shall terminate, the walkway shall be removed, and all costs of
removal shall be the responsibility of the Grantees.
IN WITNESS WHEREOF, the parties have executed this instrument
under seal an of the day and year first above written.
