as authorized by the State of North Carolina,Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes,"Coastal Area Management"
Issued to Zachary and Susan Salmon, authorizing development in the Estuarine Shoreline (AEC) at 108 Abigail
Court, in Surf City, Pender County as requested in the permittee's application, dated December 23, 2011, and received
by DCM on December 28, 2011. This permit, issued on January 23, 2012, is subject to compliance with the application
and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth
below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the
permit to be null and void.
This permit authorizes:the construction of a single family residence on Lot 17 in the Cedar Point Subdivision.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s)dated received on January 9, 2012.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 766-7221 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project Jason Dail
modification not covered under this permit, require further written permit CAMA LOCAL PERMIT OFFICIAL
approval.All work must cease when this permit expires on:

In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal PERMITTEE

(5) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of Normal High Water level. Any portion of
the permitted "cantilevered deck" extending into the 30 foot Coastal Shoreline buffer shall be uncovered and less
than 200 square feet in size.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land-disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(7) Any proposed for grading within the 30' buffer from the Normal High Water level must be contoured to prevent
additional stormwater runoff to the adjacent waterbody. This area shall be immediately vegetatively stabilized, and
must remain in a vegetated state.
(8) The applicant has effectively demonstrated, through innovative construction design, that the amount of impervious
surface areas may be exceeded in a way that runoff water will be managed and the AEC protected, so as to allow
1,620.48 square feet of impervious areas within the 75' Coastal Shoreline AEC. All proposed development and
associated construction must be done in accordance with the design specifications of the permitted innovative
design, sealed by the design professional, David Newson, on map dated January 6, 2012.
(9) Upon completion of construction and prior to the issuance of a Certificate of Occupancy(CO), a letter of certification
must be received from the designer of the innovative system installed, certifying that the permitted system has been
installed in accordance with this permit, the approved plans and his design specifications. Any deviations from the
approved plans and specifications must be noted on the Certification and a permit modification may be required
prior to receiving a CO.
(10) The landowner or permittee shall at all times provide the operation and maintenance necessary to assure the
permitted stormwater system functions at optimum efficiency. The landowner or permittee shall maintain the
permitted stormwater system for the life of the project.

Pursuant to NCGS 113A-119(b), the North rolina Division of Coastal Management, an

Dear Morison:
Reference your application for a Department of the Army permit to perform maintenance
dredging within an existing entrance channel and access channel along Kings Landing Road,
adjacent to the AIWW&Topsail Sound, in Hampstead, Pender County,North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process for construction activities that
receive authorization from the State of North Carolina. Therefore,you may commence
construction activity in strict accordance with applicable State authorization and the approved
plan. Failure to comply with the State authorization or conditions of the Federal permit could
result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for any
other reason,plans revised to show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any such change or alteration.
Such action is necessary as revised plans must be reviewed and the authorization modified. Your
Department of the Army permit will expire January 17, 2015.

Good day Mr. Salmon and Mr. Albertson:
The Division of Coastal Management is in receipt of your Minor permit application package, requesting approval for
development activities at 108 Abigail Court,Surf City, NC. The application package appears to be complete with the
exception of the following deficiencies:
1) Please provide four(4) additional copies of the 18" x 24" proposed plan development, or provide one copy if you
can reduce the size of the drawings/plans to 11" x 17" or smaller. If a smaller drawing is provided, please ensure
that it is accurately drawn to a scale of 1"=200', or less.
2) As shown on the plans and stated in the permit application,the amount of impervious coverage proposed on Lot
17, under this residential development request, is approximately 1,619 square feet,which is less than 30%
impervious coverage within the 75' Estuarine Shoreline Area of Environmental Concern. However,the existing
"hammer-head" cul-de-sac located on Lot 17 should also be included in the impervious calculations for this
property. From what I can gather,the cul-de-sac accounts for approximately 1,500 sq.ft.of impervious coverage
(within the 75'AEC) and the proposed residential development accounts for approximately 1,619 sq. ft, placing
the total amount of impervious within the AEC at roughly 3,100 sq. ft. Because you have greater than 30%
impervious coverage proposed within the 75'AEC,you will need to effectively demonstrate, through innovative
design, that the protection provided by the design would be equal to or exceed the protection by the 30%
limitation. Essentially, you will need to design and install a stormwater system that can effectively collect and
treat any/all stormwater run-off on the property in excess of 30%. In addition,you will likely need to modify the
existing DWQ stormwater permit(#SW8030526) as this permit limits to amount of impervious coverage on this
lot to 1,700 sq.ft.
As of today (1/03/12),the permit application is considered incomplete due to the lack of information required for
processing. Once the above requested information is received by our office, we will resume processing the application
package.
