Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

RE: 4712 San Juan Circle - Cama permits
I am writing this letter to confirm, that as part of the CAMA permit that is being requested, that
the repair to the failing bulkhead will extend to the area of damage that it has caused to my bulkhead
also. Looking at the photo indicating the areas of work, it fails to include a drawing or indication that
bulkhead repair will occur within the 15' riparian access setback area as well as to my bulkhead.
As a right of lateral support, I am entitled to have the following repaired in the area of damage:
- bulkhead (re -anchoring, installing of " deadmen" anchors that have pulled, and correctly positioning
bulkhead and topcap as well as backfill with proper drainage stone and soil, etc)
- whale -head replacement - due to cracking from excessive force due to failing bulkhead at 4712 San
Juan
-davit piling reset to vertical orientation to ensure safe operation of my davit lift
soil restoration including plants and sod that have been damaged.
I am not opposed to the installation of a 13x13 boatlift at the adjacent property ... as long as
measurements are confirmed that the length of the lift extending out into the creek does not extend
past the allowable distance. This particular area of Pelletier Creek is very narrow and the distance from
one side to the other quickly narrows at Mr. Wooten's property line and the property across the
waterway. The existing 15' floating dock is already at the maximum distance allowable to extend into
the creek ... and the creek narrows very rapidly from that dock westward.... which is the area where the
boat lift is proposed. If any portion of the pilings of the proposed lift extend past this dock, they would
be extending into the waterway beyond the allowable distance. In fact, a measurement should be
confirmed that the most westward outward piling of the lift is not extending into the waterway beyond
the allowable distance.... since the opposite shoreline turns sharply at this point in the creek and
allowable distance reduces exponentially from that point westward (the end of the creek).
Please confirm that this letter has been received and that Mr. Wooten is aware of the responsibility to
correct the damage that has occurred to my bulkhead.
