Dear Mr. Gabriel:
After reviewing your application in conjunction with the,development standards required by the Coastal
Area Management Act (CAMA) and the locally adopted Land Use Plan and Ordinances, it is my determination
that no permit may be granted for the project which you have proposed.
This decision is based on my findings that your request violates NCGS 113A-120(a)(8) which requires
that all applications be denied which are inconsistent with CAMA guidelines. Specifically, the development for
which you applied consisted of increasing the total floor area of a structure within the minimum setback
(measured 60 feet from the First Line of Stable Natural Vegetation (FLSNV), or 30 times the shoreline erosion
erosion rate of 2 feet/year, whichever is greater).
Your proposal is inconsistent with 15 NCAC 7H .0306(a)(6), which states that: "Structural additions or
increases in the footprint or total floor area of a building or structure represent expansions to the total floor
area and shall meet the setback requirements established in this Rule and 1 SA NCAC 07H.0309(a). New
development landward of the applicable setback may be cosmetically, but shall not be structurally, attached
to an existing structure that does not conform with current setback requirements':
I have concluded that your request also violates NCGS 113A-120(a)(8), which requires that all
applications be denied which are inconsistent with the Local Land Use Plan. On page 109 of the Land Use
Plan, you will find that The Town of Surf City's Land Use Plan, Part 2: Plan for the Future (2)(2)(B)(5)d. states
"Surf City policy is to protect the Town's natural resources through the enforcement of adopted ordinances,
which will be consistent with land use plan policy. Surf City policy is to protect and to conserve

development and enforcement, and through the consistency provision of the Coastal Area Management Act'

On August 25, 2014, I received your letter dated August 14, 2014, seeking approval "to the board" for an appeal to our
CAMA permit denial for property located at 1830 S. Shore Drive, in Surf City, NC.As you are aware, we issued a denial
for development activities at this property due to inconsistencies with 1SA NCAC 07H .0306(a)(6) and 15A NCAC 07H
.0309 (a).As proposed,you intended to increase the total floor area of a non-conforming structure. Our Notice of Denial
was transmitted in a letter to you dated November 1, 2013. Please note that any variance request submitted to the
Coastal Resources Commission and the Director of the Division of Coastal Management shall mirror the development
plan that was proposed and denied by our office, on or around November 1, 2014.
I am forwarding the documentation required to seek relief from our development Rules within the subject Area of
Environmental Concern (AEC). Please follow the directions described in the attached packet.

Dear Mr. Dail:
Please accept this letter as application to the board for an appeal to the rejection of a permit to finish the
attic with two bedrooms and a bath(see inclosure). Incidentally, this renovation to better accommodate
my family and renters would make my house identical to one just north of me. Please excuse the delay
in this new application as I had the property of the market since last fall but am loathe to take on a new
and formidable mortgage by parlaying up to a larger house.
Recall that ten years ago, after satisfying the original mortgage, I sought a permit but was denied as the
original substantial dune had so eroded as to place my cottage within the 60-foot restricted area. From
the beginning I have chosen to seek a permit in accordance with the regulations. To that end, I have
retained several contractors who felt their access to CAMA would provide a"grandfather" clause but
without success. I contracted with Terra Landscaping to install irrigation and new plants so as to
enlarge the dune; however seasonal storms negated any benefit. I hired an architect from New Bern
who suggested an addition away from the ocean; and I contacted a house mover to move the entire
structure outside the restricted area. These measures are extreme and understandably cost-prohibitive.
More recently I considered an offer from a local contractor to form a partnership replacing my cottage
with a duplex, each of us owning one half. This would divide my property and actually increase living
space, albeit outside the sixty-foot line.
Now I am returning to CAMA to finish my house on a more modest and reasonable scale as I
originally intended. Being a property owner since 1991, I have contributed to the meteoric growth and
development of Topsail Island and am seeking exception from a regulation alleging such an addition to
my house will have more of a negative impact to the coast than the explosive increase of real-estate
outside the arbitrary line.

Dear Mr. Gabriel:
The Division of Coastal Management's Wilmington Regional office received a CAMA Minor Permit application from you on September
9, 2013, requesting approval for development activities at 1830 S. Shore Drive, in Surf City, NC. In reviewing your application,we have
discovered that additional information is needed to complete the review process.Accordingly, I am requesting that you submit the
following additional information to this office:
1. On the submitted "Plot Plan for: Dan Gabriel", prepared by Weston Lyall and dated revised on 4-10-13, a"CAMA line" is
shown as well as a"60' CAMA offset". Please note that the"CAMA line"shown on the plot plan is not a recognizable
feature and cannot be used to determine the appropriate setback. Per our Rules, all ocean front development shall meet
the minimum setback requirement from what's called the" First Line of Stable Natural Vegetation"(FLSNV), which must
either be field located or verified by a representative from the Division of Coastal Management. To my knowledge, the
"First Line of Stable Natural Vegetation"has not yet been established for this property,therefore,the minimum setback
cannot be determined. To assist in your submission, I will conduct a site visit to the subject property on 9/12/13(or
9/17/2013 as an alternate date) and locate the FLSNV.Wooden stakes with the abbreviation of"FLSNV"will be placed
along the appropriate alignment with the date of determination as well as the initials"JAD". This line should then be
recorded and used to determine the appropriate minimum 60'setback. Once you have recorded these features,you will
need to re-submit a revised plan showing the location of each, in relation to the planned development.
2. In addition to the appropriate setback and FLSNV notations,the work plan drawings should also reference the dune
contours, including the crest and toe of the frontal dune.
3. A detailed drawing of the proposed addition should be included which shows both the interior and exterior dimensions for
each room and/or feature being added.Additionally, you should note on the plans what you are proposing in terms of
"total floor area". By Rule, "Total Floor Area" includes:
• The total square footage of heated or air-conditioned living space.
• The total square footage of non-heated or air-conditioned areas elevated above ground level, excluding attic space
that is not designed to be load bearing.
4. Lastly, please submit a profile, or side view, drawing of the proposed development in relation to the existing structure(s),
the minimum 60'setback, dune, and the FLSNV.
In accordance with the Department of Environment and Natural Resources regulations, we note that the application, as
submitted on September 9, 2013, is incomplete for processing. Upon resubmission of a complete application, a local decision will be
made in 25 days, provided this period is not extended as provided by law. Please contact me at 910-796-7221 if you have any

filling out the form and felt this was not necessary. The overall dune line
is similar to that along the beach with regard to vegetation and height.
2) With regard to the survey outlining the vegetation line, please find enclosed
the first formal survey performed last fall. You have already received the
more recent survey of this spring with the application. There are vegetation
lines on both surveys. You mentioned your willingness to re—stake the dune
line; however, I'm unclear if this has changed from the surveys mentioned.

I have owned this cottage since 1991 and am applying to CAMA for a Minor Permit to complete the
attic. Currently, there are three bedrooms and two full baths but this is insufficient for my growing
family. It is my desire to complete the attic by adding two bedrooms and another full bath. This will
not change the "footprint" of the property and, except for an ocean-side dormer for light, will not
change the integrity of the building. Further, it is my opinion that project's impact on the eco-system
will be minimal given the following:
1) The exponential development and growth of the Topsail area the past several years.
2) The existing house just adjacent to the north of me and in the same alignment has a
second story.
3) The existing house some fifteen houses to the north of me, and also in the same
• alignment, has an identical floor plan.
In addition to my family's personal use and enjoyment, this project would increase the rental appeal of
the property and therefore enhance the tourist industry augmented by I 40.
