Issued to John Gray Hunter, authorizing development in the Ocean Hazard (AEC) at 406 N. Shore Drive, in Surf City,
Pender County as requested in the permittee's application, dated May 3, 2012, and received by DCM on May 3, 2012.
This permit, issued on June 1, 2012, is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms
may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: The construction of a retaining wall, to be located between two existing retaining walls on the adjacent
properties to the north and south.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s)dated May 3, 2012, and received by DCM on May 3, 2012.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 796-7221 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project Jason Dail

(5) Any and/or all structure(s) authorized under this permit must be set back a minimum of 60 feet from the first line of
stable natural vegetation, as determined by the DCM, the LPO, or other assigned agent of the DCM.
(6) The permittee is required to contact the Local Permit Officer (910) 796-7221, shortly before he plans to begin
construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline
change. Construction must begin within sixty (60) days of the determination or the measurement is void and must
be redone.
(7) Dune disturbances shall be allowed only to the extent necessary for development and if the dune's protective value
is not weakened or reduced.
(8) Disturbed dune areas will be immediately stabilized. All unconsolidated material resulting from associated grading
and landscaping shall be retained on site by effective sedimentation and erosion control measures. Disturbed areas
shall be vegetatively stabilized (planted and mulched)within 14 days of construction completion.
(9) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by
changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time
when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural
shoreline recovery or beach renourishment takes place within two years of the time the structure becomes
imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or
dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary
protective measures allowed under CRC rules.
(10) This permit does not authorize the excavation or filling of any wetlands, even temporarily.
(11) This permit does not authorize the construction of a seawall, or any other hardened structure used to protect the
residence from winds, waves and/or tides. The authorized structures shall act as a retaining wall, used to prevent
sand from entering the parking/storage area.

Description of Project
We plan to clear sand away from the beachfront side of the house (which
has accumulated to aprox 18" to 20" against the beachfront wall of the
house) and under the double deck/porch, and build a retaining wall to help
keep this sand build up in check.
We plan to build a retaining wall adjoined to the existing retaining wall at
404 oN Shore Dr. (as shown in drawing) running 8' from the house (just
inside the supports for the porch), parallel to the house for aprox 24' then
jutting out to 16' from the house and continuing and adjoining to the
existing retaining wall at 408 N Shore Dr.
So we are building a retaining wall that connects the two neighboring
retaining walls. It will be 6' high.
This will require removing some sand from the house and under the porch
and depositing in on the beach side of the new retaining wall. We plan to
remove as much vegetation as possible and replant in the moved sand on
the beach side of the new retaining wall.... designated in the drawings as
"fill area".
Pavers will go under the porch where sand was removed. The paved area
will be water permeable.

CAMA MINOR PERMIT NOTICE
Pursuant to NCGS 113A-119(b), the North Carolina Division of Coastal Management, an
agency authorized to issue CAMA permits in areas of environmental concern, hereby gives NOTICE
that on May 3, 2012 John Gray Hunter, Jr. applied for a CAMA permit to construct a retaining wall at
406 N. Shore Drive, adjacent to the Atlantic Ocean, in Surf City, Pender County. The application may
be inspected at the address below. Public comments received by May 31, 2012 will be considered.
Later comments will be accepted and considered up to the time of permit decision. Project
modifications may occur based on further review and comments. Notice of the permit decision in this
matter will be provided upon written request.
