Statement of Compliance and Consistency l�
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

as Lot 23,Block B, Section 11 of Figure Eight Island located at 23 Pipers Neck Road on Figure
Eight Island,New Hanover County,North Carolina,and identified by New Hanover County Tax
Parcel identification number R05207-002-007-000 and further described in that certain deed
recorded in Book 5870 at Page 1872 of the New Hanover County Registry("Registry"),reference
to which is hereby made and fully incorporated herein by reference("Lot 23").
WHEREAS,TTJJP is the fee simple title owner of all of that real property known as Lot
21, Block B, Section 11 of Figure Eight Island located at 21 Pipers Neck Road on Figure Eight
Island,New Hanover County,North Carolina,and identified by New Hanover County Tax Parcel
identification number R05207-002-006-000 and further described in that certain deed recorded in
Book 5888 at Page 2163 of the Registry,reference to which is hereby made and fully incorporated
herein by reference("Lot 21").
WHEREAS, Lot 23 and Lot 21 are adjoining lots which both abut navigable inlet sound
waters and tidal creeks(hereinafter,"Adjacent Inlet").
WHEREAS, Lot 23 has an existing home and attached deck built upon it, which
BUCKHEAD desires to demolish and remove so as to construct a new single family,residential
home and improvements thereto, including exterior decking and porches slightly closer to the
Adjacent Inlet than the current structure on Lot 23.
WHEREAS,TTJJP desires to preserve its line of sight and view of the Adjacent Inlet from
Lot 21 and,therefore, desires to limit the extent to which BUCKHEAD and its successors in title
may place any home, deck, accessory structure,or the like on Lot 23 any closer to the Adjacent
Inlet than the presently existing house and attached deck on Lot 23.
WHEREAS, BUCKHEAD desires to also preserve its line of sight and view of the
Adjacent Inlet from Lot 23 and, therefore, desires to limit the extent to which TTJJP and its
successors in title may place any home,deck,accessory structure,or the like on Lot 21 any closer
to the Adjacent Inlet than the presently existing home and attached decking.
WHEREAS,BUCKHEAD and TTJJP in exchange for the mutual covenants and promises
set forth herein agree for themselves and their successors in title to grant these mutual negative
restrictive covenants to be binding upon and to be appurtenant to their respective lots for the benefit
of each other's lots.
NOW, THEREFORE, for and in consideration of Ten and No/100 Dollars ($10.00),the
foregoing,and the promises,covenants and conditions contained herein,the receipt and sufficiency
of which consideration is hereby acknowledged by the Parties, the Parties to this Restrictive
Covenant do hereby stipulate and agree as follows:

1. The foregoing recitals are fully incorporated herein by reference and made a binding
part of this Negative Covenant.
2. BUCKHEAD acknowledges, covenants, agrees, and hereby conveys to TTJJP and
TTJJP's successors in title that any home,deck,accessory building,improvements,porches or other
similar structures and buildings on Lot 23 shall not be located any closer to the Adjacent Inlet(as
it currently exists)than as depicted on BUCKHEAD'S new home construction plans anddrawings
collectively attached hereto as Exhibi. BUCKHEAD acknowledges,covenants,and agrees that
the negative restrictive covenant it has conveyed herein to TTJJP and TTJJP's successors or assigns
shall be appurtenant to and binding upon Lot 23,shall run with the ownershipof Lot 23,and shall be
binding upon BUCKHEAD and BUCKHEAD'S successors in title. BUCKHEAD and
BUCKHEAD'S successors in title shall specifically reference this Negative Covenant within their
respective deeds of conveyance, although the omission of any such reference shall not affect the
appurtenant and binding nature of this Negative Covenant to Lot 23.
3. TTJJP acknowledges,covenants,agrees,and hereby conveys to BUCKHEAD and
BUCKHEAD'S successors in title that any home,deck,accessory building,improvements,porches
or other similar structures and buildings on Lot 21 shall not be located any closer to the Adjacent
Inlet(as it currently exists)than as depicted on TTJJP's "as built" survey of the TTJJP's currently
existing home and associated improvements attached hereto as Exhibit B,TTJJP acknowledges,
covenants,and agrees that the negative restrictive covenant it has conveyed herein to BUCKHEAD and
BUCKHEAD'S successors or assigns shall be appurtenant to and binding upon Lot 21, shall run
with the ownership of Lot 21, and shall be binding upon TTJJP and TTJJP'S successors in title.
TTJJP and TTJJP'S successors in title shall specifically reference this Negative Covenant within
their respective deeds of conveyance,although the omission of any such reference shall not affect the
appurtenant and binding nature of this Negative Covenant to Lot 21.
4. This Negative Covenant may only be modified,amended or terminated by written
agreement signed by both Parties or their respective successors in title.
5. Each of the undersigned warrants that (i) they have the necessary authority and
ability to enter into this Negative Covenant, and (ii) the respective companies on whose behalf
they are executing this Negative Covenant have the full corporate,power and authority to execute,
deliver,and perform this Negative Covenant.
