This decision is based on my findings that your request violates NCGS 113A-120(a)(8) which requires that all applications be denied which are inconsistent with CAMA guidelines. Specifically, the development for which you applied consisted of increasing the total floor area of a structure within the minimum setback (measured 60 feet from the First Line of Stable Natural Vegetation (FLSNV), or 30 times the shoreline erosion erosion rate of 2 feet/year, whichever is greater). Your proposal is inconsistent with 15 NCAC 7H .0306(a)(6), which states that: "Structural additions or increases in the footprint or total floor area of a building or structure represent expansions to the total floor area and shall meet the setback requirements established in this Rule and 1 SA NCAC 07H.0309(a). Incidentally, this renovation to better accommodate my family and renters would make my house identical to one just north of me. Please excuse the delay in this new application as I had the property of the market since last fall but am loathe to take on a new and formidable mortgage by parlaying up to a larger house. Recall that ten years ago, after satisfying the original mortgage, I sought a permit but was denied as the original substantial dune had so eroded as to place my cottage within the 60-foot restricted area. From the beginning I have chosen to seek a permit in accordance with the regulations. To that end, I have retained several contractors who felt their access to CAMA would provide a"grandfather" clause but without success. I contracted with Terra Landscaping to install irrigation and new plants so as to enlarge the dune; however seasonal storms negated any benefit. I hired an architect from New Bern who suggested an addition away from the ocean; and I contacted a house mover to move the entire structure outside the restricted area. These measures are extreme and understandably cost-prohibitive. More recently I considered an offer from a local contractor to form a partnership replacing my cottage with a duplex, each of us owning one half. This would divide my property and actually increase living space, albeit outside the sixty-foot line. Now I am returning to CAMA to finish my house on a more modest and reasonable scale as I originally intended. Being a property owner since 1991, I have contributed to the meteoric growth and development of Topsail Island and am seeking exception from a regulation alleging such an addition to my house will have more of a negative impact to the coast than the explosive increase of real-estate outside the arbitrary line. To my knowledge, the "First Line of Stable Natural Vegetation"has not yet been established for this property,therefore,the minimum setback cannot be determined. To assist in your submission, I will conduct a site visit to the subject property on 9/12/13(or 9/17/2013 as an alternate date) and locate the FLSNV.Wooden stakes with the abbreviation of"FLSNV"will be placed along the appropriate alignment with the date of determination as well as the initials"JAD". This line should then be recorded and used to determine the appropriate minimum 60'setback. Once you have recorded these features,you will need to re-submit a revised plan showing the location of each, in relation to the planned development. 2. In addition to the appropriate setback and FLSNV notations,the work plan drawings should also reference the dune contours, including the crest and toe of the frontal dune. 3. A detailed drawing of the proposed addition should be included which shows both the interior and exterior dimensions for each room and/or feature being added.Additionally, you should note on the plans what you are proposing in terms of "total floor area". By Rule, "Total Floor Area" includes: • The total square footage of heated or air-conditioned living space. • The total square footage of non-heated or air-conditioned areas elevated above ground level, excluding attic space that is not designed to be load bearing. 4. Lastly, please submit a profile, or side view, drawing of the proposed development in relation to the existing structure(s), the minimum 60'setback, dune, and the FLSNV. In accordance with the Department of Environment and Natural Resources regulations, we note that the application, as submitted on September 9, 2013, is incomplete for processing. Ms. Staphanie Hobbs assisted me in filling out the form and felt this was not necessary. The overall dune line is similar to that along the beach with regard to vegetation and height. 2) With regard to the survey outlining the vegetation line, please find enclosed the first formal survey performed last fall. You have already received the more recent survey of this spring with the application. There are vegetation lines on both surveys. You mentioned your willingness to re—stake the dune line; however, I'm unclear if this has changed from the surveys mentioned. 3) Diminsions of the proposed project are as follows: Inside: 55'X12' plus 9 X 9 (for the stairs)=741 sq. ft. of habitable space Outside: 7 X 18= 126 sq.ft. (for the dormer, see above) . I have subsequently received verification of my neighbors having received the plans of my proposed development.
