Our properties back up to a lake and the proposed dock, etc will be jutting out into the lake at least 40-42 feet. This will completely destroy our view of the sound, which is one of the reasons we bought our house. We are retired and live here permanently. We believe it needs to be investigated, not only because it will ruin our view, we have 4 other neighbors that property backs up to this lake, three have larger boats and there are only certain "paths" to take out to the sound because the water is very low in some places and I believe this proposed dock walkway, platform and mooring piles will be blocking one of those paths. We are asking that this proposed walkway, dock and mooring pilings be investigated. The permit request was for the construction of a 20'x5' pier and a 10'x10' platform with two tie piles located at 130 Clipper Court in Colington, Dare County. On September 22, 2021, DCM Field Representative Sarah Loeffler conducted a site visit to evaluate the permit applicant's request. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H.1200. The Division has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with the Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have been satisfied. Therefore, the Division of Coastal Management issued General Permit No. 86129-A on October 19, 2021 (copy attached) for the proposed development. If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division of Coastal Management within 20 days of the permit issuance date. If you choose to pursue an appeal, please contact this office so that we can provide you with the appropriate forms and addresses. Since many of your concerns involved the shallow water area at the mouth of the basin and the difficulty it may cause with navigation, I would like to suggest that you try contacting the Colington Harbour HOA and discuss with them the possibility of applying to modify Major Permit #11-12 to add the mouth of the basin to maintenance dredging areas authorized through the active major permit. A modification to the permit could potentially assist in opening up the mouth in order to provide better navigation in and out of the basin. Good Morning Sarah, The attached photos demonstrate the natural topography and channel/cut allowing access to clipper lake/cove. I would expect that this can easily be verified during low -low water conditions, usually during northeast wind conditions. Your visit yesterday and soundings were during a high -high water condition form prevailing, southerly winds and were likely 1 foot overstated. Please push back the proposed 45 foot dock & pier as they are indeed a hazard to navigation._ ,The issue is,not at the 4-5 foot depth at the dock end but more importantly on the approach into and out of the lake. I have been navigating this since October 2016 and have determined that the angle necessary to avoid grounding in and out of the lake will be impeded by a 45 dock at that location. Please do not hesitate to call me to discuss. I would be happy to walk the sand bar with you during low -low water so that you may confirm this.
