Issued by WiRO SC 10-018 Surf City Permit Number CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statutes,"Coastal Area Management" Issued to Paul Kent and Denise Hoffman, authorizing development in the Estuarine Shoreline (AEC) at 330 Atkinson Point Road, in Surf City, Pender County as requested in the permittee's application, dated November 21, 2010. This permit, issued on January 5, 2011, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: the installation of a swimming pool. (1) All proposed development and associated construction must be done in accordance with the work plat drawings(s) dated November 22, 2010 and received on December 1, 2010: (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at 910-796-7215 for a final inspection at completion of work. (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any "� work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. (6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10),and shown on the permitted plan drawing, all development/construction shall be located a distance of 30 feet landward of Normal High Water. No portion of the pool or concrete apron shall encroach into the 30 ft. buffer. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land-disturbing activities,a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (8) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (9) All other disturbed areas shall be vegetatively stabilized (planted and mulched)within 14 days of construction completion. (10) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land-disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (11)All original permit conditions remaining effect.Any proposed change to the approved original plans for development, construction,or land use activities will require a re-evaluation and modification of this permit. One As such those adjacent oyster beds should protected as part the 75' Area of Environmental concern. Allowing a swimming pool 30' away from the habitat of these oyster beds would be contrary to Goal # 2 of the Oyster Restoration plan. From the introduction of Oyster Restoration and Protection Plan for North Carolina: A Blueprint For Action - Second Edition 2008 —2012 "The Eastern Oyster (Crassostrea virginica) is an ecological, economical and educational treasure for North Carolina. However, the oyster population has declined over 50 percent and is now listed as a species of concern for the NC Division of Marine Fisheries (DMF). This decline results from: habitat loss, pollution, diseases and historical harvest pressure. The health of the oyster reflects the health of the coastal ecosystem." Goal #2: Protect and restore healthy oyster populations and habitat as a means to improve water quality, provide essential habitat, and support a sustainable fishery. The proposed pool is within the flood line. The proposed pool site flooded in 1996 during Hurricane Fran and in 1999 during Hurricane Floyd. Swimming pools have a propensity to leak. There are multiple references on the interne that 1 pool in every 20, or 5% of swimming pools leak "Even minor swimming pool leak can cause substantial damage and result in huge water bills and it is estimated that one pool in every 20 has a leak. Just how serious can a leak become? A pinhole-sized leak in a pool plumbing system with 40-pound pressure (psi) will lose approximately 970 gallons of water in a 24-hour period. This comes to about 30,000 gallons a month or 360,000 gallons per year. Rd .pdf Dear Ms. Snider, Thank you for promptly emailing the 330 Atkinson Point Road drawings. Correct me if I am in error, but the elevation of the property is given as 8 feet in one section of the drawing and 7 feet in another. Does the drawing indicate then that property has two separate elevations, and that the elevation at 8 feet near the pool is higher than the elevation of 7 feet towards the road? The slope of the property appears to be the opposite, with the elevation grading upwards towards the road. There is a semicircular line entitled "approximate flood line". Why is the arc of flood line away from the Intracoastal Waterway? Since the flooding at this property comes over the sea wall,wouldn't the semicircle's arc be in the opposite direction? During Hurricane Floyd 330 Atkinson Point Road flooded up to about 15' before the street. Please see the attached elevation certificate for 201 Atkinson Point Road. The elevation is also given as 8 feet, lowest grade 6.0 feet. The terrain and elevation slopes downwards from 201 to 330 Atkinson Point Road and generally slopes downward from the marsh side of the street,which 201 Atkinson is located, and the sound side properties on the street. I doubt the veracity of 330 Atkinson Point Road being at either 7 or 8 feet of elevation. How were these figures determined? Can they be verified? Since 27 feet is given on the drawing to the CAMA buffer,the concrete seawall is allowed 3 feet as its measurement. That figure is highly questionable. I have lived near the proposed site full since 1997, and being outdoor oriented have spent thousands of hours observing the area surrounding the proposed location. There are numerous and significant reason why this project should be turned down including: 1. The salt marsh estuary environment is extremely shallow. Polluted water thus poses a higher risk of environmental contamination. 2. There are extensive oyster beds directy in front of and to the north and south of the location 3. There is an extensive variety of small to medium sized fish populations that inhabit the location. 4. The location is an active habit of Atlantic Coast and salt march estuary birds including Osprey, Hooded Merganser, Mallard, Brown Pelican, Snowy Egret, Great Blue Heron, Canada Goose, Glossy Ibis, Cormorants and occasional bald eagles, 1 5. The location directly adjoins a major bird nesting habitat called Goat Island, a series of four islands which have mature hardwoods and dense undergrowth favored by many birds as a nesting site. 6. This location is part of what is known as the Atlantic flyway the north south corridor for migratory birds. Granted for many birds this is simply a flyover, but many species of birds, including a wide variety of gulls temporarily, stop for nourishment. This is a diverse and fairly pristine ecology, since the area is too shallow for boat traffic. A swimming pool by it's nature is inherently prone to polluting the environment. Chemicals are constantly added to swimming pools to kill algae. A. The water aquifer runs west to east, directly into the sound. Any leaks will flow directly into the sound. B. About 1 in 20 pools leak. Just a small leak in a poll can result in the loss of 700 gallons of water per day. (1) C. Swimming pools lose water to the environment through evaporation, as much as a lawn. (1) D. Overflow hazard. The area is prone to periodic heavy rainfall, including many in the 5" to 10" range. E Overwash hazard. Location is within a mile at the Atlantic ocean. This is a hurricane zone, and a designated Tsunami zone. Winter Northeasters periodically cause overwash and flooding of this location. F. Flood zone. Atkinson Point Road flooded during Hurricane Fran in 1996 and Floyd in 1999. The proposed location of the pool was completely submerged. G. Negative impact of swimming pool construction materials, paints and sealants leaching into the environment. H. Negative impact of swimming pool maintenance material, crack sealants, paint, I. Properties in the neighborhood have a tendency to be for seasonal or vacation use.
