Issued by WiRO SC12-15 Surf City Permit Number CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina,Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statutes,"Coastal Area Management" Issued to Martha and Jim Vaughn authorizing development in the Estuarine Shoreline Area of Environmental Concern (AEC) at 3022 3rd Street, in Surf City, Onslow County as requested in the permittee's application package, dated received August 20, 2012. This permit, issued on September 12, 2012, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Construction of a single family residence,to include: driveway, parking area&stormwater system. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s)dated received August 29,2012 and September 4, 2012. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. Based on the plans that were submitted, it appears that a portion of the deck (on the canal side)will be located within the 30' Coastal Shoreline buffer(as measured from the Normal High Water line). Essentially, normal high water comes around the corner of the bulkhead on the western side, and extends approximately 12' toward the high ground in the area of the existing boat ramp. As a result,the covered deck will be located within the 30' buffer,which is something we cannot permit. I'm going to stop by there tomorrow and verify how far up the boat ramp the normal high water line comes and get back to you with an accurate distance. From there,you'll either need to alter the plans to relocate the covered deck, propose the deck as"uncovered" or apply for it,get denied and then go for a variance. Lastly, based on your site plan,your clients are well over 30%impervious coverage within the Area of Environmental Concern (AEC),which is 75'from the normal high water line. Impervious surfaces shall not exceed 30%of the AEC area of the lot, unless the applicant can effectively demonstrate,through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. So, with that said, your client will need to install an innovative stormwater system capable of handling 30%and I'll need to see the design plan before the CAMA permit is issued. Thanks, Jason The section pertaining to development within the "Coastal Shoreline" is found here: 15A NCAC 07H .0209 COASTAL SHORELINES 15A NCAC 07H .0209 (a)(2) states—"All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to adequately service the major purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible." 15A NCAC 07H .0209 (a)(10) states—"(10) Within the Coastal Shorelines category(estuarine and public trust shoreline AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal high water level, with the exception of the following: (A) Water-dependent uses as described in Rule 07H .0208(a)(1) of this Section; i • (B)Pile-supported signs (in accordance with local regulations); (C)Post- or pile-supported fences; (D) Elevated, slatted,wooden boardwalks exclusively for pedestrian use and six feet in width or less. The boardwalk may be greater than six feet in width if it is to serve a public use or need; 17 (E) Crab Shedders, if uncovered with elevated trays and no associated impervious surfaces except those necessary to protect the pump; (F)Decks/Observation Decks limited to slatted, wooden, elevated and unroofed decks that shall not singularly or collectively exceed 200 square feet; (G) Grading, excavation and landscaping with no wetland fill except when required by a permitted shoreline stabilization project.
